Ray Kring Mayor McIver Furman called the meeting to order. The Invocation was given by Dr. W. H. Colson, Superintendent of Baptist Missions. City Secretary T. Ray Kring called the roll of those in attendance. Motion by Blackmon, seconded by Sizemore and passed that the absence of Commissioner Patrick J. Dunne be excused for cause. Motion by Blackmon, seconded by McDaniel and passed that the minutes of the regular meeting of June 2, 1965, be approved as furnished to the Council. Mayor Furman recognized Mrs. Florence Smith and Mr. James Urquhart and read and presented to them Certificates of Commendation for good judgment and heroism displayed in apprehending an unsafe driver who was obviously jeopardizing the lives of others on the highway. Mayor Furman recognized the Solomon M. Coles High School, Athletic Depart- ment, and read and presented a Certificate of Commendation on their winning the State Negro Class 3A Baseball Championship for the current year. Coach John Clay accepted the Certificate and introduced the following members of the team: Clarence Jefferson, Robert Floyd, Eddie Brooks, and Armond Scott. Mayor Furman read and presented a proclamation relative to COTTON WEEK in Corpus Christi, June 13 - 19, 1965; accepted by Mr. Pat Kelly and Mrs. Lois Welhausen, County Demonstration Agent. Mayor Furman read and presented for action the following resolution: RESOLUTION N0. 7597 CONGRATULATING THE URBAN LAND INSTITUTE ON ITS WORK IN STUDYING, ANALYZING AND RE- PORTING ON TRENDS WHICH INFLUENCE THE DEVELOPMENT AND USE OF LAND; URGING THE CITIZENS OF THE CITY TO SUPPORT THE ACTIVITIES OF THE INSTITUTE AND EXPRESSING APPRECIATION FOR THE HOLDING OF A SURVEY CONCERNING THE DOWNTOWN AREA OF THE CITY BEGINNING JUNE 14, 1965. . A City of Corpus Christi, Texas Regular Council Meeting June 9, 1965 Page 2 The Charter rule was suspended and the foregoing resolution was passed by the following vote: Furman, Blackmon, Jimenez, McDaniel, Sizemore and Wallace, present and voting "Aye"; Dunne absent. Mayor Furman nominated for reappointment to the Joint Airport Zoning Board: Charles R. Manning, Jack Constantine, as City appointees, and Fred Heldenfels, Jr., as joint appointee of the City and the County. Motion by Blackmon, seconded by Sizemore and passed that the following re- appointments to the Joint Airport Zoning Board be approved and confirmed: Charles R. Manning, Jack Constantine, as City appointees, and Fred Heldenfels, Jr., as joint appointee of the City and the County. Mayor Furman nominated for reappointment to the Civil Service Board: William P. Harrington. Motion by Jimenez, seconded by Sizemore and passed that William P. Harring- ton be reappointed to the Civil Service Board. Mayor Furman nominated Rufino Garcia, III, for appointment to the Park & Recreation Board to replace L. Gilbert Herrera, resigned due to moving from the City. Motion by Jimenez, seconded by Sizemore and passed that Rufino Garcia, III be appointed to the Park & Recreation Board to replace Mr. Herrera. Mr. Garcia was present to accept his Certificate of Appointment. Mayor Furman brought up the pending item of the application of John H. Hill for a Permit to Drill a well in Lot 25, Section 52 of Flour Bluff and Encinal Farm and Garden Tracts, on which public hearing was held June 2, 1965. Motion by McDaniel, seconded by Blackmon that the foregoing Permit to Drill be denied. Gerald James, attorney representing the applicant, asked to be heard before the vote on the motion to deny, and Mayor Furman explained that the hearing had been closed. Mr. James urged that he be allowed to present additional informa- tion, contrary to the rules of procedure, on the basis that the applicant had only learned the nature of the opposition to the application at the hearing, and could • City of Corpus Christi, Texas Regular Council Meeting June 9, 1965 Page 3 l now reveal facts that would undoubtedly have a great bearing on this matter to the extent that the opposition may voluntarily agree to consider that the venture should be carried forward. Charles Cartwright, attorney representing some of the opponents, stated he was prepared to make a presentation to the Council, but felt that the Council has had adequate opportunity to consider the matter, and that he would not move to re- open the hearing for the purpose of delay. Commissioner Wallace stated he was inclined to agree with Mr. James that it would be in the public interest to re -open the hearing since additional facts have been developed since the hearing. In discussing the motion, Mr. Wallace said his opposition to the original application was that the granting of the permit would create a violation of the City's Anti -noise Ordinance, but that it is his under- standing that plans are available which would in all probability comply with the Anti -noise Ordinance. He pointed out that the application conforms with the City Code in all respects according to the facts as presented; that the status of owner- ship of mineral rights was of record when the surface land was sold, and therefore, everyone was aware of the status of ownership when the surface land was bought; and that the drilling operation is not unduly hazardous, otherwise drilling within the City limits should not have been permitted in the first place; and commented that drilling is obviously hazardous, but only to a degree, and perhaps not any more so than driving on the highway. Commissioner Wallace recommended that the motion before the house be defeated, and that the permit be granted with the stipulation that the noise properly be taken care of; and said that it was his opinion that the hearing should be re -opened so the applicant can present his plans for taking steps which would cause the operation not to violate the Anti -noise Ordinance. In answer to a question from the Council with respect to re -publication, City Attorney Singer explained that the applicant could file the request again next week, which would not be any more expensive or delaying than as if the hear- ing were to be re -opened now, since re -publication would be required. Mayor Furman called for a roll call vote on the motion to deny the permit to drill a well £n Lot 25, Section 52 of Flour Bluff and Encinal Farm and Garden • 7� City of Corpus Christi, Texas Regular Council Meeting June 9, 1965 Page 4 Tracts. Furman, Blackmon, McDaniel, and Sizemore voted "Aye," Wallace voted "Nay," and Jimenez abstained; and the Chair declared the motion to deny had passed 4 to 1 with one abstention. Mr. James stated he thought it necessary to state to the Council his serious objection to disallowing the facts of this matter to be made public; that he considered the action by the Council is not in conformance with due process of law; that the applicant has no alternative but to seek redress in those forms that will recognize these facts; and expressed his regret that the Council saw fit to proceed in this manner. Mayor Furman called for the City Manager's Reports. Motion by Jimenez, seconded by Wallace and passed that the City Manager's Reports be accepted, and the recommendations and requests be approved and granted, as follows: a. That the plans and specifications for the proposed Marina Improvements, Unit IV, consisting of the installation of 14 single mooring pilings, the reloca- tion of one 3 pile cluster and one pier extension, be approved; and that authority to advertise for bids to be received on June 30, 1965, be granted; b. That authority to advertise for bids to be received on June 23, 1965, on 60 palm trees to replace trees on Shoreline Boulevard, be granted; c. That authority to advertise for bids to be received on June 23, 1965, on one offset duplicating machine for the Print Shop, be granted. d. That authority to advertise for bids to be received on June 23, 1965, on approximately 900 feet of 36 inch corrugated galvanized caning, be granted; e. That authority to advertise for bids to be received on June 23, 1965, on traffic control equipment for signalizing the intersection of Ocean Drive and Craig approach to the Crest Hotel, Emerald Cove, be granted; f. That the sales contracts for purchase of Parcel No. 1, from Saratoga Land Company, containing approximately 3.76 acres of land out of Lots 1 and 2, Section 10, Bohemian Colony Lands, and for Parcel No. 2, from Del Star Realty Company, containing approximately 8.35 acres of land out of Lots 1, 3 and 4, Section 10, Bohemian Colony Lands, both in connection with S:hanen Ditch, Unit 2, City of Corpus Christi, Texas Regular Council Meeting June 9, 1965 Page 5 Saratoga to Flynn Parkway, for $250000 per acre, be approved; g. That the date of June 16, 1965, during the regular meeting, be set for public hearing on the application of S. A. Story for Permit to Drill Well No. 1, T. F. Masten, Jr., et al Lease, Block 500, Sheppard Farm Lots, Saxet Field, Nueces County; h. That the change of the approved value of Parcel No. 9, the northwest one-half of Lot 5, Block 1, Meadow Park Addition, from $3,415.00 to $3,665.00 for the purpose of the authority granted in Ordinance No. 7442, be approved. Mayor Furman declared a brief recess before the scheduled public hearings on zoning cases, and Mayor Pro Tem Blackmon was excused and departed. Mayor Furman reconvened the meeting after a brief recess, announced the Council would now hold the scheduled public hearixgs,and explained the procedure to be followed. Mayor Furman announced the public hearing on Application #465-7, Memory Gardens of Corpus Christi, Inc., for a change of zoning from "B-4" General Busi- ness District to "B-5" Primary Business District on all of Lot 1, Brown -Lex Tract. Tom Lake, Zoning Coordinator, located the property on the map; pointed out the zoning and land use of the area; explained that at the Commission hearing no one appeared either in support of the application or in opposition; and that a letter was read stating the applicant was unable to be present, and preferred to withdraw this application in favor of obtaining a special Council permit to permit the erection of a 10' x 60° billboard on this property for a period of four years, City of Corpus Christi, Texas Regular Council Meeting June 9, 1965 Page 9 or until the property is developed, the primary purpose of the billboard being directional for the Memory Gardens Cemetery located five miles from the subject property, the billboard to be located and set back in such a manner as not to be a visual obstruction to traffic, and unlighted so as not to distract at night. Mr. Lake stated that six notices were sent out, and no returns were received; and that the recommendation of the Zoning & Planning Commission was that it be denied on the basis that the request is out of character with the existing zoning pattern. Mr. Lake added that the feeling was that billboard signs are inappropriate at that location and out of character with the general area. Gordon Raid, president of Memory Gardens, in support of the application, stated they need some visual aid, without lights, on the shamble Oil & Refinery site at this intersection of Lexington and Old Brownsville Road, and requested a special Council permit for this sign. During the discussion, in answer to a question from the Council, Mr. Reid answered that they could live with a smaller sign but that the application had been made in the 10° x 60° size because they have a sign that size to use; and Mr. Lake pointed out that the setback, size, and actual location of a sign on the property can be designated in the enabling ordinance. No one appeared in opposition to the application. Motion by Wallace, seconded by Sizemore and passed that the hearing be closed. Wallace moved that the application be denied, and for the purpose of dis- cussion, the Chair seconded the motion. Commissioner Wallace stated he has nothing against this particular sign, but that insofar as he knows, Lexington Boulevard is relatively free of billboards, that he is not in favor of creating a billboard alley along Lexington, and is strongly opposed to the erection of any more billboard signs. Commissioner Size- more felt the matter should be tabled for one week; and Nayor Furman explained that the Council is considering a new sign ordinance for the City as a whole, which most of the citizens agree is needed. With the approval of the Council, the matter was tabled for discussion at Monday's Work Shop. City of Corpus Christi, Texas Regular Council Meeting June 9, 1965 Page 10 Mayor Furman announced the public hearing on Application No. 456-8, Mrs. Anne Rogers Leech, for a change of zoning from "R -1A" One -family Dwelling District to "R-2" Two-family Dwelling District on all of Lots 1-A and 2-A, Block 5, Calallen Townsite. Tom Lake located the property on the map; pointed out the zoning and land use of the area; stated that at the Commission hearing the applicant appeared in support of the request, and five people appeared in opposition; that eleven notices were sent out, one return was received in favor and one in opposition, and eight letters were received in opposition from nearby property owners not notified; and that the recommendation of the Zoning & Planning Commission was that the applica- tion be denied on the basis that approval would constitute spot zoning and the pro- posed development would be detrimental to the value of properties across Calallen Drive. Mr. Lake explained the applicant lives in one portion of the existing b uilding, renting out the other portion, and that the addition of the proposed addi- tional kitchen facilities would definitely make it a duplex as far as the Building Code is concerned. Ted L. Shaffer, attorney representing Mrs. Anne Rogers Leech, spoke in support of the application. He explained the existing residence has been there for many years; that Mrs. Leech is a nurse and lives there alone, but is not there very much; that the house was constructed at the time to conform and adapt itself for the living quarters of two different persons, with living room, bedroom and kitchen for each; that the request is really to permit the installation of a sink and gas stove as she has an opportunity to rent the other living quarters to another per- son; that it is not really two families, but two ladies living alone; that there is other rental property in the area; and that although there are some fine homes near the river, he cannot see any detriment to the River Forest Subdivision; and presented a statement signed by thirty-three neighbors of Mrs. Leech in support of the request. The applicant was also present in support of the application., Harry Smith and Leland Rose, property owners in the area, spoke in oppo- sition to the application on the basis that they are opposed to any change in zon- ing that would allow other than single family dwellings; that the granting of this application would open the door for other requests for re -zoning which would lessen City of Corpus Christi, Texas Regular Council Meeting June 9, 1965 Page 11 the desirability of the properties in the Calallen Addition; that it would devalue the more expensive type residences in the River Forest Subdivision directly across Calallen Drive from the subject property; and presented a petition of approximately thirty-six signatures of property owners in the area opposed to the application due to the effect that spot zoning would have on their properties. Motion by Sizemore, seconded by Wallace and passed that the hearing be closed. Motion by Wallace, seconded by McDaniel and passed that the application be tabled for one week for Council discussion. Mrs, Miles Harding, 722 Caddo, presented a petition of approximately eighty-seven signatures of residents of Claremont Place, for the closing of Caddo Street from Jacquelyn to Gollihar. (Petition #7) Mrs. Harding and other residents described the conditions that exist with respect to teenagers hot -rodding and driving three abreast down Caddo, calling out insults to the women and threatening the children, running the cars onto the park, all of which is making it unsafe for the young children living and playing in the area, and also described the recent vandalism which they said they had never had before the street was opened when Atlantic Mills and Pick's were opened. Tom Lake located the area under discussion on the map, pointed out the park, the undeveloped portions of Caddo, and a tract of land on the northeast corner of Caddo and Gollihar on which special permit for apartment development bas been approved but has not yet been started. The matter was referred to the City Manager for information for Monday's Work Shop. Motion by McDaniel, seconded by Sizemore and passed that the City Manager be granted permission to be absent from the City to attend the Texas City Managers' Association meeting in Beaumont, Texas, June 13 to 16,1965; and that T. Ray Rring be appointed Acting City Manager during his absence. There being no further business to come before the Council, the meeting was adjourned.
