SPECIAL COUNCIL MEETING
April 21, 1965

Mayor Pro Tem Jack R. Blackmon called the meeting to order in absence of
Mayor McIver Furman.
City Secretary T.•Ray Kring called the roll of those in attendance.
Motion by Sizemore, seconded by Jimenez and passed that the absence of
Mayor McIver Furman and of Commissioner Wm. H. Wallace be excused for cause.
Mayor Pro Tem Blackmon explained the purpose of the special meeting to hold
public hearings on several zoning cases, and explained the procedure to be followed.
Mayor Pro Tem Blackmon announced the public hearing on Application #265-7,
South Texas Realty Company, for change of zoning from "B-1" Neighborhood Business
District to "B-4" General Business District on all of Lot 24, Block 5, Lexington
Estates.
Tom Lake, Zoning Coordinator, located the property on the map; pointed out
the zoning and land use of the area; stated that the applicant appeared at the Com-
mission hearing in support of the request, and no one in opposition; that twenty
notices were sent out, one return received in favor of the request, and three against;
and that the recommendation of the Zoning & Planning Commission was that it be denied
on the basis that the general area is not construed as a general business area, and
permitted uses of the "B-4" district are not compatible with the existing adjacent
development.
0. W. Whitley, the applicant) pointed out the "B-4" zoning across the street,
and that Lexington will eventually be all business; showed three different designs of
the type of free-standing signs he desires; and explained that his Golden Dome Hamburger
Stand complies with all of the setback requirements and regulations of the "B-4"
district, but that all he is trying to get is a sign large enough to be seen at a
distance by the motoring public, since this is the only way he can protect his invest-
ment.

Fred Quaile, realtor, suggested that in lieu of the 'B-4" zoning, a special
permit be granted for the desired sign.
Commissioner Jimenez was in favor of allowing the sign; Commissioner McDaniel
felt if an exception was granted in this instance, it would have to be granted every-
where; and the Chair pointed out that it takes the affirmative vote of a majority
plus one of the Council to over -rule the recommendation of the Zoning Commission,
and that two of the Council were not present.
Motion by McDaniel, seconded by Dunne and passed that the hearing be closed.
Motion by Dunne, seconded by McDaniel and passed that the foregoing appli-
cation be tabled for one week.
Mayor Pro Tem Blackmon announced the public hearing on Application #265-8,
Signal Oil & Gas Company, for change of zoning from "B-1" Neighborhood Business District
to "B-4" General Business District on all of Lots 9 and 10, Block 4, Sunflower Addi-
tion #2.
Tom Lake located the property on the map; pointed out the zoning and land
use of the area; stated that the attorney representing the applicant, two persons
connected with the company, and one adjacent property owner appeared at the Commis-
sion hearing in support of the application, and four persons spoke in opposition;
that twenty-seven notices were sent out, four returns received in favor of the re-
quest, and five in opposition; and that the recommendation of the Zoning & Planning
Commission was that it be denied on the basis that the general area is not construed
as a general business area, and permitted uses of the 'B-4" district are not com-
patible with the existing adjacent development.
Jake Jarmon, attorney representing the applicant, stated that the request for
'B-4" zoning was filed in order to be allowed more sign area than the 40 -square
feet permitted under the "B -l" district; that the applicant was requesting a total
of four signs, one 25' x 3' free-standing sign from 25 feet above the surface of
the ground, and three signs 24' x 8', standing 3 feet above the ground, the one
being a double -billboard type to direct the attention of the motorist travelling east
and west on Gollihar. He pointed out that those who were opposed to the request,
spoke against the business zoning but not against the signs. He explained that the

Board of Adjustment had granted a portion of :their sign,request; but that before they
were able to construct the station, the power to grant sign variances had been taken
away from the Board. In answer to a question from the Council, Mr. Jarmon explained
that the bill -board sign is actually a part of the building structure and act as a
fencing for adjacent property, and that the Hancock sign is nationwide and as standard
as the Enco, Humble and Texaco signs.
John Thomason, speaking in support of the request for the signs, pointed out
that at the Board of Adjustment hearing, the representative of the Signal Oil &
Gas Company from Houston had stated that they have several hundred service stations
in many cities over the nation, and this was the first time they had had a problem
in getting approval of this standard free-standing sign. Mr. Thomason pointed out
that almost all retailers on a national level eventually request signs larger than
the zoning ordinance permits, and suggested a review of the sign requirements in
the various zoning classifications so that this problem will not be repeatedly
coming before the Council.
No one appeared to speak in opposition to the request.
Motion by McDaniel, seconded by Dunne and passed that the hearing be closed.
Motion by McDaniel, seconded by Dunne and passed that the foregoing applica-
tion be tabled for one week.
Mayor Pro Tem Blackmon announced the public hearing on Application #365-2,
Mrs. Georgia Lee Price, for change of zoning from "A-2" Apartment House District
to "I-2" Light Industrial District on all of Lot 39 and the remainder of Lot 18,
Block 6, Montrose Park Addition.
Tom Lake located the property on the map; pointed out the zoning and land
use of the area; stated that thirty-one notices were sent out, five returns were
received in favor of the request, and two in opposition; that Fred Quaile and
John Thomason had appeared at the Commission hearing in support of the request,
and no one appeared in opposition; and that the recommendation of the Zoning &
Planning Commission was that it be approved as submitted.
Mr. Quaile &,Mr.Thomason were present in support of the application, and
Mr. Thomason pointed out that the "B-4" zoning would be acceptable and would

accomplish their proposed use of the property, but that they had applied for the
"I-2" since the balance of the property under the same ownership is so zoned, and
the subject property will be for the extension of the existing service station use.
No one appeared in opposition.
Motion by Sizemore, seconded by Dunne and passed that the hearing be closed.
Motion by Sizemore, seconded by Dunne and passed that the recommendation of
the Zoning & Planning Commission be concurred in, and that an ordinance be brought
forward changing the zoning on all of Lot 39 and the remainder of Lot 18, Block 6,
Montrose Park Addition, from "A-2" to "I-2" Light Industrial District.
Mayor Pro Tem Blackmon announced the public hearing on Application #365-5,
W. D. Moschel, Trustee, for change of zoning from "8-1B" One -family Dwelling District
and "A-1" Apartment House District to "8-4" General Business District on the remainders
of Lots 1, 64 and 65, Baymoor Addition, and the remainder of Lot "A," Baymoor Annex.
Tom Lake located the property on the map; pointed out the zoning and land use
of the area; stated that the applicant, representing Gulf Oil Company, and three
additional persons, appeared at the Commission hearing in support of the applica-
tion, and no one in opposition; that twenty-five notices were sent out, eleven
returns received in favor of the request, and one in opposition; and that the recom-
mendation of the Zoning & Planning Commission was that it be approved as submitted.
W. D. Moschel, applicant, was present in support of the request.
No one appeared in opposition.
Motion by McDaniel, seconded by Sizemore and passed that the hearing be closed.
Motion by Jimenez, seconded by McDaniel and passed that the recommendation of
the Zoning & Planning Commission be concurred in, and an ordinance be brought for-
ward changing the zoning on the remainders of Lots 1, 64 and 65, Baymoor Addition,
and the remainder of Lot "A," Baymoor Annex, from "R -1B" and "A-1" to "8-4" General
Business District.
Mayor Pro Tem Blackmon announced the public hearing on Application #365-6,
Pete Burgess, for change of zoning from "A-1" Apartment House District to "18-1"
Neighborhood Business District on all of Lots 19 and 20, Block 25, Nueces Bay
Heights Extension.

Tom Lake located the property on the map; pointed out the zoning and land
use of the area; stated that the applicant and his father-in-law appeared at the
Commission hearing in support of the request, and no one appeared in opposition;
that seventeen notices were sent out, no returns were received in favor, and two
were received in opposition; and that the recommendation of the Zoning & Planning
Commission was that it be approved as submitted. Mr. Lake explained that a drive-in
grocery is proposed to be constructed on the front portion of the subject property
to be operated by the applicant's father-in-law since his existing store is no longer
profitable in its present area.
No one appeared in connection with this application.
Motion by Sizemore, seconded by Jimenez and passed that the hearing be closed.
Motion by McDaniel, seconded by Jimenez and passed that the recommendation of
the Zoning & Planning Commission be concurred in, and an ordinance be brought for-
ward changing the zoning on all of Lots 19 and 20, Block 25, Nueces Bay Heights
Extension, from "A-1" to "B-1" Neighborhood Business District.
Mayor Pro Tem Blackmon announced the public hearing on Application #365-7,
Mrs. C. H. Duff, for change of zoning from "R -1A" One -family Dwelling District to
"B-1" Neighborhood Business District on a 0.416 acre portion of Tract "A," Calallen
Annex.
Tom Lake located the property on the map; pointed out the zoning and land use
of the area; stated that the applicant had appeared in support of the request at
the Commission hearing, and no one in opposition; that four notices were sent out,
and no returns were received either in favor or in opposition to the request; and
that the recommendation of the Zoning & Planning Commission was that it be approved
as submitted. Mr. Lake added that the applicant was in the process of platting the
property.
Mrs. C. H. Duff, applicant, speaking in support of the request, stated that
she lives there and would like to operate her beauty shop there, and that she needs
the zoning to allow a sign large enough to be seen at this highway location.
No one appeared in opposition.
Motion by McDaniel, seconded by Dunne and passed that the hearing be closed.

Motion by Jimenez, seconded by Sizemore and passed that the recommendation
of the Zoning & Planning Commission be concurred in, and an ordinance be brought
forward changing the zoning on the 0.416 acre portion of Tract "A," Calallen Annex,
described in the application, from "R -1A" to "B-1" Neighborhood Business District.
Motion by Dunne, seconded by Sizemore and passed that the special meeting be
adjourned.
