Mayor James L. Barnard called the meeting to order.
City Secretary T. Ray Kring called the roll of those in attendance.
Motion by Blackmon, seconded by Maldonado and passed that the absence
of Commissioner J. R. de Leon be excused for cause.
Lee Mahoney, attorney for Parkview General Hospital, stated that he had
conferred with his clients with respect to the proposal as reported by Assistant
City Manager Townsend in the regular meeting earlier, and suggested a few changes,
such as deletion of any reference to the access to park and playground, provision
for use of the rear lot for emergency ingress and egress, deferment of platting of
certain property until such time as actually to be used, and the deletion of refer-
ences to the fencing in certain sections of the proposed ordinance.
After some discussion, it was suggested that the proposal of the Staff,
in general, be given Council approval, with the idea of having the ordinance pre-
pared for next week's meeting, setting forth the provisions outlined, and Mr.
Mahoney asked that passage of the ordinance be deferred for a few days to give him
an opportunity to study the actual wording of the ordinance.
Motion by Blackmon, seconded by Young and passed that the request for a
change of zoning from "R -1B" to "AB" on a 12.772 -acre tract out of Lot 12, Sec-
tion "A", Paisley's Subdivision of the Hoffman Tract, be denied but in lieu the
Special Council Permit granted on November 11, 1959, be extended and modified with
provisions and revisions as outlined by the Staff, and which will be included in
the ordinance to be brought forward for Council action on August 14th at the regu-
lar meeting.
Mayor Barnard announced the public hearing on the application of Frances
I. Gandy for change of zoning from "B-4" General Business District to "I-2" Light
Industrial District on Lot 9 and those portions of Lots 10 & 11 lying North of
Baldwin Boulevard, Block 26, Meadow Park Addition.

Earl Goetsch, Senior Planner, located the property in question on the
map; pointed out the zoning and land use of the area; that 27 notices had been
mailed out, 1 return received in favor of the request, and 1 against; that no one
had appeared either for or against the request at the Commission hearing; that the
requested zoning would make the existing non -conforming use of the property as a
lumber yard, a conforming use; and that the recommendation of the Zoning & Planning
Commission was that the request be denied on the basis of lack of information re-
garding the applicant's plans and that approval would constitute spot zoning.
Frances I. Gandy, owner and applicant, appeared in support of the request;
stated that he had been unable to appear at the Commission hearing due to illness;
and urged that the request be granted as he has an opportunity to lease the proper-
ty to Mr. Doty of Factory Outlet on a month to month basis for temporary storage
and disposal of retail factory outlet lumber.
No one appeared in opposition to the request.
Motion by Young, seconded by Maldonado and passed that the hearing be
closed.
Motion by Blackmon, seconded by Maldonado and passed that the zoning on
Lot 9 and those portions of Lcts 10 & 11 lying North of Baldwin Boulevard, Block
26, Meadow Park Addition, be changed from "B-4" to "I-2" Light Industrial District.
Mayor Barnard announced the public hearing on the application of Flato
Brothers, Inc. for change of zoning from "R -1B" One -family Dwelling District to
"B-4" General Business District on Tract I, all of Lots 20, 21, 22, 23 & 24,
Block 4, Jackson Place Subdivision; Tract II, all of Lot 10, Block K, Jackson
Woods Subdivision; Tract III, all of Block J, Jackson Woods Subdivision; and for
change of zoning from "R -1B" One -family Dwelling District to "A-1" Apartment House
District on Tract IV, all of Block H, Jackson Woods Subdivision; Tract V, all of
Lots 6, 7, 8 & 9, Block G, Jackson Woods Subdivision; Tract VI, all of Lots 11 &
12, Block G, Jackson Woods Subdivision.
Earl Goetsch located the property on the map; pointed out the zoning and
land use of the area; stated that 43 notices had been mailed out, and that there
were 6 returns received in favor of the request and none against, and that one
person had appeared at the Commission hearing in support of the application in

addition to the representative of the applicants; and that the recommendation of
the Zoning & Planning Commission was that the requested changes in zoning be
approved.
Ian Naismith, engineer representing the applicants, presented and ex-
plained the details of a master plan for development of the Tracts involved in the
request, and urged that the application be granted as recommended by the Commission.
No one appeared in opposition to the request.
Motion by Young, seconded by Blackmon and passed that the hearing be
closed.
Motion by Roberts, seconded by Maldonado and passed, with Commissioner
Young abstaining due to a personal interest, that the recommendation of the Zoning
& Planning Commission be concurred in, and the zoning on Tracts I, II and III, as
described in the application, be changed from "R -1B" to "B-4" General Business Dis-
trict, and that the zoning on Tracts IV, V and VI, as described in the application,
be changed from "R -1B" to "A -l" Apartment House District.
Mayor Barnard announced the public hearing on the application of Joseph
Hans for change of zoning from "B -1A" Tourist Court District to "B-1" Neighborhood
Business District on all of Lots 1, 2 & 3, Block B, Manor Terrace.
Earl Goetsch located the property on the map; pointed out the zoning and
land use of the area; explained. that 8 notices had been mailed out, that 3 returns
had been received in favor of the request and 2 against, and 2 persons had appeared
at the Commission hearing in opposition; and that the recommendation of the Zoning
& Planning Commission was that the request for change of zoning be approved.
Joseph Hans, architect representing the property owner, explained the
plans for the development of the property for a funeral home operation with the
building construction on the front portion of the property, and fencing and land-
scaping screening to be included, and urged that the request be granted onthe
basis that it was a better use of the property and more compatible with the neigh-
borhood residential uses than the permitted use under the present zoning for a
tourist court.
No one appeared in opposition to the request.

Motion by Wallace, seconded by Blackmon and passed that the hearing be
closed, and the recommendation of the Zoning & Planning Commission be concurred in,
and the zoning on all of Lots 1, 2 and 3, Block B, Manor Terrace, be changed from
"B -1A" to "B-1" Neighborhood Business District.
Mayor Barnard announced the public hearing on the application of G. R.
Swantner for change of zoning from "R -1B" One -family Dwelling District to "I-2"
Light Industrial District on a triangular shaped portion out of the southern por-
tion of Lot 3, Baldwin Moore Farm Lots, described by metes and bounds.
Earl Goetsch located the property on the map; pointed out the zoning and
land use of the area; stated that 4 notices had been mailed out, 2 returns re-
ceived in favor of the request and none against; explained that the remaining por-
tion of Lot 3 had been zoned "I-2" when the area of request was still outside the
City limits; and that the recommendation of the Zoning & Planning Commission was
that the request be approved.
Fred Fowler, speaking for himself, his mother and 2 sisters, owners of
Lot 6 adjoining the area of request, did not oppose the application, but was con-
cerned as to the permanent zoning that would be given to his property, and was in-
formed that he would be given an opportunity to be heard relative to his zoning at
the public hearing which would likely be held in the near future.
No one appeared in opposition to the request.
Motion by Maldonado, seconded by Wallace and passed that the hearing be
closed, and that the recommendation of the Zoning & Planning Commission be con-
curred in, and the zoning on the triangular shaped portion out of the Southern
portion of Lot 3, Baldwin Moore Farm Lots, as described in the application, be
changed from "R -1B" to "I-2" Light Industrial District.
A representative of Brazelton Construction Company, asked if he could
be given a Building Permit to begin construction on the Parkview General Hospital
in view of the action of the Council at the beginning of this meeting. The matter
was discussed briefly, and Mayor Barnard explained that the issuance of a Build-
ing Permit did not come under the jurisdiction of the Council, and that although
the Council did not want to delay development or cause undue hardship, he would
not allow the Council to be bound to passage of en ordinance by implied agreement

before the ordinance has been written and the wording approved as to Legal form
by the City Attorney, and that it was best to wait until all details had been
worked out satisfactorily to both the City and the Hospital and the ordinance
voted upon at next week's regular meeting.
There being no further business to come before the Council, the special
meeting was adjourned.
