Mayor James Lo Barnard. called the meeting to order
City Secretary T. Ray Kring called the roll. of those in attendance.
Motion by Roberts, seconded by young and passed that the absence of
commissioner de Leon be excused for cause,
Mayor Barnard announced the purpose of the special meeting to hold
public hearings on three zoning cases, and explained !-..te procedure to be followed.
Mayor Barnard announced. the public hearing on the application of Western
Steel Company for a change of zoning from "R -IB" One -family Dwelling District to
"I-2" Light Industrial District on a 65.4 acre tract, ihcludlng Lnt 11, 12, 13
and those portions of Lots 20, 21 & 22, located adjacent to the northerly right of
way line of Wooldridge Road, Section 4, Flour Bluff and Encinal Farm and Garden
Tracts,
T�2 Lake, Zoning coordinator, located, the property on the map; pointed
out the zoning and land use of the area, stated that Mr. George Gaines appeared
in support of the application. at the Commission hearing, and. W. J. W. Gary,
attorney, appeared in opposition to the rezoning; that 6 notices were mailed out,
no replies were received either for or against, but that 8 letters were received
in opposition from interested parties; and that the recommendation of the Zoning
& Planning Commission was that the change of zoning be denled but that in lieu a
Special Permit for a rodeo, riding stable complex and. other uses customarily in-
cident thereto, be approved subject to the following conditions2 (1) Compliance
to plot plan of the existing structures and facilities as submitted bythe appli-
cant; (2) That outdoor lighting be erected in such manner that it be directed
away from adjacent residential uses; (3) That no new stables, animal facilities,
signs, or other new construction be erected without amendment of this permit and
that such construction. not be erected. within 100 feet of outside boundary lines;
(4) That thenoise level emanating from the public address system and related

components shall not be permitted to such an extent that it would be offensive to
a person or ordinary sensibilities at any point beyond the existing outside bound-
ary lines; (5) That signs be limited to not more than one free-standing sign of the
non -illuminated, non -electric, non. -flashing type, of not more than 100 square feet
1n size, not more than 12 feet in height to top of sign, and located not less than
100 fee from outside boundary line; and that such sign pertain only to the uses on
the property; (6) That this permit expire five years from the date of passage of
ordinance granting same; provided., however, that this permit be voided at any time
that the above conditions are not complied with; and (7) That all the conditions
and limitations of said permit shall be finding on the present owner of the subject
property, his heirs, assignees, and/or successors in title, for the duration of the
entire life of said permit.
George Gaines, Vice President of Western Steel Company, briefly reviewed
the background of ownership and use of the subject property as Boots and Spurs, Inc,,
presently called Western Corral, the company's desire to complete the construction
of a large steel 'building intended for an indoor arena as it was uneconomical to
leave it unusable; and explained that the company could accept the Special Permit
for the existing operation provided they were allowedsome flexibility for future
expansion and development, but objected to the 5 -year time limitation, and to the
recommended conditions as to additional construction, noise level, and signs.
Roy Caldwell., representing John and George Hawn, spoke in opposition to
any rezoning of the subject property on the basis of incompatibility with the golf
course operation and plans for future residential developments in the area, but did
not object to the present operation or to the granting of a special permit provided
there were restrictions on future expansion of the operation and on new construc-
tion on the site.
John Keitner, associated with Hawn Brothers, pointed out that the site
plan presented was an approved preliminary plat, and displayed an aerial photograph
to show that the golf course was under construction at the time the site plan was
approved; and William Anderson, attorney, pointed out that in the zoning of so
large an area there is going to be spot zoning unless there is a comprehensive plan.

Motion by Wallace, seconded by Roberts and passed that the hearing be

Motion by Roberts, seconded by Young and passed, with Wallace voting
"Nay," that the "1-2" zoning be denied on the 65,4 acre tract including Lots 11,
12 & 13 and portions of Lots 20, 21 & 22, Section 4, Flour Bluff and Fncinal Farm
and Garden Tracts, but in .lieu a Special Permit for a rodeo, riding stable complex
and other uses customarily incident thereto, be granted. subject to compliance to
the plot plan of the existing structures and. facilities as submitted by the appli-
cant.
Mayor Barnard announced the public hearing on the application of We H.
Hammonds for a change of zoning from "R -LB" 0ne-family Dwelling District and "B-1"
Neighborhood Business District to "A-19° Apartment House_ District on all of Sunny -
brook Addition No, 2, save andexcept that portion occupied by Southwestern Bell
Telephone Company facilities, located on the northwest right of way line of
Kostoryz Road,
Tom Lake located, the property on the map; pointed out the zoning and
land use of the area; stated that the applicant appeared at the Commission hearing
in support of his request, and no one appeared in oppos:Y.tion; that 47 notices were
sent out, 3 replies received in favor and none against, and one letter received in
opposition following the public hearing; and that the recommendation of the Zoning
& Planning Commission was that the change of zoning be approved on that portion of
the subject property which is presently zoned."R-1B" and that the remainder of the
request be denied.
W. H. Hammond, speaking in support of his request,, stated that he plans
to build moderate priced apartments for which there is quite a demand in that area;
that he intends to fence in the whole property; that he plans a swimming pool away
from the single-family homes; and that no buildings will be closer than 40° to the
single-family residence property lines. He pointed out further that he believed
there was some slip-up in the property description since there was no need for de -
zoning the presently zone3 "B-1" portion of the property.

NO one appeared in opposition.
The letter from the property owner at 4634-4630 Kostoryz, which had been
received in opposition following the Commission hearing was read, to the effect
that the "B-1" zoning along Kostoryz should be maintained in order to keep the
value of the property high, and that the change of zoning might interfere with
their future plans.
Motion by Roberts, seconded by Blackmon and passed that the hearing be
closed.
Motion by Young, seconded by Maldonado and passed that the recommendation
of the Zoning & Planning Commission be concurred in, and that an ordinance be
brought forward changing the zoning on that portion of Sunnybrook Addition No. 2,
save and except that portion occupied by Southwestern Bell Telephone Company facil-
ities, presently zoned "R -1B" to "A-1" Apartment House District, and that the por-
tion of the property presently zoned "B-1" along Kostoryz Road, remain as is,
Mayor Barnard announced the public hearing on the application of The
Wilson Investment Company for change of zoning from "R -1B" One -family Dwelling
District to "A-1" Apartment House District on all of Park Terrace Unit #3, includ-
ing Lots 13 through 22, located on the northwest right of way line of Lavaca Drive
at McArdle Road.
Tom Lake located the property on the map; pointed out the zoning and
land use of the area; stated that Mr. J. M. Wilson had appeared in support of the
company's application at the Commission hearing, that approximately 15 persons had
spoken in opposition to the request; that 36 notices were sent out, no replies
were received in favor, but 17 in opposition, plus one received after the hearing;
and that the recommendation of the Zoning & Planning Commission was that the re-
quest be denied on the basis that it wouldbe detrimental and would constitute en-
croachment into a desirable and well -kept existing residential neighborhood.
Ed Highfill, Lot 11, Block 6, Park Terrace, Unit 1, at 4802 Trinity Drive,
speaking for approximately a dozen property owners present, spoke in opposition to
the request on the basis that the residents are virtually all property owners, with
very few renters, and desire to maintain the well -kept one -family residential Char-
acter of the area; the on -street parking increase; and the increase in traffic by

approximately 5 times the present use; the increased u.se of water, thereby lower-
ing the water pressure; and the increased sewage situation, thereby overloading the
sewage line; and that according to information received by these property owners
from the City Engineer and the F.H.A., the sanitary fill area included in the sub-
ject description belongs to the City.
No one appeared in support of the application.
Motion by Wallace, seconded by Roberts and passed that the hearing be
closed.
Motion by Wallace, seconded by Roberts and passed that the recommendation
of the Zoning & Planning Commission be concurred in, and the application be denied.
City Manager Whitney reported that the Exposi+tion Hall is engaged for the
evening of November 17 by the Ray High School Band Mothers, Club, and suggested
the use of the south concourse of the Coliseum for the joint public hearing with
the Zoning & Planning Commission on the Text Changes to the Zoning Ordinance, on
which the date and place of public hearing was set at the regular meeting.
Motion by Roberts, seconded. by Young and passed that the City Secretary
be instructed to change the wording of the motion in the minutes of the regular
meeting of this date to reflect that the joint public hearing on the Text Changes
will be held in the south concourse of the Coliseum, instead of the Council Chamber.
City Manager Whitney reported receipt of a letter from Mro J. Be Trimble,
attorney representing Econo-Car Rental., requesting that the lease agreement at
International Airport be terminated, and recommended that the request be approved,
and that the lease and rental be adjusted on a pro rata basie.
Motion by Wallace, seconded by Roberts and passed, with Mayor Pro Tem
Young abstaining, that the lease agreement with Economy Car Rentals of Corpus
Christi, Inc, for space at International Airport for a, driverless automobile busi-
ness, be terminated as requested, and that adjustment in the lease and rental
charges be made on a pro rata basis.
There being no further business to come before the Council, the special
meeting was adjourned.
