Mayor James L. Barnard called the meeting to order.
City Secretary T. Ray Kring called the roll of those in attendance.
Mayor Barnard explained the purpose of the meeting for holding public
hearings on three zoning applications, and the procedure to be followed.
Mayor Barnard announced the public hearing on the application of Roy
Smith for a change of zoning from "R -1B" One -family Dwelling District to "I-2"
Light Industrial District on a 21.4 -acre tract out of Lot 1, Section 5, Bohemian
Colony Lands.
Tom Lake, Zoning Coordinator, located the property on the map as being
behind Columbia Park Center between Greenwood Drive and the Airport Drainage Ditch;
pointed out the zoning and land use of the area; stated that 9 noticeb had been
mailed out, 2 written returns received in favor of the request, and none against;
that only the applicant had appeared at the Zoning & Planning Commission public
hearing; that the recommendation of the Zoning & Planning Commission was that the
application be approved; and that there has been no further correspondence or
activity.
Roy Smith, applicant, explained that the property is under contract of
sale to Austin Bridge Company, contingent upon approval of the rezoning, for loca-
tion of their construction operation offices, and urged that the request be granted
since it is a logical use for this tract near the new Highway Department facilities
location.

on the 21.4 -acre tract out of Lot 1, Section 5, Bohemian Colony Lands, described
in the application, from "R -1B" to "I-2", be granted, subject to platting required.
Mayor Barnard announced the public hearing on the application of Frank
Longoria for a change of zoning from "A-1" Apartment House District to "B-1"
Neighborhood Business District, on all of Lots 30 and 31, Country Club Place, save
and except that portion heretofore conveyed to the State of Texas for highway pur-
poses and to be included within the right-of-way of Interstate Highway 37.
Tom Lake located the property on the map; pointed out the zoning and land
use of the area; stated that 16 notices had been mailed out, 1 written return re-
ceived in favor of the request, and none against; that 2 persons had appeared at
the Zoning & Planning Commission public hearing in favor of the request, other than
the applicant, and 2 against; that the recommendation of the Zoning & Planning Commis-
sion was that the application be approved subject to the filing of a letter by Texaco,
Inc., stipulating that a suitable fence be built and that the property be used only
for a service station; and submitted a subsequent letter received from Texaco, Inc.
agreeing to the foregoing conditions.
Bob Sorrell, attorney representing the applicant, presented and explained
the proposed Interstate Highway 37 layout in this area showing the designated under-
pass; explained the anticipated traffic circulation pattern for the area; presented
several photographs of the area of request and adjacent properties; a sketch of the
proposed development of the property by Texaco, Inc. for a filling station; and urged
that the application be granted on the basis that the intersectional location at
Up River Road and Interstate 37 and the shape of the property is ideal for this
type of development and quite undesirable for any type of residential use.
Mrs. Clara Taylor, owner of an unplatted tract across Up River Road from
the subject property, spoke in favor of the application as a logical location for
a filling station.
No one appeared in opposition to the application.
Mayor Barnard declared the hearing closed.
Motion by de Leon, seconded by Blackmon and passed that the recommenda-
tion of the Zoning & Planning Commission be concurred in, and the change of zoning
on all of Lots 30 and 31, Country Club Place, save and except that portion hereto-
fore conveyed to the State of Texas for highway purposes and to be included within

the right-of-way of Interstate Highway 37, described in the application, from "A-1"
Apartment House District to "B-1" Neighborhood Business District, be granted.
Mayor Barnard announced the public hearing on the application of John
Hutson for a change of zoning from "R -1B" One -family Dwelling District to "B-1"
Neighborhood Business District, on a 2.27 -acre tract of land out of a 23.15 -acre
tract out of the 172 -acre John Dunn, Sr. Tract, out of the Rincon Del Oso Grant.
Tom Lake located the property on the map; pointed out the zoning and land
use of the area; stated that 6 notices had been mailed out, 2 written returns re-
ceived in favor of the application, and 1 against; that no one had appeared to speak
either for or against the application at the public hearing of the Zoning & Plan-
ning Commission; and that the recommendation of the Zoning & Planning Commission
was that the application be approved.
Commissioner Blackmon disqualified himself from taking part in any dis-
cussion or action on this application on the basis that his law firm represents the
Dunn and ?teeny families, who may or may not be directly or indirectly interested in
this application, and requested that the minutes so reflect.
No one appeared in connection with this application, either for or against.
Mayor Barnard declared the hearing closed.
Motion by Young, seconded by Maldonado and passed, with Commissioner Black-
mon remaining silent, that the recommendation of the Zoning & Planning Commission
be concurred in, and the change of zoning on the 2.27 -acre tract of land out of a
23.15 -acre tract out of the 172 -acre John Dunn, Sr. Tract, out of the Rincon Del Oso
Grant, described in the application, from "R -1B" to "B-1", be granted.
There being no further business to come before the Council, the special
meeting was adjourned.
