SPECIAL COUNCIL MEETING
August 5, 1964

Meycr Barnard called the meeting to order.
City Secretary T. Ray Kring called the roll of those in attendance.
Motion by de Leon, seconded by Young and passed that the absence of
Commissioner M. P. Maldonado be excused for cause.
Mayor Barnard announced the purpose of the special meeting to hold
public hearings on three zoning cases and explained the procedure to be followed.
Mayor Barnard announced the public hearing on the application of W. V.
Noakes for a change of zoning from "R -1B" One -family Dwelling District to "R-2"
Two-family Dwelling District on all of Lots 11, 12, 13, 14, 15 & 16, Block 20,
Calallen Townsite.
Tom Lake, Zoning Coordinator, located the property on the map; pointed
out the zoning and land use of the area; stated that no one appeared at the
Commission hearing either for or against the request; that 12 notices were sent
out, two returns received in favor and none against; and that the recommendation
of the Zoning & Planning Commission was that it be approved.
No one appeared in connection with this application.
Motion by Wallace, seconded by Blackmon and passed that the hearing be
closed.
Motion by Blackmon, seconded by de Leon and passed that the recommenda-
tion of the Zoning & Planning Commission be concurred in, and that an ordinance
reflecting a change of zoning on all of Lots 11, 12, 13, 14, 15 & 16, Block 20,
Calallen Townsite, from "R -1B" to "R-2" Two-family Dwelling District be brought
forward.
Mayor Barnard announced the public hearing on the application of Raul G.
Vasquez for a change of zoning from "R -1B" One -family Dwelling District to "B-1"
Neighborhood Business District on all of Lot 29, Block 3, Lexington Subdivision.

use of the area; stated that Mrs. Vasquez appeared in support of the application
at the Commission hearing, and one person appeared in opposition to the rezoning
but not opposed to the proposed grocery store operation; that 18 notices were sent
out, one return received in favor, and one against the request; and that the recom-
mendation of the Zoning & Planning Commission was that it be denied on the basis
that approval would constitute spot zoning and encroachment of business into a resi-
dential area,
Raul Vasquez, applicant, appeared in support of his application, and follow-
ing an explanation of the wcrktngn of a special permit, he stated that this would
satisfy his proposed use for his residence and small grocery store.
No one appeared in opposition to the request.
Motion by Wallace, seconded by de Leon and passed that the hearing be
closed.
Motion by Wallace, seconded by de Leon and passed that the application
be denied but that in lieu an ordinance be brought forward granting a special
permit for the operation of a grocery store on all of Lot 29, Block 3, Lexington
Subdivision, subject to the erection of a 6 -foot high solid fence on two sides of
the property separating surrounding residential property and also subject to the
"B-1" regulations.
Mayor Barnard announced the public hearing on the application of H. W.
Reagan for a change of zoning from "A-1" Apartment House District to "B-4" General
Business District on all of A-2 and B-2, Habluetzel. Tract, being a portion of a
2.659 -acre tract out of Lot 18, Section 2, Flcik Bluff and Encinal Farm and Garden
Tracts.
Tom Lake located the property on the map; pointed out the zoning and land
use of the area; stated that the applicant and a realtor representing the owner of
adjacent property appeared at the Commission hearing in support of the request, and
no one appeared in opposition; that 12 notices were sent out, two returns received
in favor of the request and one against; and that the recommendation of the Zoning
& Planning Commission was that it be approved.
H. W. Reagan, applicant, spoke .in support of his request mainly for opera-
tion of his Water boy Lawn Sprinkler Systems business.

Paul Erb, realtor representing Dr. Martin B. Pigott, Jr., owner of the
adjacent properties, spoke in favor of the request.
No one appeared in opposition to the application.
Motion by Wallace, seconded by Young and passed that the hearing be closed.
Motion by Blackmon, seconded by Wallace and passed that the recommendation
of the Zoning & Planning Commission be concurred in, and an ordinance be brought
forward reflecting a change in zoning from "A-1" Apartment House District to "B-4"
General Business District on all of Lots A-2 and B-2, Habluetzel Tract described
in the application.
There being no further business to come before the Council, the special
meeting was adjourned.
