REGULAR COUNCIL MEETING
September 23, 1964

Mayor James L. Barnard called the meeting to order.
The Invocation was given by Commissioner J. R. de Leon in the absence
of a guest Chaplain.
Mayor Barnard welcomed to the meeting as special guests of the Council,
the Senior Civics Class of Corpus Christi Academy, their sponsor, Mr. William J.
Carter, the president of the "B" Group, Larry Gilbert, and the vice-president of
the "A" Group, Tommy Dodson.
City Secretary T. Ray Kring called the roll of those in attendance.
Motion by de Leon seconded by Blackmon and passed that the absence
of Mayor Pro Tem Jim. Young be excused for cause.
Motion by Roberts, seconded by Maldonado and passed that the minutes
of the regular meeting of September 16, 1964, be approved as furnished to the
Council.
Mayor Barnard read and presented proclamations on the following:
HIGHWAY WEEK in Corpus Christi, October 4 through 10, 1964, accepted by Mr. Tom
Foster, District Engineer for the State Highway Department; and NATIONAL PUBLIC
WORKS WEEK in Corpus Christi, September 28 to October 4, 1964, accepted by Mr.
Jack Graham, Director of Public Works for the City of Corpus Christi.
Mayor Barnard announced the opening of bids.
Bids were opened and read on construction of Stage II of the Saratoga
Drainage from the following: Slovak Brothers; Womack & Manning; Jess Edwards,
Inc.; Heldenfels Brothers; and South Texas Construction Company.
The foregoing bids were tabled for 48 hours as required by City Charter
and referred to the City Manager for tabulation and recommendation.
Bids were opened and read on Elevator Maintenance Service for three
years in the City Hall and Public Utilities Buildings, La Retama Public Library,

and Corpus Christi International Airport, from the following: Emco Elevator Co.,
Inc.; Hunter -Hayes Elevator Co.; and Westinghouse Electric Corp.
Bids were opened andread on assorted lengths and sizes of Type K Soft
Copper Tubing from the following: Ajax Supply Co.; Alamo Iron Works; Crane Supply
Co.; Metal Goods Corp.; Norvel-Wilder Supply Co.; SAMSCO; Southern Plumbing Supply
Co.; Superior Iron Works & Supply Co.; and Tropical Supply, Inc.
The foregoing bids were tabled for 48 hours as required by City Charter,
and referred to the City Manager for tabulation and recommendation.
Mayor Barnard called for the City Manager's Reports.
Motion by de Leon, seconded by Roberts and passed that the City Manager's
Reports be accepted, and the recommendations and requests be approved and granted,
as follows:
a. That the award of contract for the construction of street improve-
ments on Chippewa between Osage and Eleanor, on Cosner between Tweet and Lexing-
ton, and on Brawner Parkway at Fort Worth, to Womack and Manning in the amount of
$18,767.60 be approved; and request for appropriation of funds in the sum of
$21,000.00 be granted;
b. That the plans and specifications for the construction of Storm
Sewer installations in North and South Saxet Drives, Liberty, Victory, Granada,
and Westgate Drives be approved; and request for authority to advertise for bids
to be received on October 14, 1964, be granted;
c. That acquisition of right of way of Parcel No. 6 for Thompson Road -
Williams Ditch be approved; and request for appropriation of funds in the sum of
$366.55 be granted;
d. That acceptance and payment of final Estimate No. 1 in the amount
of $34,278.46 to Heldenfels Brothers for construction of the Hot -Mix Resurfacing
of various streets in the Downtown Area, be approved;
e. That the date of October 21, 1964, during the regular meeting, be
of
set for public hearing on the abandoning/all that surplus right of way of Timon
Boulevard east of the property line of Blocks 59, 60, 61 and 62, Brooklyn Addi-
tion, and the west right of way line of Timon Boulevard;

f. That the date of October 14, 1964, during the regular meeting, be
set for public hearing on the request for change of street name of Surf Street to
Bayshore-Baycliff;
g. That the date of October 14, 1964, during the regular meeting, be
set for public hearing on one zoning case previously set for public hearing on
September 30, 1964;
h. That the City Manager be granted leave of absence from the City on
September 28, 29, and 30, 1964, to attend the conference of the International
City Managers' Association in Chicago; and the appointment of R. Marvin Townsend
as Acting City Manager during his absence be approved.
Mayor Barnard announced that the second reading of an ordinance closing
the alley in Block 387, Brooklyn Addition, has been withdrawn from the agenda and
would not be considered at this time due to the absence of Mayor Pro Tem Young.
Mayor Barnard felt that since the ordinance had been passed at its first reading
by a split vote, the full Council should be given an opportunity to vote on the
subsequent readings.
ORDINANCE NO. 7358
AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON BEHALF OF THE CITY OF CORPUS
CHRISTI, TO EXECUTE A CONTRACT WITH WOMACK AND MANNING FOR CONSTRUCTION OF STREET
IMPROVEMENTS ON CHIPPEWA BETWEEN OSAGE AND ELEANOR, ON COSNER BETWEEN TWEET AND
LEXINGTON, AND ON BRAWNER PARKWAY AT FORT WORTH, PROJECT N0.220-64-69.8; APPROPRIAT-
ING OUT OF NO. 220 STREET BOND FUNDS THE SUM OF $21,000.00, OF WHICH AMOUNT
$18,767.60 IS FOR THE CONSTRUCTION CONTRACT AND $2,232.40 IS FOR CONTINGENCIES,
INCLUDING ENGINEERING, LABORATORY TESTING AND LEGAL ADVERTISING; AND DECLARING AN
EMERGENCY.
The Charter rule was suspended and the foregoing ordinance passed by

ORDINANCE NO. 7359
APPROPRIATING OUT OF NO. 295 STORM SEWER BOND FUND THE SUM OF $366.55 OF WHICH AMOUNT
$309.00 IS FOR ACQUISITION OF RIGHT OF WAY FOR PARCEL N0. 6, SAID PARCEL BEING MORE
FULLY DESCRIBED HEREINAFTER, AND $57.55 IS FOR TITLE EXPENSE, RECORDING FEES AND
RELATED COSTS THERETO, ALL APPLICABLE TO PROJECT 295-61-17 THOMPSON ROAD-WILLIAMS
DITCH; AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE REAL ESTATE SALES CON-
TRACT FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, FOR ACQUISITION OF SAID

ORDINANCE NO. 7360
RECEIVING AND ACCEPTING THE CONSTRUCTION, CONSISTING OF HOT -MIX RESURFACING OF
VARIOUS STREETS IN THE DOWNTOWN AREA, AS PERFORMED BY THE CONTRACTOR HELDENFELS
BROTHERS, UNDER THEIR CONTRACT DATED 29 JULY 1964, AUTHORIZED BY ORDINANCE NO.
7295; AUTHORIZING PAYMENT OF FINAL ESTIMATE NO. 1 DATED 17 SEPTEMBER 1964, IN THE
AMOUNT OF $34,278.46, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF,
SAID PAYMENT TO BE MADE FROM NO. 108 STREET FUNDS, ACTIVITY NO.4915, PREVIOUSLY
APPROPRIATED; AND DECLARING AN EMERGENCY.

ORDINANCE NO. 7361
AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH
DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565 ET SEQ OF THE
ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME, AND 2ARTICULARLY AS
AMENDED BY ORDINANCE N0. 6106, PASSED AND APPROVED ON THE 29TH DAY OF MARCH, 1961,
BY GRANTING A SPECIAL USE PERMIT ON THE EAST 50 FEET OF LOTS 9 AND 10, BLOCK 3,
NELSON ADDITION TO THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FOR OPERA-
TION OF A RADIO AND TV REPAIR SHOP, SUBJECT TO THE CONDITIONS CONTAINED HEREIN;
KEEPING IN EFFECT OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEAL-
ING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY.

ORDINANCE NO. 7362
PROHIBITING THE HITTING OF ANY GOLF BALL IN ANY PARK OR PARKWAY, DRAINAGE WAY OR
STREET AREA OF THE CITY OF CORPUS CHRISTI OR THE SHOOTING OF ANY ARROW OR ARROWS
IN ANY PARK OR PARKWAY, DRAINAGE WAY OR STREET AREA OF THE CITY OF CORPUS CHRISTI;
PROVIDING FOR PENALTY; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION AND
DECLARING AN EMERGENCY.
The Charter rule was suspended and the foregoing ordinance passed by
the following vote: Mayor Barnard, Commissioners Blackmon, de Leon, Maldonado,
Roberts and Wallace, present and voting "Aye," Young absent.
Mayor Barnard invited anyone with petitions or information for the Council
to come forward and be heard.

Mike Gonzales, precinct chairman, and Jonas Salinas, president of the West Oso

School Board, appeared in regard to the matter of the drainage situation on Villareal
Street and the access to the new John F. Kennedy Elementary School at the corner of
Rockford and Cliff Maus Drives. They explained that the children from Molina Addi-
tion travel Villareal and Bloomington Streets to where these streets end to get
to the shelled pathway between these two streets and down to the school; described
the danger of children drowning in the drainage ditch along Villareal next to the
sidewalk when it rains and when the ditch is filled with water; and urged that the
City take immediate steps to install permanent storm sewers to eliminate the hazard
of the open ditch.
It was pointed out that the Council and City Staff are well aware of the
situation which was and is being studied in an effort to try to help the area; that
the City has provided 100' of sidewalk in the most needed section along Villareal,
and in order to provide the shell pathway to the school in an attempt to help the
situation of access to the school, had obtained a revocable easement from the prop-
erty owner since he is not ready to develop or plat his property; that several of
the Council had personally viewed the situation on Villareal for about an hour
immediately after the recent heavy rain and felt that since the ditch was draining
rapidly, and not really deep enough for a school child to drown, that until such
time as the City is able to obtain the funds to provide a permanent solution, that
it is a matter of parental control to see that the children stay out of the ditch.
It was further pointed out that the matter of access to the school was not the City's
fault, since the usual procedure for locating new schools is to provide for access
on all four sides, which was not done in this instance.
On viewing the photos taken of the Villareal Ditch, several of the boys
in the Civics Class expressed the opinion the ditch was not deep enough to be really
hazardous, that a fence between the sidewalk and the ditch would not help the situa-
tion since if the parents could not keep the children from going into the ditch
they wouldn't be able to keep them from climbing the fence either, and that the
City was being very reasonable in doing what it could to help the situation.
C. P. Cayse called attention to three different streets with similar
names and house numbers, being Lexington Boulevard, Lexington Avenue, and Lexington

Road, which is causing the people who live on these streets a great deal of diffi-
culty in receiving their mail; and suggested that the house numbers on Lexington
Boulevard start at Highway 9 and continue on out to Flour Bluff, and that the names
of the other two streets be changed.
The procedure for requesting street name changes was explained to Mr.
Cayse, and the matter of the numbering of houses was referred to the City Manager
for recommendation.
Mrs. Gloria Walrath explained that her request for a permit to locate her
20' x 42' mobile home on a lot in Flour Bluff at 506 Skipper Lane had been denied;
that she had been informed the denial was based on the objection of neighbors; that
she had resubmitted her request, and had supplied the written consent of those
neighbors who had objected; and that she understood that the Council would reconsider
her request at this meeting. She explained further that her purchase of the lot was
conditioned on being allowed to locate her mobile home on the property; that a two
or three-year limitation for this use would not be helpful since this is her per-
manent mode of residence; and that she would not be considering the purchase of the
property except that all of the trailer parks in this City are very substandard as
compared to trailer parks in many other cities, both in facilities and arrangement
and size of space allotted each mobile home.
Tom Lake, Zoning Coordinator, informed the Council that the application
for an Interim Zoning Permit as resubmitted by Mrs. Walrath would be considered
by the Zoning & Planning Commission at its Tuesday night meeting, and a recommenda-
tion presented to the Council at next week's Council meeting,
Mr. William J. Carter explained that the Civics Class has been follow-
ing the matter of the closing of the alley on the Beach rather closely as a project,
and asked questions relating to the question of keeping the Beach open, the procedure
in event of future need by the City.
Noah Cunningham, Superintendent of Tuloso-Midway Independent School District,
and M, R. Snapka, resident, appeared in regard to the traffic situation in getting
the students by buses across Highway 9 and across Tuloso Road in front of the high
school, particularly between 745 and 8:30 a.m., described the very dangerous

situation of the ten buses making several trips trying to cross Highway 9 just
this side of Turkey Creek; and asked that a policeman or a highway patrolman be
stationed at these two death traps starting in the morning on every school day until
such time as a permanent control can be worked out with the City and the State,
The matter was referred to the City Manager to see what could be worked
out with the Police Chief in this regard.
There being no f=thar business to come before the Council, the meeting
was adjourned,
