Wallace, Jr. • CITY OF CORPUS CHRISTI, TEXAS SPECIAL COUNCIL MEETING June 26, 1963 4:00 p.m. City Manager Herbert W. Whitney City Attorney I. M. Singer City Secretary T. Ray Kring Mayor James L. Barnard called the meeting to order. City Secretary T. Ray Kring called the roll of those in attendance. Mayor Barnard called for a motion regarding the matter of a petition previously presented by Leo Duran and discussed and considered in Work Shop sessions by the Council relative to the establishing of a parking lot in the vicinity of Agnes and Laredo Streets and one or two blocks beyond the Cross- town Expressway right-of-way. Motion by Roberts, seconded by Maldonado and passed that the City Manager be authorized to request the State Highway Department to make a study of the feasibility of building a parking lot in the general location of the Agnes and Laredo Crosstown Expressway right-of-way. Mayor Barnard announced the purpose of the special meeting to hold public hearings on 3 applications for zoning changes, and explained the pro- cedure to be followed. Mayor Barnard announced the public hearing on the application of Mrs. • Guadalupe Bernal for a change of zoning from "R -1B" One -family Dwelling District to "B-1" Neighborhood Business District on all of Lot 4, Block 4, Southwest Heights. Tom Lake, Zoning Coordinator, locate¢ the property on the map; pointed out the zoning and land use of the area; and the approximate location of the pro- posed expressway route, the frontal road being Prescott Street; explained that 19 notices had been mailed out, 1 letter was received in favor of the request, 2 against, and 1 person had appeared in opposition to the request; and stated that the recommendation of the Zoning & Planning Commission was that the request be denied, but that in lieu a Special Permit for a beauty shop under Article 25, Section 25-4, Subsection (12) of the Zoning Ordinance, be approved subject to the following conditions: (1) That outdoor advertising be restricted to one sign of • • • • City of Corpus Christi, Texas Special Council Meeting June 26, 1963 Page 2 not more than five square feet, be non -illuminated, and be erected flat against the wall of the building but not to protrude above the eave; (2) subject to compliance with all other regulations of the "AB" Professional Office District. Mrs. Bernal, the applicant, appeared in support of the application on the basis that she needed to operate her beauty shop at her home in order to be with her asthmatic daughter, that she planned to be the only operator, and only minor repairs to the building were needed. No one appeared in opposition to the request. In answer to a question from Mayor Barnard, City Attorney Singer replied that a suggested amendment to the Zoning Ordinance relative to home occupations has been prepared and will be presented at the next Workshop meeting for Council consideration. Motion by de Leon, seconded by Maldonado and passed that the hearing be closed, that the recommendation of the Zoning & Planning Commission be concurred in, and the request for "B-1" be denied but in lieu a Special Use Permit for the opera- tion of a beauty shop on Lot 4, Block 4, Southwest Heights, be granted, subject to the following conditions: That outdoor advertising be restricted to one sign of not more than five square feet, be non -illuminated, and be erected flat against the wall of the building but not to protrude above the eave, and subject to com- pliance with all other regulations of the "AB" Professional Office District. Mayor Barnard announced the public hearing on the application of W. J. Roberts and Pedro Garcia for a change of zoning from "A-1" Apartment House District to "B-1" Neighborhood Business District on all of Lots 1, 2, 3, and 4, Block 21, Nueces Bay Heights Extension, and directed that the minutes reflect that Com- missioner W. J. Roberts, one of the applicants, had left the meeting for the purpose of this hearing. Tom Lake located the property on the map; pointed out the zoning and land use of the area; explained that 23 notices had been mailed out, 6 letters were received in favor of this request and none against; and stated that the recommendation of the Zoning & Planning Commission was that the request be approved subject to the erection of a satisfactory fence or other kind of screening along the property lines adjacent to residential properties. • • City of Corpus Christi, Texas Special Council Meeting June 26, 1963 Page 3 City Manager Whitney reported receipt of a telephone call from Mrs. Harry L. Olsen, 3026 Noakes, in favor of the request. Paul Nye, attorney, representing the applicants, presented a photo of the type of service station proposed by Texaco, Inc. for this location, and spoke in support of the application on the basis of its being the ideal location for a service station operation, and a benefit to the area. John Thomason, realtor, appeared in support of the application on the basis the location at the intersection of Interstate 37 and Nueces Bay Boulevard being most logical for business and anticipated changes in land use and zoning patterns. Pedro Garcia, applicant, and Mr. Newton and Mr. Page, representing the Texaco, Inc., were present in support of the application. No one appeared in opposition to the application. Motion by Wallace, seconded by Blackmon and passed that the hearing be closed, that the recommendation of the Zoning & Planning Commission be concurred in, and that the change of zoning on Lots 1, 2, 3, and 4, Block 21, Nueces Bay Heights Extension, from "A-1" to "B-1" Neighborhood Business District, be approved, subject to erection of a suitable fence or other kind of screening along the property lines adjacent to residential properties. Commissioner Roberts returned to the meeting. Mayor Barnard announced the public hearing on the application of Rodolfo Rodriquez for a change of zoning from "R -1B" One -family Dwelling District to "R-2" Two-family Dwelling District on all of Lot 11, Block B, La Gloria Addition. Tom Lake located the property on the map; pointed out the zoning and land use of the area; explained that 52 notices had been mailed out, 1 letter had been received for and one against the request; and that the recommendation of the Zoning & Planning Commission was that the request be approved. No one appeared either for or against this request. Motion by Blackmon, seconded by Maldonado and passed that the hearing be closed, that the recommendation of the Zoning & Planning Commission be concurred in, and that the change of zoning on Lot 11, Block B, La Gloria Addition, from "R -1B" to "R-2" Two-family Dwelling District, be approved. • City of Corpus Christi, Texas Special Council Meeting June 26, 1963 Page 4 City Manager Whitney reviewed the background of a previous request of the former Council to the Area Development Committee to study the question of a future water supply for the City of Corpus Christi, the appointment of a Sub- committee, and a brief progress report on studies to date. He presented and read a report dated June 17, 1963, addressed to Mr. Guy I. Warren, Chairman of the Area Development Committee, signed by the Area Development Committee Sub -Committee, M. Harvey Weil, Chairman, Don Cox, Jesse Laurence, Duane Orr, C. Joe Watson, Wm. V. Byrd, Lon Lacey, and Wm. Anderson. The report summarized the work to date of the Sub -committee relative to qualifications of prospective engineering firms for the development of a Master Plan for the Coastal Bend Area by which various area agencies can most effectively implement a staged program of projects, continuing new developments concerning Texas water developments, the report of the U. S. Study Commission for Texas, the report of the Bureau of Reclamation of the U. S. Depart- ment of the Interior for continuance of their program, and the Sub -committee's recommendation that the City of Corpus Christi, singly or joined by other interests, suggest to the Bureau of Reclamation that the key study phase of the program be completed as soon as possible, and that the City and other local interests furnish cooperation to the Bureau in the studies, including financial assistance in such reasonable amounts as may be negotiated, and suggested that an agreement be worked out with the Bureau including provisions for local participation in directing and reviewing all studies and plans. City Manager Whitney advised the Council that the A.D.C. is prepared to formally accept the foregoing report and to request the City to make this request of the Bureau of Reclamation, that personal discussions with Mr. Harry Burleigh, Division Engineer in Southwest Area, with the City Staff and Commissioner Roberts, and representatives of the A.D.C. have indicated concurrence with the recommenda- tion contained in the Sub -committee's report. Commissioner Roberts requested that a meeting be arranged at an early date for the entire Council with Mr. Burleigh to be fully acquainted with the details and to fully discuss the project. Motion by Roberts, seconded by Young and passed that the City Manager be authorized to request the Bureau of Reclamation to develop a Master Plan for • City of Corpus Christi, Texas Special Council Meeting June 26, 1963 Page 5 the Coastal Bend Area which will include all of the water resources in a staged program of implementation that will be economically feasible for the entire Coastal Bend Area. There being no further business to come before the Council, the special meeting was adjourned. I, JAMES L.
