Barnard called the meeting to order. The Invocation was given by Commissioner J. R. de Leon in the absence of the Chaplain. City Secretary T. Ray Kring called the roll of those in attendance. Motion by Maldonado, seconded by de Leon and passed that the minutes of the regular meeting of April 1, 1964, be approved as furnished to the Council. Mayor Barnard read and presented the following proclamations: TEXAS LIONS CAMP FOR CRIPPLED CHILDREN WEEK in Corpus Christi, April 6-12, 1964, accepted by Mr. V. F. McBride, president of Downtown Lions Club; PAN AMERICAN DAY, April 14, 1964, and PAN AMERICAN WEEK, April 12-18, 1964, requested by Mr. Jose' A. Mora, secretary general of Pan American Union for display during the month of April in the Pan American Union building in Washington, D. C.; and LOLA FORRESTER FLOWER SHOW DAYS, April 11 and 12, 1964, accepted by Mrs. Theodore F. Weber, president of the Corpus Christi Judges Association. Mayor Barnard announced the Chair was open for nominations to Boards and Committees. Motion by Roberts, seconded by Maldonado that the following names be placed in nomination to fill existing vacancies: Building Standards Commission, Harold Thomas; Charter Amendment Advisory Committee, Preston Doughty; and Golf Advisory Board, Henry Dace. Motion by Maldonado, seconded by Blackmon and passed that the nominations cease, and the appointments be made by acclamation of Harold Thomas to the Building Standards Commission; Freston Doughty to the Charter Amendment Advisory Committee; and Henry Dace to the Golf Advisory Board. Commissioner Roberts presented Certificates of Appointment to the fore- going. • • City of Corpus Christi, Texas Regular Council Meeting April 8, 1964 Page 2 Mayor Barnard welcomed a group of students of the 8th Grade of the Cathedral School, and their sponsor, Mrs. Delia Palmo, who were present to observe. Mayor Barnard announced the opening of bids. Bids were opened and read on construction of the Staples Street Relief Sewer Main and Lift Station, Unit I, from the following: T. H. Lee, contractor; and Heldenfels Brothers. The foregoing bids were tabled for 48 hours as required by the City charter, and referred to the City Manager for tabulation and recommendation. Mayor Barnard announced the pending item of the applications of Cecil Burney and of Frank Cech for a change of zoning from "R -1B" One -family Dwelling District to "I-2" Light Industrial District on a portion of an 8.0 -acre tract of the Hatch Tract, and a portion of the 8.38 -acre Frank Cech Tract, being a portion of the Hatch Tract. City Manager Whitney presented a recommendation that in lieu thereof a Special Council Permit be issued for the proposed warehouse complex subject to ap- proval of final plat with certain provisions and stipulations with respect to build- ing setback lines, fencing, off-street parking and off-street loading requirements, and outdoor lighting; and stated that the final plat would provide for the proper drainage. Mr. Bert Haas, representing the applicants, stated that subsequent to the last Council meeting on these applications, there had been a meeting with the West- gate property owners before submission of the final plat to the Planning Staff, but that final action by the Council is needed before the final plat can be approved. Mayor Barnard reminded the Council that the property owners in Westgate Heights who opposed these applications were told they would be notified personally when the Council was to take action in these matters, and that although the hearing was closed and he did not intend to reopen the hearing, with the Council's approval, action on these applications would be postponed for one week to allow the property owners in the area an opportunity to view the plans and to be informed as to the conditions and stipulations of the proposed action of the Council; and that the prop- erty owners in the area be so notified. • • City of Corpus Christi, Texas Regular Council Meeting April 8, 1964 Page 3 Mayor Barnard announced the hearing on the matter of access to Brock Drive from the shopping center located on Alameda and Airline. City Manager Whitney explained that the portion of the property pertain- ing to the "8-1" Business section was approved by Council as a change in the zoning map at the time the new zoning ordinance and map was passed and approved on March 29, 1961; that the residential plat was not approved until June 7, 1963; and that the building permits were issued in accordance with the zoning granted on the prop- erty. William Anderson, Director of Planning, presented and read a history from the records and minutes of the chronological order of facts pertaining to the Meadow - brook Subdivision from the submission on October 31, 1960, by the engineer of a pre- liminary plat called the Cech Tract to the approval on June 7, 1961, of the final plat of Meadowbrook Subdivision. Mrs. J. B. Cotrell, 510 Brock, Mr. and Mrs. E. L. Britt, 617 Brock, speak- ing for a large group of residents of the residential portion of the Meadowbrook Subdivision, indicated that they were well aware of the zoning and of the location of the shopping center when they purchased their properties, and had no objection to this; that they had been told when they purchased that there was to be a solid fence to protect the residential property; that based on the City's history of providing buffer zones, fencing, and even planting acres for the protection of abutting residential property, they had assumed this would be done in this instance; that they are objecting and protesting only the entrances and exits being permitted from and to Brock Drive; that at a meeting held last Saturday with the developer, they had requested that Mr. Massad provide an 8' solid fence on Brock Drive all the way to Alameda and agree to maintain same, and sidewalk all the way to Alameda with no entrances or exits off Brock Drive, but that Mr. Massad, essentially, offered to make no compromise. They particularly called attention to the service road under construction with entrance off Brock which would be a traffic hazard to the small children of the Subdivision since it would be used as a shortcut to avoid a traffic light at Brock and Alameda by all the cars travelling down Brock. Bill Anderson, attorney representing Mr. Massed, pointed out that Mr. Massad did not plan or apply for the zoning; that he had merely bought the platted property zoned a certain way, and proceeded with his construction accordingly, and • City of Corpus Christi, Texas Regular Council Meeting April 8, 1964 Page 4 was flabergasted at all the sudden opposition; and stated that he personally was not aware of any service road connection from Brock to Airline under construction. City Manager Whitney indicated that only two curb cuts on Brock have been granted so far, and that he had no knowledge of a service road connection or cut on Airline. Commissioner Blackmon felt that perhaps the residents' quarrel was with the person from whom they bought their property and who had told them, according to statements made, that all the businesses would face on Alameda or Airline and that all entrances and exits would be on Alameda and Airline; but that the records show that the zoning and building and construction permits were all properly applied for and granted. Commissioner de Leon stated that he had talked with Mr. Massed this morning and had been requested to announce publicly that Mr. Massed was willing to meet with this group, or a committee of the group, and try to work out something that will be fair and satisfactory to all concerned. Motion by Blackmon, seconded by de Leon and passed that the hearing be closed. Mayor Barnard requested that the City Manager direct the Public Works Department not to grant any additional curb cuttings on Brock Drive or on Airline Road, and to investigate the matter of the service road. Commissioner Roberts was excused, and left the meeting. Mayor Barnard called for the City Manager's Reports. Motion by Wallace, seconded by Young and passed, with Commissioner Blackmon voting "Nay" on Item 'b", and Commissioner Roberts, absent, that the City Manager's Reports be accepted and the recommendations and requests be approved and granted, as follows: a. That authority to advertise for bids to be received on April 29, 1964, on Concessions Rights for a two-year period, beginning June 1, 1964, or as soon there- after as equipment to be furnished by the City can be purchased, and expiring two years from the date the contract commences, for the Coliseum and Exposition Hall, be granted; City of Corpus Christi, Texas Regular Council Meeting April 8, 1964 Page 5 b. That authority to join for and in behalf of the City in the compro- mise agreements between the Corpus Christi Municipal Gas Corporation and Houston Natural Gas Corporation regarding interest on accounts acquired by the Corporation from Houston Natural and settlement of the cost of installation of connections to the Gas System in Peary Place Addition, in accordance with the written agreement between Corpus Christi Municipal Gas Corporation and Houston Natural Gas Corpora- tion and John L. Tompkins, owner, be approved;(said action was ratified by the Corpus.Christi Municipal Gas Corporation this date) c. That the proposal of the developers of Heritage Park Subdivision to install to the City's specifications the permanent storm sewer within the present street right of way of McArdle Road abutting the proposed subdivision providing the City furnishes the necessary pipe, be approved; and that authority to advertise for bids to be received on April 22, 1964, on the required reinforced concrete pipe be granted; d. That as a matter of policy, representatives of the City aCtend the hearing before the Texas Water Commission regarding the application of La Salle County Water Improvement District No. 1 for the construction of a proposed dam at Cotulla for the purpose of not opposing the application, but for assuring the City's Nueces River water rights are protected. ORDINANCE NO. 7188 THIRD READING OF AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE AND DELIVER AN AGREEMENT WITH THE CORPUS CHRISTI CHAPTER OF THE AMERICAN ASSOCIATION OF RETIRED PERSONS TO PERMIT SAID ORGANIZATION TO USE THE BUILDING AND FACILITIES LOCATED ON A PORTION OF THE GROUNDS GENERALLY REFERRED TO AS "ARTESIAN PARK", FOR A TERM OF FIVE YEARS, ALL IN ACCORDANCE WITH THE TERMS AND CONDITIONS OF THE AGREEMENT, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF. In connection with the first reading of a proposed ordinance amending the Corpus Christi Oil & Gas Ordinance to provide special provisions relative to Corpus Christi Bay and Nueces Bay, as proposed by the Oil & Gas Committee, and amendments to provide for the granting of perming for the operation of wells drilled -before annexation and for the reworking of any such wells, suggested by City Attorney Singer, were distributed and discussed very briefly relating to fees to be charged and extent of prohibited off -shore drilling area. Motion by de Leon, seconded by Blackmon that the proposed ordinance be amended before the first reading to provide that the prohibited area referred City of Corpus Christi, Texas Regular Council Meeting April 8, 1964 Page 8 to in Section 6 and 7 be extended an additional 1,000 feet making the distance 4400 feet between Buford Street and the Ship Channel only because of the bayfront activity within this area. Mayor Pro Tem Young felt he would like advice as to whether or not1,000- foot extension would still enable the lease -holders to explore the possible yield of their leases. Commissioner Wallace felt the Oil & Gas Wells Commission had made an excellent report fully protecting the City's interest as well as providing a reasonable regulation of the drilling activities in the Bay, and strongly urged that the Council recognize and accept the proposed amendment to the Drilling Ordinance as recommended. Commissioner Maldonado felt he would like to hear from those opposed to any drilling in the Bay area. Commissioner Blackmon felt that the recommended 3400 feet was a fair compromise; that some people are opposed to any drilling in this area, and that therefore it is the Council's job to define and set the distance. Mayor Barnard felt that if 3400 feet would allow the lease holders to explore by directional drilling all of their leases from the State, it might be well to find out if an additional 1,000 feet will change the situa- tion. Mayor Barnard suggested that all of the suggested amendments be fully studied before the second reading of the proposed ordinance, and that the first reading of the ordinance be voted upon at this meeting as recommended by the Oil & Gas Wells Commission. Commissioner de Leon stated he had no objection, but reserved the right to change his vote on future readings. Mayor Barnard requested that the views be ascertained of the Oil & Gas Wells Commission with respect to the proposed amendments for Monday night's Work Shop. Kenneth Gunderland, Gunderland Marine Supplies, Inc., appeared with respect to the proposed acquisition of his property in connection with the pro- posed Arts & Science Park. City Manager Whitney explained that he has the individual tract estimates, but not all of the individual tract appraisals; that he expects to have these on Friday; and that Mr. Gunderland will be contacted with regard to this information on Friday. City Manager Whitney submitted as a matter of information, a report from T. 0. Foster, District Engineer for the State Highway Department, approving in general, plan No. 18 for the Midtown Traffic Exchange subject to modifications as necessary to fit into the Urban Transportation Plan. There being no further business to come before the Council, the meeting was adjourned.
