Mayor James L. Barnard called the meeting to order.
City Secretary T. Ray Kring called the roll of those in attendance.
Mayor Barnard announced the purpose of the special meeting to hold public
hearings on several zoning cases, and explained the procedure to be followed.
Mayor Barnard announced the public hearing on the application of T. U.
Hamlett, Sr. and others, for a change of zoning from "A-2" Apartment House District
to "AB" Professional Office District on all of Lots 1 through 22, Block 3, Hughes
Addition.
Tom Lake, Zoning Coordinator, located the property on the map; pointed
out the zoning and land use of the area; stated that all of the property owners
with the exception of one had joined in the request; that 30 notices had been
mailed out, 7 returns received in favor of the request and none against, and one
additional return in favor following the hearing; and that the recommendation of
the Zoning & Planning Commission was that the application be approved.
(T. U. Hamlett, Sr., applicant, was present in support of the application,
and no one appeared in opposition.
Motion by Wallace, seconded by Young and passed that the hearing be closed,
and the recommendation of the Zoning f Planning Commission be concurred in, and the
zoning on all of Lots 1 through 22, Block 3, Hughes Addition, be changed from "A-2"
to "AB" Professional Office District.
Mayor Barnard announced the public hearing on the application of Jim E.
Hernandez for a change of zoning from "R -1B" One -family Dwelling District to "B-4"
General Business District on the Southern portion of Lot 1, Block 4, Coronado
Addition.
Tom Lake located the property on the map; pointed out the zoning and land
use of the area; stated that 31 notices had been mailed out, 15 returns received

in favor of the request, one against; that a petition signed by 38 neighboring
property owners had been received and presented in favor of the request, and 12
persons had stood in favor of the request at the hearing; and that the recommenda-
tion of the Zoning & Planning Commission was that the request be approved.
Jim E. Hernandez, applicant, was present in support of the request, and
presented 12 returns in favor Of the request; and no one appeared in opposition.
Motion by Maldonado, seconded by de Leon and passed that the hearing be
closed, and cne recommendation of the Zoning & Planning Commission be concurred in,
and the zoning on the Southern portion of Lot 1, Block 4, Coronado Addition described
in the application, be changed from "R -1B" to "B-4" General Business District,
Mayor Barnard announced the public hearing on the application of Corpus
Christi Teachers Federal Credit Union for a change of zoning from "R-111" One -family
Dwelling District to "AB" Professional Office District on' a 1 -acre tract out of Lot
4, Section "B', Paisley's Subdivision of the Hoffman Tract,
Tom Lake located the property on the map; pointed out the zoning and land
use of the area; stated that 30 notices were mailed out, one return received in favor
of the request, and 7 against; that one neighboring property owner had appeared in
support of the application, and 2 against at the Commission hearing; and that the
recommendation of the Zoning & Planning Commission was that the change of zoning be
denied on the Northeast one-half of the one -acre tract, but that "AB" Professional
Office District be granted on the South one-half of the one -acre tract as shown on
the presented site plan and subject to the following conditions: (1) Submission of
a proper plat; (2) Erection of a 5 -foot fence at the rear of that portion of the lot
to be granted "AB" zoning; and (3) Filing of deed restrictions that would require
1 -story masonry veneer exterior construction.
In answer to the Council's question, City Attorney Singer and Assistant
City Attorney Pilcher advised that additional restrictions could not be enforced if
the change of zoning to "AB" Professional Office District is granted, other than by
written agreement between the City and the property owner; but that if special permit
is granted, the use of the property can be limited to "AB" use subject to certain
restrictions.

Harold gamey, executive secretary of the Corpus Christi Teachers Federal
Credit Union, and J. W. Gary, attorney, explained the nature and manner of the
Credit Union operation, the size and type of construction of the proposed office
building; and urged that the requested "AB" zoning be granted rather than a special
permit because of the difficulty in obtaining Financing under a special permit; and
stated that the conditions would; be voluntarily met by written instruments so as to
be enforceable.
Two members of the Board of Directors of the Credit Union were also present
in support of the request.
The following persons viewed the proposed site plan, stated that they
would like to see the property developed and did not object to the proposed use of
the property, but preferred the granting of a special permit rather than the change
of zoning because they were concerned as to possible future use and zoning on the
North half of the area of request in the event of the future sale of the property;
Lewis Lovelace, 1549 Casa Grande, representing also the 13 signers of a statement
in favor of a special permit but opposed to a change in zoning; R. C. Welch, 3209
Olsen; and Mrs> H. W. Rogers, 3205 Olsen.
Mr, Gary pointed out that the submission of the final plat for approval
would straighten out the street right-of-way to conform to the rest of the street
width; that the one-story masonry construction building proposed would probably
dictate the type of any future development on the other half of the lot; and
that passage of the ordinance granting the change of zoning could be delayed until
the voluntary deed restrictions have been filed and the other conditions met; and
urged that the "AS" zoning be granted on that portion of the property proposed for
the Credit Union operation.
Motion by young, seconded by de Leon and passed, with Commissioner Wallace
abstaining, that the hearing be closed, and the recommendation of the Zoning & Plant
ning Commission be concurred in, and the change of zoning on the Northeast one-half
of the one -acre tract described in the application be denied, but that "AB" Pro-
fessional Office District be granted on the South one-half of the one -acre tract out
of Lot 4, Section "5", Paisley's Subdivision of the Hoffman Tract, as shown on the

presented site plan and subject to the following conditions: (1) Submission of a
proper plat; (2) Erection of a 5 -foot fence at the rear of that portion of the lot
to be granted "AB" Professional Office District zoning; and (3) Filing of deed
restrictions that would require one-story masonry veneer exterior construction.
Commissioner Wallace stated that he had abstained because he was opposed
to the first break in zoning in a residential area.
Mayor Barnard announced the public hearing on the application of Robert
P. Bernhard for a change of zoning from "R -1B" One -family Dwelling District to
"B-4" General Business District on all of Tract "D", Lot '16, Lokey Subdivision.
Tom Lake located the property on the map; pointed out the zoning and land
use of the area; atated that 8 notices had been mailed out, one return received
in favor of the request, and none against; that no one had appeared in opposition
at the Commission hearing; and that the recommendation of the Zoning & Planning
Commission was that the application be approved,
Robert P. Bernhard, applicant, stated that he had no immediate plans
for the property, but was requesting the zoning to make it possible to use the
land consistent with the immediately surrounding area.
No one appeared in opposition to the request.
Motion by Wallace, seconded by Blackmon and passed that the hearing be
closed, and the recommendation of the Zoning & Planning Commission be concurred
in, and the zoning on all of Tract "D", Lot 16, Lokey Subdivision, be changed
from "R -1B" to "B-4" General Business District.
Mayor Barnard announced the public hearing on the application of Carlos
Schunior for a change of zoning from "A-2" Apartment House District to "B-1"
Neighborhood Business District on all of Lot 8, Block 8, Meuly Subdivision.
Tom Lake located the property on the map; pointed out the zoning and
land use of the area; atated that 23 notices had been mailed out, one return re-
ceived in favor of the request, and 2 against; that no one had appeared in opposi-
tion at the Commission hearings and that the recommendation of the Zoning 6, Plan-
ning Commission was that the change of zoning be denied, but that in lieu, a
Special Permit for a barber shop under Article 25, Section 25-4, Subsection 12,

be approved subject to compliance with the regulations on signs and outdoor adver-
tising as outlined in the Zoning Ordinance for "B-1" Neighborhood Business District.
Carlos Schunior, applicant, stated that he proposed to remodel and, re -build
on the property for his barber shop operation, but did not plan to live there.
Motion by Wallace, seconded by Maldonado and passed that the hearing be
closed, and the recommendation of the Zoning & Planning Commission be concurred in,
and the change of zoning be denied, but that in lieu a Special Permit be granted for
a barber shop operation on Lot 8, Block 8, Meuly Subdivision, subject to compliance
with the regulations on signs and outdoor advertising as outlined in the Zoning
Ordinance for "B-1" Neighborhood Business District.
There being no further business to come before the Council, the special
meeting was adjourned.
