Ray Kring Mayor James L. Barnard called the special meeting to order. City Secretary T. Ray Kring called the roll of those in attendance. Motion by de Leon, seconded by Young and passed that Commissioners Roberts, Maldonado, and Blackmon be excused to attend a meeting with representa- tives of the San Patricio Water District relative to a proposed contract be- tween the City and the District. Mayor Barnard announced the public hearing on the application of Max C. Kluge for a change of zoning from "R -1B" One -family Dwelling District to "A-1" Apartment House District on all of Block 414, Port Aransas Cliffs. William Anderson, Director of Planning, located the property on the map; pointed out the zoning and land use of the area; stated that 60 written notices had been mailed out, 4 returns received in favor of the application, and 17 against; and that the recommendation of the Zoning & Planning Commission was that the application be denied on the basis that heavier density use is not logical in this area, but that "R-2" zoning be approved on the basis that the allowable density and space requirements would be more logical and leas detri- mental to surrounding property. Joe Williams, architect, and Max Kluge, applicant, spoke in support of the application; presented architectural sketches and explained the pro- posed plan of development for 8 apartments of 10 units each, which would be residential in character and design, with garages rather than carports and separate garbage disposal for each unit, and urged the granting of the zoning on the basis that the apartment spacing planned with the apartments facing both Monterrey and Santa Fe will be more attractive than the required spacing for duplexes, and that it will not decrease the value of land in the area as would single-family dwellings on 50 -foot lots as permitted under the existing zoning. City of Corpus Christi, Texas Special Council Meeting May 1, 1963 Page 2 • The following appeared in opposition to any change in the existing zoning on the basis that the plans presented are only an architectural sketch and not definite; apartment housing will cause increased traffic and noise on a short residential street; this housing project type of development will cause deterioration of property values; approval of this request could lead to re- quests for business zoning on the property later and would be an unjust en- croachment in a purely residential neighborhood of home owners: Mr. & Mrs. Dick Harvey, 3+45 Monterrey; Mr, & Mrs. D. H. Jackson, 3417 Monterrey; Bill Holmes, 3429 Monterrey; Ford Smith, 3454 Lawnview; Mr. & Mrs. Glen Hutson, 3409 Floyd; St. Elmo Glaze, 2462 Lawnview; Albert Chapman, 3453 Monterrey; John Wincelowicz, 3414 Lawnview; H. W. Johnston, 320 Rossiter; and Mr. & Mrs. Delmas Gregory, 3413 Monterrey; and the petition signed by 43 property owners in the area in opposition to the request, which was presented at the Zoning & Planning Commission hearing. Commissioners Roberts, Maldonado, and Blackmon returned to the meet- ing during the discussion. In answer to a question of Mayor Barnard, Assistant City Attorney Pilcher stated that due to the size of the property described in the request, very likely it would not be considered spot zoning. In view of the amount of opposition to this request, Mayor Barnard asked that before final action is taken by the Council, that the City Attorney provide a ruling as to whether the 20% rule was applicable from the standpoint of adjoining property -owner opposition. Mayor Barnard declared the hearing closed. Motion by Wallace, seconded by de Leon that the recommendation of the Zoning & Planning Commission be concurred in, and the application for "A-1" zoning be denied, but that a change of zoning to "R-2" Two-family Dwelling District be approved. Motion by Blackmon, seconded by Maldonado and passed that the motion under consideration be tabled for one week to give those Commissioners who had been absent during most of the testimony an opportunity to study the informa- tion presented. Mayor Barnard announced the public hearing on the application of Dr. Leonard J. Svajda for a change of zoning from "R -1B" One -family Dwelling Dis- • City of Corpus Christi, Texas Special Council Meeting May 1, 1963 Page 3 trict to "AB" Professional Office District on all of Lots 1 and 2, Block 2, Oak Park Subdivision; and announced the receipt of a petition of 19 signatures in opposition to this request prior to the opening of this public hearing. Mr. Anderson located the property on the map; pointed out the zoning and land use of the area; stated that 22 written notices had been mailed out, 3 written returns received in favor, and 3 against the application; explained that the applicant proposes to build a doctor's office and later to build his residence on the property described; and stated that the recommendation of the Zoning & Planning Commission was that the request be denied on the basis that the applicant's request can be adequately satisfied under the home occupation regulations. No one appeared to speak in support of the application. The following appeared in opposition to any change in zoning on the property in question on the basis that it would be an encroachment into a residential area, create parking problems and traffic congestion on narrow streets, that it would be spot zoning, and that none of the property owners objected to the dental office as a home occupation; Marvin Berry, represent- ing his sister-in-law Mrs. L. E. Berry, 4002 Up River Rd.; Jake Jarmon, attorney representing himself, 842 Retama, and all of the property owners along Retama; W. D. Miles, 842 Oak Park; K. C. Brown, 818 Oak Park; V. E. Whitley, 841 Oak Park; and Mrs. Dan Kemp, 834 Retama. Mayor Barnard declared the hearing closed. Motion by Maldonado, seconded by Blackmon and passed that the recom- mendation of the Zoning & Planning Commission be concurred in, and the request for a change of zoning on Lots 1 and 2, Block 2, Oak Park Subdivision, be denied. Mayor Barnard announced the public hearing on the application of Dr. W. R. Hubler for a change of zoning from "A-2" Apartment Rouse District to "AB" Professional Office District, on all of Block 1002, Bay Terrace #2. Mr. Anderson located the triangular tract on the map; pointed out the zoning and land use in the area; stated that 45 written notices had been mailed out, 6 written returns had been received in favor of the application, and none against; and that the recommendation of the Zoning & Planning Commis- sion was that the application be approved. • City of Corpus Christi, Texas Special Council Meeting May 1, 1963 Page 1+ John Thomason, representing Dr. Hubler, the applicant, explained that the applicant has plans to build 8500 eq.ft. of office space on the northerly portion of the tract as the location for the South Texas District Office and Clerical and Professional Office of the Texas Employment commission, with paved off-street parking for 35 to 40 cars; that the Commission feels that this is the most desirable location of all the available space from the Hill area to Parkdale; that Dr. Hubler plans to continue the present pro- fessional use for his office as well as for the additional building; and urged that the request be granted. No one appeared to speak 1n opposition to the request. Mayor Barnard declared the hearing closed. Motion by Blackmon, seconded by Young and passed that the recom- mendation of the Zoning & Planning Commission be concurred in, and the re- quest for a change of zoning on all of Block 1002, Bay Terrace #2, from "A-2" to "AB" Professional Office District be granted. Mayor Barnard announced the public hearing on the application of Albert Perez, Perez Mattress Factory, for a change of zoning from "R -1B" One -family Dwelling District to "I-2" Light Industrial District on Lot 23, Block 3, Molina Addition #1. Mr. Anderson located the property on the map; pointed out the zoning and land use of the area; stated that 36 written notices had been mailed out, 1 written return received in favor of the application, and 1 against; and that the recommendation of the Zoning & Planning Commission was that the request for "I-2" zoning be denied but that, in lieu, a Special Permit for a mattress factory be approved. Albert Perez, applicant, appeared in support of the application and explained that the remodeled building was about 90 percent finished for this use as a mattress factory, that the neighbors did not object to this proposed use of the property, but strenuously objected to use of the property for a tavern, and that a Special Use Permit would take care of his needs and would be an improvement to the property. No one appeared to speak in opposition to the request. Mayor Barnard declared the hearing closed. City of Corpus Christi, Texas Special Council Meeting May 1, 1963 Page 5 Motion by Young, seconded by Maldonado and passed that the recom- mendation of the Zoning & Planning Commission be concurred in, and the request for "I-2" Light Industrial District be denied, but that in lieu a Special Use Permit for a mattress factory on Lot 23, Block 3, Molina Addition #1, be approved. Victor Brock, member of the American Institute of Architects, re- quested that a landscape architect be appointed to fill the next vacancies on both the Park Board and the Zoning & Planning Commission, and submitted the names of Durward Thompson and George Porcher for the Council's consideration. There being no further business to come before the Council, the special meeting was adjourned.
