Ray Kring Mayor Pro Tem Jim Young called the meeting to order in the absence of Mayor James L. Barnard. City Secretary T. Ray Kring called the roll of those in attendance. Motion by Roberts, seconded by Maldonado and passed that the absence of Mayor James L. Barnard, and Commissioner J. R. de Leon be excused for cause. Mayor Pro Tem Young announced the purpose of the special meeting for public hearing on four zoning applications, and explained the procedure to be followed. Mayor Pro Tem Young announced the public hearing on the application of Max F. Dullnig, Jr., for change of zoning from "R -1B" One -family Dwelling District to "AB" Professional Office District on all of Lot 1, Block 35, Del Mar Addition. Tom Lake, Zoning Coordinator, located the property on the map; pointed out the zoning and land use of the area; explained that the applicant and one other person appeared in support of the application at the Zoning & Planning Commission hearing, and three persons in opposition; that twenty notices were sent out, three returns received in favor of the request, and three against; and that the recom- mendation of the Zoning & Planning Commission was that the request be denied on the basis that the proposed use would be an encroachment of a commercial use into an existing residential area. Max F. Dullnig, Jr., applicant, appeared in support of his request on the basis that the professional office building he proposes to build is small and attractive; would improve the looks of the area; would not be an encroachment since the property backs up to a lot that is zoned "B-4" and proposed for a service station use; that the lot is unsuitable for a residence since it fronts on Alameda and will be backing up to the service station; and that since the Commission hear- ing he has contacted the adjoining property owners and the property owner directly across the street, and presented letters in favor of the change in zoning from John N. Barnes, 506 Cole; Mr. and Mrs. E. A. Jones, 462 Cole; Miss Dean LaRue Haley, 501 Cole; Mrs. Frances R. No one appeared in opposition to the request. Motion by Wallace, seconded by Roberts and passed that the hearing be closed. Motion by Blackmon, seconded by Wallace that the request for change of zon- ing from "R -1B" One -family Dwelling District to "AB" Professional Office District on all of Lot 1, Block 35, Del Mar Addition, be granted, and that an ordinance re- flecting this change in zoning be brought forward. Mayor Pro Tem Young, and Com- missioners Blackmon, Roberts,, and Wallace all voted "Aye," and Maldonado voted "Nay," and the Chair declared the motion to overrule the recommendation of the Zon- ing & Planning Commission had passed, since three-fourths of the Council present and voting had voted "Aye." Mayor Pro Tem Young announced the public hearing on the application of T. E. Ballin for change of zoning from "A-2" Apartment House District to "B-1" Neighborhood Business District on the east 50' of Lots 9 & 10, Block 3, Nelson Addi- tion. Tom Lake located the property on the map; pointed out the zoning and land use of the area; explained that the applicant had appeared in support of the request at the Commission hearing; that nine notices were sent out, one return received in favor, and none against, and since the Commission hearing one additional reply was received in opposition; and that the recommendation of the Zoning & Planning Com- mission was that the request be denied but in lieu a Special Permit for the opera- tion of a radio and TV repair shop be granted on the east 50' of Lots 9 & 10, Block 3, Nelson Addition, subject to the following conditions: (1) A minimum of one off-street parking space be provided; (2) That outdoor advertising be limited to one sign of not more than 10 square feet, non -illuminated, flat against the building, and not to protrude above the eave line of the existing building; and (3) That remodeling be limited to the existing garage apartment building on its existing location. Motion by Wallace, seconded by Maldonado and passed that the hearing be closed, • Motion by Wallace, seconded by Blackmon and passed that the recommendation of the Zoning & Planning Commission be concurred in, that the change of zoning be denied but in lieu a Special Permit for the operation of a radio and TV repair shop on the east 50' of Lots 9 & 10, Block 3, Nelson Addition, be granted subject to the following conditions: (1) A minimum of one off-street parking space be pro- vided; (2) That outdoor advertising be limited to one sign of not more than 10 square feet, non -illuminated, flat against the building, and not to protrude above the eave line of the existing building; and (3) That remodeling be limited to the existing garage apartment building on its existing location; and that an ordinance be brought forward reflecting this action. Mayor Pro Tem Young announced the public hearing on the application of Mr. and Mrs, Jesus Gutierrez for change of zoning from "R -1B" One -family Dwelling District to "B-1" Neighborhood Business District on the north one-half of Lot 12, Block 12, Molina Subdivision #2. Tom Lake located the property on the map; pointed out the zoning and land use of the area; explained that the applicant appeared at the Commission hearing in support of the request, and no one appeared in opposition; that eighteen notices were sent out, one return received in favor of the request and none against; and that the recommendation of the Zoning & Planning Commission was that the request be approved as a reasonable extension of the existing "B-1" Neighborhood Business District zoning. Mrs. Jesus Gutierrez, applicant, spoke in support of the request on the basis that she desired to operate a beauty shop in the house existing on the frott of the property, and to live in the house on the rear of the property. No one appeared in opposition to the request. Motion by Roberts, seconded by Maldonado and passed that the hearing be closed. Motion by Maldonado, seconded by Blackmon and passed that the recommenda- tion of the Zoning & Planning Commission be concurred in, and the request for change of zoning from "R -1B" to "B-1" Neighborhood Business District on the north • • City of Corpus Christi, Texas "SpecialCouncil Meeting September 9, 1964 Page 4 one-half of Lot 12, Block 12, Molina Subdivision #2, be granted, and that an ordinance reflecting this action be brought forward. Mayor Pro Tem Young announced the public hearing on the application of Guaranty National Bank & Trust and Nolan Culp for change of zoning from "R -1B" One -family Dwelling District to "B-1" Neighborhood Business District on all of Lots L & M, Block 28, Bass Subdivision. Tom Lake located the property on the map; pointed out the zoning and land use of the area; explained that a representative of Guaranty National Bank, the co - applicant, and two other persons appeared at the Commission hearing in support of the application, and no one appeared in opposition; that thirteen notices were sent out, one return received in favor and none against; and that the recommenda- tion of the Zoning & Planning Commission was that the request be approved as sub- mitted. Nolan Culp, co -applicant, speaking in support of the application, stated he plamnedto locate a steak house on Lot M. G. L. Stewart, representing Guaranty National Bank and eight other prop- erty owners in the immediate area, spoke in support of the request on the basis that the adjoining eight acres is zoned for a shopping center and the proposed steak house will be an asset to the area. No one appeared in opposition to the request. A member of the audience and nearby property owner asked about the utility connections for the area, and the locations for the sewer line and ma}n water line proposed for the near future were explained to him. Motion by Blackmon, seconded by Roberts and passed that the recommenda- tion of the Zoning & Planning Commission be concurred in and the change of zoning from "R -1B" to 'B-1" Neighborhood Business District on all of Lots L & M, Block 289 Bass Subdivision, be granted, and that an ordinance reflecting this action be brought forward. There being no further business to come before the Council, the special meeting was adjourned.
