SPECIAL COUNCIL MEETING
May 19, 1965

Mayor McIver Furman called the meeting to order.
City Secretary T. Ray Kring called the roll of those in attendance.
Mayor Furman announced the purpose of the special meeting to hold public
hearings on several zoning applications, and explained the procedure to be followed.
City Secretary Kring identified the first public hearing on Application
#465-1, W. L. Bates Company, for change of zoning from "A-1" Apartment House Dis-
trict to "1-2" Light Industrial District on a 2.199 -acre tract, being all of
Block 19 and a portion of Fisher Street, save and except a portion of Lot 6,
Forest Park.
Tom Lake, Zoning Coordinator, located the property on the map; pointed
out the zoning and land use of the property in the area; stated that four persons,
including a realtor representing the applicant, two persons representing Norvell-
Wilder Company who plan to use the property, and a realtor representing nearby
property owners, spoke in favor of the request at the Commission hearing, and
one person in opposition; that thirteen notices were sent out, two returns were
received in favor, and one in opposition; and that the recommendation of the
Zoning & Planning Commission was that it be approved as submitted. Mr. Lake
added that Norvell-Wilder Company, which deals in oil field supplies, plans to
use this property for its operation; and explained that Fisher Street at one time
extended through Leopard, Antelope and Buffalo Streets but has been vacated, and
one can no longer drive through from Antelope to Buffalo, but that it was included
in the application as part of the description. Mr. Lake also pointed out the
location with respect to the subject property of the properties whose owners
indicated support of the request or opposition.

W. L. Bates, applicant, appeared in support of the request and stated
he plans to relocate an oil well supply business on the property subject to the
approval of the zoning from the present location now located next to the Citizens
State Bank.
Ben F. McDonald, owner of the lot immediately west of the Forest Park
Baptist Church property, spoke in support of the request on the basis that he
thinks the location is admirably suited to the type of business proposed.
John Mobley, president of Citizens State Bank, stated that it was the in-
tention of the bank to acquire the property presently occupied by the Norvell-
Wilder Supply Company for expansion of the bank; that the relocation of the
Norvell-Wilder Supply Company, involving the change in zoning, would not be
detrimental to anyone in the area.
Mayor Pro Tem Blackmon asked about the present ownership of the Heaney
property, since his legal firm has represented the Heaney Estate. Walter Young,
Vice President and Trust Officer representing the Corpus Christi State National
Bank, explained the ownership of this particular property jointly by Mrs. Heaney
and the Heaney Estate with the Bank as Trustee; and stated he wished to go on
record as being in favor of the request for rezoning.
No one appeared in opposition to the request.
Mayor Furman declared the hearing closed.
Motion by Dunne, seconded by Jimenez and passed, with Blackmon abstain-
ing, that the recommendation of the Zoning & Planning Commission be concurred in,
and that an ordinance be brought forward changing the zoning from "A-1" to "I-2"
Light Industrial District on the 2.199 -acre tract, being all of Block 19 and a
portion of Fisher Street, save and except a portion of Lot 6, Forest Park, de-
scribed in the application.
City Secretary Kring identified the next public hearing on Application
#465-2, B. W. Bell, for change of zoning from "A -l" Apartment House District to
"AB" Professional Office District on the east two-thirds of the east one-half of
Lot 2, also known as Lot "R," Block II, South End Addition.

Tom Lake located the property on the map; pointed out the zoning and
land use of the area; stated that at the Commission hearing two persons appeared
in support of the application and two persons representing several property owners
appeared in opposition; that eighteen notices were sent out, three returns were
received in favor and two in opposition; and that the recommendation of the Zoning
& Planning Commission was that it be approved as submitted. Mr. Lake presented
several photographs of nearby properties and a petition of five nearby property
owners in favor of the request which was submitted at the Commission hearing, and
a petition of seven property owners in opposition.
B. W. Bell, applicant, Mrs. Agnes Blakey DeDecker, owner of Lot A on Tancahua
Street adjoining the subject property, Thomas N. Givens and Jim Fleming, realtors,
and Nelson Wray of Wray Insurance Company, spoke in support of the request on the
basis of improvement of vacant property and upgrading of the neighborhood. They
explained the proposed use of the property was for a 1600 square foot, single -use
office building for Wray Insurance Company, and that it would not involve people
coming and going all day; that the building will face on Park Avenue with drive-
way entrance and off-street parking so as not to have to back out onto Park Avenue,
landscaping in keeping with the park across the street, and flower beds behind the
building.
Sen F. McDonald, attorney representing Louise Ward, read and filed the
petition of Nr. and Mrs. Charles Roster, Louise Ward, Howell Ward, Mrs. John S.
McCampbell, Mrs. Emma Duran, Benjie Ward, and Mamie Ward Parr protesting the change
of zoning on the basis that it would constitute spot zoning, cause an intrusion of
office and business zoning into a purely residential area, destroy the fundamental
theory of zoning in having a buffer zone between single-family residences and
business sectors, create an undue traffic hazard and make difficult traffic con-
trols, cause deterioration and reduction of adjoining and nearby property values,
and permit numerous uses not consistent with residential -apartment character of the
area.
Howell Ward spoke in opposition to the change in zoning on the same basis
as the petition, but suggested a special permit to serve Mr. Wray's purpose without
creating a problem in the neighborhood.

R. N. Duran, speaking for his mother and neighbor who owns the property
directly across from the subject property on Tancahua, also spoke in opposition to any
change in zoning on the same basis as the petition.
In answer to questions from the Council, Assistant City Manager Town-
send stated that plans for widening Park Avenue are in the distant future, but there
isn°t anything immediate in this respect; and Mr. Wray stated that a special permit
would serve his purpose since all he wants is to build an office building; Mr. Duran
stated it was mostly the commercial building he was opposed to; and Mr. McDonald
stated his clients were opposed to the commercial type building, and that although a
special permit was less objectional, it was still objectionable to his clients.
Motion by McDaniel, seconded by Sizemore and passed with Blackmon and Dunne
not voting, that the application be tabled for one week.
City Secretary Kring identified the next public hearing on Application
#465-3, Ira E. Hayley, for change of zoning from "R -1A" One -family Dwelling District
to "A-1" Apartment House District on all of Lots 4 and 5, Block 2, Haigler Addition.
Tom Lake located the property on the map; pointed out the zoning and land
use of the area; stated that the applicant and his wife appeared in support of the
request at the Commission hearing and explained they proposed to have four units on
each property, a total of eight apartment units on the property, and that no one
appeared in opposition; that twenty-three notices were sent out, four returns re-
ceived in favor and one in opposition; and that the recommendation of the Zoning &
Planning Commission was that it be approved as submitted. Mr..Lake added that the
Staff felt the property could not feasibly be developed in residences, but that
some type of project was reasonable, or else a complete resubdivision of the lots,
which was difficult.
The receipt of a communication from Harrison Smith in favor of the appli-
cation was noted.
The applicants were present in support of the application; and no one
in opposition.
Motion by Blackmon, seconded by Sizemore and passed that the hearing be
closed.

Motion by Blackmon, seconded by Sizemore and passed that the recommenda-
tion of the Zoning & Planning Commission be concurred in, and an ordinance be brought
forward changing the zoning from "R -1A" to "A-1" Apartment House District on all of
Lots 4 and 5, Block 2, Haigler Addition.
City Secretary Kring identified the next public hearing on Application
#465-4, W.D. Hayley, for change of zoning from "R -1A" One -family Dwelling District
to "A-1" Apartment House District on all of Lots 33, 34, 35, 36 and 37, Block 4,
Bervonne Terrace.
Tom Lake located the property on the map; painted out the zoning and
land use of the area; pointed out that one of the existing buildings on the property
existed prior to annexation of the Annaville area, and that one building and the
swimming pool were built under an Interim Permit; stated that the applicant had
appeared at the Commission hearing and one person appearing in opposition had pre-
sented a petition of seven signatures representing six properties in opposition;
that twenty-nine notices were sent out, two returns were received in favor of the
request and one in opposition; and that the recommendation of the Zoning & Planning
Commission was that it be approved as submitted on the basis that it will permit a
logical extension of the existing apartment development. Mr. Lake pointed out the
location of those properties represented on the petition, and explained that the
applicant wants to add more apartments to the existing two-story apartments.
No one appeared in opposition to the request.
Mayor Furman declared the hearing closed.
Motion by Dunne, seconded by McDaniel and passed that the recommendation
of the Zoning & Planning Commission be concurred in, and that an ordinance be brought
forward changing the zoning from "R -1A" to "A-1" Apartment House District on all
of Lots 33, 34, 35, 36 and 37, Block 4, Bervonne Terrace.
In answer to a question from the Council, City Attorney Singer answered
that the 20% Rule would apply on the foregoing application if the properties in-
volved in opposition are determined to be directly behind the subject property,
and added that according to the City ordinance the objection must be signed and
acknowledged.
There being no further business to come before the Council, the special
meeting was adjourned.
