f. That the City Manager's Report on the list of recommendations to
the City Council submitted by the Corpus Christi Acquatic Council, be accepted;
and the City Manager's recommendations be approved as follows; (1) That one of
the lifeguards from the Corpus Christi Beach swimming area provided last year by
W. D. Miles, be transferred to South Beach to give coverage of three guards for
this larger area; (2) That two surf boards, estimated at $250.00, be provided
for the South Beach lifeguards; (3) That anchored float lines not be installed
at this time to designate the swimming area at South Beach, by installing
anchored posts at 50 -foot intervals and suspending nylon line between them with
cork or wooden floats at mid -points, estimated at $1620.00, but be given further
study as to their need; (4) That the ladders installed last year around the T -
Heads and L -Head having been kept in good condition by the Park Department, are
felt to be adequate to assist anyone who may have slipped into the water; (5)
That since the ring buoy installed by the park Department on the L -Head on a
trial basis has had to be replaced several times during the past year due to
theft, and since it is impossible to secure reach poles from possible theft and
still have them available, that these items are not recommended; (6) That signs
on the T -Heade as to depth of water be painted at approximately 100 -foot inter-
vals, estimated at $140.00; (7) That 17 "Danger - No Swimming" signs, mounted on
redwood posts at 200 -foot intervals, be installed, estimated at $170.00; (8)
That the non-skid coating on the lower step of the seawall be renewed, estimated
at $750.00; (9) That the area below Cole Park is normally cleansed out whenever
needed, but that repair of the seawall at Cole Park, estimated to cost $32,800.00,
and requiring the preparation of plans and specifications and taking of bids, be
given further study and consideration; (10) That warning signs of slippery groins
and jagged rocks be placed on each groin, estimated at $70.00; (11) That since

three lifeguards are on duty all day at Collier Pool, which meets all normal
standards for that size area, additional lifeguards are not recommended; (12)
That the City Manager's attempts to have the hazard corrected by the owner in
regard to the oil well blowout behind Tuloso-Midway school, be approved; (13)
That since the Health Department's inspection of the drainage ditch on Highway
44 from the meat packing plant indicates that it is unsightly, but no health
hazard, the City Manager's attempts to have the drainage and appearance improved,
be approved; and (14) That the referral of the other items to the attention of
the Navigation District, relative to commercial piers having no protection, the
installation of posters on resusitation, and warning signs being needed along
the ship channel, be approved since they are beyond the jurisdiction of the City.

ORDINANCE NO. 7533
ABANDONING THE EXISTING UTILITY EASEMENT ACROSS LOTS 1, 2 AND 6, BLOCK 2, GENEVA
HEIGHTS ADDITION, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS; AND DE-
CLARING AN EMERGENCY.
The Charter rule was suspended, and the foregoing ordinance was passed
by the following vote: Young, Blackmon, de Leon, Maldonado, Roberts, and Wallace
all present and voting "Aye," and Barnard absent.
Ray Grandy, Fire Patrolman of the Maritime Union, presented and read a
resolution protesting the proposed closing of seven U. S. Public Health facili-
ties for merchant seamen within the next three years, and the proposed elimination
of the remaining hospitals within a ten-year period, on the basis that the Bureau
of the Budget is attempting to transfer the responsibility for medical service of
merchant seamen to the Veterans Administration facilities, which are already over-

crowded, and thereby depriving both groups of medical services provided for them
by law. Mr. Grandy urged that the resolution be adopted by the City Council and
by the Mayors' Conference, that President Johnson and the Department of Public
Health and Welfare be advised of such action; and that the City Council urge the
Texas Senators and Congressman for their support in keeping these U. S. Public
Health facilities open.
Motion by Roberts, seconded by Blackmon and passed that the foregoing
information be received, and the matter be discussed and considered at Work Shop
on Monday.
Mayor Pro Tem Young declared a brief recess.
Following the brief recess, the meeting was reconvened and it was noted
that all of the Council was present, with the exception of Mayor Barnard whose
absence was excused earlier in the meeting, and the City Manager, City Attorney,
and City Secretary.
Mayor Pro Tem Young announced the Council would now hold the advertised
public hearings on several zoning cases, and explained the procedure to be followed.
Mayor Pro Tem Young announced the public hearing on Application #265-9,
Gas House, Inc., for change of zoning from "R -1B" One -family Dwelling District to
"B-1" Neighborhood Business District on all of Lots 9 and 10, Block 1, Sunflower
Addition #2.
Tom Lake, Zoning Coordinator, located the property on the map; pointed
out the zoning and land use of the area; stated that three persons, including a
representative of the applicant, appeared at the Commission hearing in favor of
the request, and four persons in opposition; that twenty-five notices were sent
out, three returns received in favor of the request, and six against; and that the
recommendation of the Zoning & Planning Commission was that it be denied on the
basis that approval would constitute encroachment of business into a residential
area and would not be consistent with the Commission's recommendation on the
property directly across the street. Mr. Lake pointed out the property across the
street on which the Commission has recommended denial of a change of zoning to
"B-1," and for which there is is an application on file asking for "B-4" zoning
for which the Commission has recommended denial, as an explanation of the Com-

mission's recommendation for denial of this application. Mr. Lake further ex-
plained that the previous owner of that property had been denied a request for
"B-4" zoning for the purpose of improving the existing non -conforming garage
operation, but had been granted "B-1" to allow the filling station.
Joe F. Hall, speaking in support of the application, stated that he
had made the application with the thought in mild to have a coin-operated car
wash; that he believed the neighborhood would support and use this operation
very favorably; that he would be willing to erect a six-foot fence on the back
and side of the property to protect the neighbors from any disturbance; that
since a car wash would be operated mostly after working hours and on weekends,
he did not believe it would interfere with the school children, and that there
was a blinker light in front of the property to slow down the traffic when
children were going and coming from school.
Commissioner de Leon asked Mr. Hall if the car wash was the original
intention of the application, since the minutes of the Zoning & Planning Com-
mission indicate the request was for the purpose of a filling station. Mr. hall
answered that the application was made on Gas House stationery, that they didn't
ask what he was going to put there, and he didn't tell them. In answer to fur-
ther question from Commissioner Blackmon as to a proposed filling station, Mr.
Hall answered that something was said about two service stations at that corner,
but they don't have that much business for a service station. Commissioner
Maldonado asked if Mr. Hall was willing to sign an agreement as to the car wash
operation, in which case, a Special Council Permit limiting the use of the prop-
erty to a car wash operation would be sufficient; and Mr. Hall answered yes but
if they can't make money, they can't operate.
Rev. Charles Ferris, representing the Bethany Christian Ch.urnh at 2821
Gollihar Road, spoke in opposition to any business operation in this victr,it,
that would have driveway entrance on Gollihar, thereby causing the ch.ildren to
have to look approximately eight different ways for crossing safety, since *there
are already driveway entrances on both sides of Green Street, and in oppoit.iox
to anything that would increase traffic at this point. Rev. Ferris stated that
the Church's stand in opposition to the change in zoning is already on record.

Eugenio G. Castillo, 4509 Evelyn, spoke in opposition to any business
zoning in the area, and stated that they had opposed the request of the Dukes'
for business zoning and did not understand how the station was built there.
At the request of Commissioner Blackmon, Mr. Lake presented the
letters received by the Commission in opposition and located each of the prop-
erties represented on the map. In addition, in answer to a question of Commis-
sioner Roberts, Mr. Lake stated that the application was opposed by the Corpus
Christi Independent School District on the basis of the safety of the school
children as to pedestrian traffic.
No one else appeared to be heard.
Motion by Maldonado, seconded by Roberts and passed that the hearing
be closed.
•
Motion by Blackmon, seconded by de Leon and passed that this applica-
tion be tabled for consideration at Work Shop.
Mayor Pro Tem Young announced the public hearing on Application ,265-10,
Lowell Benefield, for change of zoning from "R -1B" One -family Dwelling Districk
to "B-1" Neighborhood Business District on all of Lot 36, Gust Heye Addition.
Tom Lake located the property on the map; pointed out the zoning and
land use of the area; stated that the applicant's representative appeared in
support of the request at the Commission hearing, and no one appeared in opposi-
tion; that twenty-six notices were sent out, no returns were received in favor of
the application, and one in opposition; and that the recommendation of the Zoning
& Planning Commission was that it be approved subject to the erection of a six-
foot solid fence along the interior property lines.
Receipt of a letter in opposition to the request from Mrs. John C. Bishop
was noted for the record.
Lowell Benefield, applicant, speaking in support of the application,
stated that he had originally purchased the property at the corner of Houston and
Kostoryz for a drive-in grocery and an independent filling station; that when the
City took eighteen feet on the Houston Street side and ten feet on the Kostoryz
side for future street widening, he had gone too far with the purchase to get out
of it, and that he had then proceeded to acquire the additional half of Lot 1, and

the sixty -foot Lot 36 to provide the needed land for the use in mind which was
for the filling station and drive-in grocery.
Mrs. John C. Bishop, 3146 Horne Road, spoke in opposition to the ap-
plication on the basis that it would destroy her privacy and the use of her
property for her home, and particularly to the drive-in grocery operation due to
the accompanying sale of beer for either on -premises or off -premises consumption.
No one else appeared in connection with this application.
Motion by Roberts, seconded by Maldonado and passed that the hearing
be closed.
Motion by Roberts, seconded by de Leon and passed that the application
for change of zoning from "R -1B" One -family Dwelling District to "B-1" Neighbor-
hood Business District on all of Lot 36, Gust Heye Addition, be approved subject,
to the erection of a six-foot solid fence along the interior property lines, and
that an ordinance be brought forth reflecting this.
Mayor Pro Tem Young announced the public hearing on Application #265-11,
Mrs. Thelma I. Bosques, for change of zoning from "R -1B" One -family Dwelling Dis-
trict to "A-2" Apartment House District on all of Lots 7, 8, 45 and 46, Block "A,"
Don Patricio Subdivision.
Tom Lake located the property on the map; pointed out the zoning and
land use of the area; stated that no one appeared at the Commission hearing
either in support of, or in opposition to the application; that the proposed de-
velopment is to be a hospital; that twenty-two notices were sent out, and three
returns received in favor and none in opposition; and that the recommendation of
the Zoning & Planning Commission was that it be approved as submitted on the
basis that the requested zoning is consistent with the existing development.
No one appeared to speak in connection with this application.
Motion by Wallace, seconded by Roberts and passed that the hearing be
closed.
Motion by Wallace, seconded by Blackmon and passed that an ordinance
be brought forward approving the change of zoning on all of Lots 7, 8, 45 and 46,

Mayor Pro Tem Young announced the public hearing on Application ;;=265-13,
Humble 0i1 & Refining Company, for change of zoning from "B-1" Neighborhood Busi-
ness District to "B-4" General Business District on Lots 2, 4, 6, 8, 10 and 12,
Block 115, Brooklyn Addition.
Tom Lake located the property on the map; pointed out the zoning and
land use of the area; stated that no one appeared at the Commission hearing either
in favor of, or in opposition to the application; that three notices were sent out,
and no returns were received; and that the recommendation of the Zoning & Planning
Commission was that it be approved as submitted.
Commissioner Roberts pointed out that recently, requests for heavier
zoning have been made solely for the purpose of a larger sign, and that it should
be clarified as to whether the requested zoning is for heavier use of the property,
or whether the "B-1" designation will accommodate the intended use. Commissioner
Blackmon asked if there were any plans for removal of the boat that was used for
a cafe or lounge and was burned out about a year ago, as it may possibly be a
hazard, and is most certainly an eye -sore.
A representative of Humble Oil, appearing in support of the request,
stated that it was not their boat, but that there was an injunction to remove the
boat within sixty days, and that the "B-4" zoning was needed in order to expand
the operation to include mechanical work.
No one else appeared in connection with this application.
Motion by de Leon, seconded by Maldonado and passed that the hearing be

Motion by de Leon, seconded by Wo-llace and passed that the recommenda-

Richard Colley, appeared in support of the application at the Commission hearing
and explained that the request was for Mr. Colley's proposed office building,
since his present location is being taken for expressway right of way, and that
no one appeared in opposition to the request; that twenty-two notices were sent
out, four returns received in favor of the request, and none in opposition; and
that the recommendation of the Zoning & Planning Commission was that it be ap-

Tom Lake located the adjacent Tracts I and II on the map; pointed out
the zoning and land use of the area; stated that the applicant and his repre-
sentative, and one person had appeared in support of the application at the
Commission hearing, and two persons, one of them representing the membership of
the Trinity Baptist Church, had appeared in opposition; that twenty-eight notices
were sent out, four returns received in favor and five in opposition, and that
two of those in opposition now favored the application; and presented a petition
of seventeen signatures received in favor of the request; and that the recommenda-
tion of the Zoning & Planning Commission was that it be approved as submitted for
both Tracts.
City Manager Whitney reported receipt of one telephone call in protest
to the application.
Bush Caswell, representing the applicant, speaking in support of the
application, explained the proposed development for a drive-in grocery with no
drinking, on Tract I and an eight -unit apartment building on Tract II that would
be a buffer between the residences and the business operation, and with a fence
between the apartment unit and the drive-in operation.
Two residents from across Everhart Road in Mt. Vernon Subdivision spoke
in support of the application on the basis that the neighbors feel they need the
convenience of the drive-in grocery and that the apartments on the back of the
lot will be very attractive, and that since they feel the corner will eventually
become a business use, they would like this operation to be approved now.
Lowell Benefield, applicant, explained at length the manner in which he
surveys the actual residents in a neighborhood to determine whether or not his
operation will receive the favor and support of the area in a six or seven block
radius; pointed out that in many instances in the city, churches are afterwards
built in the immediate vicinity of filling stations, and are very compatible if
the business is run properly; and explained his need for early action on this
application due to his loan commitment.
A representative of the Trinity Baptist Church, and pr. W. H. Colson,
Baptist Superintendent, both spoke at length in opposition to the request for
business, but were in favor of the request for apartment development, on the basis

that they are opposed to encroachment of business into a residential area, that
a drive-in grocery will not be compatible with the church development, that they
plan to spend about $200,000 for construction of the auditorium, and plan to open
their kindergarten this fall; and emphasized that the filling station and drive-
in grocery were not at all compatible with the operation of the church facilities
which have been there for about twelve years, but they did not oppose the apart -
went construction.
P. G. Thornton, owner of Terrace Grocery at 4249 McArdle, spoke in op-
position to the application on the basis of its being an encroachment of business
upon a residential area, and of setting a precendent for adjacent property owners
and would not enhance the value of the surrounding residential property. He
pointed out there is a great deal of vacant property only about two blocks away
on Lexington already zoned for business and related types of industry, and that
the Council just recently denied another application in the near neighborhood;
but felt the apartment building would be most welcomed by most people in the
neighborhood.
Motion by Maldonado, seconded by Blackmon and passed that the hearing be
closed.
Motion by Blackmon, seconded by de Leon and passed that this application
be tabled for one week.
Mayor Pro Tem Young announced the public hearing on Application 056-1,
The Chris -Rae Corporation, for change of zoning from "R -1B" One -family Dwelling
District to "B-4" General Business District on a 31.496 -acre tract out of Lots 9
and 10, Section 18, Flour Bluff and Pncinal Farm and Garden Tracts.
Tom Lake located the property on the map; pointed out the zoning and
land use of the area; stated that Mr. Ray Peterson, representing the Corporation,
Fred Quaile, realtor, and Dr. Harold N. Siemer all spoke in support of the request
at the Commission hearing; that nine notices were sent out, two returns were re-
ceived in favor of the request and none against; and that the recommendation of
the Zoning & Planning Comunission was that it be approved as submitted.

stated that he felt it would enhance property values in this area and further
encourage development in the area. He mentioned that Hulen Hunt is ready to
build across the road, and that Bob Swamtner has plans for developing his 160
acres nearby as soon as the drainage is taken care of, and that both are in
favor of the application.
No one appeared in opposition.

Mayor Pro Tem Young asked what was the Council's pleasure with re-
gard to the pending item of Application #265-5, Lowell Benefield, for change
