SPECIAL COUNCIL MEETING

Mayor James L. Barnard called the meeting to order.
City Secretary T. Ray Kring called the roll of those in attendance.
Mayor Barnard announced the purpose of the meeting to hold public
hearings on four zoning cases, and explained the procedure to be followed.
Mayor Barnard announced the public hearing on the application of Mrs.
David F. Pena for a change of zoning from "A-2" Apartment House District to "AB"
Professional Office District on Lot 4, Block 4, Paul. Court Addition.
Tom Lake, Zoning Coordinator, located the property on the map; pointed
out the zoning and land use of the area; stated that at the Commission hearing,
the applicant had appeared in support of the request, and no one had appeared in
opposition; that 25 notices were mailed out, one written return was received in
favor, and none against, and no communications were received since that hearing;
and that the recommendation of the Zoning & Planning Commission was that the re-
quest be denied, and in lieu thereof a Special Council Permit be approved on the
north 85' portion of the subject property subject to the following conditions:
that all regulations of the "AB" Professional Office District be complied with.
Mr. Lake added further that the 85' portion of the area of request can provide
the minimum of three off-street parking spaces required under the "AB" classifi-
cations
City Manager Whitney reported receipt of a written reply from W. T. Ney-
land in favor of the application.
Mrs. Pena, applicant, appeared in support of her application, and in
answer to questions from the Council, stated that she understood the purpose of
the Special Permit, that this would be satisfactory for her purpose as she is
only seeking permission to operate her beauty shop from the portion of the property
which fronts on Howard Street, and that since she is the only operator and works

by appointment only, there would be no need for more than three off-street parking
spaces.
No one appeared in opposition to this application.
Motion by Maldonado, seconded by Wallace and passed that the hearing be
closed, and the recommendation of the Zoning & Planning Commission be concurred in,
and the application be denied, but in lieu a Special Permit be approved on the north
for a beauty shop,
85' portion of Lot 4, Block 4, Paul Court Addition) subject to the condition that
all regulations of the "AB" Professional Office District be complied with.
Mayor Barnard announced the public hearing on the application of R. E.
Macomber for a change of zoning from "R -1B" One -family Dwelling District to "I-2"
Light Industrial District on a 9 -acre portion of Lot 5, Section 7, Bohemian Colony
Lands, also called Blocks 1 & 2, Saratoga Place.
Tom Lake located the property on the map; explained that the permanent
zoning for this area has not yet been designated; pointed out the land use of the
area; stated that at the Commission hearing, the applicant had appeared in support
of his application, and one person had appeared in favor of the application if only
the front portion was granted; that 13 notices were mailed out, no written returns
received in favor, and two against, and no communications received since that hear-
ing; and that the recommendation of the Zoning & Planning Commission was that the
request on the rear portion be denied, but that the request be approved on the front
580.8', which area would be designated as Lot 1, Block 1, and Lot 1, Block 2, of the
proposed Saratoga Place Subdivision. Mr. Lake added that the portion of the property
recommended for "1-2" zoning has since been plaited and filed for record.
Mr. Macomber, applicant, appeared in support of his application, stated
that the recommended zoning was sufficient for his present plans for expansion of
his Cabinet Shop operation on the property.
No one appeared in opposition to the application.
Motion by Blackmon, seconded by Young and passed that the hearing be
closed, and the recommendation of the Zoning & Planning Commission be concurred in,
and the request on the rear portion be denied, but that the change of zoning from
"R -1B" to "I-2" Light Industrial District on the front 580.8' of the 9 -acre portion

of Lot 5, Section 7, Bohemian Colony Lands, which area would be designated as Lot
1, Block 1, and Lot 1, Block 2, of the proposed Saratoga Place Subdivision, be
approved.
Mayor Barnard announced the public hearing on the application of J. C.
Byrd for a change of zoning from "R -1B" One -family Dwelling District to "B-4"
General Business District on all of Lots 1, 2, 3 & 4, 38, 39 & 40, Block 4, Flour
Bluff Center.
Tom Lake located the property on the map; explained that the permanent
zoning for this area has not yet been designated; pointed out the land use of the
area; stated that at the Commission hearing, the applicant's representative had
appeared in support of the application, and no one had appeared in opposition;9 that
15 notices were mailed out, and 4 written returns received In favor, and none
against, and no communications received since that hearing; and that therecom-
mendation of the Zoning & Planning Commission was that it be approved.
No one appeared either for or against this application,
Motion by Wallace, seconded by Roberts and passed that the hearing be
closed, and the recommendation of the Zoning & Planning Commission be concurred in,
and the change of zoning from "R -1B" to "8-4" General Business District on all of
Lots 1, 2, 3 & 4, 38,39 & 40, Block 4, Flour Bluff Center, be approved.
Mayor Barnard announced the public hearing on the application of Rafael
Davila for a change of zoning from "R -LB" One -family Dwelling District to "B-1"
Neighborhood Business District on Lot 23, Block F, Las Palmas Subdivision, Unit 2,
Section 10
Tom Lake located the property on the map; explained that the permanent
zoning for this area has not yet been designated; pointed out the land use of the
area; stated that at the Commission hearing, the applicant had appeared in support
of his application, and no one had appeared in opposition; that 9 notices were
mailed out, one written return received in favor, and none against, and no communi-
cations received since that time; and that the recommendation of the Zoning & Plan-
ning Commission was that it be approved,

William Childress stated he had sold the property to the applicant,
and spoke in favor of the request on the basis that development of the property
will help to prevent vandalism, and that the present drive-in grocery operation
had been in operation two years before the annexation.
Mr. Lake reminded the Council that a request for an Interim Zoning
Permit for operation of a boxing arena had been recently denied for the adjoining
property as there was no provision for off-street parking.
Commissioner Maldonado felt the request should be granted since the
business operation was in existence before the annexation of the area.
No one appeared in opposition to the application.
Motion by de Leon, seconded by Maldonado and passed that the hearing be
closed, and the recommendation of the Zoning & Planning Commission be concurred
in, and the change of zoning from "R -1B" to "B-1" Neighborhood Business District
on Lot 23, Block F, Las Palmas Subdivision, Unit 2, Section 1, be approved.
There being no further business to come before the Council, the special
meeting was adjourned.
