SPECIAL COUNCIL MEETING

Mayor McIver Furman called the eating to order, and announced the
purpose of the special meeting to hold public hearings on four zoning applica-
tions, and such oth®r business as might properly come before the Council; and
explained the procedure to be followed;
Mayor Burman announced the public hearing on Application d863-6, Walter
Weenie, for change of zoning from 1°R-13' One -family Dwelling District and "A-1"
Apartment House District to "A-2" Apartment Roue District, Lots 31, 32, 33 and
34. Block 14, Port Aransas Cliffs, located on the South Right of Way line of
Rossiter Street and extending from Ocean Drive to Denver Street.
To Lake, Zoning Coordinator, located the property on the map; pointed
out the zoning and land use of the area; explained that at the Commission hearing
held August 17, 1965, the applicant, Mro Walter Wiaznia, presented and explained
the proposed plan of development, and that two neighboring property owners appeared
in opposition; that twenty lettere were mailed, four returns received in favor,
and two returns in opposition; explained to the :.,,until that Mrs Wieznia proposes
to build six studio apartments fronting on Rossiter Street, but that the canopy
would extend into the 10 -foot setback; and that "A-1" zoning would be acceptable
but would"require a variance on the setback requirement. He stated that the re-
commendation of the Zoning and Planning Commission was that it be denied but that
"A-1" Apartment Rouse District be approved on Lots 33 and 34 as Lots 31 and 32 are
presently zoned "A-1" Apartment House District.
In answer to a question from Co,nissioner Wallace as to the difference
between "A=1" and "A-2" zoning, Mr. Lake advised that "A-2" zoning would allow
more units to be constructed,
Mrs Wo Jo Shaw, General Contractor for the project, and Mr. Neil ;:iudson,
representing a property owner, were present in support of the application. In
answer to questions from the Council, Mr, Shaw stated that the apartments could be
built with "A-1" zoning.

Motion by Sizemore, seconded by Wallace and passed that the hearing be
closed.
Motion by Wallace, seconded by Jimenez and passed, with Blackmon voting
"Nay", that the application be denied but that "A-1" Apartment House District be
approved on Lots 33 and 34 and that an ordinance be brought forward specifying the
proper set -back restrictions and that building be completed within a year. For.
Blackmon explained the reason for his negative vote was that in his opinion there
were several minor things that needed to be worked out and more time would permit
this being donee
Mayor Furman announced the public hearing on Application #865-7, The
Planned Building Company, for change of zoning from "AB" Professional Office
District to "B-4" General Business District, Lots 36-A, 37, 38, 39 and 40, Block
817, Port Aransas Cliffs, fronting 110 Peet on the Northeast Right of Way line of
South Alameda Street near its inteasection with Brawner Parkway,
Tom Lake, Zoning Coordinator, located the property on the map; pointed
out the zoning and land use of the area; explained that at the Commission hearing
held August 17, 1965, Bk. Ted Anderson, attorney representing the applicant,
appeared in support of the application and no one appeared in opposition; that
twenty-one letters were mailed;, five returns received in favor and one return in
opposition; and stated that the recommendation of the Zoning and Planning Com-
mission was that it be denied on the basis that the requested zoning is inappro-
priateland constitutes encroachment of business into a residential area.
Mk. Ted Anderson, attorney representing the applicant, spoke in support
of the application and stated that the change of zoning was requested so that a
free-standing 6'10"x8'sign could be erected in the front yard and a wall sign
with letters 12" high could be placed on the building,
Mrs Dave Coover, representing the Godwin Shop, appeared in support of the
application, and stated that businesses in the neighborhood had signs and that it was
a modest request, and suggested that some type of control should be exercised on
the lighting_. of the free-standing sign so that it would not be objectionable to
the property owners at night.

Motion by Jimenez, seconded by Dunne and passed that the hearing be
closed.
Motion by Blackmon, seconded by Dunne and passed that the application
for change of zoning from "AB" Professional Office District to "B-4" General
Business District, Lots 36-A, 37, 38, 39 and 40, Port Aransas Cliffs, be deferred
until Workshop Monday, September 27, 1965,
Mayor Furman announced the public hearing on Application #865-8, The
Arlington Heights Church of Christ, for change of zoning from "F -R" Farm -Rural
District to "B-4" General Business District on all of Lot 1 and a triangular
portion of Lot 2, Block "A", Frank Addition, located on the Southeast corner
of the intersection of Rand Morgan Road and the proposed South frontage road of
Interstate Highway No. 37,
Tom Lake, Zoning Coordinator, located the property on the map; pointed
out the zoning and land use of the area; explained that at the Commission hearing
held August 17, 1965, several of the church members Were present in support of
the application and no one appeared in opposition; that five letters were mailed,
and none received in favor or in opposition; and stated that the recommendation
of the Zoning and Planning Commission was that it be approved as submitted.
Bi11 Mochele, representing Gulf Oil Company, explained to the Council
that a service station would ba erected on the property, and that deed restric-
tions would be worked out between Gulf Oil Company and The Arlington Heights
Church of Christ.
No one appeared in opposition to this application.
Motion by Sizemore, seconded by Jimenez and passed that the hearing be
closed.
Motion by Sizemore, seconded by Jimenez and passed that the recommenda-
tion of the Zoning and Planning Commission be concurred in, and that the request
for "B-4" General Business District on all of Lot 1 and a triangular portion of
Lot 2, Block "A", Frank Addition, be approved, and that an ordinance be brought
forward effectuating this change.

Mayor Furman announced the public hearing on Special Use #43, Mr. and
Mrs. Lloyd Price, for a Special Use Permit under Article 25, Section 25-4, Sub-
section (10) of the Zoning Ordinance authorizing the operation of a trailer park
for one trailer, located on a portion of the John Atlee Mages 6,88 -acre Tract out
of the Ira Magee Tract, also known as Lot 7 of an unrecorded 6.88 -acre survey out
of Tract 22 of the G. Ferias Grant; fronting 104.45 Feet on the West Right of Way
line of Loma Alta Road, beginning at a point 208.51 Feet South of the Southwest
corner of the intersection of Leopard Street and Loma Alta Road and extending
192.67 Feet in a Westerly direction from Loma Alta Road for its most depth.
Tom Lake, Zoning Coordinator, located the property on the map; pointed
out the zoning and land use of the area; explained that at the Commission hearing
held August 17, 1965, the applicants appeared in support of the application and
no one appeared in opposition; that nine letters were mailed; one return received
in favor, and none in opposition; and stated that the recommendation of the Zoning
and Planning Commission was that it be denied on the basis that mobile homes are
out of character with the existing residential development and will be detrimental
to adjacent property values.
Mr. Lake explained to the Council that the requests for Special Use Permits
normally do not come before the Council, but that applicant has appealed on the
denial recommended by the Zoning and Planning Commission.
Mr. Lloyd Price, prospective purchaser of the property, explained to the
Council that an existing steel frame with a concrete floor already located on the
property, would be used for his trailer house, and that he did not intend to operate
a trailer park; that he intended to enclose his trailer in this building completely
with a garage and breezeway, and that one end of the structure would be used for
pulling the trailer in and out when and if it became necessary for him to leave
temporarily and find work elsewhere. Mt. Price stated that this would be a per-
manent home.
Mr. Harry Smith, Real Estate Agent, spoke in support of the application
and stated that Annaville Realty Company had contacted the surrounding neighbors
and they felt it would be an improvement to the area and had no objections.

No one appeared it opposition to this application.
Motion by Blackmon, seconded by Wallace and passed that the hearing
be closed.
Motion by Sizemore, seconded by Blackmon and passed that the request for
Special Use Permit be deferred until Workshop Monday, September 27, 1965.
There being no further business to come before the Council, the special
meeting was adjourned.
