Wallace, Jr. CITY OF CORPUS CHRISTI, TEXAS REGULAR COUNCIL MEETING May 29, 1963 2:00 P.M. City Manager Herbert W. Whitney City Attorney I. M. Singer City Secretary T. Ray Kring Mayor James L. Barnard called the meeting to order. The Invocation was given by the Reverend Earl Hill, Pastor of Southside Baptist Church. City Secretary T. Ray Kring called the roll of those in attendance. Motion by Maldonado, seconded by Young and passed that the minutes of the regular meeting of May 22, 1963, and of the special meeting of May 27, 1963, at 4:30 p.m., be approved as furnished to the Council. Mayor Barnard recognized and presented to the Council and audience Bobby Berry, age 16, and recited the details of an incident at one of the local swimming pools in which Bobby had discovered a youngster, unconscious on the bottom of the pool, pulled him to safety, and with the aid of the life guard, resusitated and revived him. Mayor Barnard read and presented to Bobby, a Special Citation expressing the pride and congratulations of the Council and citizens in his display of quick think- ing, good judgment and heroism on May 27, 1963, at the Collier Swimming Pool, which resulted in saving the life of Sammy Allred, age 8. Mayor Barnard recognized and introduced Paul Ligon, Convention Manager of the Driscoll Hotel, and read and presented a proclamation proclaiming Friday, May 31, 1963, PAUL LIGON DAY in Corpus Christi, in recognition of his efforts in bringing more than 131 conventions within 2 years to Corpus Christi and his activity in civic movements and clubs, and in appreciation of his outstanding accomplishments for our City. Paul Ligon accepted the foregoing proclamation with deep appreciation for the honor, and invited each of the Council, including wives, to attend an informal PooI- side Get-to-gether at the Driscoll Hotel to welcomein Red Carpet style the delegates of the Texas Society of Associated Executives who are responsible for bringing con- ventions to any area. s • City of Corpus Christi, Texas Regular Council Meeting May 29, 1963 Page 2 Mayor Barnard read and signed a proclamation proclaiming the month of June, 1963, as CLEANUP - PAINT UP - FIX UP MONTH in Corpus Christi, and calling upon all citizens and associations of the City to take an active and constructive part in this community program. Motion by Blackmon, seconded by de Leon and passed that Mrs. Sam L. Stokes and Frank Allen, Sr. be appointed Co-chairmen of a Clean Up Committee to further the project, and to make recommendation to the Council with respect to appointment of their committee members. Mayor Barnard called for the opening of bide. Bids were opened and read on an estimated 12 -months' supply of 2 lots of Tabulating Machine Cards from the following: Mid -Continent Tab. Card Co.; Southwest Globe Ticket Co.; The Tabulating Card Co.; and I.B.M. Bids were opened and read on ap annual contract for Linen Towel Service from the following: C. C. Linen Service, Co.; and South Texas Linen Service. Bids were opened and read on an estimated 12 -months' supply of 2 lots of Mechanical Joint Cast Iron Fittings from the following: American C.I. Pipe; U.S. Pipe & Foundry; Trans -Tex Supply Co.; Tyler Pipe & Foundry; and SAMSCO. Bids were opened and read on en estimated 12 -months' supply of Reinforced Concrete Pipe from the following: Brown Supply Co.; Mission Concrete Pipe Co.; The Southern Co.; and Texcrete Co. Bids were opened and read on en estimated 12 -months' supply of 17 items of Gas & Water Meters from the following: Neptune Meter Co.; Rockwell Mfg. Co. (Water Division); Superior Meter Division; Worthington Gamon Meter Division; Badger Meter Mfg. Co.; Hersey-Sparling Meter Co.; American Meter Co.; Rockwell Mfg. Co. (Gas Division); Sprague Meter Co.; and Arkla Meters. Bids were opened and read on Lin -estimated 12 -months' supply of Police- men's Uniforms from the following: Best Tailors, Inc.; Burke Mfg. Co.; Donovan Uniform Co. All of the foregoing bids were tabled for 48 hours as required by the City Charter, and referred to the City Manager for tabulation and recommendation. Mayor Barnard announced the Council was not ready to take any action at this time on the pending items relating to the Grossman tax matter. • City of Corpus Christi, Texas Regular Council Meeting May 29, 1963 Page 3 Mayor Barnard called for the City Manager's Reports Motion by de Leon, seconded by Wallace and passed that the City Manager's Reports, with the exception of Item "e (1)" which would be considered separately, be accepted, and the recommendations and requests be approved and granted as follows; a. That acceptance and final payment of Estimate #3 in the amount of $2,080.67, for completion of the installation of new hardwood flooring for Ben Garza Gymnasium by Benedict & Clark, be approved; b. That the plans and specifications for construction of the Upper McArdle Storm Sewer, along McArdle between Everhart Road and Nesbitt Drive, be approved; and. that authority to advertise for bids to be received on June 19, 1963, be granted; c. That the agreement with Woody Crawford and wife Dorothy Crawford, owners of Lots 7 and 8, Block 3, Ocean Drive Addition, in connection with the proposed ex- tension and improvements of University Drive through Block 3 of Ocean Drive Addition, be approved; d. That reimbursement of the General Fund in the total amount of $53,668.00 for the engineering costs for the 4 -months' period January through April, 1963, applicable to certain bond projects, be approved; and that the sum of $45,043.00 be appropriated from various bond funds to supplement remaining funds previously appro- priated; e. That award of bid on the basis of low bid meeting specifications be made as follows: (1) To be considered separately, as stated above; (2) Alamo Iron Works, for Lot I, 340 Mechanical Joint Gate Valves ranging in sizes 4" through 12", for $18,520.38; McAllen Pipe & Supply Co., for Lot II, 1 - 16" Mechanical Joint Gate Valve, for $702.86; for a grand total of $19,223.24; (Bid Tabulation #32); (3) Nunn Electric Supply Corp., for Traffic Signal Equipment, consisting of 15 items of controllers, detectors, signals, and signal cable, for a total of $21,758.42; (Bid Tabulation $33); f. That authority to advertise for bids to be received on June 12, 1963, on estimated 12 -months' supplies of the following, be granted: (1) Cast Iron and/or Asbestos Cement Pipe; (2) House Type Gas Service Regulators; (3) Lubricated Plug Valves; City of Corpus Christi, Texas Regular Council Meeting May 29, 1963 Page 4 g. That the lease agreement with the Corpus Christi School District for the leasing of the grounds at David Hirsch Elementary School in Block 95, Beach Addi- tion, for a term of one year, at an annual rental of $1.00 per year, for use as a playground area under the supervision and control of the Park & Recreation Department, be approved; and that the playground be named for Myrle Grasty as recommended by the Park Board; h. That the following policy statement adopted by the Zoning & Planning Commission, effective January 25, 1963, be approved and adopted by the City Council with regard to applications for Interim Zoning Permits: That the Council will act under Article 31 of the Zoning Ordinance through the means of an Interim Zoning Permit on only those cases meeting the following general qualifications: The request for Interim Permit must involve property on which construction had begun before annexation; on property which is being remodeled, altered or restored; or on the erection of struc- tures of a temporary nature. Those cases involving new construction separate from existing structures or land use changes will be processed as a regular zoning appli- cation in accordance with the Zoning Ordinance. i. That the application for Interim Zoning Permit of Wilcox Furniture Co., #62-52, to erect a 12' x 24' "V" -shaped sign near the front line of Lots 7, 8, 9 & 10, Block B, Annaville Subdivision be approved subject to compliance with regula- tions of the "B-4" General Business District, as recommended by the Zoning & Planning Commission. In response to a request of the applicant for permission to erect the fore- going sign at the property line rather than the 20' setback line required under the "B-4" regulations, Mr. Wilcox was referred to the Board of Adjustment for his re- quest for any variance from zoning regulations. (See subsequent action later in this meeting) Mayor Barnard announced he would entertain any desired discussion of Item "e(1)" of the City managerl Reports. Robert Belhasen, representing the Plumbers & Pipe Fitters Local 185 of the Coastal Bend Labor Council, objected to the purchase of foreign pipe on the basis that such pipe is inferior to domestic pipe and will deteriorate in a short time. City of Corpus Christi, Texas Regular Council Meeting May 29, 1963 Page 5 • Clifford Cosgrove, 2625 Riggan, objected to the purchase of any foreign -made pro- ducts on the basis of inferiority to domestic -made products and the low price competition which results in loss of trade for domestic products and unemployment for our laborers. City Manager Whitney explained that the foreign pipe considered meets all the A.P.I.-5L specifications for gas distribution pipe, same size pipe, same wall thickness, same metalurgical specifications, and will have to meet the same testing procedure; that two of the bidders recommended for award are local suppliers; and that there is a saving to the City by the purchase of the foreign pipe of 8.2% on Lot I, 17% on Lot 2, and 16.1% on Lot 3, making a total saving of $5,249.12 on the grand total award of $32,599.96. Mayor Barnard explained that the Council has thoroughly discussed and considered the matter, and that the recommendation was made in accordance with the United States Government policy to purchase foreign material in cases where there is a saving of more than 6%. Motion by Roberts, seconded by Blackmon and passed that the recommenda- tion of the City Manager with respect to the purchase of Steel Pipe be accepted, and the award of bid be made as follows: Item "e(1)" E -Z Pipe & Steel Co., Inc., for Lot I (Mexico) 12,000' 1.314" OD Sgl. Rndm., .133" wall, and 30,000' 2.375" OD Dbl. Rndm., .154" wall, Steel Pipe, for $10,539.31; Fort Worth Pipe & Supply Co., for Lot II (Japan) 6,000' 6.625" OD Dbl. In connection with the first reading of a proposed ordinance relating to the trimming of trees and shrubs obstructing the free passage or view of drivers of vehicles and pedestrians of public right-of-ways, Commissioner Blackmon felt that since the plantings referred to are ox City property, it should be the responsi- bility of the City to keep trimmed so as not to cause obstruction, and that it was not the same as in the case of vacant lots which are private property. He commented further that if the reference is to existing plantings, there may be some question as to the legality of the lien, and that the proposed wording appears to make criminals of 95% of the citizens and might be unenforceable. Commissioner Wallace commented on a few areas in which there was consider- able obstruction of free passage both in the street and on the sidewalk due to planting at one time or another by the adjoining property owner, mad felt the City had need of this type of control as a safety measure, but that he did not antici- pate rigid enforcement. Mayor Barnard oa led for petitions or information, from the audience on matters not scheduled on the agenda. Wilfred Wilcox, Wilcox Furniture Co., explained that he had just been in- formed that the Board of Adjustment has no jurisdiction to change the conditions of an Interim Zoning Permit, and further that the Board of Adjustment does not meet for another 30 days. He requested that he be permitted to erect his sign in some manner at the property line, since the 20' setback requirement prevented the sign from being seen from the street due to existing planting and trees. Motion by Wallace, seconded by Roberts and passed with Commissioner Blackmon voting "Nay", that the previous action of the Council relating to the ap- plication of Wilcox Furniture Co. for a Interim Zoning Permit for the erection of a free standing sign, be reconsidered. There followed considerable discussion of the request and manner in which to allow the erection of the sign so it would not constitute a traffic hazard. Com- missioner Blackmon felt that in allowing the erection of the sign at any point leas than the 20' setback was going against all of the recommendations of the Council's advisors, and further that to grant the request would be contrary to the policy with respect to Interim Zoning Permits adopted by the Council earlier is the meet- ing. Mayor Barnard reread the policy referred to, and ruled that the request came under the provision of property being remodeled, altered or restored, or on the erection of structures of a temporary nature. Cash Asher presented the petition of the Conservation Committee of the Corpus Christi Outdoor Club urging Council action to establish a wildlife sanctuary • City of Corpus Christi, Texas Regular Council Meeting May 29, 1963 Page 10 on the 72 acres of City -owned land near the North Pole community which extends from Up River Road to the Nueces River adjoining the Stevens Filtration Plant, and stated that the Club will provide the necessary signs and will do the posting of the area. Various members of the Committee added further information to support the petition with respect to rare species of birds and plant life observed, the great attraction for visitors, and the seed for action to prevent destruction of the nesting areas and disturbance of the plant life. (Petition #5 in File) After some discussion of the mechanics involved in designating such a sanctuary, the matter was referred to the City Manager for study and recommendation. The Chair called for a 5 -minute recess, following which, the meeting was reconvened with all members of the Council present. There being no further business to come before the Council, Mayor Barnard declared the regular meeting adjourned.
