SPECIAL COUNCIL MEETING
October 13, 1965

Mayor McIver Furman called the meeting to order.
City Secretary T. Ray Kring called the roll of those in attendance.
Mayor Furman announced the purpose of the special meeting to hold public
hearings on four zoning applications, and such other business as might properly
come before the Council; and explained the procedure to be followed.
Mayor Furman announced the public hearing on Application #965-1, Harold
Alberts, for change of zoning from 1R -1B" One -family Dwelling District and "AB"
Professional Office District to "B-1" Neighborhood Business District on Lots 2,
3, 4 and 5, Block 7, San Diego Addition, located on the Southerly right of way
line of Campana Street.
Tom Lake, Zoning Coordinator, located the property on the map; pointed
out the zoning and land use of the area; explained that at the Commission hearing
held September 7, 1965, the applicant and two neighboring property owners appeared
in favor of the application and no one appeared in opposition; that thirty-four
notices were sent out, three returns were received in favor of the request and
none in opposition, and that one letter was received in opposition after the hear-
ing was held; and stated that the recommendation of the Zoning and Planning Commission
was that it be approved as submitted.
Mr. Harold Alberts spoke in favor of the application and stated that in
addition to the two people in favor of the application, he had signed statements
from property owners along 250 Feet of Campana Street and along 250 Feet of
Guadalupe Street, requesting the rezoning, and that property owners in that area
do not object and that the business is needed in that area because of the Cross-
town Expressway.
No one appeared in opposition to this application.

Motion by Blackmon, seconded by Wallace and passed that the hearing be
closed.
Motion by Blackmon, seconded by Wallace and passed that the recommenda-
tion of the Zoning and Planning Commission be concurred in, and that the request
for change of zoning from "R -1B" One -family Dwelling District and "AB" Professional
Office District to "B-1" Neighborhood Business District on Lots 2, 3, 4 and 5,
Block 7, San Diego Addition, be approved, and that an ordinance be brought forward
effectuating this change.
Mayor Furman announced the public hearing on Application f965-2, Ruben R.
Castro, for change of zoning from "R-2" Two-family Dwelling District to "AB" Pro-
fessional Office District on Lot 20, Block 2, Baldwin Park Addition, located on
the Southeasterly right of way line of Prescott Street,
Tom Lake located the property on the map; pointed out the zoning and land
use of the area; explained that at the Commission hearing held September 7, 1965,
the applicant did not appear but that a neighboring property owner appeared in
favor of the request and no one appeared in opposition; that twenty-four notices
were sent out, two returns were received in favor of the request and none in
opposition, and stated that the recommendation of the Zoning and Planning Com-
mission was that it be denied but in lieu a Special Permit for a kindergarten be
approved subject to the following conditions
(1) That the property be fenced in accordance with the State require-
ments for a kindergarten;
(2) That the premises be maintained in the present residential character
of the neighborhood;
(3) That outdoor identification signs be limited as outlined in the
definition of "home Occupations" under "R -1A" One -family Dwelling
District regulations;
(4) That adequate off-street parking be provided so that patrons of the
kindergarten will not cause congestion or create hazards to
other traffic while dispersing or picking up children; and
(5) That all other regulations of the "AB" Professional Office District
be complied with.

In answer to questions from the Council, Mr. Lake stated that the change
of zoning was being requested so that a kindergarten caring for not more than 25
children could be established; and that a circular type drive -way for off-street
parking would be needed. Mr. Lake further stated that a large sign was on the
property which should be removed.
No one appeared in connection with the application.
Motion by Jimenez, seconded by Sizemore and passed that the hearing be
closed.
Notion by Blackmon, seconded by Sizemore and passed that the recommenda-
tion of the Zoning and Planning Commission be concurred in, and that the request
for change of zoning be denied, but in lieu thereof a Special Permit for a kinder-
garten be approved subject to the applicant being notified to remove the sign and
to comply with the recommendation for off-street parking.
Mayor Furman announced the public hearing on Application #965-4, Mrs.
Janice Rodgers and Dr, Edwin E. Connor, for change of zoning from 1R-111" One -
family Dwelling District to "AB" Professional Office District on Lots 1 and 2,
Block 2, Nanjean Park, Unit #2, located on the Northeast corner of the inter-
section of Bradford Drive and Weber Road.
Tom Lake located the property on the map; pointed out the zoning and land
use of the area; explained that at the Commission hearing held September 7, 1965,
three people appeared in favor of the request and three people appeared in opposition;
that twenty-five notices were sent out, no returns were received in favor of the
request and three received in opposition; and stated that the recommendation of
the Zoning and Planning Commission was that it be denied on the basis that approval
constitutes spot zoning and an encroachment into an existing residentially used
and zoned area.
Mr. Harold Hartgravea, representing Parkview Hospital, explained that
Lot 1 was being used as a guest house for hospital visitors and a meeting place
for several organizations, and that Lot 2 was being used as a Pathology Labora-
tory temporarily, and that the Pathology Laboratory would be moved as soon as
the building program progressed, Mr. Hartgravea stated that the entry was at the
rear and did not increase the flow of traffic on Bradford Drive or Weber Road.

In answer to questions from the Council, Mr. Hartgraves replied that the
property was well land-acaped and there were no signs on the property, and that
two Special Permits had been issued to Parkview Hospital within the past few years.
Mayor Furman pointed out to Mr. Hartgraves that the present use of the prop-
erty was in violation of the existing zoning, and Mr. Hartgraves replied that there
was not enough room in the hospital for the Pathology equipment.
Mr. W. K. Wall, spoke in opposition to the request, and stated that Parkview
Hospital had acquired at least ten of the houses on the opposite side of the street
and painted them a "dirty black", and that the meeting place was a nuisance, and he
objected to a change of zoning.
Mrs. Edwin E. Conner, co -applicant, explained to the Council that the
hospital had purchased the houses for the use of "key" personnel in the hospital;
that the houses were all painted a "pretty" gray color, and that the house used
for a meeting place was used by at least six neighborhood organizations without
charge. Mrs. Connor stated that visitors were told to use the hospital parking
lot.
Motion by Jimenez, seconded by Sizemore and passed that the hearing be
closed.
Motion by Jimenez, seconded by Dunne and passed that the application for
change of zoning from "E-18" One -family Dwelling District to "AB" Professional
Office District be tabled for further study.
Mayor Pro Tem Blackmon asked Mr. Whitney to determine the status of the
conditions imposed in the other permits and what performance had been made, and to
check on the property owned by Dr. and Mrs. Connor.
Mayor Furman announced the public hearing on Application #965-5, John L.
Drury, for change of zoning from "Id -18" One -family Dwelling District to "A-1"
Apartment House District on Lots 7, 8 and 9, Block 8, Gateway Park Addition, located
on the Northwest right of way line of Laguna Shores Road.
Tom Lake located the property on the map; pointed out the zoning and land
use of the area; explained that at the Commission hearing held September 7, 1965,
the applicant appeared in favor of the request and no one appeared in opposition;

that twenty-three letters were sent out, two returns were received in favor of
the request and none in opposition; and stated that the recommendation of the
Zoning and Planning Commission was that it be approved as submitted on the basis
that "A-1" zoning will provide a transitional zoning and buffer along a major
thoroughfare.
No one appeared in connection with this application.
Motion by Wallace, seconded by Sizemore and passed that the hearing be
closed.
Motion by Wallace, seconded by Blackmon and passed that the reco
ends -
tion .of the Zoning and Planning Commission be concurred in, and that the request
for change of zoning from "R, -1B" fine -family Dwelling District to "A-1" Apartment
Rouse District on Lots 7, 8, and 9, Block 8, Gateway Park Addition, be approved,
and that an ordinance be brought forward effectuating this change.
There being no further business to come before the Council, the special
meeting was adjourned,
