Ray Kring Mayor McIver Furman called the meeting to order. The Invocation was given by the Reverend A. C. Bell, Pastor of First Methodist Church. City Secretary T. Ray Kring called the roll of those in attendance. Motion by Blackmon, seconded by Sizemore and passed that the minutes of the regular meeting of April 21, 1965, at 2 p.m., and of the special meeting of the same day at 3:30 p.m., be approved as furnished to the Council. Motion by Blackmon, seconded by Dunne and passed that the absence of Commissioner Wm. H. Wallace be excused for cause. Mayor Furman issued and read proclamations relative to the following: LOYALTY DAY in Corpus Christi, May 1, 1965; accepted by Mr. Gerald F. Taber; and LET'S BEAUTIFY AMERICA MONTH in Corpus Christi, May, 1965. Mayor Furman called for appointments to the Board of Equalization. Motion by Blackmon, seconded by Dunne and passed that Bill G. Read be reappointed, and Virgil Howard and Jay Davis be appointed as the Board of Equal- ization. Bill Read and Virgil Howard were present to accept Certificates of Appointment. Mayor Furman called for appointments to the Housing Authority. Motion by Jimenez, seconded by Sizemore and passed that Rosa Garza and Rev. Harold T. Branch be reappointed to the Housing Authority. Mrs. Garza and Rev. Branch were present to accept Certificates of Appointment. Mayor Furman called for appointment of three members to the Traffic Safety Advisory Board. Motion by McTniel, seconded by Dunne and paseed that Guy Alexander, Mrs. William Bonilla, and Sigmund J. Henry be appointed to the Traffic Safety Advisory Board. Bids were opened and read on several items of Traffic Control Equipment from the following: Kar-Trol; Nunn Electric Supply Corp.; and Signal Sales & Maintenance Corp. The foregoing bids were tabled for forty-eight hours as required by City Charter, and referred to the City Manager for tabulation and recommendation. Bids were opened and read for City Depository from the following: Corpus Christi Bank & Trust Co,; and. Corpus Christi State National Bank. Mayor Firman announced the pending item of Application #265-7, South Texas Realty Company, for a change of zoning from "B-1" Neighborhood Business District to "B-4" General Business District on all of Lot 24, Block 5, Lexington Estates, on which public hearing was held April 21, 1965. City Manager Whitney pointed out that the request for "B-4" zoning vas made because of the sign problem; presented a sketch of the proposed sign; and explained that the "B-1" regulations allow a forty square foot freestanding sign, non -flashing, not above the roof line, unlimited size flat against the wall of the building, no free-standing billboards, and advertising limited to primary use of the property; and that the "B-4" regulations put no limit on the size or height as long as the sign advertises only the primary use of the premi.ees, except that only forty square feet of free-standing sign is allowed in the twenty foot front yard setback area. Motion by McDaniel, seconded by Jimenez and passed that the request for Change of zoning be denied, but that a Special Council Permit be granted for a sign not to exceed 120 square feet in area, not to exceed thirty feet in height, ru,ri nrt 'S[+.hin i:hn tsar -tar! - .' amkt..m 9_ , on Lot 24, Block 5, Lex- ington Estates. Mayor Furman announced the pending item of Application #265-8, Signal Oil & Gas Company, for change of zoning from "B-1" Neighborhood Business District to "B-4" General Buainese District on all of Lots 9 and 10, Block 4, Sunflower Addition #2, on which public hearing was held April 21, 1965. Minutes City of Corpus Christi, Texas Regular Council Meeting April 28, 1965 Page 3 0 City Manager Whitney pointed out that this request for "B-4" zoning also vas made with respect to signs; and pointed out that the applicant desired to be allowed to erect signs totaling 816 square feet, incluAing one seventy-five square foot free-standing sign. In the discussion that followed, the Council felt that due to the residential zoning and use of the area, anything beyond 100 square feet vas too much. Motion by Blackmon, seconded by Sizemore and passed that this application be deferred for one week, and that the applicant be requested to submit something along the lines of a free-standing sign not exceeding 100 square feet for the Council's consideration. Mayor Furman called for the City Manager's Reports. Motion by Rlacioson, seconded by Sizemore and passed that the City Mana- ger's Reports be accepted, and the recommendations and requests be approved and granted, as follows: a. That the award of contract to T. H. Lee in the amount of $218,309.84 for construction of the Turkey Creek Interceptor Sewer, a portion of Line 25A, be approved, subject to final approval by the State Department of Health and the U.S. Public Health Service; and that appropriation in the sum of $2110,000.00 be granted; b. That the plans and specifications for the proposed Street Improve- ments, under the Voluntary Paving Program, on North, West and South Saxet Drives, on Brooks Drive between North and South Saxet, and on Fifteenth Street from Morgan to Craig, be approved; and that authority to advertise for bids to be received on May 19, 1965, be granted; c. That appropriation out of Park Trust Funds paid by subdivision de- velopers in lieu of land dedication, be granted in the sum of $8,500.00 for the initial development of a portion of South Guth Park; d. That the Tax Error and Correction Lists for November and December for the City and the Water District, of 1964,/be approved; e. That the date of May 19, 1965, during a special meeting convening at 3:30 p.m., be set for public hearing on four zoning applications; f. That the owner or tenant of the George Jones building at the corner Of Cooper and West Shoreline be permitted to finish painting the sign, on both Minutes City of Corpus Christi, Texas Regular Council Meeting April 28, 1965 Page 4 that is presently under controversy with the City, subject to the execution by both the owner and the tenant of an agreement satisfactory to the City's Legal Department, which would stipulate that if the decision of the Council is adverse to this sign, then the sign will be removed by overpainting without further ado until the matter of the right to maintain such sign shall be resolved. ORDINANCE N0. 7557 AUTHORIZING AND DIRECTING MRF CITY MANAGER, FOR AND ON BEHALF OF 'i'HH; CITY OF CORPUS CHRISTI, TO Ex1CUTE A CONTRACT WITH T. H. T,H'F FOR CONSTRUCTION OF THE TURKEY CREEK INTERCEPTOR SEWER, A PORTION OF LINE 25A AND DESIGNATED AS PROJECT NO. 250-64-36.4, SAID CONTRACT AWARD TO BE SUBJECT TO FINAL APPROVAL OF THE STATE DEPARTMENT OF HEALTH ARD U. S. PUBLIC HEALTH SERVICE; APPROPRIATING OUT OF N0. 250 SANITARY SEWER BOND FUNDS THE SUM OF $240,000 of WHICH AMOUNT $218,309.84 IS FOR THE CONSTRUCTION CONTRACT AND $21,690.16 IS FOR CONTINGENCIES, INCLUDING ENGINEERING STAKING AND DETAIL INSPECTIONS, LABORATORY TESTING AND LEGAL ADVER- TISING COSTS; AND DECLARING AN EMERGENCY. NO. 7560 AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A REVOCABLE EASEMENT TO HOUSTON PIPE LINE COMPANY TO PLACE A PIPELINE CONSISTING IN PART OF 4" PIPE AND IN PART 6" PIPE WITHIN THE CITY AT CORPUS CHRISTI INTERNATIONAL AIRPORT AT A CROSSING OF KOSAR ROAD, A CROSSING OF HIGHWAY 44 AND OTHER PUBLIC ROAD CROSSINGS, ALL AS MORE FULLY DESCRIBED IN SAID REVOCABLE EASEMENT, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF; AND DECLARING AN EMERGENCY. ORDINANCE N0. 7561 APPROPRIATING OUT OF NO. 295 STORM SEWER BOND FUND THE SUM OF $2700.00, OF WHICH AMOUNT $1200.00 IS FOR ESTIMATED APPRAISERS, AND WITNESS FEES AND THE SUM OF $15uu,00 IS FOR COURT COSTS AND TRANSCRIPT. OF COURT PROCEEDINGS, IN CONNECTION WITH ACQUISITION OF PARCELS 3 AND 4, APPLICABLE TO PROJECT NO. 29544-37.1, SOHABEN DRAINAGE DITCH RELOCATED; AND DECLARING AN EMERGENCY. ORDINANCE NO. 7562 APPROPRIATING OUT OF TRUST FUND ACCOUNT NO. 1781, THE SUM OF $8,500 FOR THE DE- VELOPMENT OF A THREE -ACRE PLAYGROUND IN SOUTH GUTH PARK, ADJOINING PHARAOH VALLEY SUBDIVISION, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TERAS; AND DECLARING AN EMERGENCY. The Charter rule was suspended, and the foregoing ordinance was passed by the following vote: Furman, Blackmon, Dunne, Jimenez, McDaniel and Sizemore all present end voting "Aye," and Wallace absent. In connection with the first reading of a proposed ordinance relative to amending the City Code with respect to speed limits for railroad cars within the City, Mr. McKeithan, Superintendent of the Missouri -Pacific, stated that his company operates in the Q1A» en area and is in favor of the ordinance, but re- quested the insertion in Section 30-6.1, Speed Limit Exceptions, of the wording that maximum speeds shall be permitted by any railroad engine moving alone or pushing or pulling one or more cars. Motion by Sizemore, seconded by Blackmon and passed that Section 30-6.1 of the proposed ordinance relative to speed limits for railroad cars be amended before the first reading to read, as follows: "Notwithstanding the speed limits ( Minutes City of Corpus Christi, Texas Regular Council Meeting April 28, 1965 Page 6 set forth in Sections 30-5 and 30-6 of this Code, the following maximum speeds shall be permitted by any railroad engine moving alone or pushing or pulling one or more cars in the below designated areas:" FIRST READING OF AN ORDINANCE AMENDING SECTIONS 30-5 AND 30-6 OF THE CORPUS CHRISTI CITY CODE, 1956, AS AMENDED, BY STRIKING ALL OF SAID SECTIONS AND IN LIEU THEREOF ADOPTING NEW SECTIONS 30-5, 30-6 AND 30-6,1 PROVID1nt, FOR A SPEED LIMIT FOR RAILROAD CARS BEING PULLED BY ANY RAILROAD ENGINE; PROVIDING FOR A SPEED LIMIT FOR RAILROAD CARS BEING PUSHED BY ANY RAILROAD ENGINE; PRO- VIDING FOR CERTAIN EXCEPTIONS; CONTAINING A SEVERABILITY CLAUSE; REPEALING ALL ORDINANCES IN CONFLICT THEREWITH; PROVIDING FOR PUBLICATION. The foregoing ordinance was read for the first time and passed to its second reading by the following vote: Furman, Blackmon, Dunne, Jimene, McDaniel and Sizemore all present and voting "Aye," and Wallace absent. City Manager Whitney presented and read a petition of approximately 125 signatures of residents of Glen Arbor Addition for the immediate installation of flashing yellow lights to be used during sehool hours, near the intersection of Williams Drive and South Staples Street, and Cain Drive and South Staples, for a Safety Sally at Cain Drive, and for the lowering of the speed limits in this area. (Petition #65-3), Due to the possible emergency need involved, the matter was referred to the Traffic Engineer for technical information, such as traffic and pedestrian counts, and signel.ization installation information, to be furnished for Monday's Work Shop, City Manager Whitney reported on the progress made following the pre- sentation of W. A. Scholl, Local 936, International Association of Firefighters, at last week°s meeting regarding certain grievances of firemen, and certain per- sonal grievances, Mr. Scholl, present with several firemen and their wives, stated that he was satisfied with the progress so far, and had no further in- formation to give the Council, and that he would await the written replies men- tioned by Mrs Whitney. Mrs, N. E. Sullivan, 3714 Liberty Drive, presented a petition of approx- imately sixty-six signatures of property owners on Liberty Drive, requesting the restoration of Liberty Drive at City2s expense since the street was in good con- dition before the installation by the City of a drainage systems (Petition #65-4), The foregoing petition was referred to the City Manager for appropriate action. Minutes City of Corpus Christi, Texas Regular Council Meeting April 28, 1965 Page 7 Cary Fitch, resident and owner of a commercial, wire -transmitted music system, explained the details of his unsuccessful efforts to arrange for satis- factory telephone service with Southwestern Bell Telephone Company for his opera- tion. He Pelt that since the telephone company uses City streets, alleys, etc. for their poles and lines, that they should be required to obtain a franchise, and urged that the Council require a franchise, and stated that he would like to apply for each frandhise himself. He further stated that he had information that the telephone company is in violation of the City Electrical Code with respect to the number of volts applied to a line without City inspection, and that this matter is being investigated presently by the City's Inspection Division. Mayor Furman asked Mr. Fitch to submit a draft of his proposal for a franchise to the City Manager, and the matter would be given every consideration. There being no further business to come before the Council, the meeting was adjourned.
