Ray Kring Mayor James L. Barnard called the special meeting to order. City Secretary T. Ray Kring called the roll of those in attendance. Mayor Barnard announced the purpose of the special meeting to hold public hearings on three zoning applications, and explained the procedure to be followed. Mayor Barnard announced the public hearing on the application of Mr. and Mrs. Joe W. Johnson for a change of zoning from "B -1A" Tourist Court District to "8-1" Neighborhood Business District on all of Lots 10 and 12, Block 79, Brooklyn Addition. Tom Lake, Zoning Coordinator, located the property on the map; pointed out the zoning and land use of the area; explained that 6 notices were sent out, one return was received in favor of the request, and none against; that the pro- posed use of the property is to build a service station fronting on Highway 181; that one neighboring property owner had appeared at the Commission hearing in favor of the request; and that the recommendation of the Zoning & Planning Com- mission was that the request be approved. No one appeared in opposition to the application. Notion by Wallace, seconded by Maldonado and passed that the hearing be closed, that the recommendation of the Zoning & Planning Commission be concurred in, and that the zoning on all of Lots 10 and 12, Block 79, Brooklyn Addition. be changed from "B -1A" to "B-1" Neighborhood Business District. Mayor Barnard announced the public hearing on the application of Ray Collins and C. R. Norris for a change of zoning from "A-1" Apartment House District to "A-2" Apartment House District, on all of Block C, Lots 1 through 15 inclusive, South Staples Center. • City of Corpus Christi, Texas Special Council Meeting October 30, 1963 Page 2 TOm Lake located the property on the map; pointed out the zoning and land use of the area; explained that 11 notices were sent out, one return received in favor of the request, and one against; and that the recommendation of tne Zoning & Planning Commission was that the request be denied, but that in lieu a Special Permit for an apartment complex be approved subject to tne following conditions: (1) The buildings be not more than two -stories in height; (2) The apartment complex to includ no more than 38 living units; and (3) The construction be carried out in substantial compliance with the site plan as presented by the applicant. It was noted for the record that a petition containing 41 signatures of nearby property owners who were opposed to the request was received at the Commission hearing. Mr. Lake presented the site plan for the subject property. Mr. Ray Collins, one of the applicants, appeared in support of the applica- tion; presented photos of a similar development he is constructing in Dallas, point- ing out that parking for all cars will be underneath the building, that there will be an enclosed, heated swimming pool, and studio apartments in the rear with indivi- dual courtyards; and stated that the requested zoning will permit 8 more units than the present zoning allows which he felt the shopping center would welcome. In answer to questions from the Council, Mr. Collins replied that there would be fencing in the rear for the privacy of the studio apartments, and that the recommended Special Permit with the stated conditions was entirely satisfactory for his development, which he proposed to get under way in about 14 days, as he already has his financ- ing arranged. No one appeared in opposition to the request. Motion by Roberts, seconded by Maldonado and passed that the hearing be closed, and the recommendation of the Zoning & Planning Commission be concurred in, and the request for a change of zoning to "A-2" on all of Block C, South Staples Center, be denied, but in lieu a Special Permit for an apartment complex on all of Block C, Lots 1 through 15 inclusive, South Staples Center, be approved subject to the following conditions: (1) The building be not more than two -stories in height; (2) The apartment complex to include no more than 38 living units; and (3) the con- struction be carried out in substantial compliance with the site plan presented and approved at this meeting. (Filed in Office of Zoning & Planning Department.) • City of Corpus Christi, Texas Special Council Meeting October 30, 1963 Page 3 Mayor Barnard announced the public hearing on the application of Corpus Christi quarter Midget Racing Association to amend Special Permit #162-2 to in- clude quarter midget racing tract on the South 350' portion of Tract 4, Wilkey Partition. Tom Lake located the property on the map; pointed out the zoning and land use of the area; explained that 6 notices were sent out, no returns were received either for or against the request, and that no one had appeared at the Commission hearing in opposition; and that the recommendation of the Zoning & Planning Com- mission was that the request be approved subject to the condition that racing activities not be permitted before 1:00 p.m., on Sundays. Mr. Lake explained further that although the condition of this Special Permit requiring a new application for any enlargement or change of rides by Childs' Paradise was recently removed by Council action, new application was made in this instance because the area of request would be leased by, and the activity managed by the Association rather than Mr. Rex Wayland of Child's Paradise; that the pro- posed hours of operation are on Sunday afternoon in the winter season, and Friday evening during the summer season; and that the activity has been recently operating on Atlantic Mills parking lot causing numerous complaints of the noise. Pat Horkin, representing Bishop Garriga and Our Lady of Perpetual help Catholic Church, and Elmer Theis, spoke in opposition to the request, emphasizing that the objection was not to the sport of building and racing these midget cars, but to the noise of the motors, and suggested that this worthwhile activity should be located in some area where it will not disturb the adjacent property owners. He particularly pointed out that the Church and School are only 300' from the area of request, that the prevailing wind is toward the Church property, that there are regular Masses Sunday evenings as well as in the morning and numerous Parish meet- ings, School activities and services during the week; that the living quarters for the priests and for the nuns who teach in the School are also on the Church property, and that the noise of the midget racers would very seriously disturb and interfere with their study periods, prayer periods, and rest. He urged that the application be denied. City of Corpus Christi, Texas Special Council Meeting October 30, 1963 Page 4 • Mrs. Paul Erb, developer of the subdivision to the West of the Church, spoke in opposition to the request on the basis that the noise would be very detri- mental in the sale of the rest of the lots in the subdivision. Father Shandannah, of Our Lady of Perpetual Help Catholic Church, spoke in opposition to the request and in support of Mr. Horkin's remarks with respect to the disturbance due to the noise, and urged that the application be denied on the basis that it would seriously interfere with the use of nearby property. Motion by Wallace, seconded by Maldonado and passed that the hearing be closed, and the application be denied. City Manager Whitney presented several applications for Interim Zoning Per- mits and the respective recommendations of theZoning & Planning Commission for the Council's consideration. Motion by Wallace, seconded by de Leon and passed that the recommendations of the Zoning & Planning Commission be concurred in, and the following applications for Interim Zoning Permits be approved and denied as indicated: #61-5, S.F. Hawley, to complete the erection of a 4' x 10' neon sign to be attached to existing sign pole and to project from the front of the existing building on a 60' x 150' portion of Lot 1, Section 56, Flour Bluff & Encinal Farm & Garden Tracts, at 15350 Lexington Boulevard, be approved; #61-6, Jack Delagrange, to locate a house trailer on a 20' x 56' slab on the North half of Lot 5, Block 4, Naval Center, at 436 First Ave., Flour Bluff, be approved subject to the following conditions: (1) An occupancy period of one year from date of approval; and (2) That no additional trailers be located, or additional buildings erected, on the property during that period of time; #61-7, Anna Lee Mofiene & Blanche Hardeman, to remodel the existing build- ing to be used as a beauty shop on Lots 51 & 52, Block L, Don Patricio Subdivision, at 1905 Orange Street, be approved; #61-8, Humble Oil & Refining Company, to alter and add tanks, oil and gas separators and oil treating gun barrels to the existing tank battery on Lots 26, 27, 28, 29 & 30, Block 12, Flour Bluff Park, be approved; #62-70, Frank Barr & Albert E. Till, to erect a 20' x 20' metal frame and clad oil field repair shop and locate a house trailer to be used as living quarters and office on a 240' x 225' portion of Section 8, Range 5, H.L. Kinney Sectionized Lands, at 7433 Leopard Street, be denied on the basis that it consti- tutes new construction and would be more appropriately processed as an application for permanent zoning; #62-71, J. R. Preis, Coastal Bend Enterprizes, Inc., to locate a triplex on Lots 23 & 24, Block 4, Cabaniss Acres at 5801-03-05 Wood Street, be denied on the basis that this request proposed a change in the existing land use pattern of the area, and would be more appropriately processed as an application for permanent zoning.
