Singer Ass't City Attorney Wayland Pilcher City Secretary T. Ray Rring Mayor James L. Barnard called the meeting to order. • The Invocation was given by the Reverend A. J. Ramona, Pastor of Garden - dale Church of Christ. City Secretary T. Ray Kring called the roll of those in attendance. Motion by Young, seconded by Maldonado and passed• that the minutes of the regular meeting of July 10, 1963g at 2:00 p.m., and of the special meeting of July 10, 1963, at 4:00 p.m., be approved as furnished to the Council. Dr. H. J. Williams, Reverend Harold Branch, Mr. C. C. Sampson and Mrs. Mattie Flowers, spokesmen for a group of approximately 30 negroes, each spoke at length on matters relative to full and complete integration in this City; expressed their confusion as to which public facilities have been fully integrated; their feeling of humiliation and frustration due to misleading information, reciting certain instances, and their impatience and disappointment at what they consider lack of progress in their cause; their feeling that the City Council cannot be considered an inter -racial committee since there is no Negro on the Council, and their insistence that such committee with Negro representation be officially appointed to present the problems to the Council for definite and quick action; the special need for planning and action in the field of employment and housing in order to attain their ultimate goal that the Negro race will not be judged and condemned because of the shortcomings or unacceptable actions of individuals of that race, any more than as if they were Angios. Reverend Rodman P. Kypke, Associate Rector of the Church of the Good Shepherd, Miss Penny Dudley and William Shireman, each spoke of their work with inter -racial committees, and urged the appointment by the City Council of an Inter -racial Committee composed of Negro, Latin-American, and Anglo, in order to City of Corpus Christi, Texas Regular Council Meeting July 17, 1963 Page 2 • • give official standing and recognition to fact findings, and to bring about better communication and a clear understanding of all groups as to what is being said officially and what is being done. Mayor Barnard requested Dr. Williams, Reverend Branch and Mr. Sampson, to meet with the City Council at 5 p.m. in an unofficial Work Shop Session for further discussion of these matters, and they gladly agreed to do so. Mayor Barnard read and signed a proclamation proclaiming the week of July 17 through July 24, 1963, as COS.PUS CHRISTI JAYCEE SAFETY SEAT BELT WEEK and en- couraging all citizens to avail themselves of the opportunity to equip themselves with, and use, seat belts and to cooperate in the educational program launched by the Jaycees in this field. The proclamation was accepted by Giles Giddings, presi- dent of the Junior Chamber of Commerce. Mayor Barnard announced the opening of bids. Bids were opened and read on the construction of Street Improvements in the Koolside Area, Lambert, Francis, Lum and Babalo Streets, from the following: King Construction Co.; Womack & Manning; H. D. Zachry; Fowco Construction Co.; South Texas Construction Co.; and Heldenfels Brothers. The foregoing bids were tabled for 48 hours as required by the City Charter, and referred to the City Manager for tabulation and recommendation. Bids were opened and read on the construction of Street Improvements on Bonham and Bowie Streets, each from Sacky to Sokol Drive, from the following: King Construction Co.; Womack & Manning; H. D. Zachry; Fowco Construction Co.; South Texas Construction Co.; and Heldenfels Brothers. The foregoing bids were tabled for 48 hours as required by the City Charter, and referred to the City Manager for tabulation and recommendation. Bids were opened and read on an estimated 12 -months' supply of 3 Lots of Lumber from the following: Raffle Lumber Div.; Cletus Brown Lumber Co.; C. C. Brick & Lumber Co.; The Great Texas Lumber Co.; and Westside Lumber Co. The foregoing bids were tabled for 48 hours as required by the City Charter, and referred to the City Manager for tabulation and recommendation. Mayor Barnard announced the public hearing on the Appeal from the Decision of the Taxicab Inspector regarding the Disapproval of the Application of Roberto C. • City of Corpus Christi, Texas Regular Council Meeting July 17, 1963 Page 3 Bazan for a Taxicab Driver's License, and explained the manner in which the hearing would be conducted, and that since this was not a Court of Law, the Chair would allow the submission of any evidence that the Council felt it needed to ascertain the facts in the matter. At the request of Edwardo E. de Ases, attorney for Roberto C. Bazan, the two witnesses, Sgt. Walter B. Marsalis and Lt. Jeff Bagwell, were individually placed under oath, instructed not to discuss the matter or their testimony with anyone, and excluded from all portions of the Hearing except for when individual'ty testifying. Mr. de Ases' request for a limitation of period of time for submission of evidence by the City Attorney as to the past record of the applicant for con- sideration in this matter, instead of the sixteen years covered in the communica- tion dated May 8, 1963, signed by the Director of Public Utilities and the Taxicab Inspector, vas denied on the basis that all of a person's past record of actions makes up his character, which is the basis provided in the ordinance for approval or disapproval of a taxicab driver's license. Be -t, Walter B. Harsalis, of the City Police Department and Taxicab Inspect- or, testified under oath to the effect that on July 9, 1963, at 9 a.m., he had re- ceived the application of Roberto C. Bazan on the standard application form for a taxicab driver's license; that the application was incomplete in that the complete set of photos required by the ordinance were not attached, and the question of in- tended employment by a taxi firm was answered "unknown at present time"; and point- ed out that the question of violation of any criminal law had been answered in the affirmative and cited the letter of G. C. Letch to City Manager Whitney, dated May 8, 1963, for list of offenses; and that on June 28, 1963, Roberto Bazan had been given the standard geography test required by the ordinance, and had failed 8 questions out of 20; that the geography test 1s often given first so as not to make a person fill out the application if he can't pass the teat; that on Septem- ber 18, 1961, by written notice, the taxicab driver's license of Roberto C. Bazan had been revoked, based on a charge of speeding for which the fine of ',25.00 had been paid on September 7, 1961, in Corporation Court and his past record; and that the new application had been disapproved on the basis of failure to pass the geog- raphy test, and on judgment of character based on his past record. Sgt. Marsalis • City of Corpus Christi, Texas Regular Council Meeting July 17, 1963 Page 4 testified under questioning that the subject license had been revoked, not sus- pended. Lt. Jeff Bagwell, of the City Police Department and Supervisor of Iden- tification Department, testified under oath to the effect that the I.D. card #19590 in the name of Roberto Bazan, submitted as evidence, and listing the dates, numbers, rhRrges, and disposition of same, was his official record, and that all offenses listed were against Roberto Bazan, not Roberto Bazan, Jr. Assistant City Attorney Wayland Pilcher presented in evidence the appli- cation of Roberto C. Kazan for Taxicab Driver's License, the Geography Test given to applicants for Taxicab Driver's License taken by Roberto Bazan on June 28, 1963, I.D. card #19590 from Police Records, copy of communication to City Manager Whitney from G. C. Letch, Director of Public Utilities, dated May 8, 1963, titled Taxicab Driver License Canceled, and copy of letter to Roberto C. Bazan, dated September 18, 1961, from R. T. Runyan, Chief of Police by Sgt. W. B. Marsalis, Inspector of Taxicabs, revoking City Taxicab Driver's License. Roberto C. Bazan testified under oath as to his driving experience and police record of offenses, and under cross-examination testified to the effect that he had only two car accidents, and that he did not hit any pedestrian but that the pedestrian had been drunk and ran into his car; and that the ticket for speeding on September 7, 1961, was for his son, Roberto Bazan, Jr. Mr. de Ases argued that the applicant was asking for an opportunity to work at the thing he knows best to do to support himself and his grandchildren; that he has an aggressive personality, is a rugged individual with perhaps a chip on his shoulder in the face of constant objections presented in his attempt to get a permit to drive a taxicab; that the type and number of offenses in most recent years do not justify disapproval of his application; and that if allowed to take the geography test without Sgt. Marsalis present, the applicant would pass it; and that the speeding violation referred to in the letter dated Septem- ber 18, 1961, was issued to the applicant's son. Assistant City Attorney Pilcher argued that the failure of the appli- cant to supply the full information and particulars set forth in the ordinance in connection with the application, his failure to answer correctly a sufficient City of Corpus Christi, Texas Regular Council Meeting July 17, 1963 Page 5 number of the questions in the geography test, and the consistent pattern of violations of drunkeness, disturbance, and resistence evidenced by the Police Record, constitute justification for disapproval of the application for a taxicab driver's license, and for denial of the appeal by the Council. Motion by Blackmon, seconded by de Leon and passed that inasmuch as the ordinance required the Council to make its decision within 5 days of the hearing on the appeal, that the hearing be continued until next week's regular meeting, at which time the Council will receive official evidence from Corporation Court relative to the speeding ticket referred to in the testimony. Mayor Barnard called for the City Manager's Reports. Motion by de Leon, seconded by Young and passed that the City Manager's Reports be accepted, and the recommendations and requests be approved and granted, as follows; a. That bid awards be made on the basis of low bid meeting specifica- tions as follows; (1) To Armco Drainage & Metal Products, Inc., for 1 Model 20 Flap Gate, 72" x 72", for $5,261.74; (Bid Tabulation #59); and (2) To Gulf Iron Works, for Repair of the 250,000 gal. Water Tank on Mestina and Sam Rankin Streets, for $3,670.00; (Bid Tabulation #60); b. That a lease with the U.S. Navy for the installation of GCA Radar Unit at International Airport for the consideration of $1.00 per year, on a year- to-year basis, be approved; c. That the purchase by the City Gas System from the Corpus Christi Municipal Gas Corp. of 2,897' of 8" wrapped steel gas main located in Tribble Lane, at a cost of $15,093.00, be approved; d. That the appropriation of $17,565.00 from bond funds to reimburse the General Fund for charges for engineering work performed on bond projects dur- ing the 4th quarter of the current 1962-63 fiscal year, be approved; e, That the dates for public hearings be set as follows; (1) August 7, 1963, during a special meeting convening at 4;00 p.m., on the zoning applications of Mr. Frances I. Gandy, Plato Brothers, Inc., Mr. Joseph Hans, and Mr. G. R. Swantner; (2) August 7, 1963, during the regular meeting, on the Abandonment of a part of Denver Street between Ropes and Sinclair Streets; and (3) August 14, 1963, Rides; the regular meeting, on the Appeal of Grande Courts relative to Amusement _rides; f. That the assignment of a farm lease on Tract B, of approximately 113.77 acres, at International Airport, formerly awarded to C. F. Lehman, to Tom Slay under the same terms and conditions, be approved. City of Corpus Christi, Texas Regular Council Meeting July 17, 1963 Page 6 ORDINANCE NO. 6956 AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON BEHALF OF THE CITY OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A USE PRIVILEGE WITH THE UNITED STATES OF AMERICA FOR USE BY THE UNITED STATES NAVY OF AN AREA AND FACILITIES AT THE CORPUS CHRISTI INTERNATIONAL AIRPORT FOR A TERM OF ONE YEAR, ALL AS DESCRIBED IN AN AGREE- MENT WITH THE UNITED STATES OF AMERICA, A COPY OF WHICH IS ATTACHED HERETO AND MADE APART HEREOF; AND DECLARING AN EMERGENCY. ORDINANCE NO. 6957 APPROPRIATING THE SUM OF $15,093.00 OUT OF NO. 200 GAS SYSTEM BOND FUND FOR THE PURCHASE FROM THE CORPUS CHRISTI MUNICIPAL GAS CORPORATION OF 2,897 FEET OF 8" WRAPPED STEEL GAS MAIN LOCATED IN TRIBBLE LANE, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS; AUTHORIZING AND DIRECTING THE CITY MANAGER TO ACQUIRE FROM THE CORPUS CHRISTI MUUNICIPAL GAS CORPORATION THE AFORESAID PIPE, AND TO D0 SUCH THINGS AS ARE NECESSARY TO MAKE SUCH ACQUISITION; AND DECLARING AN EMERGENCY. RESOLUTION NO. 6963 THAT THE CORPS OF ENGINEERS BE URGED TO EXPEDITE THE STUDIES AND PLANS CONCERNING HURRICANE FLOOD PROTECTION FOR THE CORPUS CHRISTI AREA BEFORE DEVELOPMENTS TAKE PLACE WHICH MAY CONFLICT WITH SUCH PLANS; GIVING SPECIAL ATTENTION AT THE EARLIEST PRACTICABLE DATE TO SUCH PLANS FOR THE CONSTRUCTION OF A HIGH BEACH IN FRONT OF THE CORPUS CHRISTI BEACH PENISULA; THAT COPIES OF THIS RESOLUTION BE FORWARDED TO THE DISTRICT ENGINEER, CORPS OF ENGINEERS; DECLARING AN EMERGENCY. Mrs.Sherman O. Carlson, 1755 Santa Fe, expressed her objections to the one-way street pattern on Santa Fe and Third Streets, and to the proposed areas and hours of restricted parking on Santa Fe, and by means of a rough sketch drawn on the easel, City Manager Whitney pointed out the direction of the moving traffic and explained the purpose of the proposed hours and areas of restricted parking; and it was further explained that the matter of one -streets was not presently before the Council, and that the proposed ordinance presently before the Council related only to the restriction of parking during peak hours of traffic on these streets. William Shireman, attorney, suggested that consideration be given to re- versing the direction of the one-way traffic on these streets making Santa Fe and Tancahua the North -bound streets, thereby permitting continuous traffic on Santa Fe all the way from Doddridge into the downtown area, and making Third and Carancahua the South -bound streets, which he felt would benefit traffic from Spohn Hospital, the majority of which he felt would be heading South and West. Joe Roscoe, Santa Fe business property owner, expressed the hope that nothing permanent would be done until experiment and time have shown what needs to be done in these matters and whether or not this will accomplish the necessary results. ORDINANCE NO. 6964 AMENDING SECTION 21-156 OF THE CORPUS CHRISTI CITY CODE, 1958, AS AMENDED, BY MAKING PROVISION FOR ITEMS 15 THROUGH 20, RESPECTIVELY, SO AS TO FORBID THE STOPPING STANDING OR PARKING OF VEHICLES ON THE WEST SIDE OF TANCAHUA STREET BETWEEN BUFFALO STREET AND HANCOCK STREET FROM 4:00 P.M. FIRST READING OF AN ORDINANCE GRANTING CORPUS CHRISTI SIGHT SEEING SERVICE, INC., A FRANCHISE ON AND OVER THE PUBLIC STREETS, ALLEYS AND PUBLIC THOROUGHFARES OF THE CITY OF CORPUS CHRISTI, FOR THE PURPOSE OF OPERATING SCENIC MOTOR TOUR SERVICES, IN THE SAME FORM AS THE FRANCHISE GRANTED BY ORDINANCE NO. 5089, PASSED AND APPROVED BY THE CITY COUNCIL ON JULY 2, 1958, AND AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE AND DELIVER SAID FRANCHISE; PROVIDING FOR THE FORFEITURE OF SAID FRANCHISE; AND PROVIDING AN EFFECTIVE DATE. The foregoing ordinance was read for the first time and passed to its second reading by the following vote: Mayor Barnard, Commissioners Young, Blackmon, de Leon, Maldonado, Roberts and Wallace, present and voting "Aye". Mayor Barnard announced that the applications of Mr. Cecil Burney and Mr. Frank Cech for changes in zoning on portions of the Hatch Tract described in the applications by metes and bounds, upon which public hearings were held on July 10, 1963, would be held in abeyance for a reasonable length of time pending a plan of development being worked out satisfactory to the applicants and protecting the resi- City of Corpus Christi, Texas Regular Council Meeting July 17, 1963 Page 11 dents, the thought being that perhaps the development of a one story warehousing complex, screened off from the residents, with access roads - without connections to residential areas - being provided by the developers on which a Special Use Permit might be granted, could be developed. Harry Grimm, Flour Bluff resident, asked when that area would officially be within the City, and was informed that a motion was being prepared by the Legal Department for filing to prevent any further delay in the lifting of the injunction as soon as Judge Paul Martineau receives the mandate from the Court of Civil Appeals. Mayor Barnard declared a short recess. Following the recess, Mayor Barnard reconvened the meeting with all members of the Council, the City Manager, Assistant City Attorney, and the City Secretary all in attendance. Mayor Barnard read the following proposed resolution to be sent to all business places in Corpus Christi: "The City Council of Corpus Christi strongly favors and supports full integration of all public accommodations and amusement facilities. The City Council has asked that all businesses which are open to the public serve all persons regard- less of race, creed or color. "In evidence of your support of this resolution, please sign the attached statement and return it to the Office of the Mayor, Corpus Christi, Texas." Motion by de Leon, seconded by Young and unanimously passed that the fore- going statements be approved and adopted in resolution form at this meeting. RESOLUTION NO. 6965 IN SUPPORT OF FULL INTEGRATION OF ALL PUBLIC ACCOMMODATIONS AND PUBLIC AMUSEMENT FACILITIES AND THEREFORE HEREBY ASKING THAT ALL BUSINESSES WHICH ARE OPEN TO THE PUBLIC ADOPT A POLICY AND PRACTICE OF SERVING ALL PERSONS REGARDLESS OF RACE,CREED OR COLOR.
