Barnard called the meeting to order. The Invocation was given by the Reverend Harold T. Branch, Pastor of St. John Baptist Church. City Secretary T. Ray Kring called the roll of those in attendance. Motion by Roberts, seconded by de Leon and passed that the minutes of the regular meeting of August 21, 1963, be approved as furnished to the Council. Mayor Barnard read a proclamation proclaiming today as "Citizenship Day" in recognition of the rights of citizens to assemble peacefully and come to City Hall, and symbolir..iiy joining the momentous march of our fellow citi- zens from all walks of life who are using this means to demonstrate, in the finest traditions of the American system, their desire to present grievances for redress. Dr. H. J. Williams, president of United Citizens Civic League, ex- pressed appreciation for the acceptance in the spirit in which it was made, of the demonstration march around City Hall just completed, and for the proclama- tion of Citizenship Day just read by Mayor Barnard; and read and presented a petition in the interest of democracy, Christianity, and common decency, that the City Council enact an ordinance forbidding the denial of service to anyone because of race, creed or color by any place of public accommodation or amuse- ment within the City. The following presented the same petition on behalf of the organiza- tion or group they represent: Reverend Harold T. Branch, St. John First Baptist Church; Reverend Dale H. Hansboro, St. Paul Methodist Church; Reverend E. Grant, St. Matthew's Baptist Church; Father C. J. Aulvy, Holy Cross Church; Reverend R. A. Hicks, Mt. Zion Baptist Church; Mrs. Lillian Leathers, National Associa- tion for the Advancement of Colored People. • • City of Corpus Christi, Texas Regular Council Meeting August 28, 1963 Page 2 Travis Smith, 433 Wilma, spoke in opposition to the proposed ordin- ance on Constitutional grounds and sociological grounds as being an infringe- ment on the rights of a vast majority of the citizens of this country, and on the belief that passage of such an ordinance would do more to widen the breach between the races. C. C. Sampson, retired school teacher, refuted Mr. Smith's state- ments as to having the same advantages; stated that the proposed ordinance would not be forcing togetherness; that as citizens of the United States they want all the privileges and responsibilities of citizenship; and that other discriminations due to race and place of birth have been wiped out with the exception of the Negro. The following appeared and spoke in support of the passage of the proposed ordinance: Reverend E. Grant, pastor of St. Matthew's Baptist Church; Miss Aurora Williams, student at Del Mar College; William Nutting, 1322 Fifth Street; Guy Watts, 322 South Carancahua; Dr. Frank Hovell; Reverend Tom Morris, All Saints Episcopal Church; and Florence Moore, 1415 Stillman. The following appeared and spoke in opposition to the proposed or- dinance on the basis that there is segregation in all walks of life, and that the rights of private enterprise should be preserved: Travis Parker, 2613 Lynch; Jack Davis, Corpus Christi Beach; and Mrs. Levi Materne, 325 Ohio. The petitions were ordered received, and Mayor Barnard stated that many things have been said on this serious and difficult problem; that the Council fully appreciated hearing from both sides; assured the citizens that the Council has the intelligence to ferret out the logical and the illogical arguments; and that the Council will give the proposed ordinance, as it does all matters that come before it, due and careful consideration, and will do what their conscience and intelligence dictate is the right thing for the City of Corpus Christi as a whole. (Petition #12). The receipt of a letter, signed by nine Methodist ministers, stating their continued support of the official position of their church relative to human rights and equality of opportunity; commending the Council for the pro- gress made thus far in the field of race relations; and requesting consideration • City of Corpus Christi, Texas Regular Council Meeting August 28, 1963 Page 3 of the formation of a bi-racial and inter -cultural committee to facilitate the continued progress in this realm, was acknowledged. (Petition #13). Mayor Barnard called for the City Manager's Reports. Motion by Wallace, seconded by Roberts and passed that the City Manager's Reports be accepted, and the recommendations and requests be approved and granted, as follows; a. That the plans and specifications for the construction of street improvements on North Staples Street, from Kinney Street to Interstate Highway 37, be approved; and that authority to advertise for bids to be received on September 18, 1963, be granted; b. That the award of bid on the basis of low bid meeting specifi- cations, be made as follows; (1) To Kaffie Lumber Division, for 3 items of Polyethylene Plastic, for a total of $7,740.80; (Bid Tabulation #66); (2) To M. B. Skinner Company, for 2 items of Bell Joint Clamps, for a total of $24,224.31; (Bid Tabulation #67); (3) To Wyatt Industries, Inc., for 4 items of Corrugated Galvanized Casing, for a total of *7,565.76; (Bid Tabulation #68); ' (4) To American Cast Iron Pipe Company, for Items 1 and 3, Ductile Iron Pipe and Mechanical Joint Cast Iron Pipe, for a total of $6,730.88, and to Gifford - Hill -American, Inc., for Item 2B, Pretensioned Concrete Steel Cylinder Pipe, for a total of $11,202.10; (Bid Tabulation #69); c. That the employment of McCall, Parkhurst, Crowe, McCall & Horton, Attorneys, Dallas, Texas, to act as bond attorney for the bonds to be sold by the City on September 24, 1963, be approved; d. That the sum of $3,150.00 be appropriated for purchase of Parcel #5 and Parcel #6, in connection with the 19th Street intersection connection to State Highway #286, Relocated; e. That the Tax Error and Correction List for July, 1963, be approved; f. That the date of September 18, 1963, during the regular meeting, be set for public hearing on the application of Red Top Taxi Co. for a change of zoning; g. That the requests for Interim Zoning Permits be approved as fol- lows: (1) #62-63, W. 3. Jenkens, to add a 12, x 18' porch on one house, a • City of Corpus Christi, Texas Regular Council Meeting August 28, 1963 Page 4 40' x 20' x 12' covered patio on the second existing house, and a 20' x 24' detached double garage between the two houses on a portion of Lot 31, H. B. Shepard Farm Lot, at 8226 Leopard Street (Highway #9); and (2) #62-64, W. D. Hayley, to erect a 28' x 98', 9 -unit apartment building with 18' x 42' open carports, on Lots 33 & 34 and portion of 35, Block 4, Bervonne Terrace, at 10501 Helier. h. That consideration of the request of Dr. and Mrs. Mark Pomerantz regarding a certain street improvement assessment against their property at 502 Santa Monica, be temporarily deferred to see if either of them appear at the meeting. THIRD READING OF AN ORDINANCE: ORDINANCE NO. 70128 AUTHORIZING THE CITY MANAGER TO EXECUTE, FOR AND ON BEHALF OF THE CITY, A RE- VOCABLE EASEMENT FOR USE OF A PORTION OF THE PUBLIC RIGHT OF WAY AND STREET OF OCEAN DRIVE, LYING SOUTH OF THE SOUTH LINE OF LOT 1, MARKAMAY ESTATES, AND EAST OF THE EASTERLY LINE OF LOT 1, BLOCK 1, ALTA PLAZA, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS; PROVIDING THE TERMS OF SUCH EASEMENT, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF. The foregoing ordinance was read for the third time and passed finally by the following vote: Mayor Barnard, Commissioners Young, de Leon, Maldonado, Roberts, and Wallace all present and voting "Aye", and Commissioner Blackmon, abstaining. Commissioner Blackmon requested that the minutes reflect that he had abstained on the foregoing ordinance due to a personal interest in the area. ORDINANCE NO. 7013 APPROPRIATING OUT OF NO. 220 STREET BOND IMPROVEMENT FUND THE SUM OF $3,150.00 FOR THE ACQUISITION OF PARCELS #5 AND #6, OF WHICH AMOUNT $2,000.00 IS FOR THE ACQUISITION OF PARCEL #5; $1,000.00 IS FOR THE ACQUISITION OF PARCEL #6; AND $150.00 IS FOR TITLE EXPENSE AND RELATED COSTS THERETO, ALL APPLICABLE TO PRO- JECT N0. 220-56-27, 18TH AND 19TH CONNECTION TO MORGAN; AUTHORIZING AND DIR- ECTING THE CITY MANAGER TO EXECUTE REAL ESTATE SALES CONTRACTS FOR AND ON BE- HALF OF THE CITY OF CORPUS CHRISTI, FOR THE ACQUISITION OF SAID PARCELS AT THE PURCHASE PRICE HEREIN STATED; AND DECLARING AN EMERGENCY. ORDINANCE NO. 7015 AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE e(TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565 ET SEQ OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME, AND PARTICULARLY AS AMENDED BY ORDINANCE N0. 61o6, PASSED AND APPROVED ON THE 291$ DAY OF MARCH, 1961, BY GRANTING A SPECIAL USE PERMIT ON LOTS 10 AND 12, BLOCK 54, AND LOTS 2 AND 4, BLOCK 55, BROOKLYN ADDITION, AN ADDITION TO THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FOR TRP OPERATION OF A CARNIVAL, SUBJECT TO THE CONDITIONS CONTAINED HEREIN; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDIN- ANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. ORDINANCE NO. 7016 AN ORDINANCE LEVYING ASSESSMENTS AGAINST VARIOUS PERSONS AND THEIR PROPERTY FOR THE PAYMENT OF A PART OF THE COST OF IMPROVING AND PAVING PORTIONS OF THE FOLLOW- ING STREETS AND PORTIONS THEREOF IN THE CITY OF CORPUS CHRISTI, TEXAS, TO -WIT: 1. LAMBERT STREET, FROM LUM STREET TO WEST PROPERTY LINE OF KOOLSIDE ADDITION; City of Corpus Christi, Texas Regular Council Meeting August 28, 1963 Page 6 2. FRANCIS STREET, FROM LUM STREET TO WEST PROPERTY LINE OF KOOLSIDE ADDITION; 3. FRANCIS STREET, BOBALO STREET TO LUM STREET; 4. LUM STREET, GOLLIHAR ROAD TO MC ARDLE ROAD; 5. ORDINANCE NO. 7017 • AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE AN AGREEMENT WITH THE TEXAS HIGHWAY DEPARTMENT WHEREBY THE STATE OF TEXAS AGREES TO CONSTRUCT OR TO HAVE CONSTRUCTED PARKING FACILITIES WITHIN THE LIMITS FROM FITZGERALD STREET NORTH TO CORPUS CHRISTI SHIP CHANNEL AND U. S. HIGHWAY 181, AND WHEREBY THE CITY OF CORPUS CHRISTI AGREES TO REIMBURSE THE STATE OF TEXAS FOR THE COST OF SUCH CONSTRUCTION, A COPY OF WHICH AGREEMENT IS ATTACHED HERETO AND MADE A PART HEREOF; APPROPRIATING OUT OF TRUST FUND ACCOUNT NO. 1749 THE SUM OF $22,600.00 TO BE TRANSMITTED TO THE STATE OF TEXAS UPON DELIVERY OF THE EXECUTED CONTRACT REFERRED TO HEREIN; AND DECLARING AN EMERGENCY. Mayor Barnard called for petitions or information from the audience on matters not scheduled on the agenda. Mayor Barnard welcomed to the meeting, Boy Scout Jack Miller, of Troop 175, who was attending the Council meeting in connection with earning his Merit Badges for Citizenship in the Community, and Citizenship in the Nation. Since neither Dr. nor Mrs. Pomerantz were present,'Mayor Barnard an- nounced that Council action on their request that they be allowed to pay the original assessment without accumulated interest, in respect to street im- provement assessments against their property at 502 Santa Monica, be deferred for one week. • City of Corpus Christi, Texas Regular Council Meeting August 28, 1963 Page 7 Mrs. Rose Clemmer, 1425 Mango Courts, complained of unfair treatment of her application for a change of residence from her apartment in the La Armada Housing Units to the Clairelaine Housing Apartments. Mayor Barnard explained that except for appointing the members of the Board, the Council has no authority over the Housing Authority; but re- - quested that the question of unfair treatment of Mrs. Clemmer's application be looked into. Mayor Pro Tem Jim Young reported that it was good to be home after his 5,000 -mile trip through 21 states; that Corpus Christi is one of the finest spots in the country; and that the City's future is ahead of us and can grow industry -wise as big as the people want it to and are willing to invest in its future. There being no further business to come before the Council, the meet- ing was adjourned. I, JAMES L.
