Wallace, Jr. CITY OF CORPUS CHRISTI, TEXAS SPECIAL COUNCIL MEETING July 1, 1964 2:00 p.m. City Manager Herbert W. Whitney Ass't City Att'y Wayland Pilcher City Secretary T. Ray Kring Mayor James L. Barnard called the meeting to order; announced the purpose of the special meeting to hold public hearings on five zoning applications; and explained the procedure to be followed. City Secretary T. Ray Kring called the roll of those in attendance. Motion by de Leon, seconded by Maldonado and passed that the absence of Commissioner Jack R. Blackmon be excused for cause. Mayor Barnard announced the public hearing on the application of R. J. Bryant for a change of zoning from "R -1B" One -family Dwelling District to "8-1" Neighborhood Business District on a 2.17 -acre portion of the southwest 1 of Tract C, Lot 16, Lokey Subdivision. Tom Lake, Zoning Coordinator, located the property on the map; pointed out the zoning and land use of the area, and indicated the proposed zoning for the area; stated that the realtor representing the subject property owner and the realtor representing the prospective purchaser of the subject property had appeared in support of the ap- plication at the Commission's hearing; that ten notices had been mailed out, one return received in favor and none against; and that the recommendation of the Zoning & Planning Commission was that the application be approved. No one appeared to speak either for or against this application. Motion by Wallace, seconded by Maldonado and passed that the hearing be closed. Motion by de Leon, seconded by Wallace and passed that the recommendation of the Zoning & Planning Commission be concurred in, and the change of zoning on the 2,17 - acre portion of the southwest of Tract C, Lot 16, Lokey Subdivision, described in the application, from "R -1B" to "B-1" Neighborhood Business District be granted. Mayor Barnard announced the public hearing on the application of Dr. Orville A. Lundeen for a change of zoning from "A-2" Apartment House District to "B-1" City of Corpus Christi, Texas Special Council Meeting July 1, 1964 Page 2 Neighborhood Business District on Lots 23 & 24, Block 4, Hughes Addition. Tom Lake located the property on the map; pointed out the zoning and land use of the area; stated that no one had appeared either for or against the request at the Commission hearing; that 17 notices were mailed out, two returns received for, and none against, and one return received in favor since the Commission hearing; and that the recommendation of the Zoning & Planning Commission was that the application be approved. City Manager Whitney reported receipt of a telegram from Saul and Rose Cooper, and one return from Paul McAllister in favor of the request, which were noted for the record. Mr. P. I. Pruett, representing Dr. Lundeen, appeared in support of the re- quest and stated that the Knolle Company was also in favor of the application. No one appeared in opposition to the request. Motion by Wallace, seconded by Maldonado and passed that the hearing be closed. Motion by Maldonado, seconded by Young and passed that the recommendation of the Zoning & Planning Commission be concurred in, and the change of zoning on Lots 23 & 24, Block 4, Hughes Addition, from "A-2" to "B-1" Neighborhood Business District, be granted. Mayor Barnard announced the public hearing on the application of E. L. Laird and others for a change of zoning from "R -1B" One -family Dwelling District to "R-2" Two-family Dwelling District on all of Lots 39 through 63, Block 4, Airport Park. Tom Lake located the property on the map; pointed out the zoning and land use of the area; stated that the applicant had appeared at the Commission hearing in support of his request, and 5 persons spoke in opposition, and approximately 15 persons had indicated their opposition; that 63 notices were mailed out, one return received in favor, and 7 against; and that the recommendation of the Zoning & Plan- ning Commission was that the request be denied on the basis that two-family dwelling district zoning and duplex residential uses would be out of character with the existing residential area. • • City of Corpus Christi, Texas Special Council Meeting July 1, 1964 Page 3 Mr. Lake presented the application showing the names of those included as applicants and indicating which are property owners, renters, or persons not within the area of request. E. L. Laird, applicant, explained that he is the owner of lots 52 & 53; that there are 2 small rental houses on each lot; that a Special Permit on Lot 52 allows its use for residence and grocery store; that one rental house on each lot is vacant and cannot be rented or repaired because of the existing zoning; that he had not anticipated the opposition received at the Commission hearing; and that he was there- fore requesting a Special Permit so that he could make the necessary repairs in order to rent the other 2 houses that have been there for about 20 years; and ex- plained that the houses range from about 14 feet to 20 feet apart, and do not con- stitute a fire hazard as there is room for a fire truck to get to the houses in event of a fire. In answer to questions from the Council, Mr. Lake explained that some of the signers of the application had at least implied at the Commission hearing that they had not been fully aware of the fact that the request was for a change of zoning, but had thought the request was made in order to keep the grocery store. Mayor Barnard suggested that a special permit could be granted for Lots 52 and 53, and the rest of the application be denied; Commissioner de Leon was con- cerned as to whether the 2 lots qualify for "R-2" classification with respect to lot size; and Mr. Lake explained that "R-1" and "R-2" classifications have the same lot size requirement. Motion by Maldonado, seconded by Roberts and passed that the hearing be closed. Motion by Wallace, seconded by Roberts and passed, with Mayor Pro Tem Young voting "Nay," that the change of zoning from "R-1" to "R-2" Two-family Dwelling District on Lots 52 and 53, Block 4, Airport Park, be granted, and that such change of zoning not effect the existing Special Permit with respect to Lot 52; and that the change of zoning on the rest of the Lots recited in the application, being Lots 39, 40, 41, 42, 43, 44, 45, 46, 47, 48, 49, 50, 51, 54, 55, 56, 57, 58, 59, 60, 61, 62, and 63, Block 4, Airport Park, be denied. • City of Corpus Christi, Texas Special Council Meeting July 1, 1964 Page 4 Mayor Barnard announced the public hearing on the application of Austin Sanchez for a change of zoning from "A-2" Apartment House District to "8-1" Neigh- borhood Business District on all of Lot 26, Block 1, Loma Alta Addition. Tom Lake located the property on the map; pointed out the zoning and land use of the area; stated that the applicant's daughter had appeared in support of the request at the Commission hearing, and no one appeared in opposition; that 31 notices were mailed out, 3 returns received in favor of the request, and 2 against, and one return received neither for nor against; and that the recommendation of the Zoning & Planning Commission was that the request be denied but that in lieu a Special Permit for a barber shop be approved subject to the following conditions: (1) That not more than two barber chairs be permitted in the sholr; (2) That outside lighting be prohibited; and (3) That outdoor advertising be limited to one unlighted sign, not more than five square feet in size to be attached to the front of the building and not to protrude above the roof line. Receipt of letters in opposition to the application from Guadalupe Torres, 2353 Howard Street, and from Susan Cervantes, 2347 Howard Street, were noted for the record. Phillip Sanchez, representing his father who was also present, spoke in support of the application, and explained that his father, who is semi -retired needs to supplement his retirement income. No one appeared in opposition to the request Motion by Young, seconded by Wallace and passed that the hearing be closed. Motion by de Leon, seconded by Maldonado and passed that the recommendation of the Zoning & Planning Commission be concurred in, and the request for change of zoning from "A-2" to "B-1" on Lot 26, Block 1, Loma Alta Addition, be denied but in lieu a Special Permit for a barber shop be granted subject to the following con- ditions ° (1) That not more than two barber chairs be permitted in the shop; (2) That outside lighting be prohibited; and (3) That outdoor advertising be limited to one unlighted sign, not more than 5 square feet in size to be attached to the front of the building and not to protrude above the roof linea • City of Corpus Christi, Texas Special Council Meeting July 1, 1964 Page 5 Mayor Barnard announced the public hearing on the application of L. P. Even, B. B. Gabbert, Woodrow Smith & V. B. Wilkins for a change of zoning from "R -1B" One - family Dwelling District to "A-2" Apartment House District on Lots 6, 7, 8, 9, 10, & 11, Block 14, Villa Gardens. Tom Lake located the property on the map; pointed out the zoning and land use of the area; stated that Mr. Even had appeared in support of the request at the Commission hearing and no one appeared in opposition; that 32 notices were mailed out, one return received in favor, and 2 against; and that the recommendation of the Zoning & Planning Commission was that the request be denied on the basis that ap- proval would constitute spot zoning and encroachment of multi -family uses into an existing single-family area, Mr. Lake reminded the Council that Lots 6 and 7 of the area of request were the subject properties of a recent application of Mr. Even for apartment zoning that was denied by the Council as recommended by the Commission. Byran Wingo, attorney representing L. P. Even, described the existing con- ditions in the area, pointing out the industrial area behind the subject property, and felt that use of the property as an apartment area would not detract any neigh- borhood values. Mr. Wilson, owner of property at the corner of Baldwin and Villa Drive, felt that although it was spot zoning, it would not cause any hardship in the area and would improve the appearance of the neighborhood. Mrs. Even felt that the property was not suited for residential living due to the trucking debris and trash from the industrial area. No one appeared in opposition to the application. Motion by Young, seconded by Roberts and passed that the hearing be closed. Commissioner de Leon pointed out that no plans for the property had been pre- sented or discussed, and Mr. Wingo stated that plans cannot be made until the zoning is approved. Motion by Wallace, seconded by Roberts that the request for a change of zoni- ing from "R -IB" to "A-2" be granted (on the basis that a buffer zoning classifica- tion between single-family residence and industrial zoning is considered good zoning) City of Corpus Christi, Texas Special Council Meeting July i, 1964 Page 6 On vote, Commissioners Wallace, Roberts, and de Leon voted "Aye", and Mayor Barnard, and Commissioners Young and Maldonado voted "Nay," and the Chair declared the motion failed. Motion by Wallace, seconded by Roberts that the request for change of zoning from "R -1B" to "A-2" on Lots 6 to 11, Block 14, Villa Gardens be denied but in lieu a Special Permit be granted for apartment house use subject to compliance with all of the regulations of the "A-2" Apartment House District. On vote, Commissioners Wallace, Roberts, and de Leon voted "Aye," and Mayor Barnard, and Commissioners Young and Maldonado voted "Nay," and the Chair declared the motion failed. Motion by de Leon, seconded by Young and passed with Commissioners Wallace and Roberts voting "Nay," that the recommendation of the Zoning & Planning Commis- sion be concurred in, and the request for a change of zoning from "R -1B" to "A-2" Apartment House District on Lots 6, 7, 8, 9, 10 & 11, Block 14, Villa Gardens be denied. The Chair declared the motion to deny the request had passed. There being no further business to come before the Council, the special meeting was adjourned.
