Barnard Commissioners: Jim Young, Mayor Pro tem Jack R. Blackmon J. R. de Leon M. P. Maldonado W. J. Roberts W. H. Wallace, Jr. City Manager Herbert W. Whitney City Attorney I. M. Singer City Secretary T. Ray Kring Mayor James L. Barnard called the meeting to order. City Secretary T. Ray Kring called the roll of those in attendance. Mayor Barnard announced the purpose of the special meeting for public hearings on three zoning cases, and such other business as may come before the Council, and announced the procedure to be followed. Mayor Barnard announced the public hearing on the application of Mr. and Mrs. L. C. Flemister for a change of zoning from "R -1B" One -family Dwelling District to "AB" Professional Office District, on all of Lot 23, Block 5, Lex- ington Estates. Tom Lake, Zoning Coordinator, located the property on the map; pointed out the zoning and land use of the area; stated that four persons, including tie applicants, spoke in support of the request at the Commission hearing, and no one appeared in opposition; that 25 notices were mailed out, 3 returns were received in favor, and 2 against, and that 2 additional returns were received in favor of the request since the Commission hearing; and that the recommenda- tion of the Zoning & Planning Commission was that the request be denied but that in lieu a special permit for the operation of a beauty shop be approved subject to the following conditions: (1) That signs and other outdoor advertising be prohibited; (2) That outside lighting be prohibited; (3) That parking be in accord- ance with the requirements of Article 22 of the Zoning Ordinance. Mr. Lake informed the Council that just prior to this meeting, Mrs. Flemister, applicant, telephoned to say her husband has just returned from serious illness in the hospital and she was unable to attend the hearing, but that the special permit as recommended by the Zoning 4. Planning Commission was agreeable to them. No one appeared in opposition to the request. Motion by Maldonado, seconded by de Leon and passed that the hearing be closed. Motion by de Leon, seconded by Maldonado and passed that the recommendation 1 City of Corpus Christi, Texas Special Council Meeting August 12, 1964 Page 2 • of the Zoning & Planning Commission be concurred in, and that the request for a change of zoning be denied, but that in lieu, an ordinance be brought forward granting a special permit for the operation of a beauty shop on all of Lot 23, Block 5, Lexington Estates, subject to the following conditions: (1) That signs and other outdoor advertising be prohibited; (2) That outside lighting be pro- hibited; and (3) That parking be in accordance with the requirements of Article 22 of the Zoning Ordinance. Mayor Barnard announced the public hearing on the application of U.M.W. Scotish Rite Grand Lodge of Texas, Inc. for change of zoning from "R -1B" One -family Dwelling District to "A-2" Apartment House District, on all of Lot 2, Block 3, Carver Addition #1. Tom Lake located the property on the map; pointed out the zoning and land use of the area; stated that Mr. Hall, Grand Lodge Master, appeared in support of the request, and no one appeared in opposition; that 33 notices were sent out, 2 returns received in favor of the request, and 2 against, and that a petition with approximately 7 signatures was presented in favor of the request; and that the recommendation of the Zoning & Planning Commission was that the request be approved as submitted. H. Kenyon, representing Mr. Hall, Grand Lodge Master, and one other per- son appeared in support of the application. No one appeared in opposition to the request. Motion by Young, seconded by de Leon and passed that the hearing be closed. Motion by Blackmon, seconded by de Leon and passed that the recommendation of the Zoning & Planning Commission be concurred in, and that an ordinance be brought forward reflecting a change of zoning from "R -1B" to "A-2" Apartment House District on all of Lot 2, Block 3, Carver Addition #1. Mayor Barnard announced the public hearing on the application of B. F. Beasley, Jr. for a change of zoning from "R -1B" One -family Dwelling District to "B-1" Neighborhood Business District, on a .5 -acre portion out of the southeast corner of Lot 8 and a .667 -acre portion out of Lots 8 & 9, Section 54, Flour Bluff and Encinal Farm and Garden Tracts. • • City of Corpus Christi, Texas Special Council Meeting August. 12, 1964 Page 3 Tom Lake located the property on the map; pointed out the zoning and land use, and the proposed zoning for the area; stated that Mr. George Maddox, repre- senting the applicant and Quick Car Wash, appeared at the Commission hearing in support of the request; that 7 notices were sent out, one return received in favor of the request, and none against, and that just prior to this meeting a reply was received from Mr. Stenwick in favor of the request; and that the recommendation of the Zoning & Planning Commission was that the request be approved as submitted. Mr. George Maddox, representing the applicant, appearing in support of the request, stated that the car wash operation is primarily to prevent saline corrosion, that the applicant wanted a small operation that would supplement his income in a modest way that would not take him away from the property, and that his company was willing to finance this operation. No one appeared in opposition to the request. Motion by Young, seconded by Blackmon and passed that the hearing be closed. Motion by Young, seconded by Maldonado and passed that the recommendation of the Zoning & Planning Commission be concurred in, and that an ordinance be brought forward reflecting the change of zoning from "R -1B" to "B-1" Neighborhood Business District, on the .5 -acre portion out of the southeast corner of Lot 8 and the .667 -acre portion out of Lots 8 & 9, Section 54, Flour Bluff and Encinal Farm and Garden Tracts described in the application. City Manager Whitney reported for the record that the following two appli- cations for zoning changes which were set by the City Council for public hearing at this special meeting, were withdrawn prior to publication and notification by the respective attorneys for these applicants: Application of J. M. Rollins for change of zoning from "R -IB" to "B-1" on the southeast k of Lot 6, Ava Cooper Addition, withdrawn by Ted M. Anderson, attorney, by letter dated July 31, 1964; Application of Jack Kins for change of zoning from 'R -1A" to "A-1" on all of Lot 1, Block "A", Surfview Estates Unit 1, withdrawn by Houston Abel, attorney, by letter dated July 22, 1964. City Manager Whitney presented the following proposed ordinance for con- sideration at this meeting: City of Corpus Christi, Texas Special Council Meeting August 12, 1964 Page 4 ORDINANCE NO. 7321 AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO ENTER INTO AN AGREEMENT WITH THE NUECES COUNTY RURAL 'FIRE PREVENTION DISTRICT NO. 2 FOR THE FURNISHING OF MATERIALS AND EQUIPMENT AND FUNDS IN PREVENTING AND EXTINGUISHING FIRES IN THE FLOUR BLUFF AREA, FOR A PERIOD OF ONE YEAR, ALL IN ACCORDANCE WITH THE AGREEMENT, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF; AND DECLARING AN EMERGENCY. The Charter rule was suspended by the following vote: Mayor Barnard, Commissioners Young, Blackmon, de Leon, Maldonado, Roberts and Wallace, present and voting "Aye". The foregoing ordinance was passed by the following vote: Mayor Barnard, Commissioners Young, Blackmon, de Leon, Maldonado, Roberta and Wallace, present and voting "Aye". There being no further business to come before the Council, the special meeting was adjourned.
