Whitney Asst City Att'y Wayland Pilther City Secretary T, Ray Kring Mayor James L, Eard called the special meeting to order. City Secretary T. Ray Kring called the roll of those in attendance. Motion by de Leon, seconded by Young and passed that the absence of Commissioner M. P. Maldonado be excused for cause. Mayor Barnard announced the purpose of the special meeting to hold public hearings on six zoning cases, and explained the procedure to be followed. Mayor Barnard announced the public hearing on the application of Plato Brothers, Inc. for a change of zoning from "R -1B" One -family Dwelling District "A-2" Apartment House District on a 22,2 -acre tract, more or less, out of Lots 9 and 16, Section. 5„ Range VIII, Gugenheim & Cohn Farm Lots. Tom Lake, Zoning Coordinator, located the property on the map; pointed out the zoning and land use of the area; stated that Mr, Ian Naismith had repre- sented the applicants at the Commission hearing; that 16 letters were sent out, no replies were received in favor, and one in opposition to the request; and that the recommendation of the Zoning & Planning Commission was that the request be denied but that "A-1" zoning be approved; and explained further that the Commission had felt that the density on the subject property would be of utmost concern, Ian Naismith, representing the applicant° explained the extensive owner- ship of the applicants., that their We Haven residential subdivision pretty well covers the market for single family dwellings in the area, and that they were satisfied with the recommended "A-1" zoning for the present plans, but that the higher density zoning night be needed at some later date; and pointed out the ex- isting adjacent "B-1" and "I-2" coning of their master plan for the general area. No one appeared in opposition to the request. Motion by Wallace, seconded by Roberts and passed that the hearing be to closed, • City of Corpus Christi, Texas Special Council Meeting November 25, 1964 Page 2 Motion by Roberts v aecondA.d by Blackmon and passed that the recommenda- tion of the Zoning & Planning Commission he accepted, and an ordinance be brought forward reflecting a change of zoning from "R -1B" One -family Dwelling District to "A-1" Apartment House District on the 22,2 -acre tract out of Lots 9 and 16, Section 5, Range {VIII, Gugenheia & Cohn Farr Lots described in the application, Mayor Barnard armour c^ed the public hearing on the application of Don Davis for a change of zoning from "A.-1" Apartment House District to "AB" Profes- sional Office Districl on all of Lot 1., Block 3, South Park Addition, Tom Lake located the property on the map; pointed out the zoning and land use of the area; stated that Nt, Ian Naismith and the applicant were present at the Commission hearing in support of the application, and two persons spoke in opposition; that 23 letters were sent out, 3 returns were received in favor, and 3 in opposi- tion to the request; and that. the recommendation of the Zoning & Planning Commis- sion was that the request be dented. but that in lieu a Special Permit authorizing the operation of a builder's sales o Tice he approved subject to the following conditions: (1) That there be no alterations to the existing exterior of the building; (2) That the residential character of the property be maintained; (3) That outdoor advertising consist: of not more than one 4 sq.ft. sign, that it be non -illuminated, flat against the wall of the building and not protrude above the eave line; and (4) That the permit be limited to a time period of two years. Ian Naismith, representing the applicant, pointed out that this is the only residence that fronts on Lexington along the length of the Expressway, that Mr, Davis wants to use the existing house for his personal office and for an office for sales people, and that the recommended Special Permit and the four con- ditions are satisfactory to the applicant for his purposes and will maintain the residential character of the. area. Mrs, Long, in aupporr of the application, stated she desired to occupy an exchange office and real estate saes office in the building and did not anti- cipate more than two or three cars at one time in connection with her use, Mrs, C, E, Brown, 5041 Con ord, and Mr, Sam F. Sovey, 550 Breckenridge Drive, both appeared in supportof the request on the basis of the improvement to • City of Corpus Christie Texas Special Council Meeting November 25, 1964 Page 3 the property which would increase the land value, ir, the immediate area, C, B. Plunk, 5034 Kasper, and Lee Williams, 5037 Kasper, stated they had not seen the recommended conditions until today,, but that they were concerned with the additional traffic and the parking, that they did not want to be encroached upon, and that they preferred a time limit of one year instead of two years, Motion by Wallace, seconded by Blackmon andpassed that the hearing be closed. Motion by Wallace, se^onded by Young and massed that the recommendation of the Zoning & Planning Commission be concurred in, and that an ordinance be brought forward reflecting a Special Permit on Lot 1, Block 3, South Park Addition, for the operation of a builder's sales office sub,!,ect to the following conditions: (1) That there be no alterations to the existing exterior of the building; (2)That the residential character of the property be maintained; (3) That outdoor adver- tising consist of not more than one 4 sq ft, sign, that it be non -illuminated, flat against the wall of the baail&ing and not protrude above the eave line; (4) That the permit be limited to a time period of two years; and with the additional condition that off-street parking for four cars be provided. Mayor Barnard announced the public hearing on the application of Ted M. Anderson, and others, for a change of zoning from "R -1B" One -family Dwelling District to "B-1" Neighborhood Business District on the southeast one-half of Lot 6 and ,Lot 7, including portions 0, B, I, , K and L, of Lot 7, Ave Cooper Addition, Tom Lake located the property on the map,, pointed out the zoning and land use of the areastated that Mr, Anderson, representing all of the property owners of the subject property, had spoken in support of the request at the Com- mission hearing on the basis that the proposed zoning and use would provide off- street parking in the rear of these properties. and upgrade the area and values of the adjacent properties and encourage development of existing zoning along Kostoryz; that no one had appeared in opposition to the request; that 22 letters were sent out, three replies received in favor, and none in opposition to the re- quest; and that the recommendation of the Zoning & Planning Commission was that the change of zoning be approved. No one appeared in opposition to the request: Motion by Wallace, seconded by Blackmon and passel. that the hearing be closed. Motion by Wallace, secorded by Blackmon and passed that the recommenda- tion of the Zoning &Planning Commission be concurred in, and that an ordinance be brought forward reflecting a change in zoning from One -family Dwelling District to "B-1" Neighborhood Business District on the southeast one-half of Lot 6 and Lot 7, including portions•C, P. 2 J, K and L, of Lot. 7, Ana Cooper Addi- tion, described in the application. Mayor Barnard announced the public hearing on the. application of Garth M. Taylor and Hobart L Taylor of American House Moving Company for a change of zoning from 'R-18" One -family Dwelling District to "I.-2" Light Industrial District on a 5 -acre tract being a portion of. Lot 2, Fellin's Riverside Subdivision. Tom Lake located the property on the map; pointed out the zoning and land use of the area; explained that this application had been beard by the Commission more than a year ago on February 19, 1963, at which public hearing the applicants had appeared in support of the request on the basis that the property had been purchased for establishing a contractor's storage yard for house moving in November of 1961, that the property was annexed by the City in September of 1962, that they had been operating under an Interim Permit granted by the City Council since that time, and expected to continue this use and eventually develop the. property as a small shopping center after retirement from the house moving. husiness: Mr: Lake stated that no one appeared in opposition at that Commission hearing, and that no letters were received either for or against. the application; but that the Commis- sion had tabled the application as being premature until the comprehensive zoning plan in this area was established: He explained that theapplication had been reviewed at the Commission meeting of October 13, 1964; that since the permanent zoning in this area was recommended as "R -1A" Single-family Dwelling District, the Commission felt that industrial zoning was not acceptable, hut, that some considera- tion should be given since this operation exited at the time of annexation, and • City of Corpus Chrieti, Texas Special Council Meeting November 25, 1964 Page 5 • that the recommendation of the Zoning & Planning Commisstor, was that the request for "I-2" Light Industrial District zoning be denied but that in lieu a Special Permit to operate the presently existing house moving company or, the subject prop- erty be approved for a period of three years. J. T, Persons and Atlee Cunningham, property owners in the area, appeared in opposition to any change from residential zoning of the area based on the large tracts and rolling terlain which they felt made it ideal for residential dwellings, but did not object to a temporary permit for a three-year use of the subject prop- erty, Motion by Wallace, seconded by Blackmon and passed that the hearing be closed - Motion by Wallace, seconded by de Leon and passed that the recommendation of the Zoning & Planning Commission be concurred in, and that an ordinance be brought forward granting a Special Permit on the 5 -acre portion of Lot 2, Fallin's Riverside Subdivision described in the application to operate the presently exist- ing house moving company for a period of three years. Mayor Barnard announced the public hearing on the application of Mrs, M, C. Tutwiler for a change of zoning from "R -1B" One -family Dwelling District to "A-1" Apartment House District on all of Lots /1A, 11B, 11C and 11D, Block 2, Mahan Acres, Tom Lake located the property on the map; pointed out the zoning and land use of the area stated that the applicant had appeared at the Commission hearing in support of the request, and one neighboring property owner appeared in opposi- tion; that 19 letters were sent out, and one return was received in favor of the request, and a total of 6 returns in opposition; that following receipt of a site plan and building layout for the proposed use of the property, the recommendation of the Zoning & Planning Commission was that the request for change of zoning be denied but in lieu a Special Permit for an 8 -unit apartment house and one residence be approved subject to compliance with the site plan as submitted. Mr. Tom Swantner and a total of five others had ap- peared at the Commiesion hearing ln support of the remrest; that 10 letters were sent out, and two replies were received. in favor of the request, and none against; and that the recommendation of the. Zoning & Planntng Ccion was that the ap- plication be approved as submitted, Mr, Bob Swantner was present: to support of the application, No one appeared in opposition to the request - Motion by Wallace, seconded by de Leon and passed that the hearing be. closed, Motion by Wallace, seconded by de Leon and passed (Mayor Pro Tem Jim Young abstained) that the recommendation of the Zoning & Planning Commission be City of Corpus Christi, Texas Special Council Meeting November 25, 1964 Page 7 • concurred in, and that an ordinance be brought forward reflecting the change in zoning from "R -1B" One -family Dwelling District to "B-4" General Business District on the 29.15 -acre portion out of the east half of Lot 3, Oso Farm Tracts described in the application. There being no further business to come before the Council, the special meeting was adjourned. I, JAMES L.
