Singer City Secretary T. Ray Kring Mayor James L. Barnard called the meeting to order. The Invocation was given by the Reverend H. G. Tomlin, Pastor of St. Bartholomew Episcopal Church. City Secretary T. Ray Kring called the roll of those in attendance. Mayor Barnard recognized and welcomed as special guests of the Council, representatives of the Hamlin Junior High School Student Council, their sponsor, Mrs. Baggett; and counselor, Mr. Crone; and Commissioner de Leon awarded Certifi- cates of Attendance designating them as Honorary Junior City Commissioners, to the following: Tommy Elkins; Robert Connell; Jane Trigg; Shelley Wallock; Leslie Boren; Lee Offner; Debbie Blackmon; and Sylvia de Leon. Motion by Maldonado, seconded by Young and passed that the minutes of the regular meeting of December 2, 1964, be approved as furnished to the Council. Mayor Barnard announced the opening of bids. Bids were opened and read on the construction of 19th Street Connection to Morgan from the following: Fowco Construction Co.; and Heldenfels Brothers. The foregoing bids were, tabled for 48 hours as required by City Charter, and referred to the City Manager for tabulation and recommendation, Bids were opened and read on 6100' of 20" Cast Iron, Ductile and/or Asbestos Cement Pipe from the following: American Cast Iron Pipe Co.; James B. Clow & Sons, Inc.; Johns -Manville Sales Corp.; The Rohan Co.. Inc.; Viking Supply Corp.; and United States Pipe & Foundry Co. The foregoing bids were tabled for 48 hours as required by City Charter, and referred to the City Manager for tabulation and recommendation. City Manager Whitney explained briefly the request of the City to be designated for a pilot transportation study under the Federal Highway Act of 1962; • • City of Corpus Christi, Texas Regular Council Meeting December 9, 1964 Page 2 the acceptance by the City, by Ordinance No. 6793 on January 30, 1963, of the Minute Order No. 52216 of the Texas Highway Department and the appropriation of $9,000 as the City's share in the cost of developing a comprehensive and continu- ing urban arterial street plan to provide information for routing and design of freeways, expressways, and arterial streets within the metropolitan area of Corpus Christi; and the manner in which this Transportation Study was carried on through the contractural cooperation of governmental agencies, the City, the County, and the State Highway Department. T. 0. Foster, District Engineer for the State Highway Department, explained that the Federal Highway Act of 1962 provides in effect that all cities or munici- palities in the United States of over 50,000 population would be required to have a transportation study by July 1, 1965, and that those cities that did not have such study complete and in the continuing pattern would not be eligible for Federal aid funds for development of highway and transportation facilities. He presented bound copies of the final report, pointing out that it was not only the first of the nine- teen reports to be made in Texas, but the first report in the nation, and will be used as a guide for cities within the State and for other cities that have not pro- gressed as far with their reports. He explained that population studies, economic factors, land use, transportation facilities, terminal and transfer facilities, traffic engineering community control, financial resources, and community value factors were all specific elements covered in these actual plans for the long-range development of highways and streets within the metropolitan area of Corpus Christi; and stressed that the continuing phase is one of the specific requirements under the Federal Act; the need for a special office to keep this master plan up to date; and the need to implement this by another contractural agreement between the High- way Department and the City very similar to the one under which this report was prepared. City Manager Whitney explained that copies of this final report will be furnished to the public information media for use as they see fit; to the Zoning & Planning Commission; the Traffic Safety Advisory Board; the County as cooperative City of Corpus Christi, Texas Regular Council Meeting December 9, 1964 Page 3 agency; and to the Highway Committee of the Corpus Christi Chamber of Commerce. He pointed out that the City Charter provides for the adoption of a Master Plan for the City, either in whole or in part; that the Zoning & Planning Commission study and make recommendation for adoption of the Master Plan in whole or in part; and that the City Council hold public hearing and take such action as they consider wise to adopt or modify. Mr. Whitney recommended that the Council accept this plan just submitted and authorize him to forward to the Zoning & Planning Commission for their study and recommendation. Motion by de Leon, seconded by Maldonado and passed that the Corpus Christi Transportation Plan prepared jointly by the City, County, and State Highway Depart- ment presented by Mr. T. 0. Foster, District Engineer for the State HighwayDepart- ment, be accepted with appreciation for the fine cooperation and work done by these governmental agencies, and that it be referred to the Zoning & Planning Commission for their study and recommendation. City Manager Whitney commented that following instructions of the City Council, he had met with the Texas Legislative Committee in Austin at the public hearing held by that Committee on Mass Transportation, and had presented as the City's brochure the pertinent portion of the foregoing report. Mayor Barnard called for the City Manager's Reports. Motion by Young, seconded by Roberts and passed that the City Manager's Reports be accepted, and that the recommendations and requests be approved and granted, as follows, with Item "i", relative to the application for a Permit to Drill and operate a well being temporarily deferred: a. That the award of contract for construction of the Everhart Road Im- provements, from the Railroad to Saratoga Boulevard, to Womack and Manning in the amount of $174,930.21, and the request of the developer to vary the sidewalk align- ment to fit into the landscape, be approved; and that request for appropriation in the sum of $29,400 be granted; b. That acceptance and payment of final Estimate No. 1 in the amount of $11,367.23 to H. D. Zachry for construction of the Leopard Street Improvements at Port and Leopard, be approved; • • City of Corpus Christi, Texas Regular Council Meeting December 9, 1964 Page 4 c. That the award of bid for furnishing Irrigation Equipment to Can -Tex Industries, Inc. for Lot I, Plastic Pipe & Fittings, in the sum of $25,982.48, to Goldwaite's of Texas, Inc., for Lot II, Sprinklers, in the sum of $26,168.45, and to Telsco Industries, for Lot III, Solenoid Valves, for a grand total of $58,989.14, be approved; (Bid Tabulation 042) d. That the award of bid for twenty-four 11 -Station Control Panels and twelve 5 -Station Control Panels to Telsco Industries in the sum of $4,752.71, be approved; (Bid Tabulation #43) e. That request for appropriation from various bond funds in the sum of $7,448.60 for expenses in connection with the recent sale on October 1, 1964, of $3,750,000 General Improvement Bonds, Series 1964„ and $400,000 Park Improvement Bonds, Series 1964, be granted; f. That request for appropriation out of Gas Bond Fund in the sum of $668.24 for expenses in connection with the sale of September 30, 1964, of $125,000 Gas System Revenue Bonds, Series 1964, be granted; g. That request for authority to advertise for bids to be r8ceived on January 6, 1964, on one Class A 750 -gallon Tripple Combination Pumpet, be granted; h. That the date of December 23, 1964, during the regular meeting, be set for public hearing on the adoption of the Master Sanitary Sewer Plan for areas annexed in 1960 and 1961 except Flour Bluff, as prepared by Reagan & McCaughan, consulting engineers; i. Temporarily deferred as stated in the motion; j. That the date of January 6, 1964, during the regular meeting, be set for public hearing on two zoning cases. Item "i" of the City Manager's Reports, relative to an application for per- mit to drill and operate a well within the City limits was considered at this time. Mayor Barnard announced that with the consent of the Council, public hear- ing on the application of Socony Mobil Oil Company, Inc. for a permit to drill and operate Well No. 8, Weil "C" Lease, Saxet Field, Nueces County, would be held at this time. City Manager Whitney presented the application and a plat showing the pro- posed location of the well in Section 6 & 7, Enrique Villareal Grant, Saxet Field, City of Corpus Christi, Texas Regular Council Meeting December 9, 1964 Page 5 in the Weil "C" Lease, to be located 563 feet from Corn Products Road; pointed out the objective zones, the proposed depth, and proposed casing program as stated in the application; that the required documents have been submitted by the applicant; explained that the City Staff has certified that the proposed to location meets the requirements as/distances from buildings, public roads, etc.; and called attention to the three variances being requested by the applicant with respect to bond, pits, and depth of casing. No one appeared in opposition to the application. Motion by Roberts, seconded by Maldonado and passed that the hearing be closed. Motion by Wallace, seconded by Young and passed that the application of Socony Mobil Oil Company, Inc. for a permit to drill and operate Well No. 8, Weil "C" Lease, Section 6 & 7, Enrique Villareal Grant, Saxet Field, Nueces County, be granted with the three requested variances. FIRST READING OF AN ORDINANCE AMENDING THE CORPUS CHRISTI CITY CODE, 1958, AS AMENDED, BY AMENDING CHAPTER 36, ARTICLE II, AS AMENDED, ENTITLED "DRIVERLESS AUTOMOBILES", BY REPEALING SECTION 36-91 THROUGH SECTIONS 36-115, INCLUSIVE; AND ADOPTING AS PROVISIONS SECTION 36-91 THROUGH 36-110, INCLUSIVE, AS HEREIN- AFTER SET FORTH; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. The foregoing ordinance was read for the first time and passed to its second reading by the following vote; Barnard, Young, Blackmon, de Leon, Maldonado, Roberts and Wallace, present and voting "Aye." ORDINANCE NO. 7427 AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI TO EXECUTE A CONTRACT WITH WOMACK AND MANNING FOR CONSTRUCTION OF EVERHART ROAD IMPROVEMENTS FROM THE RAILROAD TO SARATOGA BLVD. DESIGNATED AS PROJECTS NO; 220-61-79 AND 250-61-41; APPROPRIATING OUT OF NO. 220 STREET BOND FUND THE SUM OF $150,600 OF WHICH $146,632.11 IS FOR THE CONSTRUCTION CONTRACT AND $3,967.89 IS FOR CONTENGENCIES, AND APPROPRIATING OUT OF NO. 250 SANITARY SEWER FUND THE SUM OF $29,400 OF WHICH $28,298.10 IS FOR THE CON- STRUCTION CONTRACT AND $1,101.90 IS FOR CONTINGENCIES; AND DECLARING AN EMERGENCY. The Charter rule was suspended and the foregoing ordinance was passed by the following vote; Barnard, Young, Blackmon, de Leon, Maldonado, Roberts and Wallace, present and voting "Aye." • City of Corpus Christi, Texas Regular Council Meeting December 9, 1964 Page 6 ORDINANCE NO. 7428 APPROPRIATING THE SUM OF $7,448.60 OUT OF VARIOUS BOND FUNDS FOR EXPENSES IN CON- NECTION WITH THE SALE OF $3,750,000 GENERAL IMPROVEMENT BONDS, SERIES 1964, AND $400,000 PARK IMPROVEMENT BONDS, SERIES 1964, ON OCTOBER 1, 1964, AND DECLARING AN EMERGENCY. The Charter rule was suspended and the foregoing ordinance was passed by the following vote: Barnard, Young, Blackmon, de Leon, Maldonado, Roberts and Wallace, present and voting "Aye." ORDINANCE NO. 7429 APPROPRIATING THE SUM OF $668.24 OUT OF N0. 200 GAS BOND FUND FOR EXPENSES IN CON- NECTION WITH THE SALE OF $125,000 GAS SYSTEM REVENUE BONDS, SERIES 1964, ON SEPT- EMBER 30, 1964; AND DECLARING AN EMERGENCY. The Charter rule was suspended and the foregoing ordinance was passed by the following vote: Barnard, Young, Blackmon; de Leon, Maldonado, Roberts and Wallace, present and voting "Aye." ORDINANCE NO. 7430 AUTHORIZING EMINENT DOMAIN PROCEEDINGS BY THE CITY OF CORPUS CHRISTI TO CONDEMN FEE TITLE TO A CERTAIN LOT OR PARCEL OF LAND LOCATED IN NUECES COUNTY, TEXAS, DESCRIBING SAID PROPERTY, IDENTIFYING THE RECORD TITLE OWNERS, SAID CONDEMNA- TION BEING NECESSARY FOR PUBLIC STREET PURPOSES AS A PART OF THE CROSSTOWN EX- PRESSWAY WITHIN THE CORPORATE LIMITS OF THE CITY OF CORPUS CHRISTI; DIRECTING THE CITY ATTORNEY TO INSTITUTE CONDEMNATION PROCEEDINGS TO CARRY OUT THE INTEN- TION OF THIS ORDINANCE; AND DECLARING AN EMERGENCY. ORDINANCE NO. 7431 AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH, DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME, AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, BY AMENDING THE ZONING MAP BY CHANGING THE ZONING OF THE 22.2 ACRE TRACT OUT OF LOTS 9 AND 16, SECTION 5, RANGE VIII, GUGGENHEIM & COHN FARM LOTS IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, HEREINAFTER MORE FULLY DESCRIBED, FROM "R -1B" ONE -FAMILY DWELLING DISTRICT TO "A-1" APARTMENT HOUSE DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED;'REPEALING ALL ORDINANCES IN CONFLICT HERE- WITH; AND DECLARING AN EMERGENCY. D. ZACHRY, UNDER HIS CONTRACT DATED 4 NOVEMBER 1964, AUTHORIZED BY ORDINANCE NO. 7407; AUTHORIZ- ING PAYMENT OF FINAL ESTIM..LE NO. 1 DATED 4 DECEMBER 1964 IN THE AMOUNT OF $11,367.23, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, SAID PAYMENT TO BE MADE FROM NO. 220 STREET BOND FUNDS PREVIOUSLY APPROPRIATED; AND DECLARING AN EMERGENCY. The Charter rule was suspended and the foregoing ordinance was passed by the following vote: Barnard, Young, Blackmon, de Leon, Maldonado, Roberts and Wallace, present and voting "Aye." RESOLUTION NO. 7433 AUTHORIZING THE CITY'S PARTICIPATION WITH THE FEDERAL GOVERNMENT UNDER TITLE II(B) OF PUBLIC LAW 88-452; AND DECLARING AN EMERGENCY. The Charter rule was suspended and the foregoing Resolution was passed by the foregoing vote: Barnard, Young, Blackmon, de Leon, Maldonado, Roberts and Wallace, present and voting "Aye." For the benefit of the student guests, it was explained that the fore- going resolution, in addition to approving the City's application for Federal participation to carry out programs involving primarily welfare, recreation, library services, that the City, through its Accounting Department, agrees to serve as the Accounting Agency for the Community Committee, receiving, administering and accounting for all of the funds; and that 757 to 807 of the proposed programs are centered on educational opportunities to relieve and improve economic condi- tions in the community. Philip Rosenstein presented his suggestions for use of any funds received under this Federal Grant to help school children before they become victims of the poverty cycle. Mayor Barnard thanked Mr. Rosenstein for his concern and suggestions, but explained that the act passed by Congress was to provide Federal Funds for economic opportunity for people in areas that would submit a program or plan for use of the funds; that the Council is endorsing a plan submitted by the Community Committee which mostly involves educational opportunities for people to get more education, vocational training or special training in order to get better jobs, on the long range basis that needy people need to be able to help themselves rather than to be • City of Corpus Christi, Texas Regular Council Meeting December 9, 1964 Page 8 given money. The student guests asked questions relative to Council proceedings in general and various items on this meeting's agenda which were answered and explained by the Council, and expressed their appreciation for being invited to attend the meeting. There being no further business to come before the Council, the meeting was adjourned.
