Wallace, Jr. Mayor James L. Barnard called the meeting to order. The Invocation was given by the Reverend Richard Stone, Pastor of West - minister Presbyterian Church. City Secretary T. Ray Kring called the roll of those in attendance. Motion by Roberts, seconded by Blackmon and passed that the absence of Commissioner J. R. de Leon be excused for cause. Motion by Young, seconded by Blackmon and passed that the minutes of the regular meeting of December 9, 1564, at 2 p.m., and of the special meeting of the same day at 4 p.m., be approved as furnished to the Council and corrected. Mayor Barnard recognized and welcomed as special guests of the Council representatives of the Student Council of North Side Junior High School, and their sponsor, Miss Florence Adams; and Commissioner Maldonado presented Certificates of Attendance designating them as Honorary Junior City Cumaissioners to the following: Mary Helen Acosta; Deborah Grasty; Yolanda Ortiz; Sylvia Davila; and Kenneth Crosthwait. Mayor Barnard announced receipt of the resignation of John Mitchell, Jr. from the Bayfront Advisory Board because he is moving out of the City, and com- mented on Mr. Mitchell's many years of fine service on this Board. Motion by Blackmon, seconded by Maldonado and passed that the resigna- tion of Mr. John Mitchell, Jr. from the Bayfront Advisory Board be accepted with extreme regret; and that he be commended for his fine service to the City; and that the best wishes of the Council he extended to him in his new position. Mayor Pro Tem Young nominated Eli Abrams to fill the unexpired term of Joh:z Mitchell, ,jr. on the Bayfront Advisory Board. Motion by Yo:_ig, seconded b;; Maldonado and passed that nominations cease, and that Eli Abrams be appointed to the Bayfront Advisory Board to fill the unex- pired term of John Mitchell, :?r. • City of Corpus Christi, Texas Regular Council Meeting December 16, 1964 Page 2 Mayor Barnard called for the City Manager's Reports. Motion by young, seconded by Roberts and passed that the City Manager's Reports be accepted, and the recommendations and requests be approved and granted, as follows, with Item "h," relative to the application for a Permit to Drill an oil well being temporarily deferred: a. That acceptance and payment of Estimate No. 2 in the amount of $8,412.69 to Womack and Manning for construction of Chippewa, Cosner, and Brawner Parkway Street Improvements, be approved; and that request for additional appro- priation in the sum of $189 be granted; b. That contract with Heldenfels Brothers for construction of the 19th Street Connection to Morgan, in the amount of $23,798.50, be authorized; and that request for appropriation in the sum of $27,000 be granted; c. That authority to advertise for bids to be received on January 6, 1965, on several items of Heavy Equipment be granted; d. That authority to advertise for bids to be received on January 6, 1965, on several items of Mowing Equipment be granted; e. That authority to advertise for bids to be received on January 6, 1965, on several items of Special Bodies and Utility Tool Boxes be granted; f. That authority to advertise for bids to be received on January 6, 1965, on 61 Parking Meters be granted; g. That the plans and specifications for the first stage of the Side- walk Construction Program, consisting of approximately 15,550 lin.ft. of 4' wide concrete on portions of McArdle, Gollihar, Campana, Bloomington, and Carrizo, and approximately 1880 lin.ft. of temporary shell sidewalk on a portion of Airline, under the Council's Assessment Program, be approved; and request for authority to advertise for bids to be received on January 6, 1965, be granted; h. Temporarily deferred as stated in the motion; i. That the date of January 13, 1965, at a special meeting convening at 3:30 p.m., be set for public hearing on nine zoning cases. Item "h" of the City Manager's Reports, relative to an application to drill an oil well within the City limits was considered at this time. Mayor Barnard announced that with the consent of the Council, public hearing on the application of Daubert Oil & Gas Company for a Drilling Permit for • City of Corpus Christi, Texas Regular Council Meeting December 16, 1964 Page 3 Well #2, Payne-Flato (92.63 Acre Lease), Lot 10, H. B. Sheppard Farm Lots, Nueces County, would be held at this time. City Manager Whitney presented the application and a plat showing the location of the proposed well in Lot 10, H. B. Sheppard Farm Lots, in the Saxet Field, approximately 75 feet from the center line of a railroad spur, approximate- ly 200 feet from a tank battery and compressor units, and 300 feet from the north property line of a construction company's material and storage yard; pointed out the proposed depth and casing program as stated in the application; and that the required documents have been submitted by the applicant. No one appeared in opposition to the application. Motion by Young, seconded by Maldonado and passed that the hearing be closed. Motion by Wallace, seconded by Young and passed that the application of Daubert Oil & Gas Company for a Permit to Drill Well #2, Payne-Flato (92.63 Acre Lease), Lot 10, H. B. Sheppard Farm Lots, Saxet Field, Nueces County, be granted. SECOND READING OF AN ORDINANCE AMENDING THE CORPUS CHRISTI CITY CODE, 1958, AS AMENDED, BY AMENDING CHAPTER 36, ARTICLE II, AS AMENDED, ENTITLED "DRIVERLESS AUTO- MOBTLES", BY REPEALING SECTION 36-91 THROUGH SECTIONS 36-115, INCLUSIVE; AND ADOPT- ING AS PROVISIONS SECTION 36-91 THROUGH 36-110, INCLUSIVE, AS HEREINAFTER SET FORTH; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. The foregoing ordinance was read for the second time and passed to its third reading by the following vote; Barnard, Young, Blackmon, Maldonado, Roberts, and Wallace all present and voting "Aye," and de Leon absent. ORDINANCE N0. 7434 THIRD READING OF AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE A LEASE FOR THREE YEARS WITH CORPUS CHRISTI COUNCIL FOR RETARDED CHILDREN FOR RENT- AL OF PARKWAY HOUSE FOR GIRLS FOR $1.00 PER YEAR AND OTHER CONSIDERATION, A COPY OF WHICH LEASE IS ATTACHED HERETO AND MADE A PART HEREOF. The foregoing ordinance was read for the third time and passed finally by the following vote: Barnard, Young, Blackmon, Maldonado, Roberts, and Wallace all present and voting "Aye," and de Leon absent. ORDINANCE NO. 7435 RECEIVING AND ACCEPTING fir_. S RUCTION OF CHIPPEWA, COSNER, AND BRAWNER PARKWAY STREET IMPROVEMENTS, PROJECT O. 220-64-69.8, AS PERFORMED BY THE CONTRACTOR, WOMACK AND MANNING, UNDER THEIR CONTRACT DATED SEPTEMBER 23, 1964, AUTHORIZED BY ORDINANCE NO. 7358; APPROPRIATING OUT OF N0. 220 STREET BOND FUND THE SUM OF $189.00, SUPPLE- MENTING REMAINING FUNDS PREVIOUSLY APPROPRIATED IN THE AMOUNT OF $8,224.00; AUTHOR- IZING PAYMENT OF FINAL ESTIMATE N0. 2, DATED DECEMBER 8, 1964, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, SAID PAYMENT TO BE MADE FROM FUNDS HEREBY APPROPRIATED AND PREVIOUSLY APPROPRIATED FOR CONSTRUCTION AND CONTINGENCIES; AND DE- CLARING AN EMERGENCY. • City of Corpus Christi, Texas Regular Council Meeting December 16, 1964 Page 4 The Charter rule was suspended and the foregoing ordinance was passed by the following vote: Barnard, Young, Blackmon, Maldonado, Roberts, and Wallace all present and voting "Aye," and de Leon absent. ORDINANCE NO. 7436 AUTHORIZING AND DIRECTING THE CPI"Y MANAGER, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A CONTRACT WITH HELDENFELS BROTHERS FOR CONSTRUCTION OF THE 19TH STREET CONNECTION TO MORGAN, PROJECT NO. 220-56-27; APPROPRIATING OUT OF NOo 220 STREET BOND FUNDS THE SUM OF $27,000.00, OF WHICH AMOUNT $23,798.50 IS FOR THE CONSTRUCTION CONTRACT AND $3,201.50 IS FOR CONTINGENCIES, INCLUDING ENGINEERING, LABORATORY TESTING, SPECIAL APPRAISAL FEES AND OTHER LEGAL COSTS; AND DECLARING AN EMERGENCY. OF LAND LOCATED IN NUECES COUNTY, TEXAS, DESCRIBING SAID PROPERTY, IDENTIFYING THE RECORD TITLE OWNERS, SAID CONDEMNATION BEING NECES- SARY FOR PUBLIC STREET PURPOSES AS A PART OF THE CROSSTOWN EXPRESSWAY WITHIN THE CORPORATE LIMITS OF THE CITY OF CORPUS CHRISTI; DIRECTING THE CITY ATTORNEY TO IN- STITUTE CONDEMNATION PROCEEDINGS TO CARRY OUT THE INTENTION OF THIS ORDINANCE; AND DECLARING AN EMERGENCY. ORDINANCE NO. 7439 APPROPRIATING THE SUM OF $12, 571;,82 OUT OF NO. 20u UA:_ SYSTEM BOND FUND AND THE SUM OF $31,013.18 OUT OF GAS FUND N0. 106, MAKING A TOTAL OF $159,587.00, TO BE USED FOR THE COST OF PROJECT N0. 200-53-45, THE ACQUISITION OF A 10", 8" and 6" TRANSMISSION MAIN ALONG KOSAR ROAD FROM CORPUS CHRISTI MUNICIPAL GAS CORPORATION; AUTHORIZING THE CITY MANAGER TO COMPLETE THE ACQUISITION OF SAID PIPELINE; AND DE- CLARING AN E[RGENCY. • City of Corpus Christi, Texas Regular Council Meeting December 16, 1964 Page 5 The Charter rule was suspended and the foregoing ordinance was passed by the following vote: Barnard, Young, Blackmon, Maldonado, Roberts, and Wallace all present and voting "Aye," and de Leon absent. Mrs. Richard Herald, 1011 Eleventh Street, and Mr. Charles Hower, 1015 Eleventh Street, called the Council's attention to the constant and continuous set- ting off of fire works during and following the Christmas season by persons of all ages in the area between Staples and Brownlee, and Morgan and Agnes Streets; the failure of the Police Department to investigate complaints in this regard; cited specific instances to support the reasonableness of the complaints and accidents to emphasize the very real danger because of the criminal way in which some indi- viduals have set off the firecrackers; and suggested that the City Ordinance for- bidding the sale of fireworks within the City limits also forbid the possession of fireworks within the City limits; and that if a few of the parents were fined for such offenses, it would discourage the practice and help the situation greatly. Mayor Barnard commented that it was a strange way to celebrate Christmas; requested the City Manager to call this matter to the attention of the Chief of Police with respect to some response being made to such complaints; and suggested that the present ordinance relative to fireworks be reviewed for the next Work Shop with a view to making the possession of fireworks a punishable offense within the City limits. Miss Florence Adams thanked the Council for providing extra traffic officers on Ayers in front of Del Mar College Auditorium for special events, and commented it was such a relief and pleasure to be able to cross the street without fear of being run down at these performances. There being no further business to come before the Council, the meeting was adjourned.
