Wallace, Jr. CITY OF CORPUS CHRISTI, TEXAS REGULAR COUNCIL MEETING October 16, 1963 2:00 p.m. Acting City Manager R. Marvin Townsend City Attorney I. M. Singer City Secretary T. Ray Kring Mayor James L. Barnard called the meeting to order. The Invocation was given by the Reverend Glen Norman, Pastor of Second Baptist Church. City Secretary T. Ray Kring called the roll of those in attendance. Motion by de Leon, seconded by Roberts and passed that the minutes of the regular meeting of October 9, 1963, at 2 p.m., and of the special meeting of the same day at 4 p.m., be approved as furnished to the Council. Mayor Barnard welcomed representatives of the Student Council of W. B. Ray High School, and explained that Certificates of Attendance would be presented to each of them later in the meeting, but that he wished to congratulate the Youth Advisory Council, through them, for the fine work they are doing in connection with the City's Traffic Court. Mayor Barnard announced the pending item of the request to waive the park land requirement in connection with the development of Meadowbrook Park, and to accept a sum of money in Lieu of the 5 -acres of land for park purposes. Bob Cantwell, speaking as an individual member of St. Pius X Parish, spoke at length in support of the request based on the need for this particular 5 acres which is adjacent to a 6 -acre tract owned by the Catholic Church for the construction of a church and school and playground to serve the area and to relieve the crowded conditions at St. Patrick's Parish; that no land could be put to a higher use than the one proposed; that there is no other available land in the area for this purpose; that there are other park areas within easy radius of the sub- division; and that the playground proposed for the school would be developed within a year and would be available to the children in the area. Dewey Johnson presented a petition containing approximately 145 signa- tures of residents in Meadowbrook Addition, and a petition containing approximately • City of Corpus Christi, Texas Regular Council Meeting October 16, 1963 Page #2 222 signatures of residents in the City requesting that the Council not waive the 5 -acre park land dedication, and urged that the 5 -acres be retained for a public park on the basis that there are a large number of pre-school children in the subdivision, and that the developer had obligated himself to provide for a public park on this 5 acres. He stated that the residents of Meadowbrook Subdivision are in a position to form an association to help develop the park with the assistance and guidance of anyone the City designates. Douglas Maston supplemented the foregoing remarks with information as to the number of adults and children of high school age or younger living in the area. During the general discussion, Commissioner Wallace stated he sympa- thized with both sides, but considered the land had been contracted for as a public park when the original plat was approved, that it was too late to change it now, and that the residents have a prior right over anyone else who might wish to use the land for other purposes; Commissioner Blackmon stated the residents had bought their homes relying on the approved plat that the park would be there, and conse- quently should be given the greater consideration; Commissioner de Leon stated he believed it was not a legal matter, but a perogative of the Council, that the money would have to be used for park development in the area and would likely be developed sooner with the money in trust, and that if the Church had to build only on the 6 acres it would not be able to function as well as if they were allowed the adjacent 5 acres; Mayor Pro Tem Young stated that he believed the matter could have been worked out before it came to the Council and prior to filing of the plat, and expressed the hope that however the decision was made, that the park would be available to both the area residents and the school. In answer to a question from the Chair, City Attorney Singer stated that in essence the Council was contemplating exchanging a contractual right of the City to require the park to be established for a cash consideration. Motion by Blackmon, seconded by Roberts and passed with de Leon voting "Nay", that the park requirement for the Meadowbrook Subdivision not be waived and the 5 acres in question be retained for park development. • City of Corpus Christi, Texas Regular Council Meeting October 16, 1963 Page 3 At the request of the Chair, Commissioner Blackmon introduced the re- presentatives of the Student Council of W. B. Ray High School, and presented Certi- ficates of Attendance designating them as Honorary Junior City Commissioners to the following: Danny Davis, president; Dave Tomlin, vice-president; Herby Agan; Candy Alexander; Kaze Metzger; and Dee Dee Blackmon. Mayor Barnard announced the pending item of the applications of Cecil Burney and of Frank Cech for change of zoning from "R -1B" to "I-2" Light Industrial District on a 3.4 -acre tract, more or less, out of an 8.0 -acre tract of the Hatcu Tract, and on approximately 3 -acres out of the 8.38 -acre Frank Cech Tract, being a portion of the Hatch Tract, on which public hearing was held on July 10, 1963. Mayor Barnard explained in answer to a question of how the development of the properties in question for a warehouse complex only could be assured and con- trolled, that one way was by the granting of a special Council permit for this pur- pose only, and the other was by requiring the owners to file deed restrictions of record before the ordinance effecting the change of zoning was passed. Several residents revoiced their opposition to the use of the property in question for any other purpose than residences; and Commissioner Blackmon stated that he felt whatever zoning is granted on the portion of the properties in question will determine what is granted for the balance of the property for which 200' a zoning application is anticipated, and that in this connection the matter of streets, buffers, fences, etc. need to be studied, and suggested that it might be advisable to defer action on these applications until decision could be made on the property as a whole. Motion by de Leon, seconded by Blackmon and passed with Wallace abstain- ing, that action on the foregoing applications be deferred until such time as the balance of the area is before the Council for zoning, and for further study as to all of the items mentioned. Mayor Barnard announced the pending item of the Appeal of $3.99 Economy Car Rentals of Corpus Christi, Inc., from the Taxicab Inspector's denial of appli- cation for driverless car franchise, and requested that the minutes reflect the absence of Mayor Pro Tem Young during consideration of this item. City of Corpus Christi, Texas Regular Council Meeting October 16, 1963 Page 4 • Motion by Wallace, seconded by Maldonado and passed that the ruling of the Taxicab Inspector to deny the application of $3.99 Economy Car Rentals of Corpus Christi, Inc. for a driverless car franchise be overruled, and the franchise be granted. Commissioner Blackmon requested that the Legal Staff review the ordinance governing the granting of franchise for driverless car operations as he believes the ordinance is too stringent. Mayor Barnard directed that the minutes reflect the return of Mayor Pro Tem Young to the meeting. Mayor Barnard called for the City Manager's Reports. Motion by Roberts, seconded by Young and passed, with Wallace voting "Nay" on Item "p" as noted, and Blackmon abstaining on Items "a" and "k" as noted, that the City Manager's Reports be accepted, and the recommendations and requests be approved and granted, as follows: a. That the employment of Burt C. Blanton for industrial development services, for a period of 6 months, at a cost not to exceed $8,225.00, to be shared equally by the City and the Nueces County Navigation District, subject to concurrence by the Navigation District, be approved; (Commissioner Blackmon abstained on the foregoing item, as noted in the motion.) b. That the sale of the approximately 30' x 210' portion of the recently acquired tract of land from Thelma Lee Montgomery by the City for the extension of Kay Street not needed for the right-of-way of the Kay Street extension, be approved; c. That the request of the Downtown Businessmen's Association for free parking at metered stations on Saturday, October 26, 1963, after 10 a.m., in con- nection with the National Downtown Week sales promotion, be granted; d. That the sale of the 10' x 20' tract out of the West corner of Lot 12, Block 1, Broadmoor Park, known as the McDaniels Lift Station site, to the State Highway Department in connection with the right-of-way for the Crosstown Expressway, Unit II, for the sum of $3,700.00, for which the State pays 50% of the cost, be approved; e. That the three existing encroachments into the public right-of-way on Starr and North Chaparral Streets by the K. Wolens Building, Lots 11 and 12, Block 6, Beach Portion, be allowed to continue until such time as the building is replaced; a City of Corpus Christi, Texas Regular Council Meeting October 16, 1963 Page 5 f. That a revised lease with the Council of Garden Clubs for a portion of the 23 -acre tract of City -owned property on Alameda Street, designated for a Nature Center, in lieu of the existing lease of property on South Staples Street, be approved; and that the plans and specifications for the construction of the Garden Center building, be approved; g. That the revised method of calculating City employee vacations from a calendar day to a work day basis, be approved; h. That payment of the salaries for October, November and December, 1963, for the positions of Director and Assistant to the Director of the Corpus Christi Museum, be approved, and that this policy be reviewed in the near future with respect to the 1964 calendar year; i. That the $1.00 per year token payment by the Federal Aviation Agency for lease of Airport Traffic Control Tower space and for Instrument Landing System site at International Airport, be waived; j. That the speed limits on Violet Road be reduced to 45 m.p.h. from Highway 9 to approximately one mile south, and from that point to Highway 44 be reduced to 55 m.p.h., as recommended by the State Highway Department; k. That acceptance and final payment to Joe Kelly in the amount of $7500.00 for the film regarding the industrial development of the Corpus Christi area, be approved; Commissioner Blackmon abstained on the foregoing item, as noted in the motion. That the applications for permit to drill for oil of Humble Oil & Refining Co., Well #A-21, on State Tract "A" in the Cayo Del Oso, Nueces County, and of Logue & Patterson and 3 & C Drilling Co., W. E. McKinzie Well No. 1, B.S.& F. Survey No. 419, A-570, Turkey Creek Field, be approved; M. That authority to advertise for bids to be received on October 30, 1963, on 5 new banquet tables and 50 replacement table tops for the Coliseum, be granted; n. That authority to advertise for bids to be received on October 30, 1963, on 36 items of Radio Equipment, be granted; • City of Corpus Christi, Texas Regular Council Meeting October 16, 1963 Page 6 o. That authority to advertise for bids to be received on November 6, 1963, on oil and gas lease on 100.32 acres of the W. J. Robertson Tract, Westside Sewer Treatment Plant site, be granted; P. That the request for Interim Zoning Permit #61-3, Stanly Stinson by Eli Abrams, Courtesy Advertising Co., to complete the erection of a 12''x 30' free standing sign to advertise a sporting goods store on a portion of Tract 6, Flour Bluff & Encinal Farm and Garden Tracts, at 2669 So. Lexington Boulevard, be granted as recommended by the Zoning & Planning Commission; Commissioner Wallace voted "Nay" on the foregoing item, as noted in the motion. q. That the request for Interim Zoning Permit #61-4, Mr. & Mrs. Jose Salinas Benavides, to move a 20° x 20' frame building onto Lot 11, Block 14, Naval Center, to be used as a grocery store, be denied as recommended by the Zoning & Planning Commission on the basis that this request proposed a change in the existing land use pattern of the area and would be more appropriately processed as an appli- cation for permanent zoning. SECOND READING OF AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE AN AGREEMENT WITH THOMAS Y. PICKETT & COMPANY, INC., OF DALLAS, TEXAS, FOR THE PURPOSE OF APPRAISAL AND VALUA- TION OF OIL AND GAS PROPERTIES AND PIPELINES IN THE CITY OF CORPUS CHRISTI FOR TAX ASSESSMENT PURPOSES, ALL AS MORE FULLY SET FORTH IN THE AGREEMENT, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF; APPROPRIATING OUT OF GENERAL FUND 102 THE SUM OF $5,700.00 FOR PAYMENT OF THE AFORESAID SERVICES. ORDINANCE NO. 7048 THIRD READING OF AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, A LEASE AGREEMENT WITH ROY SMITH, COVERING 28.51 ACRES OF LAND SITUATED IN NUECES COUNTY, TEXAS, SOUTH GUTH PARK, ON THE WATERS OF THE OSO BAY, ABOUT 8 MILES SOUTH 25° EAST FROM THE COUNTY COURTHOUSE, FOR FARMING AND AGRICULTURAL PURPOSES, IN ACCORDANCE WITH THE TERMS AND PROVISIONS OF SAID LEASE AGREEMENT, SAID AGREEMENT BEGINNING SEPTEMBER 1, 1963, AND ENDING AUGUST 31, 1964, AND IN THE FORM PRESCRIBED BY ORDINANCE NO. 6375. Captain Clark presented and read a petition to the Mayor and Council to the effect that the Corpus Christi Charter Boat Association Inc., at a regular meeting held, Monday, October 14, 1963, voted 8 to 1 to endorse and concur in the recommendations of the Bayfront Advisory Board, the Traffic Safety Advisory Board, and the Park Board, that a one-way street pattern, running counterclockwise, be established on the two T -Heads, and urged that the ordinance relating to this matter be passed finally on its third reading, (Petition #17) Mayor Pro Tem Young reported that he was to represent the Council at the Atlantic Industrial Land Institute, tomorrow evening, at which the Industrial Development in Corpus Christi area film would be shown to some key people, and expressed the hope that it would greatly benefit the City. There being no further business to come before the Council, the meeting was adjourned.
