Mayor James L. Barnard called the special meeting to order.
City Secretary T. Ray Kring called the roll of those in attendance.
Mayor Barnard announced the Council desired to recognize and commend
the Honorable 0. E. Cannon, Judge of the Corporation Court, for his efforts and
work above the call of duty in the improvement of procedures and administration
of justice in that Court, whose accomplishments in this field have been recog-
nized by the American Bar Association by its recent award of first place to the
Corporation Court of Corpus Christi in the American Bar Association Traffic
Court Improvement Program, and presented the following Resolution for consider-
ation of the Council.
RESOLUTION NO. 7062
IN COMMEMORATION OF THE WORK OF JUDGE O. E. CANNON AS RECOGNIZED BY THE AWARD
OF THE AMERICAN BAR ASSOCIATION TO THE CORPORATION COURT OF CORPUS CHRISTI IN
PB.NAMERICAN BAR ASSOCIATION TRAFFIC COURT IMPROVEMENT PROGRAM.
The Charter rule was suspended by the following vote: Mayor Barnard,
Commissioners Young, Blackmon, de Leon, Maldonado, Roberts, and Wallace all
present and voting "Aye".
The foregoing resolution was passed by the following vote: Mayor
Barnard, Commissioners Young, Blackmon, de Leon, Maldonado, Roberts, and Wallace
all voting "Aye".
Mayor Barnard presented a copy of the foregoing resolution to Judge
Cannon with the congratulations of the Council and appreciation for his fine
work.
Mayor Barnard announced the purpose of the special meeting to hold
public hearings on one amendment to the text of the Zoning Ordinance and on 6
zoning applications, and explained the procedure to be followed.
Mayor Barnard announced the public hearing on the recommendation from
the Zoning & Planning Commission that Section 27-3.01.02 of the Zoning Ordinance

of the City of Corpus Christi be amended to read as follows: "Every part of a
required yard shall be open to the sky, except as authorized by this article,
and ordinary projections of sills, belt courses, window air conditioning units,
chimneys, cornices and ornamental features which may project to a distance not
to exceed 24 inches into a required yard; provided further that vents, hatches
and other ordinary and usual projections from underground shelters, the design
of which has been approved by the Federal Office of Civil Defense and Mobiliza-
tion, or its successors, shall be permitted in any yard area, excluding ease-
ments, required by this Ordinance; provided, however, that a roof cornice or
eave may extend a distance not to exceed 42 inches into a front or rear yard."
Tom Lake, Zoning Coordinator, explained the purpose of the proposed
recommended amendment was to satisfy the front and rear yard requirements for
residences with attached garage, and that the effect of the proposed amendment
was to increase from 24" to 42" the overhang permitted into a front or rear
yard.
A representative of the Home Builders Association was present in
support of the proposed amendment.
No one appeared in opposition to the amendment.
Motion by Blackmon, seconded by Maldonado and passed that the recom-
mendation of the Zoning & Planning Commission be concurred in, and that the
amendment be approved as proposed.
Mayor Barnard announced the public hearing on the application of J. C.
Rackley for a change of zoning from "R -1B" One -family Dwelling District to "A-1"
Apartment House District on all of Lots 4 and 5, Share 3A, Kaler Subdivision.
Tom Lake located the property on the map; pointed out the zoning and
land use of the area; explained that 11 notices were sent out, 2 written returns
were received in favor of the request, and 3 against; and that the recommendation
of the Zoning & Planning Commission was that the request be approved on the basis
that such zoning is in keeping with the adjacent surrounding land uses.
J. C. Rackley, applicant, appeared in support of the request and ex-
plained that he desired to move some apartments onto the property for rent pur-
poses which he had purchased from the State Highway Department and only had a
short time to move them.

No one appeared in opposition to the request.
Motion by Roberts, seconded by Wallace and passed that the hearing be
closed, and the recommendation of the Zoning & Planning Commission be concurred
in, and the zoning on Lots 4 and 5, Share 3A, Kaler Subdivision, be changed. from
"R -1B" to "A-1" Apartment House District.
Mayor Barnard announced the public hearing on the application of J. H.
Bourcier for a change of zoning from "B -1A" Tourist Court District and "R -1B"
One -family Dwelling District to "B-4" General Business District on a 1.7 -acre,
more or less, tract of land out of Tract 3, Wilkey Partition, out of Lots 13 and
14, Section 13, Flour Bluff & Encinal Farm & Garden Tracts.
Tan Lake located the property on the map; pointed out the zoning and
land use of the area; explained that 3 notices were sent out, one written return
received in favor of the request, and one against; and that the recommendation
of the Zoning & Planning Commission was that the request be approved on the basis
that such approval will continue the comprehensive zoning pattern in this area.
No one appeared in opposition to the request.
Motion by Blackmon, seconded by Roberts and passed that the hearing be
closed, and the recommendation of the Zoning & Planning Commission be concurred
in, and the zoning on the 1.7 -acre, more or less, tract of land out of Tract 3,
Wilkey Partition, out of Lots 13 and 14, Section 13, Flour Bluff & Encinal Farm
& Garden Tracts, be changed from "B -1A" and "R -1B" to "B-4" General Business
District.
Mayor Barnard announced the public hearing on the application of Flato
Brothers Incorporated for a change of zoning from "R -1B" One -family Dwelling
District to "B-1" Neighborhood Business District on Lot A, Edwin Farm Lots.
Tom Lake located the property on the map; pointed out the zoning and
land use of the area; explained that 23 notices were sent out, 6 written returns
received in favor of the request, and one against; and that the recommendation
of the Zoning & Planning Commission was that the request be approved on the
basis that the requested zoning complies with the applicants' over-all plan of
the area.
The receipt of a letter in favor of the request from D. W. Grant was
noted.

Ian Naismith, representing the applicants, appeared in support of the
request and explained the plans for a shopping center on the subject property.
No one appeared in opposition to the request.
Motion by Young, seconded by Maldonado and passed that the hearing be
closed, and the recommendation of the Zoning & Planning Commniasion be concurred
in, and the zoning on Lot A, Edwin Farm Lots, be changed from "R -1B" to "B-1"
Neighborhood Business District.
Mayor Barnard announced the public hearing on the application of Flato
Brothers Incorporated for a change of zoning from "11-1B" One -family Dwelling
District to "B-4" General Business District on a 30 -acre, more or less, portion
of Share G, McBride Partition.
Tom Lake located the property on the map; pointed out the zoning and
land use of the area; explained that 18 notices were sent out, 4 written returns
received in favor of the request, and 5 against; and that the recommendation of
the Zoning & Planning Commission was that the request be approved on the basis
that it is a logical extension of the existing "B-4" General Business District
and is located adjacent to the intersection of two major highways.
Ian Naismith, representing the applicants, appeared in support of the
application, and explained that he felt "B-4" was the only logical zoning for
the property abutting on this very major intersection of Interstate Highway 37
and Highway 358, and that they were working on the leasing for this area, and
that although fencing on the rear of the property in question to protect the
residential neighborhood had not been suggested, it was quite often done on the
final plat.
Mr. and Mrs. J. P. McCarty, 802 Hackberry Lane, asked what vas pro-
posed for the businesses on the subject property, and after the permitted uses
in the "B-4" classification were read to them, stated that they would like to be
recorded as being opposed to the change in zoning since some of the permitted
uses would be objectionable to them.
Motion by Maldonado, seconded by Young and passed that the hearing be
closed, and the recommendation of the Zoning & Planning Commission be concurred
in, and the zoning on the 30 -acre, more or less, portion of Share G, McBride Par-
tition, be changed. from "R -1B" to "B-4" General Business District.

Mayor Barnard announced the public hearing on the application of
Margarito C. Garza for a change of zoning from "R -1B" One -family Dwelling Dis-
trict to "AB" Professional Office District on all of Lot 15, Block 4, Southwest
Heights Addition.
Tom Lake located the property on the map; pointed out the zoning and
land use of the area; explained that 23 notices were sent out, 4 written returns
received in favor of the request, and one against; and that the recommendation of
the Zning & Planning Commission was that the request be approved on the basis
that the requested zoning will provide logical and transitional land uses for
the adjacent "B-1" Neighborhood Business District.
Margarito Garza, applicant, appeared in support of the application,
and explained that he intends to have his own office in the building, that the
rear of the lot will be the parking area, and that the entrance and exit will
be around the corner off of the expressway.
The telephone call of Mrs. Marek, 2618 Niagara, opposing the request
on the basis of the parking problem in the area, was noted for the record.
Motion by Blackmon, seconded by de Leon and passed that the hearing
be closed, and the recommendation of the Zoning & Planning Commission be con-
curred in, and the zoning on Lot 15, Block 4, Southwest Heights Addition, be
changed from "R -1B" to "AB" Professional Office District.
Mayor Barnard announced the public hearing on the application of Mr.
and Mrs. Guy D. Winstead for a change of zoning from "AB" Professional Office
District to "B-1" Neighborhood Business District on all of Lot 15, Block 8,
Koolside Addition.
Commissioner Blackmon stated that he was quite familiar with the fore-
going application and request and wished to be recorded as voting in favor of
the change in zoning, and at his request was excused from the meeting by the
Chair for cause.
Tom Lake located the property on the map; pointed out the zoning and
land use of the area; explained that 28 notices were sent out, and that no re-
plies were received either for or against the request; and that the recommenda-
tion of the Zoning & Planning Commission was that the request be approved on
the basis that it constitutes logical extention of the existing "B-1" Neighbor-

hood Business District and because of hardship in not being able to effectively
use the subject property under existing zoning.
Mr. and Mrs. Winstead, applicants, were present in support of their
application.
No one appeared in opposition to the request.
Motion by Young, seconded by de Leon and passed that the hearing be
closed, and the recommendation of the Zoning & Planning Commission be concurred
in, and the zoning on Lot 15, Block 8, Koolside Addition, be changed from "AB"
to "B-1" Neighborhood Business District.
There being no further business to come before the Council, the
special meeting was adjourned.
