Mayor James L. Barnard called the meeting to order.
City Secretary T. Ray Kring called the roll of those in attendance,
Mayor Barnard announced the purpose of the special meeting to hold
public hearings on three zoning cases, and explained the procedure to be followed.
Mayor Barnard announced the public hearing on the application of
Sessions Mortgage Company and Edgar Linkenhoger, et al, for a change of zoning
from "R -1B" One -family Dwelling District to "B-1" Neighborhood Business District
on a 3.34 -acre tract of land out of Lot 4, Bryon Willis Subdivision,
Tom Lake, Zoning Coordinator, located the property on the map; pointed
out the zoning and land use of the area; explained that 5 notices had been mailed
out, and no replies had been received; and stated that the recommendation of the
Zoning & Planning Commission was that the request be approved on the basis that
the over-all planning of this and adjacent subdivisions included the establish-
ment of a small business center to serve the area.
John Keltner, engineer representing the applicants, was present in
support of the application.
No one appeared in opposition to the application.
Notion by Wallace, seconded by Maldonado and passed that the hearing
be closed, that the recommendation of the Zoning & Planning Commission be con-
curred in, and that the zoning on a 3.34 -acre tract of land out of Lot 4, Bryon
Willis Subdivision, be changed from "R -1B" to "B-1" Neighborhood Business District.
Mayor Barnard announced the public hearing on the application of Ted M.
Anderson for a change of zoning from "R -1B" One -family Dwelling District to "AB"
Professional Office District onall of Lots 3, 4 and 5, Block 1, Arcadia Sub-
division.

Tom Lake located the property on the map; pointed out the zoning and
land use of the area; explained that 16 notices had been mailed out, and that
2 written returns had been received against the request, and none for; and that
the recommendation of the Zoning & Planning Commission was that the request be
approved, and that the Commission further recommended that the City Council con-
tinue their efforts to determine the need for additional right-of-way at this
Staples -Baldwin -18th Street intersection and acquire such right-of-way at the
earliest practical date, if such need is proven.
Ted Anderson, applicant, and. W. E. Nobles, 1018 York, appeared in
favor of the request. Mr. Anderson stated that he felt the value of the prop-
erty is established by its location and potential rather than by the zoning; and
presented architectural drawings from two studies made for use of the lots in
question, stating that he contemplates the use of one of the lots for off-street
parking of 48 ears.
No one appeared in opposition to the request.
Motion by Wallace, seconded by Blackmon and passed that the hearing be
closed.
Commissioner Wallace commented that, inasmuch as the City Staff has
plans to acquire this property in a proposed street program which includes an
overpass arrangement to divert South Staples Street traffic over into lath Street,
he felt that action should be postponed for this study.
Motion by Wallace, seconded by Blackmon and passed that the application
for change of zoning on Lots 3, 4 and 5, Block 1, Arcadia Subdivision, be taken
under advisement.
The City Manager was directed to request the City Staff to present
their plans with respect to the proposed street program for this area with all
dispatch.
Mayor Barnard announced the public hearing on the application of Mrs.
Jim Hutton for a change of zoning from "A-1" Apartment House District to "B-1"
Neighborhood Business District on all of Lots 1 and 2 and that portion of Lot 6,
save and exqept the Northerly portion, a part of Oak Park School, Block 2, Geneva
Heights Addition.

Tom Lake located the property on the map; pointed out the zoning and
land use of the area; stated the 8 written notices had been mailed out, one re-
turn received in favor of the request, and one against; and that the recommenda-
tion of the Zoning & Planning Commission was that the request be approved on the
basis that this change of zoning will compliment the area and is in keeping with
surrounding 1Prd uses, and subject to the following conditions: (1) That ingress
and egrese to the property be limited to Leopard Street; (2) That a 6 -foot fence
of solid wood construction be erected on the property line adjacent to the Oak
Park School; and (3) That standard type sidewalks 4 feet in width be constructed
along Lancaster Drive and. Burke Drive.
A letter received from J. D. Slaybaugh, Director of Business Affairs
Co C. Independent School District, opposing the contemplated business develop-
ment adjacent to Oak Park Elementary School, on the basis that it would result in
problems of safety, congestion and discipline from the standpoint of the School
District, was noted for the record.
Mrs. Jim Hutton, applicant, stated that she was willing to accept the
conditions recommended by the Zoning & Planning Commission for the re -zoning of
the proy:rty th question; that the School Board coUld have no objection to the
business zoning for the Leopard Street side of the property, since there was no
reason for the children to be crossing there, and that the sidewalks and fence to
be constructed would be safety improvement for the children.
Motion by Roberts, seconded by Blackmon and passed that the hearing be
closed and, the recommendation of the Zoning & Planning Commission be concurred
in, and, the zoning on all of Lots 1 and 2 and that portion of Lot 6, save and
except the Northerly portion, a part of Oak Park School, Block 2, Geneva Heights
Addition, be changed from "A-1" to "B-1" Neighborhood Business District, subject
to the following conditions: (1) That ingress and egress to the property be
limited to Leopard Street; (2) That a 6 -foot fence of sold construction be
erected on the property line adjacent to the Oak Park School; and (3) That
standard type sidewalks 4 foot in width be constructed along Lancaster Drive and
Burke Drive.
Mere being no further business to come before the Council, the special
meeting was adjourned.
