Ray Kring Mayor James L. Barnard called the meeting to order. The Invocation was given by W. Gene Glaeser of Windsor Park Church of City Secretary T. Ray Kring called the roll of those in attendance. Motion by Young, seconded by de Leon and passed that the minutes of the regular meeting of October 28, 1964, at 2 p.m., and of the special meeting of the same day at 4 p.m., be approved as furnished to the Council. Mayor Barnard recognized and welcomed as special guests of the Council, representatives of the Student Council of Ella Barnes Junior High School and their sponsor, Mrs. Capps Adams; and Commissioner de Leon awarded Certificates of Attend- ance designating as Honorary Junior City Commissioners, the following: Roy Garcia; Berto Guerra; Carol Gutierrez; Obidio Hernandes; and Paul Barbosa. Mayor Barnard read and presented proclamations relative to the following: BOBBY MORROW DAY in Corpus Christi, November 12, 1964, accepted by Mr. Gene Glaeser of Windsor Park Church of Christ, in connection with the Youth Rally at which Bobby Morrow, all time great athlete, Mayor Louie Welch of Houston, and others are to participate in the series of lectures; DISTRIBUTIVE EDUCATION WEEK in Corpus Christi, November 8 through 14, 1964, in recognition of the 19th Annual Leadership Conference of the Texas Association of Distributive Education Clubs of America, accepted by four local student members of the Association. Mayor Barnard announced the opening of bids. Bids were opened and read on a 72 week contract for Uniform Rental Service for Utilities Department from the following: Model Industrial Uniform Service; Texas Industrial Laundries; and Work Clothes Rental Service Co. The foregoing bids were tabled for 48 hours as required by City Charter, and referred to the City Manager for tabulation and recommendation. • City of Corpus Christi, Texas Regular Council Meeting November 4, 1964 Page 2 Mayor Barnard announced the pending item of the application for abandon- ing a portion of Niagara Street between Heinley and Morgan, on which public hearing was held October 14, 1964. Motion by Wallace, seconded by Maldonado and passed that the portion of Niagara Street between Heinley Street and Morgan Avenue, described as a portion of Niagara Street dedicated by plat of Segrest Addition recorded in Vol. 6, Page 7, Map Records of Nueces County, and a portion of Niagara Street lying northwest of and adjacent to Block 1600 Bay Terrace No. 2, as shown by map or plat of record in Vol. A, Page 26, Map Records of Nueces County, be closed except for use for utility pipes and lines. Mayor Barnard announced the public hearing on the application of Southern Minerals Corporation for permit to drill and operate Well #12, Anton Ocker Lease, located in Section 8, Range 5 of the Sectionized Lands of H. L. Kinney, Deceased, Saxet Field, Nueces County. City Manager Whitney located the well on a sketch map as being north of Leopard between Leopard and Up River Road, and to the west of Southern Minerals Road; stated that the required documents were submitted by the applicant; that the location of the proposed well has been checked out by the Public Works Department and complies with the provisions of the ordinance; and that applicant is not re- questing any exceptions. Mr. Whitney explained this is a request to re-enter an abandoned well to drill to a new depth. No one appeared to speak either for or against the application. Motion by Roberts, seconded by de Leon and passed that the hearing be closed. Motion by de Leon, seconded by Maldonado and passed that the application of Southern Minerals Corporation for permit to drill and operate Well #12, Anton Ocker Lease, located in Section 8, Range 5 of the Sectionized Lands of H. L. Kinney, Deceased, Saxet Field, Nueces County, be granted. Mayor Barnard called for the City Manager's Reports. Motion by Roberts, seconded by Maldonado and passed that the City Mana- ger's Reports be accepted and the recommendations and requests be approved, as follows: City of Corpus Christi, Texas Regular Council Meeting November 4, 1964 Page 3 a. That the award of contract for construction of Street Improvements at the southwest corner of Leopard Street and Port Avenue, on the basis of low bid, to Zachry Construction Company in the amount of $11,446.50, be approved; and the request for appropriation in the sum of $13,000.00 for this project, be granted; b. That authority to advertise for bids to be received on November 18, 1964, on a total of 36 automatic Control Panels, be granted; c. That the acquisition of Parcel #1, right of way for 19th Street exten- sion to Morgan, from Fred Frank and wife, Velma Frank, for the sum of $11,650.00, plus the conveying to them by the City of that portion of Niagara abutting their property proposed to be closed, be approved; and that appropriation in the sum of $11,870.70 be granted; d. That agreement with Corpus Christi State National Bank for the beauti- fication of the sidewalk area along Schatzel Street abutting their property by the planting of trees or palms be approved under the same provisions as set forth in similar agreements previously granted; e(1). That the request of Vaughn Plaza Reproduction Service, Inc. for termination of the present 12 months' contract for Blueprint Service on the basis of their going out of business, be granted; and that a contract for the remainder of the existing contract to L. L. Ridgway Company, Inc. for furnishing Blueprint Service for 9 months for $2,539.00 be approved; (Bid Tabulation #37) e(2). That the request of Great Texas Lumber Company for termination of the present 12 months' contract for Lumber and Survey Stakes on the basis of their going out of business, be granted; and that a contract for the remainder of the ex- isting contract to West Side Lumber Company for Lumber and Survey Stakes, Lot I, for 9 months for $4,572.00 be approved; (Bid Tabulation #38) e(3). That the request of Superior Iron Works and Supply Company, Inc. for termination of the present 12 months' contract for copper tubing on the basis of increases by manufacturers making their cost higher than the prices quoted, be granted; and that a contract to Ajax Supply Company for 15,000° of 3/4", 1,000° of 14", and 500' of 2" Type K Soft Copper Tubing for $7,171.93, be approved; (Bid Tab- ulation #39) f, That the date of Wednesday, November 25, 1964, at a special meeting convening at 3:30 p.m., be set for public hearing on 6 zoning cases. Walton, Jr. for a permit to rework, operate and produce an oil and/or gas well identified as W. W. Walton Well #B-2, Enrique Villareal Survey, Saxet Field, Nueces County (formerly designated as Southern Minerals Corporation #B-2 We w. Walton); and that notice of hearing is not requiredon this application° With the consent of the Council, Mayor Barnard announced the Council would at this time hold a public hearing on the application, City Manager Whitney pointed out the location of the well on the north Side of Leopard east of Southern Minerals Road on a sketch of the site; stated the necessary documents are in order in accordance with the ordinance; that the only variances specifically mentioned are for dual completion; that the applicant plans to re-enter the well and develop the well in the shallow sand; and that it is his understanding from City Attorney Singer that the circumstances as indicated are not specifically covered by our ordinance. The applicant pointed out that several producing wells have been brought in in the area; that he wants to test two sands and is asking for variances to per- mit dual completion because he does not know whether it is economically feasible to recover oil out of both sands; that it is possible the amount of oil to be recovered will not justify the drilling of a new well but would be profitable if new produc- tion could be obtained from the same well; that the well was actually existing, op- erating, and capable of producing at the time of annexation; and requested that he be granted permission to test both sands to see which one is productive. There followed some discussion among the Council of the need to revise the drilling ordinance as' soon as possible to recognize modern drilling methods. Motion by Roberts, seconded by de Leon and passed that the permit be granted for the testing of the two sands and the completion of the one of his choice. ORDINANCE NO, 7407 AUTHORIZING AND DIRECTING THE CIT' MANAGER, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A CONTRACT WITH ZAOHR! CONSTRUCTION COMPANY FOR THE CONSTRUCTION OF THE LEOPARD STREET .IMPROVEMENTS (RIGHT TURN LANE AND TRAFFIC ISLAND) AT THE SOUTH- WEST CORNER OF LEOPARD AND PORT AVENUE, PROJECT NO. 220-64-65; APPROPRIATING OUT OF NO. 220 STREET BOND FUND THE SUM OF $13,000 OF WHICH AMOUNT $11,446.50 IS FOR THE CONSTRUCTION CONTRACT AND $1,553.50 IS FOR CONTINGENCIES, INCLUDING ENGINEERING, LAB- ORATORY TESTING AND LEGAL ADVERTISING; AND DECLARING AN EMERGENCY, • City of Corpus Christi, Texas Regular Council Meeting November 4, 1964 Page 5 The Charter rule was suspended and the foregoing ordinance was passed by the following vote; Barnard, Young, Blackmon, de Leon, Maldonado, Roberts, and Wallace all present and voting "Aye." ORDINANCE N0. 7408 AN ORDINANCE APPROPRIATING OUT OF N0. 220 STREET BOND IMPROVEMENT FUND THE SUM OF $11,870.70, OF WHICH $11,650.00 IS FOR THE PURCHASE OF PARCEL N0. 1, AND $220.70 IS FOR TITLE EXPENSE AND RELATED COSTS, APPLICABLE TO PROJECT N0. 220-56-27, 19TH STREET CONNECTION TO MORGAN, AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE REAL ESTATE SALES CONTRACT FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, FOR THE ACQUISITION OF SAID PARCEL FROM FRED FRANK AND Wilot, VELMA FRANK, FEE OWNERS, AND 0. D. SMITH, LESSEE, AT THE PURCHASE PRICE THEREIN STATED; AND DECLARING AN EMER- GENCY. The Charter rule was suspended and the foregoing ordinance was passed by the following vote: Barnard, Young, Blackmon, de Leon, Maldonado, Roberts,. and Wallace all present and voting "Aye." RESOLUTION N0. 7409 THAT IMMEDIATE STEPS BE TAKEN TO REMOVE RESTRICTION ON RIGHT OF SUFFRAGE BY MEMBERS OF THE ARMED FORCES. The Charter rule was suspended and the foregoing resolution was passed by the following vote; Barnard, Young, Blaclonon, de Leon, Maldonado, Roberts, and Wallace all present and voting "Aye." ORDINANCE N0. 7410 CLOSING A PORTION OF NIAGARA STREET BETWEEN HEINLEY STREET AND MORGAN AVENUE IN THE CITY OF CORPUS CHRISTI, TEXAS; AND DECLARING AN EMERGENCY. The Charter rule was suspended and the foregoing ordinance was passed by the following vote: Barnard, Young, Blackmon, de Leon, Maldonado, Roberts, and Wallace all present and voting "Aye." ORDINANCE N0. 7411 CLOSING THAT PORTION OF PRESCOTT STREET BETWEEN 18TH AND 19TH STREETS AT THE CROSS- TOWN EXPRESSWAY, IN THE CITY OF CORPUS CHRISTI, TEXAS; AND DECLARING AN EMERGENCY. The Charter rule was suspended and the foregoing ordinance was passed by the following vote: Barnard, Young, Blackmon, de Leon, Maldonado, Roberts, and Wallace all present and voting "Aye." ORDINANCE NO. 7412 AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE AND DELIVER, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, AN AGREEMENT WITH CORPUS CHRISTI STATE NATIONAL BANK, A NATIONAL BANKING ASSOCIATION WITH PRINCIPAL OFFICES IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, PROVIDING FOR THE BEAUTIFICATION OF THE SIDEWALK AREA BY THE PLANTING OF TREES OR PALMS ALONG THE NORTH CURB LINE OF SCHATZEL STREET, FROM WATER TO SHORELINE, A COPY OF WHICH AGREEMENT IS ATTACHED HERETO AND MADE A PART HEREOF; AND DECLARING AN EMERGENCY. rik City of Corpus Christi, Texas Regular Council Meeting November 4, 1964 Page 6 The Charter rule was suspended and the foregoing ordinance was passed by the following vote: Barnard, Young, Blackmon, de Leon, Maldonado, Roberts, and Wallace all present and voting "Aye." Mrs. H. D. Horton, Rev. Burkner of Grace Methodist Church, and Charles Cornett, Superintendent of Schools at Calallen, and other representatives of the Calallen-Annaville area, described the traffic situation and speed limits along the highway through the area to the Westwood Shopping Center. They were particularly concerned with the problem of the school buses at the intersection of Violet Road, Starlite Lane, and Rand Morgan Road in getting across the highway traffic to get to the School; mentioned that they had hired School Crossing Guards, and asked if some kind of authority could be given them to slow down the traffic along this high- way through this area, and particularly at the crossings for the safety of the children; and asked if some program could be worked out for City Patrol Cars or State Highway Patrol Cars for this area, at least for peak hours. The matter was discussed, and Mrs. Horton stated that Capt. Weeks and Mr. Oliver of the State Highway Dept. had suggested she bring the matter to the attention of the City Council and that they would confer with Mr. McLeroy. City Manager Whitney informed the Council that he has already asked Mr. McLeroy, Traffic Engineer, and Lt. Melton of the Police Traffic Safety Dept., to make an immediate survey in this respect, which they have already started; that they have been in contact with the State Highway Dept. on the matter; and that he hopes to have a report and some specific recommendation by next week; and that these School Crossing Guards can undoubtedly be given the same authority that those employed by the City have. City Manager Whitney presented the first copy of the presentation to be submitted by the City to the Corps of Engineers in connection with the hearing on Corpus Christi Beach Restoration and Protection to be held November 5, 1964, at 10 a.m. commissioner Blackmon suggested that since the Council by Resolution passed at this meeting, has assisted in initiating some corrective reforms in election procedure regarding military personnel, that the members of the Council be considering the matter of legislation to allow General Elections to be held on a Saturday rather than the first Tuesday after the first Monday in November, to • • City of Corpus Christi, Texas Regular Council Meeting November 4, 1964 Page 7 alleviate the problem some voters have in getting to the Polls on a working day and the inconvenience to the Schools in providing Polling Places during school hours. Motion by Blackmon, seconded by Roberts and passed that the meeting be adjourned.
