SPECIAL COUNCIL MEETING

Mayor James L. Barnard called the special meeting to order.
City Secretary T. Ray Kring called the roll of those in attendance.
Motion made, seconded and passed that the absence of Mayor Pro Tem
Jim Young and Commissioner M. P. Maldonado be excused for cause.
Mayor Barnard announced the purpose of the special meeting was to
hold a joint public hearing with the Zoning & Planning Commission on a proposed
amendment to the text of the Zoning Ordinance by the addition of an additional
Article to read as follows:
ARTICLE 4AFR, "F -R" FARM RURAL DISTRICT
Section 4AFR-1 The regulations set forth in this article, or set forth
elsewhere in this Ordinance when referred to in this article, are the
regulations in the "F -R" Farm Rural District. The purpose of this
district is:
1. To encourage the continued use of the land for agricultural
property;
2. To prohibit scattered commercial and industrial uses of the land,
and to prohibit other uses which interfere with an integrated and
efficient development of the land for more intensive uses as urban
development expands;
3. To discourage any use, which because of its character or size,
would create unusual requirements and costs for public services,
such as police and fire protection, water supply and sewerage,
before such services could be expanded efficiently.
Section 4AFR-2 Use Regulations. A building or premises shall be used
only for the following purposes:
1. Residences of owners and tenants, other members of their families,
and their employees;
2. Temporary farm labor camps incident and necessary to the gathering
of the crops growing on the premises;
3. Field and truck crops;
4. Orchards and vineyards;
5. Greenhouses and nurseries;
6. Brush land and pasture land;

7. Livestock ranches and guest ranches;
8. Sale and storage of hay and straw;
9. Oil and gas wells and appurtenances;
10. Schools, colleges, churches, public parks, golf courses and
other similar public and semi-public uses;
11. Home occupations;
12. Railroad rights-of-way, including a strip of land with tracks
and auxiliary facilities for tract operations but not including
passenger stations, freight terminals, switching and classifi-
cation yards, repair shops, round houses, power houses, inter-
locking towers, and fueling, sanding and watering stations;
13. Accessory buildings and uses including but not limited to:
a. Temporary sales stands for the sale of farm or ranch
products produced on the premises, provided only one
such stand may be used on each farm or ranch, and shall
be located not closer than 30 feet from an adjoining
property line, and not less than 40 feet from the roadway.
b. One temporary sign not to exceed 40 square feet in area and
not to exceed 35 feet in height pertaining to the products
sold at the temporary sales stand or pertaining to such other
permitted uses in this district.
Section 4AFR-3 Parking Regulations. The parking regulations for
permitted uses are contained in Article 22 of this Ordinance. For
temporary sales stands permitted in this district, there shall be
a minimum of five (5) off-street parking spaces provided and so
arranged that ingress and egress to such spaces are from driveways
approved by the Traffic Engineer of the City of Corpus Christi.
Section 4AFR-4 Off-street Loading Regulations. The off-street load-
ing regulations for permitted uses are contained in Article 23. For
any use not contained in Article 23 no off-street loading regulations
apply except that loading and unloading shall take place off any
public right-of-way.
Section 4AFR-5 Area Regulations. The lots in this area shall have an
area of five (5) acres or more.
Section 4AFR-6 Supplementary use regulations are contained in
Article 25.
Section 4AFR-7 Supplementary height and area regulations are con-
tained in Article 27.
William Anderson, Director of Planning, explained that the proposed
amendment would designate as FR districts a great deal of land in the newly annexed
area that is presently being farmed or used as pasture land; that there is a need
to encourage owners to continue to farm their land until it is ready for develop-
ment, as scattered developments in the large areas the City has recently annexed

would make the cost of extending utility services prohibitive; that since the land
use would be restricted, it would follow that taxes on it would be lower than other-
wise, which would provide an incentive for the owner not to prematurely develop the
land.
There followed a general discussion by the Council and Zoning & Plan-
ning Commission as to the effect of the proposed zoning, taxwise and otherwise. It
was suggested that the amendment should provide for regular and periodic review, and
in particular that the proposed Section 4AFR-1 (2) should be modified to fit the
intent and purpose of the amendment, which is to assist in the control of scattered
commercial and industrial uses of the land.
Dave Coover, attorney, pointed out that tax values are unrealistic;
that consideration should be given to productivity of the land along with other
factors; that the policy should be established that farm land is to be taxed lower
than it is presently being taxed; that review should be constant; and that an owner
should never be deprived of his right to apply for a change in zoning.
W. T. Neyland pointed out that the proposed amendment does not provide
for use of the land for billboards, which might be one way the land could produce
more revenue to help offset the cost of taxes.
Mr. Anderson pointed out that the alternate to the proposed district
submitted is "R-1" zoning.
Motion by Roberts, seconded by de Leon and passed that the hearing be
closed.
Mayor Barnard announced the Zoning & Planning Commission will subse-
quently make it's recommendation to the City Council for consideration by the
Council.
Motion by Roberts, seconded by de Leon and passed that the special
meeting be adjourned.
