Mayor James L. Barnard called the meeting to order.
City Secretary T. Ray Kring called the roll of those in attendance.
Motion by Blackmon, seconded by de Leon and passed that the absence of
Commissioners W. J. Roberts, and W. H. Wallace, Jr. be excused for cause.
Mayor Barnard announced the purpose of the special meeting to hold public
hearing on five zoning cases, and explained the procedure to be followed.
Mayor Barnard announced the public hearing on Application #1164-1, Max C.
Kluge for change of zoning from "A-1" Apartment House District to "B-1" Neighbor-
hood Business District on a 0.406 -acre tract out of Block 26, Forrest Park.
Tom Lake, Zoning Coordinator, located the property on the map; pointed
out the zoning and land use of the area; stated that the applicant appeared at
the Zoning & Planning Commission's hearing, and no one appeared in opposition;
that three notices were sent out, and no returns were received; and that the
recommendation of the Zoning & Planning Commission was that the application be
approved as submitted. Mr. Lake explained further that the proposed use is for
a restaurant, but not a drive-in type facility, and that more than adequate off-
street parking can be provided; and that the property will have to be platted be-
fore a building permit can be issued.
No one appeared to speak in connection with this application.
Motion by Maldonado, seconded by de Leon and passed that the hearing be
closed.
Motion by de Leon, seconded by Maldonado and passed with Blackmon abstain-
ing, that the recommendation of the Zoning & Planning Commission be concurred in,
and that an ordinance be brought forward changing the zoning on the 0 -406 -acre
tract out of Block 26, Forrest Park, described in the application, from "A-1" to

"B-1" Neighborhood Business District, subject to a proper plat.
Mayor Barnard announced the public hearing on Application #1164-2, Otto
Hodge for change of zoning from "A-1" Apartment House District to "B-1" Neighbor-
hood Business District on all of Lot 5, Block 21, Nueces Bay Heights Extension.
Tom Lake located the property on the map; pointed out the zoning and land
use of the area; that a representative of the property owner appeared at the Com-
mission hearing in support of the application, and no one appeared in opposition;
that twenty-three notices were sent out, one return was received in favor, and none
against; and that the recommendation of the Zoning & Planning Commission was that
the application be approved as submitted.
R. W. Duncan, realtor representing the applicant, speaking in support of
the request, explained the proposed use of the subject property with the adjoining
Lots 6, 7, and 8 for the location of a filling station.
Dave Coover, attorney representing Ivory Floyd,owner of Lot 20, had no ob-
jection to the request, and pointed out that since the subject property is between
business zoning, it could not be used for anything else.
No one appeared in opposition.
Motion by young, seconded by Blackmon and passed that the hearing be closed.

of the Zoning & Planning Commission be concurred in, and that an ordinance be
brought forward changing the zoning on all of Lot 5, Block 21, Nueces Bay Heights
Extension, from "A-1" to "B-1" Neighborhood Business District, as submitted.
Mayor Barnard announced the public hearing on Application #1164-4, Lich-
tenstein's Inc. for change of zoning from "B-1" Neighborhood Business District to
"B-5" Primary Business District on a portion of a 10.15 -acre tract, out of Tract
1, Paisley's Subdivision of the Hoffman Tract.
Tom Lake located the property on the map; pointed out the zoning and land
use of the area; stated that the attorney representing the applicant and four other
persons appeared at the Commission hearing in favor of the application, and no one
appeared in opposition; that twelve notices were sent out, three returns received
in favor and none against; and that the recommendation of the Zoning & Planning

Commission was that the request be denied, but that "B-4" General Business Dis-
trict be approved on the basis that the proposed use can be established under
regulations of this district. Mr. Lake explained the Commission's reason for the
foregoing recommendation to the effect that approval of a Special Permit for the
proposed billboard would set a precedent contrary to the intent of the sign regu-
lations, and the size and text of the proposed sign should comply with the regula-
tions of the "B-4" District, since the sign deals with a future use on the location,
which conincides with the "B-4" sign regulations.
Dave Coover, attorney representing the applicant, explained that they did
not want any change in zoning; that they wanted only permission to erect a 240 -square
foot sign to identify the property as the future home of Lichtenstein's and with
a removable panel to advertise things of a public and civic nature; that they did
not anticipate any other use of the property for seven or eight years, at which
time they would consider the matter of proper zoning for the proposed use; that they
did not want to be required to replat until they are ready for the future construc-
tion and use of the property; and presented the plans for the proposed sign.
Mayor Barnard reported receipt of a return from A. A. Lichtenstein in favor
of the request.
Mrs. Huber asked if there was a time limit in which property must be used
for "B-4" zoning when granted, and if there is an increase in taxes on property
zoned for a higher classification.
Mayor Barnard explained that down -zoning in such cases is a prerogative
of the Council seldom used, and that higher classifications usually do increase
the taxes on the property.
No one appeared in opposition.
Motion by Young, seconded by de Leon and passed that the hearing be closed.
Motion by Blackmon, seconded by de Leon and passed that the request for
change of zoning be denied, but that in lieu an ordinance be brought forward grant-
ing a Special Council Permit for a sign on the portion of the 10.15 -acre tract, out
of Tract 1, Paisley's Subdivision of the Hoffman Tract, described in the application,

in accordance with the plans submitted to the Council at this meeting, (on file
in the City Secretary's Office) and that further platting of the property not be
required at this time.
Mayor Barnard announced the public hearing on Application #1164-5, Ralph
Bennett for change of zoning from "A-1" Apartment House District to "A-2" Apart-
ment House District on all of Lots J and K1, Block 5, Bluff Front Addition.
Tom Lake located the property on the map; pointed out the zoning and land
use of the area; stated that the architect and associate of the applicant and the
owner of the property appeared in support of the request at the Commission hearing,
and no one appeared in opposition; that twenty-two notices were sent out, three
returns were received in favor, and none in opposition; and that the recommendation
of the Zoning & Planning Commission was that the application be approved as submitted.
Ralph Bennett presented and explained the plans for adding approximately
forty-seven units as an annex to the Cliff House and for covered parking, and ex-
plained the anticipated dedication of additional right of way for the widening
of Coleman Street and the side yard set -back variance granted by the Board of Ad-
justment in anticipation of the future widening of Coleman Street.
No one appeared in opposition to the request.
Motion by de Leon, seconded by Maldonado and passed that the hearing be
closed.

tion of the Zoning & Planning Commission be concurred in, and that an ordinance
be brought forward changing the zoning on all of Lots J and K1, Block 5, Bluff
Front Addition, from "A-1" to "A-2" Apartment House District, as submitted.
Mayor Barnard announced the public hearing on Application #1164-6, A. L.
Robinson for change of zoning from "R -1B" One -family Dwelling District to "R-2"
Two-family Dwelling District on all of Lot 1, Block 1, Pearson Addition.
Tom Lake located the property on the map; pointed out the zoning and land
use of the area; explained that a previous request for an interim permit to allow
the erection of a duplex had been made just prior to adoption of the permanent
zoning map; that no one had appeared at the Commission hearing in support of the

request, and that owners of an adjacent tract asked questions about the plans of
the applicant, but did not object to the request; that five notices were sent out,
and no returns were received; and that the recommendation of the Zoning & Planning
Commission was that the application be approved as submitted.
A. L. Robinson, applicant, explained that he has small two-bedroom rental
houses on Lots 2, 3, 4, 5, 6 and 7, and wants to erect a duplex on Lot 1; and that
dedication of one-half of Annabelle Street, the length of the subject property,
has been made, but that Flato Brothers own the property to the east.
Anna Belle Wilson, property owner at corner of Annabelle and Wilson, stated
she was in favor of the request.
No one appeared in opposition to the application.
Motion by Young, seconded by Blackmon and passed that the hearing be closed.
Motion by Young, seconded by de Leon and passed that the recommendation of
the Zoning & Planning Commission be concurred in, and an ordinance be brought for-
ward changing the zoning on all of Lot 1, Block 1, Pearson Addition, from "R -1B"
to "R-2' Two-family Dwelling District.
There being no further business to come before the Council, the special
meeting was adjourned.
