Wallace, Jr. CITY OF CORPUS CHRISTI, TEXAS REGULAR COUNCIL MEETING February 10, 1965 2:00 P.M. City Manager Herbert W. Whitney City Attorney I. M. Singer City Secretary T. Ray Kring Mayor James L. Barnard called the meeting to order. The Invocation was given by the Dr. Vernon Elmore, -pas5or of.the, First Baptist Church. City Secretary T. Ray Kring called the roll of those in attendance. Motion by Blackmon, seconded by Roberts and passed that the minutes of the regular meeting of February 3, 1965, be approved as furnished to the Council. Mayor Barnard welcomed as special guests of the Council, the student re- presentatives of the Tuloso-Midway High School, and Commissioner Roberts presented Certificates of Attendance, designating them as Honorary Junior City Commissioners. Those students attending and receiving certificates were: 'Robert Sparks, Billy Trott, Jack Gray, Sherry Potter, Reatha Arnold, and Mike Brawley. Mayor Barnard read and presented proclamations relative to the following: PEARL S. BUCK DAYS, February 15 and 16, 1965, honoring Miss Buck on the occasion of her visit to Corpus Christi, and in recognition of the Pearl S. Buck Foundation which bears her name and organized to aid helpless Asian -American Children, re- ceived by Mr. and Mrs. Jarzem; LULAC WEEK, February 14 - 20, 1965, in observance of its Thirty-sixth Anniversary, received by Mr. Joe Garza, brother of its founder, Ben Garza; NATIONAL SALESMEN'S WEEK, February 14 - 20, 1965, received by Mr. Brock Watson. Mayor Barnard called for the opening of bids. One bid was received and rend from W. B. Danfield (Bell & Danfield) on an Oil and Gas Lease on a 10.243 -acre tract out of J. C. Russell Farm Tracts. The foregoing bid was tabled for 48 hours as required by the City Charter and referred to the City Manager for tabulation and recommendation. Mayor Barnard called for nominations to Boards and Committees. City of Corpus Christi, Texas Regular Council Meeting February 10, 1965 Page 2 Commis,ioner B/ackmon• nominated H. P. Boubelik and Jack White to replace Thomas T. Keeler and Cecil Laws on the Bayfront Advisory Board, and the re -appointment of O. C. Bailey, Bill Reynolds, Adm. S. S. Bowling, and Dr. Wm. C. Triplett. Motion by Maakmon, seconded by Roberts and.passed that nominations cease and that the fg,regeing Inaminatitna to the Bayfront Advisory Board be affirmed and the appoint mens be made by acclanatton. Kr. Boubelik and Mr. White were present to receive AppcFAment Certifirates. Commisstcusr Wellsvre nominated Doyle McCain for re -appointment to the Fxamintne Superviatng Board of Plumbers. Motion by Walare, seconded by de Leon and passed that the foregoing nomination be affirmed and the appointrent he made. by acclamation. Mr. McCain was present to re,7,etve a Certate of Appointment- Commse'r 1-Z:zng r=Anated W, A, Riwaldt and Tom Wise to replace Othel J. Thompson and R. M. Currie on the Pest Control Licensing Advisory Committee. Motio by Roberts, seconded by 'fog and passed that the foregoing nominations he affirmed and the appointments be made by acclamation. Commissioner de Leon nominated Mrs. Cecil D. Redford, Dr. Vernon Elmore and Mrs, Fiank Allen, Jr., for re -appointment to the La Retems-Lihrdry Doard. Motion by de Leon, seconded by Maldonado and passed that the foregoing nominations be affirmed and the appointments be made by acclamation. Commissioner Maldonado nominated W. B. Mobley, Jr„ for appointment to the City Solicitations Commission to fill the unexpired term of Wm. D. Bonilla who resigned January 11, 1965. Motion by Maldonado, seconded by Blackmon and passed that the foregoing nomination be affirmed and the appointment be made by acclamation. Mr. Mobley was present to receive a Certificate of Appointment. Mayor Barnard expressed appreciation for the magnificent services rendered by the outgoing members of the Boards and Committees and directed that the City Secretary mail to them Certificates of Appreciation. City of Corpus Christi, Texas Regular Council Meeting February 10, 1965 Page 3 Mayor Barnard announced the pending item on the application of C. A. Mansheim for closing of that portion of an alley between 16th and 17th Streets lying between Lots 1 and 2, and Lots 21 and 22, Block 2, Home Place Addition, and that portion of 16th Street lying between Lot A, Block 1, and Lot 1, Block 2, Home Place Addition, all lying between Laredo Street and the Tex-Mex Railroad right of way, on which a public hearing was held January 27, 1965, and was tabled pending recommenda- tion by the City Manager after circulation to the various department heads for re- view in the light of additional information received after the publication of the notice of hearing that Mr. Mansheim is the owner of the triangular shape piece of land north of Home Place and abutting the railroad right of way, and that Kinney Avenue and 16th Street apparently dead end against property owned by the applicant. City Manager Whitney stated that after conferring with the affected de- partment heads as to location of certain utility lines and a fire hydrant, it is recommended that this application for closing of the foregoing described alley be approved with the understanding that the applicant will assume the cost of all utility relocations as a result of this closing. Motion by Wallace, seconded by Young and passed that the recommendation of the City Manager be concurred in and that an ordinance be brought forward to close that portion of an alley between 16th and 17th Streets lying between Lots 1 and 2, and Lots 21 and 22, Block 2, Home Place Addition, and that portion of 16th Street lying between Lot A, Block 1, and Lot 1, Block 2, Home Place Addition, all lying between Laredo Street and the Tex-Mex Railroad right of way, with the under- standing that the applicant will assume all cost of relocating the utilities as a result of this closing. Mayor Barnard called for the City Manager's Reports. Motion by de Leon, seconded by Maldonado and passed that the City Manager's Reports be accepted, and that the recommendations and requests be approved and granted as follows: a. That acceptance and payment of final Estimate No. 3 in the amount of $2,590.65 to South Texas Construction Company for construction of Cullen Ditch Dam, be approved; City of Corpus Christi, Texas Regular Council Meeting February 10, 1965 Page 4 b. That the date of March 3, during the regular meeting be set for public hearing on four zoning cases. ORDINANCE NO. 7494 RECEIVING AND ACCEPTING THE CONSTRUCTION OF THE CULLEN DITCH DAM, PROJECT NO. 295-64- 44,1, AS PERFORMED BY THE CONTRACTOR, SOUTH TEXAS CONSTRUCTION COMPANY, UNDER THEIR CONTRACT DATED SEPTEMBER 16, 1964, AUTHORIZED BY ORDINANCE NO. 7351; AUTHORIZING PAYMENT OF FINAL ESTIMATE NO. 3, DATED FEBRUARY 3, 1965, IN THE AMOUNT OF $2,590.65, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, SAID PAYMENT TO BE MADE FROM NO. 295 STORM SEWER BOND FUNDS PREVIOUSLY APPROPRIATED FOR CONSTRUCTION AND CONTINGENCIES; AND DECLARING AN EMERGENCY. The Charter rule was suspended and the foregoing ordinance was passed by the following vote:' Barnard, Young, Blackmon, de Leon, Maldonado, Roberts and Wallace, present and voting "Aye." FIRST READING OF AN ORDINANCE AMENDING ORDINANCE NO. 7085, AND THE CONTRACT AND LEASE AGREEMENT AUTHORIZED BY THE SAID ORDINANCE N0. 7085, BETWEEN THE CITY OF CORPUS CHRISTI AND THE CORPUS CHRISTI COUNCIL OF GARDEN CLUBS, INC., SO AS TO PROVIDE FOR HEATING AND AIRCONDITIONING OF THE GARDEN CLUB BUILDING SITUATED IN CORPUS CHRISTI NATURE CENTER PARK, IN THE CITY OF CORPUS CHRISTI, TEXAS, BY THE CITY WITH REIMBURSE- MENT OF SUCH COSTS TO BE MADE BY CORPUS CHRISTI COUNCIL OF GARDEN CLUBS, INC., AND SETTING FORTH THE TERMS AND CONDITIONS FOR SAID INSTALLATION, ALL AS MORE FULLY SET OUT IN THE AMENDED CONTRACT AND LEASE AGREEMENT, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF; KEEPING IN EFFECT ALL OTHER PROVISIONS OF ORDINANCE N0. 7085, PASSED AND APPROVED BY THE CITY COUNCIL ON NOVEMBER 20, 1963. The foregoing ordinance was read for the first time and passed 10 its second reading by the following vote: Barnard, Blackmon, de Leon, Maldonado, Roberts,,Young and Wallace, present and voting "Aye." FIRST READING OF AN ORDINANCE AMENDING SECTION 21-156 OF THE CORPUS CHRISTI CITY CODE, 1958, AS AMENDED, BY DELETING ITEMS 13 AND 14, FORBIDDING THE STOPPING, STAND- ING OR PARKING OF VEHICLES ON THE EAST SIDE OF BROWNLEE BOULEVARD BETWEEN SOUTH STAPLES AND BUFFALO STREET AND ON THE WEST SIDE OF BROWNLEE BOULEVARD BETWEEN BUFFALO STREET AND SOUTH STAPLES STREET DURING CERTAIN HOURS; AND PROVIDING FOR PUBLICATION. The foregoing ordinance was read for the first time and passed to its second reading by the following vote: Barnard, Young, Blackmon, de Leon, Maldonado, Roberts and Wallace, present and voting "Aye." ORDINANCE NO. 7495 AMENDING THE CORPUS CHRISTI CITY CODE, 1958, AS AMENDED, BY AMENDING SECTION 24-13 SO AS TO PROVIDE THAT WELLS MAY BE DRILLED TO A DEPTH IN EXCESS OF 10,000 FEET BY SPECIAL PERMIT OF THE CITY COUNCIL; REPEALING ALL ORDINANCES IN CONFLICT'•HEREWITit; PROVIDING SEVERANCE CLAUSE; PROVIDING FOR PUBLICATION: DECLARING AN EMERGENCY. The Charter rule was suspended and the foregoing ordinance was passed by the following vote: Barnard, Young, Blackmon, de Leon, Maldonado, Roberts and Wallace, present and voting "Aye."
