SPECIAL COUNCIL MEETING
April 15, 1964

Mayor James L. Barnard called the special meeting to order.
City Secretary T. Ray Kring called the roll of those in attendance.
Mayor Barnard announced the purpose of the special meeting to hold
public hearings on several zoning applications, and explained the procedure to
be followed,
Mayor Barnard announced the public hearing on the application of H. M.
DeVille for a change of zoning from "R -1B" One -family Dwelling District to "B-4"
General Business District on all of Lots 1, 11 and 12, Block 6, Oak Park, save
and except those portions taken for Interstate Highway #37 right of way.
City Secretary Kring reported receipt of a communication signed by the
applicant, Henry M. DeVille, withdrawing his application.
Mayor Barnard announced the public hearing on the application of C. A.
Simpson and Joe H. George for change of zoning from "A-1" Apartment House District
to "B-4" General Business District on all of Block 1, Lots 1 through 5, Barthlome
Addition.
Tom Lake, Zoning Coordinator, located the property on the map; pointed
ou the zoning and land use of the area; stated that 24 written notices were mailed
out and 6 returns received in favor of the request and 2 against; that the 2 appli-
cants and their representative, who was also representing 3 other property owners
in the block, appeared in support of the application at the Commission's hearing,
and no one appeared in opposition; and that the recommendation of the Zoning &
Planning Commission was that the application be approved as submitted.
City Manager Whitney pointed out the hazardous traffic situation in the
area created by the way in which Buffalo Street, Rose Street and Lawrence Drive
come to a point and by the additional traffic from Highway 37; explained the City's
tentative plans for a new street pattern for correcting the situation; and suggest-
ed that since the contemplated street pattern may include the closing of a portion

of Buffalo Street, and the building of Buffalo to enter Lawrence Drive at right
angles that the Council might wish to defer final action on the subject zoning
application to see what the effect of the new street pattern might have on the
properties in the area.
C. A. Simpson, applicant, spoke in support of the request for the purpose
of relocating his garage operation presently located at Antelope and Rose Streets
due to some of the traffic having been diverted by Highway 37.
John Morrow, representing some of the lot owners, spoke in support of
the request on the basis that the zoning of the property would not affect the
street pattern, that the requested zoning and the possible new street pattern will
enhance the property of those he represents as evidenced by the fact that he has
had 2 recent inquiries for purchase if the zoning is approved.
C. R. Lehman, 3101 Huisache St., and C. W. Bertsch, 3102 Magnolia St.,
spoke in opposition to a garage or body shop operation on the basis of the noise
nuisance.
Motion by Wallace, seconded by Blackmon and passed that the hearing be
closed.
Motion by Roberts, seconded by Wallace and passed that the matter be
tabled for 1 week for study with respect to the possible new street pattern.
Mayor Barnard announced the public hearing on the application of Max C.
Kluge for change of zoning from "R -1B" One -family Dwelling District to "A-1"
Apartment House District on a 2.589 -acre tract out of the southern portion of the
east.I of Lot 11, Bancroft Farm Lots.
Tom Lake located the property on the map; pointed out the zoning and
land use of the area; stated that 12 notices were sent out, 3 returns received in
favor of the request, and none against, and that 2 additional returns were received
following the Commission"s hearing; and that the recommendation of the Zoning &
Planning Commission was that the request be approved subject to a proper plat.
Max Kluge, applicant, spoke in support of the application; presented a
site plan of the proposed 40 -unit apartment development, with room for 64 units,
and explained his plans for swimming pool, putting green and shuffle board, 128
designated parking spaces, and including a fence.

Perry Smith, adjacent property owner, pointed out the need for a street
connection from Werner Lane to Villa Drive so that a portion of his approximately
3 -acre tract would have access to a public thoroughfare; presented a sketch of what
he wanted as to street connection; and indicated he was not opposed to the zoning
request provided the proper street pattern was provided for.
Motion by Wallace, seconded by Maldonado and passed that the hearing be
closed.
Motion by Wallace, seconded by Maldonado and passed that the application
be tabled for 1 week, and that a report on the street needs in the area be furnished
to the Council by the Staff for study.
Mayor Barnard announced the public hearing on the application of Ethel
Hendricks for change of zoning from "R -1B" One -family Dwelling District to "I-2"
Light Industrial District on a 10.99 -acre tract, more or less, out of the southern
portion of Lot 8, Baldwin -Moore Farm Lots.
Tom Lake located the property on the map; pointed out the zoning and land
use of the area; stated that 6 notices were sent out, 1 return received in favor of
the request, and none against; and that the recommendation of the Zoning & Planning
Commission was that the request be approved as a logical extension of the existing
adjacent industrial zoning. He presented the preliminary plat which had been sub-
mitted at the Commission hearing indicating a wholesale plumbing supply, warehouse,
and retail plumbing and heating firm.
George Hilscher, real estate agent representing the applicant, spoke in
support of the request on the basis of certain definite leases waiting for final
zoning for industrial development.
No one appeared in opposition to the request.
Motion by Blackmon, seconded by Young and passed that the hearing be
closed.
Motion by Maldonado, seconded by Blackmon and passed that the recommenda-
tion of the Zoning & Planning Commission be concurred in, and the change of zoning
from "R -1B" to "I-2" Light Industrial District on the 10.99 -acre tract, more or
less, out of the southern portion of Lot 8, Baldwin -Moore Farm Lots described in
the application, be granted.

Mayor Barnard announced the public hearing on the application of Joe
Solis for change of zoning from "B -1B" One -family Dwelling District to "AB" Pro-
fessional Office District on all of Lot 17, Block 3, John Jones Addition,
Tom Lake located the property on the map; pointed out the zoning and land
use of the area; stated that the applicants, Mr. & Mrs. Solis and their attorney had
appeared in support of the request at the Commission's hearing, and no one appeared
in opposition; that 40 notices were sent out, one return received in favor of the
request, and one against; and that the recommendation of the Zoning & Planning
Commission was that the request be denied but that in lieu a Special Permit for a
beauty shop be approved subject to the following conditions; (1) That no signs or
outdoor advertising be permitted; (2) That no outdoor lighting be permitted; (3)
That no more than one operator be permitted; and (4) That in all respects the resi-
dential character of the property be maintained.
Margarito Garza, attorney representing the applicant, explained the need
for Mrs. Solis to be able to supplement the family income at home due to the young
age of her three boys, that there will be no change in the character or appearance
of the neighborhood and no alterations to the existing large residence; that Mrs.
Solis plans to conduct her beauty shop operation by appointment only and her clients
will be from the neighborhood; and added that he lives next door with his family
and has no objection to the beauty shop operation.
Mrs. Solis appeared in support of the application, and requested that it
be giWen favorable consideration.
No one appeared in opposition to the request.
Motion by de Leon, seconded by Maldonado and passed that the hearing be
closed.
Motion by Blackmon, seconded by Maldonado and passed, with Mayor Pro Tem
Young voting "Nay," and Commissioner Wallace abstaining, that the application be
tabled for one week.
There being no further business to come before the Council, the special
meeting was adjourned.
