Wallace, Jr, CITY OF CORPUS CHRISTI, TEXAS REGULAR COUNCIL MEETING November 18, 1964 2:00 p.m. City Manager Herbert W. Whitney City Attorney I. M. Singer City Secretary T. Ray Kring Mayor James L. Barnard called the meeting to order. The Invocation was given by Commissioner J. R. de Leon. City Secretary T. Ray Kring called the roll of those in attendance. Motion by de Leon, seconded by Maldonado and passed that the minutes of the regular meeting of November 11, 1964, be approved as furnished to the Council. Mayor Barnard welcomed as special guests of the Council, representatives of the Student Council of Cullen Junior High School, and their sponsor Mr. James Schunke; and Mayor Pro Tem Young presented Certificates of Attendance designating them as Honorary Junior City Commissioners, to the following: Randy McManus; Barbara Nisenson; Sherry King; Sally Kurzner, David Welch; Mike Forbes; Ricky Morrell; and Beth Young. Mayor Barnard read a proclamation proclaiming Sunday, November 22, 1964, as JOHN F. KENNEDY DAY IN MEMORIAM in Corpus Christi, requesting the people of this City to solomnly reflect upon the high ideals of this great American, and in our charity, ask God's forgiveness of the transgressions he may have committed through the mortal nature of man. The proclamation was accepted by Mr. Alfred N. Nicolas who extended an invitation for everyone to attend the Memorial Service at the Corpus Christi Cathedral at 6 p.m. on the anniversary of the death of our beloved late President John Fitzgerald Kennedy. Mayor Barnard announced the opening of bids. Bids were opened and read on 2 items of Control Panels from the follow- ing: Goldthwaite's of Texas, Inc.; McAllen Pipe & Supply Co., Inc.; March Irriga- tion & Supply Co.; South Texas Lawn Sprinkler Co.; and Telsco Industries. The foregoing bids were tabled for 48 hours as required by City Charter, and referred to the City Manager for tabulation and recommendation. • • City of Corps Christi, Texas Regular Council Meeting November 18, 1964 Page 2 Mayor Barnard announced the public hearing on the application of Sirtex Oil Industry, Inc. for a Permit to Drill and Operate Wells Nos. 6 & 13, F. Quiroz Lease, Nueces County. City Manager Whitney presented a map showing the right of way of Inter- state 37 and the intersection of Tuloso Road where it crosses the right of way; the location of the two wells which the applicant proposed to re-enter and drill to approximate depths of 5825' and 7012'; explained that the necessary documents with regard to insurance and Railroad Commission Permit for these wells and state- ment regarding required distance from any buildings, structures or public roads have been submitted; that Mr. Harry Coons of the Right of Way Division of the Highway Department has indicated that he would not be present or offer any opposi- tion; and that no variances were being requested. In answer to questions from the Council, Perry Burkett, attorney, and Mr. Bates, representing Sirtex Oil Industry, Inc., stated that there are seven other producing wells in this company's program in the Saxet Field area; that these were producing wells which were plugged in 1961, and will be re-entered and drilled to the new depths; and that they are working with the State for the construction of one master tunnel for lowering the various pipelines in the area. No one appeared in opposition to the application. Motion by Roberts, seconded by Young and passed that the hearing be closed. Motion by Wallace, seconded by Roberts and passed that Sirtex Oil Industry, Inc. be granted a permit to drill and operate Wells Nos. 6 & 13, F. Quiroz Lease, Nueces County, as applied for. Mayor Barnard announced the public hearing on the application of Socony Mobil Oil Co., Inc. for Permit to Drill and Operate Well No. 7, Weil "C" Lease, Saxet Field, Nueces County. City Manager Whitney presented a map showing the location of this well approximately 120' from the right of way of Acme Road just north of the Tex-Mex track, 2 photos showing the unimproved nature of the land; and pointed out that the applicant was requesting waiver of the distance requirement as to public roads, • City of Corpus Christi, Texas Regular Council Meeting November 18, 1964 Page 3 and variance for the use of earthen reserve pits rather than steel tanks for their slush pits, and use of 1000 feet of surface casing as the Texas Water Commission has advised that water bearing strata down to 100 feet must be protected; and ex- plained that the proposed depth is 8000 feet, and it is proposed to case to 1000 feet with 10-3/4" casing and 7650 feet with 7" casing. Mr. Whitney stated that the well location does not conflict with the airport zoning regulations. In answer to questions from the Council, Mr> Henry Ince, representing the applicant, stated that there is plenty of area off the road for any equipment in- volved with the well operation which should be more than a safe distance from the motoring public using the road, but that there is not any practical way of sealing the area off from the roadway. No one appeared in opposition to the application. Motion by Young, seconded by Roberts and passed that the hearing be closed. Motion by Young, seconded by Roberts and passed that Socony Mobil Oil Co., Inc. be granted a permit to drill and operate Well No. 7, Weil "C" Lease, Saxet Field, Nueces County, with the requested distance waiver and variances as applied for. Mayor Barnard called for the City Manager's Reports. Motion by de Leon, seconded by Roberts and passed that the City Manager's Reports be accepted, and the recommendations and requests be approved and granted, as follows: a. That the plans and specifications for the construction of the connec- tion of 19th Street from the Crosstown Expressway to Morgan Street be approved; and that authority to advertise for bids to be received on December 9, 1964, be granted; b. That a contract with the architectural firm of Greene & Terry to pre- pare plans and specifications for the proposed swimming pool and recreation center at Meadow Park, on the basis of 57, on the construction cost of the pool and ac- cessories, and 6% on the recreation buildings and bathhouse, be approved; and the request for appropriation in the sum of $6,300.00, be granted; City of Corpus Christi, Texas Regular Council Meeting November 18, 1964 Page 4 • c, That authority to advertise for bids to be received on December 2, 1964, on 22 items of mobile radio equipment, one portable unit and one monitor receiver, be granted; d. That the report of the Tax Collector -Assessor, certified to by the members of the Board of Equalization, of the recapitulation of the Tax Roll for the year 1964, showing a total assessed valuation of $473,529,511.00, and based on a tax rate of $1.64 per $100 assessed valuation, showing a total tax levy of $7,765,884.66, be accepted and approved; e. That the date of December 9, 1964, at a special meeting convening at 4 p.m., be set for public hearing on 6 zoning cases; f. That the recommendation of the Aviation Committee of the Chamber of Commerce for the annual SALUTE TO AVIATION to be held under the same sponsorship and general arrangements as the past two years for one day instead of two days, and for the selection of the tentative date of Sunday, July 4, 1965, be accepted and approved. Homer Moore, representing the OCAW Union, asked if City Manager Whitney was going to give his report on the matter of the petition of the OCAW Union re- garding their strike against the Hess Oil Company. City Manager Whitney informed the Council that he was ready to give his report on the foregoing matter at this time if the Council so desired, but that he preferred making his report first to the Council at a Work Shop. Motion by Roberts, seconded by Maldonado and passed that the City Managers report on this matter be received first by the City Council. Homer Moore stated that as an official of OCAW he would like to receive a report on the petition, and Mayor Barnard explained that the matter would un- doubtedly be reported by the Press, but that Mr. Moore would be given a report. Mayor Barnard called for the reading of the proposed ordinance listed on the agenda as Item "d", which was done, MAKING IT UNLAWFUL FOR ANY PERSON, FIRM, ASSOCIATION, OR CORPORATION TO WITHHOLD FROM OR DENY ANY PERSON BECAUSE OF RACE, COLOR OR ETHNIC ORIGIN, ANY OF THE ADVANTAGES, FACILITIES OR SERVICES OFFERED TO THE GENERAL PUBLIC BY A PLACE CF PUBLIC ACCOMMO- DATION; DEFINING THE TERMS USED IN THIS ORDINANCE; PROVIDING FOR THE APPOINTMENT OF City of Corpus Christi, Texas Regular Council Meeting November 18, 1964 Page 5 A HUMAN RELATIONS ADMINISTRATOR; ESTABLISHING ADDITIONAL DUTIES FOR THE HUMAN RELATIONS COMMITTEE; SETTING FORTH RESTRICTIONS APPLICABLE TO THE SUBJECT; PRO- VIDING FOR PENALTY; PROVIDING A SEVERABILITY CLAUSE; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR PUBLICATION. Ben F. McDonald, former Mayor and Chairman of the Human Relations Com- mittee, spoke in support of the ordinance, explained the function of the Human Relations Committee, and complimented the Corpus Christi Caller -Times Publishing Company on their editorial and its clear explanation of the proposed ordinance, which he read to the Council. Mr. McDonald requested permission to appoint as ex -officio member of the Committee on Human Relations, Mr. James R. Hill, owner of Ship Ahoy restaurant, member of the State Board of Directors of the Texas Restaurant Association, and State. Education Chairman of the Association on Race Relations. It was his opinion that a representative of the local Restaurant Asso- ciation would be helpful in the program of Human Relations. Mayor Barnard, with the consent of the Council, approved the request for permission to include Mr. James R. Hill as an ex -officio member of the Committee on Human Relations. Dr. H. G. Williams, Rev. Harold T. Branch, and Mr. S. S. Sampson each spoke in support of the foregoing ordinance, and urged its passage, and expressed appreciation for the work of the Human Relations Committee. On vote, the foregoing ordinance was passed to its second reading by the following vote: Barnard, Young, de Leon, Maldonado, Roberts, and Wallace all present and voting "Aye," and Blackmon absent. Mayor Barnard, with the consent of the Council, directed that the third reading of the ordinance with reference to the closing of the alley in Block 387, Brooklyn Addition, be postponed for one week due to the absence of a full Council. SECOND READING OF AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE A LEASE FOR THREE YEARS WITH CORPUS CHRISTI COUNCIL FOR RETARDED CHILDREN FOR RENTAL OF PARKWAY HOUSE FOR GIRLS FOR $1.00 PER YEAR AND OTHER CONSIDERATION, A COPY OF WHICH LEASE IS ATTACHED HERETO AND MADE A PART HEREOF. The foregoing ordinance was read for the second time and passed to its third reading by the following vete.: Barnard, Yvnng, de Leon, Maldonado, Roberts, and Wallace all present and voting "Aye," and Blackmon absent. City of Corpus Christi, Texas Regular Council Meeting November 18, 1964 Page 6 ORDINANCE NO. 7418 1 AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI TO EXECUTE AN ARTHITECTURAL CONTRACT WITH THE FIRM OF GREENE AND TERRY FOR THE PREPARATION OF PLANS AND SPECIFICATIONS FOR RECREATIONAL FACILITIES IN CONNEC- TION WITH THE DEVELOPMENT OF MEADOW PARK, A COPY OF WHICH CONTRACT IS ATTACHED HERE- TO AND MADE A PART HEREOF; APPROPRIATING OUT OF NO. 291 PARK BOND FUND THE SUM OF $6,300 FOR ARCHITECTURAL FEES, AND RELATED CONTINGENCIES INCLUDING SOIL TESTING AND SURVEYS, APPLICABLE TO PROJECT NO. 291-64-2.1; AND DECLARING AN EMERGENCY. The Charter rule was suspended and the foregoing ordinance was passed by the following vote: Barnard, Young, de Leon, Maldonado, Roberts, and Wallace all present and voting "Aye," and Blackmon absent. Motion by de Leon, seconded by Roberts and passed that the absence of Com- missioner J. R. Blackmon be excused for cause. The student guests in the audience asked questions concerning the proposed swimming pool and facilities for Meadow Park adjacent to Ella Barnes Junior High School; and the suggestiais which will have to be worked out with the School Board were explained, for participation in the project by the School and that the pool be glass -enclosed and heated for use by Ella Barnes School during the winter months in connection with their Physical Education program, and operated as an open-air City pool during the summer, and the possible enlargement of the program for other areas of the City adjacent to schools. Perry Sherman, long-time resident, complimented both the Council and City Manager on their accomplishments for the City; said that for anyone to stand on Shoreline looking at the Bay and be able to see the signs on the motels and busi- nesses at the same time they would have to have eyes in the back of their head, so he could not see that the signs were detracting from the view, and gave an example in another state of how lighted buildings can attract people; and spoke of a study the City had had made some years ago on the feasibility of using distilled water from the Bay for the City's water needs, the recent experiments along these lines, and suggested that the City investigate the matter further in the light of new in- formation. Mayor Barnard mentioned the experimental plant at Freeport, and commented that if it is found practical, the City will have a good supply. There being no further business to come before the Council, the meeting was adjourned.
