SPECIAL COUNCIL METING
September 15, 1965

Mayor McIver Furman oared the meeting to order.
City Secretary T. Ray Kring called the roll of those in attendance.
Mayor Furman announced the purpose of the special meeting to hold public
hearings on four zoning applications, and such other business as might properly come
before the Council; and explained the procedure to be followed.
Mayor Furman announced the public hearing on Application #865-1, Carl L.
Duaine, for change of zoning from "R -1B" One -family Dwelling District to "A-1"
Apartment House District on all of Glenoak Park, Unita 1 and 2, located at the
intersection of Glenoak Drive and Waldron Field Road, fronting 190 Feet along
Waldron Field Road and 375 Feet along Glenoak Drive.
Tom Lake, Zoning Coordinator, located the property on the map; pointed
out the zoning and land use of the area; explained that at the Commission hearing
Mr. Duaine appeared in support of the application and no one appeared in opposition;
that eleven notices were mailed, one return was received in favor and one in
opposition; and stated that the recommendation of the Zoning and Planning Commission
was that it be approved as a logical use of the land
Mr. Carl L. Duaine spoke in favor of the application; and explained to
the Council that he proposes to build apartments on the location which is near
the Flour Bluff Schools, and that he intends to start building within a year.
No one appeared in opposition to the application.
Motion by Wallace, seconded by Sizemore and passed that the hearing be
closed.
Motion by Blackmon, seconded by Sizemore and passed that the recommenda-
tion of the Zoning and Planning Commission be concurred in, and that an ordinance
(Construction to begin) T.R.K.
be brought forward with a one year's condition,/changing the zoning from "R -1B"
One -family Dwelling District to "A-1" Apartment House District on all of Glenoak

Park, Units 1 and 2, located at the intersection of Gienoak Drive and Waldron Field
Road, fronting 190 Feet along Waldron Field Road and 375 Feet along Glenoak Drive.
Mayor Furman announced the public hearing on Application #865-2, J. R.
McFarland, et al, for change of zoning from "R -]B" One -family Dwelling District to
"B-4" General Business District on all of Lots 2 through 10, and the Eastern
portions of Lots 11 and 12, Block 3, Arcadia Subdivision.
Tom Lake, Zoning Coordinator, located the property on the map; pointed
out the zoning and land use of the area; explained that at the Commission hearing
Mr. J. R. McFarland and several of the co -applicants appeared in support of the
application, and four property owners appeared in opposition; that forty-seven
letters were mailed, two returns received in favor and four in opposition; and
stated that the recommendation of the Zoning and Planning Commission was that it
be denied on the basis that it is an illogical extension of the existing zoning,
that it would be detrimental to residential -1y used and zoned property along
Florida Avenue and that the property is too srs.1low for business use which will
overcrowd the land and create serious traffic problems. In answer to questions
from the Council, Mr. Lake stated that all of Lots 2, 3 and 4 and part of Lot 5
would be affected by the Traffic Twenty -rear Master Plan.
Mr. Faires Wade, attorney representing Mr. McFarland and several property
owners, spoke in support of the application, and explained to the Council that
several of the property owners had tried to sell their property for the past two
or three years, and that the F.H.A. appraisal price was only seventy-five percent
of the total value, and that the area was no longer desirable as a residential
area, and that "B-1" zoning would help to relieve the situation.
Mr. Tom Wilkinson, Real Estate Agent, verified Mr. Wade°s foregoing
statements, and stated that "B-1" zoning would be acceptable,
Mr. Paul Blanton, Architect, explained the plans for development of the
proposed redevelopment; and Mr. John Brooks, attorney representing Mr. Ed Coughlin,
stated that "B-4" zoning was requested but that it really wasn't necessary, and
that "B-1" zoning would be sufficient.

Mr. J. R. McFarland, 1122 Florida Avenue, applicant; James Via, Lot 10,
Block 3, Arcadia Subdivision, 1528 S. Staples Street; James R. Underwood, Lot 9,
Block 3, Arreriia Subdivision, 1134 Florida Avenue; Mr. Carl Green, Lot 8, Block 3,
Arcadia Subdivision, 1130 Florida Avenue; and several other property owners spoke
in support of the application on the basis that the area was no longer residential
area, and that the lots cannot be developed under the present zoning.
City Manager Whitney presented a telegram favoring the application.
Mr. and Mrs. Wayles M. Price, Lot 28, Block 6, Arcadia Subdivision,
1113 Logan Avenue; Mr. and Mrs. R. E. Rash; Mrs. M. H. Baskin, 1143 Florida Avenue;
Frank Anderson, Lot 22, Block 5, Arcadia Subdivision, 1129 Florida Avenue; Mrs. A. M.
Bernal, Lot 1, Block 5, Arcadia Subdivision, 1117 Florida Avenue; Mr. H. A. Carr,
Lots 1-A and 1-B, Block 1, Lindale Park, Section 1, 308 Chenoweth Drive, and several
other property owners, spoke in opposition of the application on the basis that it
would create traffic problems and constituted spot zoning.
City Manager Whitney submitted a letter from H. R. Hooker upposing the
application.
Motion by Wallace, seconded by Dunne and passed that the hearing be
closed.
Motion by Wallace, seconded by Sizemore and passed that the application
be tabled for one week.
Mayor Furman announced the public hearing on Application #865-3, Cecil
H. Haynes, for change of zoning from "R-2" Two-family Dwelling District to "AB"
Professional Office District on Lots 62, 63 and 64, Block 808, Port Aransas
Cliffs, located on the Northeast corner of the intersection of Breezeway Street
and South Alameda Street.
Tom Lake, Zoning Coordinator, located the property on the map; pointed
out the zoning and land use of the area; explained that at the Commission hearing
the applicant and prospective purchaser of the property, appeared in support of
the application and two property owners appeared in opposition; that twenty
letters were mailed, no returns received in favor, and three in opposition, and
one return was received at a later date in favor of the application; and stated
that the recommendation of the Zoning and Planning Commission was that it be

denied on the basis that it constitutes spot zoning and encroachment of business
into an existing residential area and will increase traffic at a major intersection.
Mr. Cecil H. Haynes, applicant, spoke in favor of the application and
explained that he proposed to sell the property for use as a Dental Office, and that
a request for a special permit was not made at the time of the zoning hearing, but
that he had contacted several people and had found no further objections to a special
permit.
Dr. Bill Whiteside, prospective purchaser, spoke in support of the
application and stated that he would use the property as a residence also, and
there would be sufficient parking at the rear.
Mrs. Tucker and Mrs. Mildred Davis spoke in opposition to the application,
stating they were opposed to any business in that area; and Mother Benedict of
Incarnate Word, stated she was against spot zoning but was not against a permit for
the dental office.
Motion by Wallace, seconded by McDaniel and passed that the hearing be
closed.
Motion by Wallace, seconded by MCTniel and passed that the recommenda-
tion of the Zoning and P1Anning Commission be concurred in, and that the request
for "AB" zoning be denied.
Mayor Furman announced the public hearing on Application #865-4, Max C.
Kluge, for change of zoning from "B-1" Neighborhood Business District to "B-5"
Primary Business District on Lot 16, Forest Park, Unit #2, located on the most
Westerly corner of the intersection of Buffalo Street and the frontage road of
Interstate Highway No. 37.
Tom Lake, Zoning Coordinator, located the property on the map; pointed
out the zoning and land use of the area; explained that at the Commission hearing
the applicant and prospective purchaser of the property appeared in support of
the application and no one appeared in opposition; that four letters were mailed,
and no returns received in favor or in opposition; and stated that the recommenda-
tion of the Zoning and Planning Commission was that it be approved subject to
execution of a deed restrictive covenant prohibiting billboards and outdoor
advertising signs which advertise uses other than those of subject property.
