Blackmon City Manager Herbert W. Whitney J. R. de Leon City Attorney I. M. Singer M. P. Maldonado City Secretary T. Ray Kring W. J. Roberts W. H. Wallace, Jr. Mayor James L. Barnard called the meeting to order. The Invocation was given by Commissioner de Leon in the absence of the guest Chaplain. City Secretary T. Ray Kring called the roll of those in attendance. Motion by Blackmon, seconded by Maldonado and passed that the absence of Commissioner Jim Young be excused for cause. Motion by Maldonado, seconded by Roberts and passed that the minutes of the regular meeting of June 12, 1963, be approved as furnished to the Council. Mayor Barnard read a proclamation proclaiming the week of July 1-7, 1963, as SOAP BOX DERBY WEEK in Corpus Christi, and inviting all citizens to view this event on July 4th, thereby encouraging the participants to strive for greater achievements in life. Mayor Barnard called for nominations for appointments to Boards and Com- mittees. Commissioner Blackmon nominated R. Putnam Hill for appointment to the Airport Advisory Board; Commissioner de Leon nominated Douglas H. Beck for appoint- ment to the Building Code of Appeals; Commissioner Maldonado nominated G. R. Swantner, Jr. for appointment to the Civil Service Board; Commissioner Roberts nominated Doyle McCain for appointment to the Examining & Supervising Board of Plumbers; Commission- er Wallace nominated Mrs. Rosa Garza for reappointment, and Rev. Harold T. Branch for appointment to the Housing Authority; Commissioner Blackmon nominated Bob J. Spann for appointment to the Memorial Hospital Board; Commissioner de Leon nominated Commander W. M. Flenniken and Manuel Cantu for reappointment, and Sam W. Main for appointment to the Traffic Safety Advisory Board; Commissioner Maldonado nominated Henry J. Annen and Tom Marshall for reappointment, and Ronald W. Wood, Joe Roscoe, and Frank Gamez for appointment to the Zoning & Planning Commission; Commissioner Roberts nominated the following for reappointment to the Port Protection Committee; Duane Orr, Port Engineer, Navigation District; John Carlisle, Fire Chief; R. Kuss, Power Plant Chief, Central Power & Light Co.; John Mitchell, Sheriff; Capt. Herbert Weeks, State Highway Patrol; H. E. Ammerman, Mgr. C. C. Motion by de Leon, seconded. by Roberts and passed that the nominations be seconded, and the appointments and reappointments be approved and confirmed as made. Mayor Barnard presented Certificates of Appointment to those appointees who were present in the audience. Mayor Barnard called for the opening of bids. Bids were opened and read on the construction of Upper McArdle Storm Sewer Improvements, Everhart to Nesbitt, from the following: Fowco Construction Co.; Slovak Brothers; T. H. Lee; Heldenfels Brothers; and Burtex Constructors. The foregoing bids were tabled for 48 hours as required by the City Charter, and referred to the City Manager for tabulation and recommendation. Bids were open»d and read on Gas Main Tapping Machine with Accessories from the following: Mueller Co.; and T. D. Williamson, Inc. Bide were opened and read on an estimated 12 -months' supply of 2 lots of Stationery Store Paper Items from the following: C. C. Paper Co.; Graham Paper Co.; Southwestern Paper Co.; and South Texas Office Equipment Co. All of the foregoing bids were tabled for 48 hours as required by the City Charter, and referred to the City Manager for tabulation and recommendation, Mayor Barnard called for the City Manager's Reports. Motion by Wallace, seconded by de Leon and passed, that the City Manager's Reports be accepted, and the recommendations and requests be approved and granted, with the exception of Item "r to be considered separately, and Item "e" which was withdrawn, as follows: a. That authority to advertise for bids to be received on July 3, 1963, on one 72" x 72" Flap Gate for the Bayfront Pump Station, be granted.; b. That award of bid on the basis of low bid meeting specifications, be made as follows: (1) To South. Texas Linen Service for an. estimated 12 -months' sup- • City of Corpus Christi, Texas Regular Council Meeting June 19, 1963 Page 3 ply, Linen and Towel Service, for $2,983.19, (Bid Tabulation #44 in File); (2) to Tyler Pipe & Foundry for estimated 1.2 -months' supply, Lot 1, Mechanical Joint Cast Iron Bends, Caps, Crosses, Plugs, Reducers, Sleeves, and Tees, for $16,922.27; and to American Cast Iron Pipe Co. for estimated 12 -months' supply, Lot II, Mechanical Joint Split Repair Sleeves, for $4,993.40, (Bid Tabulation #45 in File); (3) to Texcrete Company, for estimated 12 -months' supply, Reinforced Concrete Pipe, for $3,015.68, (Bid Tabulation #46 in File); and (4) to Best Tailors, Inc,, for esti- mated 12 -months' supply, Policemen's Uniforms, for $5,203.00, (Bid Tabulation #47 in File); c. That the bid received on May 22, 1963, for Repairing and Painting of the Mestina Street Water Tank be rejected on the basis that the only bid received was considerably in excess of the amount estimated, and that authority to readver- tise for bids to be received on a separate basis for the repairing and for the painting, be granted; d. Considered separately as stated in the motion and as noted later; e. Withdrawn by the City Manager, pending further information relating to the request from Lone Star Beer, Inc. to construct a 10' x 16' loading dock in the public right-of-way at 1125 No. Tancahua; f. That the date of July 10, 1963, at a special meeting convening at 4;00 p.m., be set for public hearing on 5 zoning applications. Item "d" of the City Manager's Reports was considered separately. City Manager Whitney explained the background, basis, and effect of the request from the Veterans Administration for a compromise settlement of half the amount of the paving assessment against Lot 1, Block 8, Sherwood Park Unit #2, 2001 Little John Drive, in connection with the Weber Road improvements, and that the recommendation of the Legal Department was that the Veterans Administration's offer of compromise be accepted, and that the City Manager be authorized and directed to release the assessment lien against the described property when payment is received from the Veterans Administration in the amount of $314.16, provided the release reserves the personal liability of Gene K. Coppin to the City for the remainder of the assess- ment that is evidenced by Weber Road Certificate No. 95. During the discussion, Commissioner de Leon felt that morally the full amount should be paid, but that on a practical basis the recommendation of the City of Corpus Christi, Texas Regular Council Meeting June 19, 1963 Page 4 Legal Department should be sustained on the basis of a bad debt. Mayor Barnard felt that if the City had a valid assessment and lien in the first place, then no part should be excused because of subsequent acquisition of ownership, whether by an individual, a mortgage company, or a governmental body. Motion by de Leon, seconded by Blackmon that the offer of compromise settlement by the Veterans Administration be accepted as recommended by the Legal Department. On vote, there were three "Ayes" and three "Nays", and Mayor Barnard ruled that whereas ordinarily a motion fails in the event of a tie vote, in this instance he would entertain a motion to table the matter until next week's regular meeting in order to have the benefit of a full Council vote, Motion by Roberts, seconded by Wallace and passed that the matter be tabled for one week. ORDINANCE NO. 6938 AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE A DEED, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, CONVEYING UNTO THE STATE OF TEXAS, A PORTION OF LOT 39, BLOCK 1500, ROPES AND CHAMBERLAIN BAY TERRACE #2, AN ADDITION TO THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, DESCRIBING TRF SAID PARCEL BY METES AND BOUNDS, LM SAME TO BE USED AS RIGHT OF WAY FOR THE CROSSTOWN EXPRESSWAY, A COPY OF SAID DEED BEING ATTACHED HERETO AND MADE A PART HEREOF; AND DECLARING AN EMERGENCY. The Charter rule was suspended by the following vote: Mayor Barnard, Commissioners Blackmon, de Leon, Maldonado, Roberts, and Wallace all present and voting "Aye," and Commissioner Young absent. Mayor Barnard called for petitions or information from the audience on matters not scheduled on the agenda. Bob Woolsey, representing Mr, & Mrs. 0. K. Winfree, Jr., owners of the "Skipper Ie, asked for information and clarification of a notice of forfeiture of berth of the "Skipper K". City Manager Whitney explained wherein the operation of the "Skipper K" was in violation of the ordinance governing the docking and berthing of boats in the Marina with respect to amount of sidewalk or pedestrian area being utilized for gear box and storage, the number of advertising signs, and the number of awnings; that the complaint of other boat operators in the Marina had been made before the City of Corpus Christi, Texas Regular Council Meeting June 19, 1963 Page 5 Bayfront Advisory Board; and the City had notified the owners of the "Skipper K" of forfeiture of privileges in compliance with the existing ordinance regulations. Mr. Whitney pointed out that the operating ordinance had been passed several years ago and had not envisioned a type of boat that runs parallel to the shore road and serves its customers from the finger pier as does the "Skipper K", and recommended that the status quo be permitted to remain for a reasonable period of time and the Bayfront Advisory Board be requested to study the existing ordinance as to possible revision in view of the changed circumstances. Mr. Woolsey stated that Mr. Whitney's recommendation was exactly what he was prepared to request since there was no facility of the size of the "Skipper K" operating from our Marina at the time the ordinance was passed. Motion by Roberts, seconded by Blackmon and passed that the status quo of the Winfrees' operation be permitted to remain for a period of 30 days beyond June 30, 1963, and that the existing ordinance in question be referred to the proper committee for study and recommendation to the Council. Joe Fernandez presented a petition of 21 signatures of property owners in the 700 block of Mohawk Street for relief from the condition 1n which their driveways and walk crossings were left after the storm sewers were put in. (Peti- tion #7 in File). Motion by Wallace, seconded by Maldonado and passed that the matter be referred to the City Manager for investigation and report to the Council next week. In answer to questions of the Council as to the matter of the complaint relative to the curbing and driveways on Naples Street, and relative to the spray- ing of trees with insecticides and pesticides in the City, City Manager Whitney replied that he had preliminary reports, and Mayor Barnard stated that the Council preferred to wait for his full report on these matters. There being no further business to come before the Council, the meeting was adjourned.
