Wallace, Jr. CITY OF CORPUS CHRISTI TEXAS SPECIAL COUNCIL MEETING June 5, 1963 4000 p.m. City Manager Herbert W. Whitney City Attorney I. M. Singer City Secretary T. Ray Kring Mayor James L. Barnard called the special meeting to order. City Secretary T. Ray Kring called the roll of those in attendance. Mayor Barnard announced the Chair would entertain a motion with re- spect to the matter of the Appeal of Miguel Adame from the action of the Taxi- cab Inspector in the revocation of his Taxicab Driver's License which had been heard earlier by the Council during the regular meeting. Motion by Roberts, seconded by Maldonado that the Council sustain the findings of the Taxicab Inspector and the Corporation Court in the matter of Miguel Adame heard during the regular meeting. Commissioner Blackmon suggested that the matter be studied further by the Council as an official body, and Mayor Barnard stated he had enter- tained a motion at the request of one of the Council members, and that the Chair was open for a motion to table the foregoing motion if it was so desired. No motion to table being made, Mayor Barnard called for any discussion on the motion by the Council. Commissioner Wallace suggested that the foregoing motion be amended to merely sustain and uphold the action of the Taxicab Inspector in revoking the Taxicab Driver's License of Miguel Adame, and Commissioners Roberts and Maldonado each accepted the amendment. Mayor Barnard called for the vote, Commissioners Blackmon and de Leon voted "Nay", the rest of the Council voted "Aye", and Mayor Barnard declared the motion had carried five to two. Mayor Barnard announced the purpose of the special meeting for public hearing on three zoning applications, and explained the procedure to be followed. Mayor Barnard announced the public hearing on the application of Mrs. Wesley D. Grounds for a change of zoning from "AB" Professional Office District to "B-1" Neighborhood Business District on all of Lot 9, Block 19, Del Mar Addition. • • City of Corpus Christi, Texas Special Council Meeting .Tune 5, 1963 Page 2 Tom Lake, Zoning Coordinator, located the property on the map; pointed out the zoning and land use of the area; stated that there had been 2 written returns received in favor of the application, two against, one in favor follow- ing the public hearing of the Zoning & Planning Commission, and a petition pre- sented by the attorney for the applicant signed by 18 area property owners in favor of the application; and that the recommendation of the Zoning & Planning Commission was that the request be denied but that in lieu a Special Permit for an art gift shop be approved subject to the conditions that (1) Out -door advertising be restricted to 1 sign 5' square attached flat against the building and not to protrude above the eave; and (2) That 5 off-street parking spaces be provided. Milton Walton, attorney representing the applicant, presented a sketch indicating the existing building and changes necessary in the layout to allow use of the property as a gift shop; pointed out the 5 off-street parking spaces pro- vided for on Lawnview to avoid further congestion of traffic on Ayers; and stated that the recommended Special Permit was acceptable to the applicant as she desired to use the property for her residence as well as for an art gift shop. He ex- plained that she had asked for one display window and a free standing sign, but that the recommendation of the Zoning & Planning Commission was acceptable. Mrs. Grounds appeared in support of her application and explained that all items are hand -made imports, and displayed a few of the gifts. Leland Ross, owner of the property, stated that the sale of the prop- erty was contingent upon approval of the Special Permit, and urged that it be approved on the basis that the operation contemplated would not hurt the neighbor- hood. Edward Ligon, 345 Paimero, and Mrs. Myrtle Basye, 41.8 Palmero, each appeared in opposition to the change in zoning, but did not object to the approval of the Special Council Permit with the restrictions recommended by the Zoning & Planning Commission. Mayor Barnard declared the hearing closed. Motion by Wallace, seconded by de Leon and passed that the recommenda- tion of the Zoning & Planning Commission be concurred in, and the request for change of zoning on Lot 9, Block 19, Del Mar Addition, to denied but in lieu a City of Corpus Christi, Texas Special Council Meeting June 5, 1963 Page 3 • Special Permit be granted for an art gift shop subject to the following condi- tions: (1) That out -door advertising be restricted to 1 sign 5' square attached flat against the building and not to protrude above the save; and (2) That 5 off-street parking spaces be provided, Mayor Barnard announced the public hearing on the application of Rain- bow House Kindergarten and Nursery for a change of zoning from "R -1B" One -family Dwelling District to "AB" Professional Office District on the Southwest portion of Lot 3 of Barthlome's Acre Tracts. City Manager Whitney presented and read a letter received from Mrs. Julia Fransler, applicant, withdrawing the application for change of zoning on 3818 Up River Road, the property described in the application, on the basis that the applicant had found it impossible to fix the building to meet the City Code and the proposed type of operation. Mayor Barnard declared the letter withdrawing the application received, and the application withdrawn. Mayor Barnard announced the public hearing on the application of Greenwood -Molina Nursery School for a change of zoning from "R -1B" One -family Dwelling District to "AB" Professional Office District on all of Lot 39, Block 2, Washington Addition. Tom Lake located the property on the map; pointed out the zoning and. land use of the area; stated that 2 written returns had been received in favor of the request, 1 against, and 1 in favor following the public hearing of the Zoning & Planning Commission; and that the recommendation of the Zoning & Planning Commission was that the request be denied but that in lieu a Special Permit for a day nursery be approved subject to compliance with all other regulations of the "AB" Professional Office District.
