SPECIAL COUNCIL MEETING
July 14, 1965

Mayor McIver Furman called the special meeting to order for the purpose of
holding public hearing on four zoning cases, and explained the procedure to be
followed.
City Secretary Kring called the roll of those in attendance.
Mayor Furman announced the public hearing on Application1665-1, John S.
Moser, for change of zoning from "R -1B" One -family Dwelling District to "B-4" General
Business District on a 10.271 -acre portion out of Lots 24 and 25, Section 55, Flour
Bluff and Encinal Farm and Garden Tracts.
Tom Lake, Zoning Coordinator, located the property on the map; pointed out
the zoning and land use of the area; stated that at the Commission hearing, Bill
Shireman, attorney representing the applicant, and two other persons appeared in
favor of the request, and no one appeared in opposition; that thirteen notices were
sent out, two returns received in favor and one in opposition; and that the recom-
mendation of the Zoning & Planning Commission was that it be denied on the basis that
the request is premature and no definite plans of development were presented to indi-
cate compatibility of zoning with adjacent undeveloped properties. Mr. Lake added that
the Commission has heard and tabled an application for a special permit for a trailer
park on all of the subject property except for a 200 -foot depth from Waldron Field
Road, pending Council action on this application.
Commissioner, Sizemore was excused and departed.
William Shireman, attorney representing the applicant, amended this zoning
request to the extent that he was not asking for any zoning in this application on
what would be east of 200 feet from a line drawn parallel to Waldron Field Road, and
on this 200 -foot depth from Waldron Field Road he was asking for "B-1" zoning. He
explained that his client had entered a contract for the purchase of the property
described in the application subject to the purchaser being able to acquire zoning

on that portion of the property fronting on Waldron Field Road and a permit
to erect mobile homes on the balance of the property; through inadvertence he
had applied for "B-1+" zoning and had been turned down, and then notified the
owners that he was not going to go through with the purchase, but the property
owners had insisted that he had not applied for the right zoning and that
the action of the Zoning Commission in denying "B-4" zoning was no excuse for
not performing the contract. In order to conform to the contract he was ask-
ing that the application be amended to ask only for "B-1" zoning on the front
portion of the property; the other application to which Mr. Lake referred was
made to apply for a special permit for mobile homes on the rear portion; however,
the applicant has no immediate plans for this property, neither the front portion
nor the back portion. Mr. Shireman said that if theebsence of immediate plans
was not satisfactory to the Council, then the amended application should be
denied. He emphasized that his client has no immediate plans for development
at this time.
No one appeared in opposition.
Motion by Wallace, seconded by Blackmon and passed that the hearing be
closed.

of the Zoning & Planning Commission be concurred in, and the application as amended
be denied.
Mayor Furman announced the public hearing on Application #665-2, Ralph
Bennet, for change of zoning from "R -1B" One -family Dwelling District to "A-2"
Apartment House District on All of Lots "C" and "D", Tract 3, Wilkey Partition.
TOM Lake located the property on the map; pointed out the zoning and land
use of the area; explained that at the Commission hearing, Mr. Joseph Hans, re-
presenting the applicant, and several other members of the Eagle Lodge appeared
in favor of the request, and no one appeared in opposition; that seven notices were
sent out, one return received in favor, and none in opposition; and that the recom-
mendation of the Zoning & Planning Commission was that it be approved as submitted.
Mr. Lake explained further that the request is for the purpose of building a new
Eagl.e Lodge on the front portion facing Williams Drive with the rear portion being
used for parking.

Joseph Hans, architect representing the applicant, presented a site plan
showing the proposed use of the property as described by Mr. Lake, and explained
this basic layout for two-stage development, and felt there was nothing about the
project that would generate a problem to the neighborhood. He pointed out that
this was a difficult tract to develop due to the Humble pipeline across the property
which had been moved off the adjacent property at the time the master plan for the
development of the Our Lady of Perpetual Help project of school and church, was
made. The Lodge facilities are to be a family -type use available to the public for
renting.
No one appeared in opposition.
Motion by Wallace, seconded by McDaniel and passed that the hearing be
closed.
Motion by Blackmon, seconded by Dunne and passed that an ordinance be
brought forward changing the zoning on all of Lots "C" and "D", Tract 3, Wilkey
Partition, from "A -1B" to "A-2" Apartment House District.
Mayor Furman announced the public hearing on Application #665-3, Mrs. J. T.
Tyson, for change of zoning from "R -1B" One -family Dwelling District to "AB" Pro-
fessional Office District on Lot 16, Block 5, Dahlia Terrace.
Tom Lake located the property on the map; pointed out the zoning and land
use of the area; explained that at the Commission hearing, the applicant and
eight other persons from the general area appeared in support of the request, and
no one appeared in opposition; that thirty notices were sent out, three returns
received in favor and one in opposition; and that the recommendation of the Zoning
& Planning Commission was that it be denied but that in lieu a Special Permit for
a day nursery be approved subject to the regulations of the "R -1B" One -family
Dwelling District. Mr. Lake pointed out that the day nursery has been in opera-
tion for some seven or eight years; that recently the Welfare Division has insisted
that day nurseries should be operated under proper zoning; that the applicant does
fulfill the requirements for operating a day nursery and fire regulations, and pro-
poses to retain the setbacks and residential look.
Mrs. J. T. Tyson, applicant, and T. P. McCord, owner of Lots 12 and 13,
Block 6, Dahlia Terrace, spoke in favor of the special permit on the basis that

it is a needed neighborhood service and the way the applicant has been supporting
herself since her husband died.
No one appeared in opposition.
Motion by McDaniel, seconded by Blackmon and passed that the hearing be
closed.
Motion by Jimenez, seconded by Blackmon and passed that the change of zon-
ing be denied but in lieu an ordinance be brought forward granting a special permit
for the operation of a day nursery on Lot 16, Block 5, Dahlia Terrace, subject to
the regulations of the "R -1B" One -family Dwelling District.
Mayor Furman announced the public hearing on Application #665-4, Seymour
Mendell, for change of zoning from "R -1B" One -family Dwelling District to "5-1"
Neighborhood Business District on all of Lots 8 through 26A, Bayder Subdivision.

use of the area; explained that at the Commission hearing the applicant appeared
in support of the application, and no one in opposition; that nine notices were sent
out, one return received in favor and none in opposition; and that the recommenda-

tion/was that it be approved as submitted on the basis that it is a logical extension
of the adjacent business zoning and will provide a more feasible basis for develop-
ment of the property.
Seymour Mendell, applicant, presented the proposed layout for a professional
building for a doctor and dentist; and explained that this is a difficult piece of
property to develop as it is a very narrow strip, approximately 75 feet deep at one
end and 160 feet at the other; that there is a 20 -foot setback that can be used for
parking; and that a brick fence is proposed along the adjoining school property at
the rear; that he felt it would be a nice addition to the area; and that construc-
tion would probably begin within sixty days.
Tom Lake pointed out that Lexington being an expressway -type facility,
there will probably be a frontage road which will slow '?own the traffic, which
will resolve one of the things the Staff was concerned about.

Motion by McDaniel, seconded by Wallace and passed that an ordinance be
brought forward changing the zoning on all of Lots 8 through 26A, Bayder Subdivision,
from "R -1B" to "B-1" Neighborhood Business District.
Mayor Pro Tem Blackmon brought up the matter of the proposed ordinance grant-
ing a special Council permit for the Goodyear sign which was deferred from today's
regular meeting, and explained that he had disqualified himself from taking part in this
matter, but wanted to bring it to the Council's attention that the request for a
150 -square foot, free-standing sing failed to include the strip sign underneath the
large sign, which is 28 -square feet; and that if the Council's intention was to
grant the sign that Goodyear wanted to erect, the proposed ordinance would need to
be amended to include the panel.
Motion by Wallace, seconded by Dunne and passed that the proposed ordinance
granting a special Council permit on all of Parkdale Village Annex "B" for a 150 -
square foot, free-standing sign, be amended before the vote to read "for a 178 -square
foot, free-standing sign".

AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY
OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565 ET SEQ OF THE ORDINANCE
AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY
ORDINANCE NO. 6106, AS AMENDED, BY GRANTING A SPECIAL COUNCIL PERMIT ON ALL OF
PARKDALE VILLAGE ANNEX "B", IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FOR
A 178 -SQUARE FOOT, FREE-STANDING SIGN, KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE
EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND
DECLARING AN EMERGENCY.
The Charter rule was suspended and the foregoing ordinance was passed by
the following vote: Furman, Dunne, Jimenez, McDaniel and Wallace, present and
voting "Aye"; Blackmon disqualified himself, and,Sizemore absent.
There being no further business to come before the Council, the special
meeting was adjourned.
