Ray Kring Mayor McIver Furman called the meeting to order. The Invocation was given by the Rt. Rev. Msgr. Edward J. Miller, pastor of St. Patrick's Church. City Secretary T. Ray Kring called the roll of those in attendance. Motion by Blackmon, seconded by Dunne and passed that the absence of Commissioner Wm. H. Wallace be excused for cause. Motion by Blackmon, seconded by Dunne and passed that approval of the minutes of the regular meeting of April 28, 1965, be deferred until the special meeting at 3:30 today in order to obtain some additional information on one item. Mayor Furman read and presented proclamations relative to the following: OPPORTUNITIES FOR PROGRESS DAYS in Corpus Christi, May 10-11, 1965; BOYS'CITY WEEK in Corpus Christi, May 9-16, 1965; accepted by Steve Brown, who invited the Mayor and Council to Open House on May 16th, 3:00 to 5:00 p.m.; GOLF WEEK in Corpus Christi, May 9-15, 1965; accepted by Mrs. J. C. Horton, who invited the Mayor and Council to play in the Scotch Foursome, and the Mayor to present the prizes at the 32nd Annual Texas Women's Public Links Championship Golf Tournament on May 15th; TEXAS NURSE WEEK, May 9-15, 1965; accepted by Mrs. Flint; PRACTICAL PATRIOTS MONTH in Corpus Christi, month of May; accepted by Joyce Key; CIRCO DE MAYO DAY in Corpus Christi, May 5, 1965. Mayor Furman announced the opening of bids. Bids were opened and read on construction of Ocean Drive Street Improve- ments, Unit I, from Craig to Furman, from the followings Womack & Manning; and Heldenfels Brothers. The foregoing bids were tabled for forty-eight hours as required by City Charter, and referred to the City Manager for tabulation and recommendation. City of Corpus Christi, Texas Regular Council Meeting May 5, 1965 Page 2 Mayor Furman brought up the pending item of Application #365-3, Lowell W. Benefield, for change of zoning from "R -1B" One -family Dwelling District to 'B-1" Neighborhood Business District on Tract I, southwest corner of the intersection of McArdle and Everhart, and from "R -LB" One -family Dwelling District to "A-1" Apart- ment House District on Tract II, adjacent to Tract I on McArdle, on which public hearing was held April 21, 1965. Motion by Blackmon, seconded by McDaniel and passed that this matter be de- ferred until after consideration of a zoning request in the same block at the special meeting scheduled for later in the afternoon. Mayor Furman brought up the pending item of Application #265-8, Signal Oil & Gas Company, for change of zoning from "B-1" Neighborhood Business District to 'B-4" General Business District on all of Lots 9 and 10, Block 4, Sunflower Addition 9k2, on which public hearing was held April 21, 1965. City Manager Whitney presented a letter received from Jake Jarmon, attorney representing the applicant, to the effect that it is the applicant's desire to in- stall a sign on the existing free-standing pole not to exceed 100 square feet, and that it is understood that this precludes the billboard type of sign. Mr. Whitney presented a picture of the sign, stating he believed it was twenty-five feet long and three feet high, except for the circle on the end of the sign, and that it would appear that the applicant was asking for in the neighborhood of seventy-nine or eighty square feet, and that City Secretary kring has asked Mr. Jarmon to ascertain from his client the exact area of the proposed sign. Motion by Blackmon, seconded by Sizemore that the change of zoning be denied, but that in lieu a special permit be granted for a single free-standing sign not to exceed eighty square feet. Commissioner McDaniel suggested that the applicant be given a little leecaay to accommodate the standard sign, and that the motion be amended to allow up to eighty-five to ninety feet. Motion by Blackmon, seconded by Sizemore and passed that the change of ton- ing be denied, but that in lieu a special permit be granted for a single free-stand- ing, standard Hancock sign, not to exceed eighty-five square feet. Motion by McDaniel, seconded by Sizemore and passed that the City Manager's Reports be accepted, and the recommendations and requests be approved and granted, as follows: a. That acceptance and payment of final Estimate No. 2 in the amount of $1,993.10 to Clements Electric Company for installation of additional utilities for the Coliseum, be approved; b. That the award of bid be made, and the Corpus Christi State National Bank be designated as City Depository for the next two years, to be covered by ordinance; (Bid Tabulation #14) c. That the award of bid be made on the basis of low bid meeting specifi- cations to Signal Sales & Maintenance Corporation in the amount of $4,608.29 for Traffic Control Equipment consisting of one three-phase fully actuated traffic signal controller with one pedestrian interval timer, two six-foot and two 8 -foot pressure sensitive vehicle detectors, one loop detector, and two pedestrian push buttons; one three-phase fully actuated controller with one railroad pre-emptor unit, and one six-foot and one eight -foot directional pressure sensitive vehicle detector; nine three -section one-way traffic signals with twelve -inch red, amber and green lenses; four three -section one-way traffic signals with twelve -inch red, amber, and arrow lenses; and two pedestrian signals; (Bid Tabulation #15) d. That authority to advertise for bids to be received on May 26, 1965, on approximately 50,000 linear feet of Copper Tubing of various sizes and lengths be granted; e. That authority to advertise for bids to be received on May 19, 1965, on various quantities of Bare Steel Pipe, ranging in sizes from one -inch to sixteen inches, be granted; f. That authority to advertise for bids to be received on May 19, 1965, on Coating and Wrapping of Steel Pipe be granted; E. That the date of May 19, 1965, during the regular meeting, be set for public hearing on the Appeal of Adolph G. Estrada from the Decision of the Taxicab Inspector in revoking his Taxicab License; City of Corpus Christi, Texas Regular Council Meeting May 5, 1965 Page 4 h. That public hearing on the application of David H. Geiser for permit to drill an oil and/or gas well, Well #1, Annie Blake Head, Lot 65 of Artemus R. Roberts Resubdivision of the T. T. Elliott Farm Lots, Nueces County, be held at this time; i. That public hearing on the application of Richardson Petroleum Enter- prises, Inc. for permit to drill a well, Well #1, Fred Frank Lease, Saxet Field, Nueces County, be held at this time. City Manager Whitney presented for public hearing the application of David H. Geiser for permit to drill an oil and/or gas well, Well #1, Annie Blake Head, in Lot 65 of Artemus R. Roberts Resubdivision of the T. T. Elliott Farm Lots, Nueces County. Mr. Whitney pointed out the location of the proposed well on the plat attached to the application between Highway 44 and Highway 9, and between McKenzie Road and Violet Road north of Highway 44 and west of the Clarkwood community; pointed out that the proposed depth is 4100 feet; that all of the necessary documents have been submitted and appear to be in compliance with the Ordinance; that the Public Works Department has inspected and checked the proposed site of the well as to dis- tance requirements; and recommended that the application be approved and the permit be issued. No one appeared in opposition to the request. City Manager Whitney presented for public hearing the application of Richard- son Petroleum Enterprises, Inc. for permit to drill a well, Well #1, Fred Frank Lease, Saxet Field, Nueces County, and pointed out the location of the proposed well on the plat generally west of Clarkwood road between Highway 9 and UpRiver Road; and pointed out the proposed depth is 5,000 feet. Mr. Whitney explained that all of the necessary documents have been submitted and appear to be in compliance with the Ordinance; that the Public Works Department has inspected and checked the proposed site of the well as to distance requirements; and recommended that the application be approved and the permit issued. No one appeared in opposition to the request. Motion by McDaniel, seconded by Sizemore and passed that the recommendations of the City Manager be accepted, and that the applications of David H. Geiser for permit to drill an oil and/or gas well, Well #1, Annie Blake Head, Lot 65 of Artemus R. Roberts Resubdivision ofthe T. T. ORDINANCE N0. 7563 RECEIVING AND ACCEPTING THE CONSTRUCTION, CONSISTING OF THE INSTALLATION OF ADDITIONAL UTILITIES FOR THE COLISEUM, AS PERFORMED BY THE CONTRACTOR, CLEMENTS ELECTRIC COM- PANY, UNDER THEIR CONTRACT DATED FEBRUARY 3, 1965, AUTHORIZED BY ORDINANCE N0. 7482; AUTHORIZING PAYMENT OF FINAL ESTIMATE N0. 2 DATED APRIL 27, 1965, IN THE AMOUNT OF $1,993.10, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, SAID PAYMENT TO BE MADE FROM FUNDS PREVIOUSLY APPROPRIATED IN THE COLISEUM CONSTRUCTION BUDGET, ACTIVITY N0. 4161, CODE 502; AND DECLARING AN EMERGENCY. The Charter rule was suspended and the foregoing ordinance was passed by the following vote: Furman, Blackmon, Dunne, Jimenez, McDaniel and Sizemore, present and voting "Aye"; Wallace, absent. ORDINANCE N0. 7564 AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE AN ENCROACHMENT AGREEMENT WITH JOHN W. STAMPS AND WIFE, GRACE INEZ STAMPS, WHEREBY THE CITY AGREES TO PERMIT THE SAID JOHN W. STAMPS AND WIFE, GRACE INEZ STAMPS, TO LEAVE THOSE PORTIONS OF A DWELLING UNIT, A STORAGE BUILDING, THE COVERED CARPORT AND THE CONCRETE DRIVEWAY LOCATED ON LOT 28, BLOCK 6, WEST - CHESTER PLACE SUBDIVISION, TO REMAIN AT THEIR PRESENT LOCATION AS ENCROACHMENTS ON THE UTILITY EASEMENT IN SAID LOT 28, BLOCK 6, WESTCHESTER PLACE. ORDINANCE N0. 7565 APPROPRIATING OUT OF N0. 220 STREET BOND IMPROVEMENT FUND THE SUM OF $5,000.00 FOR INCIDENTAL EXPENSES IN ACQUIRING PROPERTY FOR THE CROSSTOWN EXPRESSWAY PROJECT, INCLUDING COMMISSIONERS, RECORDING AND APPRAISERS FEES, AND COURT COSTS AND TITLE EXPENSES, ALL EXPENSES TO BE PAID ON RECOMMENDATION OF THE CITY ATTORNEY AND THE APPROVAL OF THE CITY MANAGER; AND DECLARING AN EMERGENCY. ORDINANCE NO. 7566 AMENDING THE CORPUS CHRISTI CITY CODE, 1958, AS AMENDED, BY AMENDING A PORTION OF SECTION 21-68, AS AMENDED, SO AS TO FIX A SPEED LIMIT OF 35 MILES PER HOUR IN BOTH DIRECTIONS ON THAT PORTION OF STAPLES STREET FROM TEXAS AVENUE TO HOLLY ROAD; PR0- VIDING FOR PUBLICATION; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLAR- ING AN EMERGENCY. FIRST READING OF AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A LEASE AT THE CORPUS CHRISTI INTERNATIONAL AIRPORT WITH THE UNITED STATES OF AMERICA FOR THE LEASING OF QUARTERS FOR AIRPORT TRAFFIC CONTROL TOWER AND SYSTEMS MAINTENANCE SECTOR, FEDERAL AVIATION AGENCY, A COPY OF WHICH LEASE IS ATTACHED HERETO AND MADE A PART HEREOF. The foregoing ordinance was read for the first time and passed to its second reading by the following vote: Furman, Blackmon, Dunne, Jimenez, McDaniel and Sizemore, present and voting "Aye"; Wallace, absent. FIRST READING OF AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A LICENSE AGREEMENT WITH THE FEDERAL AVIATION AGENCY FOR THE LOCATION OF AN APPROACH LIGHT LANE AND AN ELECTRONIC FLASH- ING APPROACH LIGHT, THE INSTRUMENT LANDING SYSTEM, MIDDLE MARKER, AND REMOTE TRANS- MITTER AT THE CORPUS CHRISTI INTERNATIONAL AIRPORT, The foregoing ordinance was read for the first time and passed to its second reading by the following vote: Furman, Blackmon, Dunne, Jimenez, McDaniel and Sizemore, present and voting "Aye"; Wallace, absent. In answer to questions from the Council in connection with the second reading of a proposed ordinance relative to the speed limits for railroad cars within the City Limits, City Manager Whitney explained the amendment was based on recommendations of the Traffic Safety Advisory Board after conferences with rail- road representatives, but that he believed that one or two of the Staff had some reservations about the proposed speed limits. The Chair requested that recommendations from the Staff be presented to the Council prior to the final reading of this ordinance. SECOND READING OF AN ORDINANCE AMENDING SECTIONS 30-5 AND 30-6 OF THE CORPUS CHRISTI CITY CODE, 1958, AS AMENDED, BY STRIKING ALL OF SAID SECTIONS AND IN LIEU THEREOF ADOPTING NEW SECTIONS 30-5, 30-6 AND 30-6,1 PROVIDING FOR A SPEED LIMIT FOR RAIL- ROAD CARS BEING PULLED BY ANY RAILROAD ENGINE; PROVIDING FOR A SPEED LIMIT FOR RAILROAD CARS BEING PUSHED BY ANY RAILROAD ENGINE; PROVIDING FOR CERTAIN EXCEPTIONS; CONTAINING A SEVERABILITY CLAUSE; REPEALING ALL ORDINANCES IN CONFLICT THEREWITH; PROVIDING FOR PUBLICATION. The foregoing ordinance was read for the second time and passed to ite third reading by the following vote: Furman, Blackmon, Dunne, Jimenez, McDaniel and Sizemore, present and voting "Aye"; Wallace, absent, Tony Juarez, 5217 Bell, described the conditions in the Lexington. Center area with respect to the septic tanks and his attempts to correct the situation City of Corpus Christi, Texas Regular Council Meeting May 5, 1965 Page 7 with regard to his property; and presented a petition of approximately twenty signa- tures for the City to install sewer lines in the Lexington Center area. (Petition #65-5). He presented a letter he has received from the City -County Health Depart- ment notifying him of the ways in which he is in violation of the City Plumbing Code and the State of Texas Sanitation and Health Protection Laws; and a letter from the president of the Corpus Christi Savings & Loan Association stating that had they known that this condition existed at the time the loan application was made, they would not have approved the loan. The matter was referred to the City Manager for investigation and recommen- dation. Jim E. Hernandez, 3903 Navajo, presented a petition of residents in the immediate vicinity of the Baldwin and Balboa Street intersection describing the traffic situation and requesting the City to install a traffic light at this intersection. (Petition 465-6)e City Manager Whitney informed the Council that he is presently investigating the foregoing matter, and will report to the Council as soon as possible. There being no further business to come before the Council, the meeting was adjourned.
