Roberts Mayor James L. Barnard called the meeting to order. The Invocation was given by the Reverend Harold T. Branch, Pastor of St. John's Baptist Church. City Secretary T. Ray Kring called the roll of those in attendance. Motion by Blackmon, seconded by Roberts and passed that the absence of Commissioner W. H. Wallace, Jr. be excused for cause. Motion by Maldonado, seconded by de Leon and passed that the minutes of the regular meeting of August 19, 1964, be approved as furnished to the Council. Meyer Barnard announced the public hearing on the application of the Calallen Baptist Church for the closing of Avenue B between Blocks 14 and 19, from 3rd Street through Lot 10 in Block 14 and Lot 4 in Block 19; the alley in Block 14; the alley in Block 13; and the alley in Block 19; all in Calallen Townsite, City of Corpus Christi. Acting City Manager Townsend presented a sketch showing the block numbers and the areas requested to be closed; a map showing the land use of the areas involved; and stated that none of the City departments have any ob- jection to the request, with the exception that since there is a gas line and a power line within the street area, that the City should retain the necessary easement or else require the applicant to pay the cost of any relocation of these utilities. He pointed out that the Staff felt Avenue B should be closed for the entire length of the block, if the request is granted, rather than only the portion requested; and further pointed out the use of a portion of the alley in Block 14 by one of the lot owners for a turn -around which should be considered in any closing of that alley. Mr. Townsend stated that apparently some owners of property within the required notification distance had inadvertently been omitted from the list of names and addresses supplied by the applicant, that City of Corpus Christi, Texas Regular Council Meeting August 26, 1964 Page 2 the application did not indicate the extent of church -owned property, nor the purpose of the request. City Secretary Kring informed the Council that a representative of the applicant had indicated he would be present for this hearing, but since there was no one present to speak for or against the request, Mayor Barnard called for emotion to table the application. Motion by Young, seconded by de Leon and passed that the foregoing application be tabled. Mayor Barnard called for the City Manager's Reports. Motion by de Leon, seconded by Maldonado and passed that the City Manager's Reports be accepted, and the recommendations and requests be approved and granted, as follows; a. That the plans and specifications for street improvements on Chippewa Street from Osage to Eleanor, on Cosner from Tweet to Lexington, and on Bremner parkway at Fort Worth Street be approved; and that authority to ad- vertise for bids to be received on September 16, 1964, be granted; b. That the sale of General Obligation Bonds totalling $4,150,000 be authorized, and authority to receive bid proposals at 11:00 a.m., C.S.T., on Thursday, October 1, 1964, at a special meeting, be granted; c. That the sale of three buildings, located at 621 Kinney and 607 Kinney, acquired by the City in connection with the right of way for the Mid - Town Traffic Exchange project, be authorized at public auction in the usual r; d. That amendment to the Plumbing Ordinance with respect to the Permit Fee Schedule to provide a fee of $1.00 each per 1,000 sq. ft. of lot area for Lawn Sprinkler and Irrigation Systems, instead of 25¢ each per head, be approved; e. That the acquisition of Parcel #17 in Block 93, Beach Portion, owned by Pearl T. Hunnicutt, in the amount of $21,500 for the land and $1,200 for the furniture, be approved as a portion of right of way for the Arts and Sciences Center; f. That the request of Southwestern Oil & Refining Company for a re- vocable easement for the laying of a 2" gas line across Interstate Highway 37, • City of Corpus Christi, Texas Regular Council Meeting August 26, 1964 Page 3 at a point on the John Weaning and Don. Barton Tract east of Clarlvood between Shell Road and Highway 9, approximately 1100 feet east of Clarrkwood Road, be approved; go That authority to advertise for bids to be received on September 9, 1964, on one Listed Ditching Machine for the Water Division, be granted; ho That amendment to the contract with the Corpus Christi Tennis Association for the operation of the center court at the Ho Eo Butt Tennis Center, to allow deduction of the cost of bringing amateur players to tennis exhibition meets from the gross receipts of such events before determination of the 75 percent of receipts, provided a specific request has been submitted and approved in writing by the Director of Parks & Recreation, the City Manager, and W. Ho Bo Butt insofar as his interest in the revenue to the City from the Center, be approved; io That the date of September 9, 1964, during the regular meeting, be set for public hearing on the closing of the portion of Last Street between Mussett and Caldwell; j. That the recommended termination of the parkway House for Girls program on the basis that these girls can be better cared for in foster homes, be recognized, and that definite plans for disposal of the property involved be made; ko That the appointment of W. Charles Jo Daley as Head of the Division of Accounting in the position of Chief Accountant, be approved; le That the agreement for the operation and maintenance of a stream - flow station on the Nueces River near Tilden be continued, and a contract with the Texas Water Commission covering Water Resources Investigations at a cost to the City of approximately $700..00 be approved; mo That the Handy Andy Store in the Hamlin Mopping Center at the corner of Weber and Staples, be approved as a Utility Pay Station for utility bills owed the City; no That the date of September 2, 1964, during the regular meeting, be set for public hearing on the application of Oil & Gas Reserises, Inca for a drilling permit at a location in Clarkwood just off Highway 44; • City of Corpus Christi, Texas Regular Council Meeting August 26, 1964 Page 4 o. That the preliminary plans for 19th Street from the Crosstown Expressway to Morgan, be approved. It was noted that a representative of the Calallen Baptist Church vas now present. Motion by Young, seconded by Roberts and passed that the matter of the application of Calallen Baptist Church for certain street and alley closings be taken from the table at this time. Rev. Gerald B. Henderson, Pastor of the Calallen Baptist Church, pointed out the church -owned properties and explained the plans for erection of a fence between the parsonage and the neighboring residence and the paving and use of other church -owned property involved for parking area and possible future building improvements, but that they did not plan to build anything on the portion of Avenue B involved in the request for closing. Rev. Henderson stated that he was not aware that the list of names and addresses of owners of property in the area was incomplete, and that he would furnish the names and addresses required for notification of consideration of this matter at next week's regular meeting. Motion by Roberts, seconded by de Leon and passed that the hearing be recessed for one week. Bob Hamric, speaking with respect to the second reading of an ordin- ance concerning special classification and rental schedule for athletic events in the Coliseum, urged that the calculation of the 5% of gross receipts be figured at the end of the contract period rather than after each event, be- cause the sponsors are not always able to present a boxer who draws good crowds, and because they hope to present other events, such as basketball games, which may not at first dray the crowd.. He pointed out that the City was protected by the minimum fee and by payment of thee.first.and last months' minimum fee in advance. The Council agreed to consider this request at Work Shop before the third and final reading of the proposed ordinance. Motion by Roberts, seconded by de Leon and passed that the ordinance amending Sections 12-32 and 12-33 of Chapter 12 of the Corpus Christi City • • City of Corpus Christi, Texas Regular Council Meeting August 26, 1964 Page 5 Code, 1958, read for the first time on August 19, 1964, be amended as follows: (1) Changing the words "sporting events" wherever they appear in the ordinance to "athletic events"; (2) Substituting the word "shall" for "may" concerning the lease contract provision for cancellation, withdrawal or substitution of two dates out of each 12 months lease period; (3) Instead of the words "by mutual agreement of the lessee and the Coliseum Manager," concerning cancella- tion, withdrawal or substitution of two dates out of each 12 months lease period, substitute therefor the words "by written notice at least 30 days prior to the date proposed to be cancelled." FIRST READING OF AN ORDINANCE AMENDDING ORDINANCE NO. 2578, PASSED AND APPROVED ON THE 16TH DAY OF AUGUST, 1949, AND GENERALLY REFERRED TO AS "THE PLUMBING CODE," INCLUDING THE "AMENDMENTS THERETO, BY AMENDING THAT PORTION OF SECTION Ea, SUB- SECTION (a) OF CHAPTER 6 OF SAID ORDINANCE TO PROVIDE A CHANGE IN THE FEE SCHED ULE SO AS TO PROVIDE A MORE EQUITABLE PERMIT FEE FOR THE INSTALLATION OF LAWN SPRINKLER AND IRRIGATION SYSTEMS; PROVIDING A SAVINGS CLAUSE; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR PUBLICATION. Mr. A. L. Lacey, local manager of Central Power & Light Company, pre- sented copies of the new rate schedules for electric service for residential and commercial customers which will be effective for electric service used atter September 1, 1964; explained the reason for the reduction was to pass on to the consumer a recent million dollar federal tax reduction to the company, and to encourage and promote the use of a greater number of kilowatt hours of electricity by their customers; cited a few hypothetical examples of the saving to the cus- tomer under the new schedules; and requested the passage of a proposed resolu- tion accepting and approving the new rate schedules. • • City of Corpus Christi, Texas Regular Council Meeting August 26, 1964 Page 8 W. G. C. Lincoln, district manager of Central Poser & Light Company, answered some of the questions of the Council sad members of the audience, as to adjustments in the price of gas to the company, the coat of kilowatt hour production, and the effect of the new rate schedules on kilowatt demand. City Attorney Singer and Acting City huger Townsend felt that before considering the compauy.s request for the passage of the proposed resolution, time should be allowed for a review of the value of the property and facilities used to produce the intended revenue expected under the new rate schedules; and commented that the reduced rate schedules can be applied by the company without prior approval of the Council. Mayor Barnard thanked Mr. Lacey and Mr. Lincoln for their presentation and explanations, and referred the matter to the City Manager for Staff study and recommendation. The following appeared in objection to the newly announced bus schedule for•the Corpus Christi Beach area on the basis that the franchise requires the Nueces Transportation Company to provide adequate transportation for all sections of the City, not to just those sections that produce a profit to the company; that the new schedule does not provide bus service to accommodate the maids and other hotel and motel help travelling to and from work across the bridge; that it does not provide bus service to and from the downtown area for tourists or retired residents without private transportation who comprise the largest part of the people in the Beach area, or for school children needing public trans- portation to and from the public library and recommended activities in the City: Ray Grandy, Precinct Chairman of Precinct 21; Jack Davis, businessman and prop- erty owner on the Beach; Frank Shell, businessman; John Stein, Tropical Motel; Mrs. Cunningham, Hi -Points Courts; Mrs. Parrott, Alura Courts; Mrs. Gordon Gray. Elmer Pope pointed out that in some cities with the same problem, only buses are allowed on the downtown streets with parking being provided for private cars outside of the downtown shopping area. Ken Cason and Roy Klett of the Eueces Transportation Company, explained the companyon position on the basis that the trips to and from the Beach area were carrying only six to eight persons a trip; recited the hours of the new bus • City of Corpus Christi, Texas Regular Council Meeting August 26, 1964 Page 9 schedule; and pointed out that the company had added two trips at noon on a six weeks' trial basis, and that the bus, under contract with the School Board to transport children from the Port area to the school on North Beach, goes back to town at 8030 a.m. Sandy Sanders, Ozark Courts, asked if a man could use a stationwagon or a Volkswagen to haul people to and from the Beach area for a price; and City Attorney Singer answered that the bus companyos franchise is not exclusive and that the individual could apply for a franchise for this purpose. The group felt that the Beach Area should have bus service seven days a week with at least one night run and one for people who did not want to stay in town all day, and at least two Sunday runs; and the Transportation Company representatives felt if they carried 84 passengers a week on each roundtrip, six days a week, the company would break even on the service. Mayor Barnard stated that the Council would study the matter of the bus routes further, but that that there is no way that the City can give any money to the bus ccapany to help with their operation, Don Newsom, Operating Superintendent of Lichtenstein's, and Mr. Morris Lichtenstein, stated they had recently purchased approximately 10 acres in the 4100 block of South Staples occupied by the KRYS Radio Station; that on the ad- vice of the Inspection Department they had appeared before the Board of Adjust- ment for permission to erect a billboard type announcement sign next to the radio station; but that the Board of Adjustment had denied the request on the grounds tat they did not have jurisdiction in this matter. Following some discussion of the matter, they were advised to apply for a change of zoning to "B-5" PrimAry Business District; that the matter will then come before the City Council, and since they are not ready to plat the property, the Council can deny the zoning but in lieu grant a special use permit for the si:i. C. W. Allison objected to the use of City funds, and particularly Park and Recreation funds, for the purchase of Mrs. Hunnicutt's apartment house; and asked what the specific plans of the City are for this apartment house. It was explained that the purchase will be made from General Funds, not from Park and Recreation funds; that the property is included in the area City of Corpus Christi, Texas Regular Council Meeting August 26, 1964 Page 10 scheduled for the Arts & Science Center development; that the resolution adopted by the Council stating the intention of the City in this matter is public record and on file in the City Secretary's office; and that the Council believed the Arts & Science Center project vas a wonderful opportunity for progress and growth of the area and of great benefit to the citizens of the City and of the area. Mt. O. W. Whitley protested that he had been denied permission to erect an adequateiy sized sign for hie Gold Dome Harahvxger stand at the corner of 'Lexington and Moravian by the Board. of Adjustment, and that the size sign he had applief vas atsolutely essential for his business. He commented further that two other applicants, Texaco Company and Goodyear Tire Company, were also denied permission to erect their standard signs which are recognized all over the country to identify their products. Commissioner B/ackmon felt that a more realistic ordinance with re- spect to signs is urgently needed; that Mr. Anderson, Director of Planning, has been delayed in his work on this matter as he has been in Washington work- ing on the plans for the new highway; and urged that such an ordinance be pre- sented for Work Shop as soon as possible. Mr. Whitley was advised to apply for a change of zoning to "B-4" Gen- eral Business District as the matter would then came before the City Council, but that the Council has no power to act on an action of the Board of Adjust- ment. Mr. Elmer Pope, Chairman of the Steering Committee for the People -to - People Program, explained that he needed the Mayor's permission and that of the president of the Musicians Union to record on tape the Sunday night concert on the T -Head to send to our Sister City in Japan, Yokosuka, and requested also that Mayor Barnarf say a few words on the tape to the citizens of Yokosuka, Mayor Barnard gave hie permission for the tape to be made and agreed to speak, and congratulated Mr. Pope on the enthusiasm and work of the Committee. Commissioner Blackmon requested the passage of a resolution to take to Austin with him on Monday, urging the early completion of Interstate High- way 37 from San Antonio to Corpus Christi in time for the Hemis Fair to be held City of Corpus Christi, Texas Regular Council Meeting August 26, 1964 Page ll in San Antonio in 1868, which vill attract vast crowds from all over the country and Mexico and South America to the Padre Island National Seashore area and to the Swim Bair.
