Ray Kring Mayor Pro Tem Jack R. Blackmon called the meeting to order. The invocation was given by the Reverend Ruben Hernandez, Pastor of Templo Bautista Baptist Church, City Secretary T. Ray Kring called the roll of those in attendance. Motion by Sizemore, seconded by McDaniel and passed that the absence of Mayor Mclvar Furman be excused for cause. Motion by Jimenez, seconded by Sizemore and passed that the minutes of the regular meeting of October 13, 1965, at 2:00 p.m., and of special meeting of same day at 3:00 p.m.; and of special meeting of September 30, 1965, at 9:15 a.m., be approved as furnished to the Council. Mayor Pro Tem Blackmon welcomed the Student Council from Roy Miller High School, and read and presented Certificates of Attendance to Dora Anaya, Mary Lupe Flores, Marian McIntyre, Tory Burke, Anna Garcia and Judy Garcia; accepted by Judy Garcia,President of the Student Council. Mayor Pro Tem Blackmon read and presented proclamations relative to the following: DAY IN COURT FOR LEGAL SECRETARIES in Corpus Christi, Tuesday, October 26, 1965, accepted by Mary F. Castillo, Chairman of "The Day in Court for Legal Secretaries" and Maria Roper, Corresponding Secretary of the Nueces County Legal Secretaries Association; TOASTMASTERS WEEK in Corpus Christi, October 17, through 24, 1965, accepted by Lt. Governor Richard T. Irby of the 56th District; and CHILD ACCIDENT PREVENTION WEEK in Corpus Christi, October 24 through 30, 1965. Mayor Pro Tem Blackmon nominated Clemente Garcia for appointment to the Civil Service Board for a three-year term. Motion by Wallace, seconded by Jimenez, and passed that Clemente Garcia be appointed to the Civil Service Board, Mayor Pro Tem Blackmon nominated Commander W. A. Mayberry for appointment to the Port Protection Committee to replace Captain Gorman W. Larson who recently City of Corpus Christi, Texas Regular Council Meeting October 20, 1965 Page 2 retired, and G. W. Stephenson, an additional appointment to the Committee. Motion by Jimenez, seconded by Sizemore and passed that Commander W. A. Mayberry and G. W. Stephenson be appointed to the Port Protection Committee. Mayor Pro Tem Blackmon brought up the pending item on Application x#965-4, Mrs. Janice Rodgers and Dr. Edwin E. Conner for change of zoning from "R -1B" One - family Dwelling District to "AB" Professional Office District on Lots 1 and 2, Block 2, Nanjean Park, Unit d#2, located on the Northeast corner of the intersection of Bradford Drive and Weber Road; and advised the Council that applicants had requested this application be tabled for two weeks. Motion by Jimenez, seconded by Sizemore and passed that the foregoing application be tabled for two weeks. Mayor Pro Tem Blackmon called for the City Manager's Reports. Motion by Sizemore, seconded by McDaniel and passed, with Blackmon disqualified on Item "a" (appraisal on Parcel x#14), that the City Manager's Reports, Items "a" through "j" and Item "1" be accepted, with Item "k" being considered separately, and the recommendations and requests be approved and granted as follows: a. That the appraisal services of Gregory S. Moore on Parcels No. 14 and 39, Midtown Traffic Exchange Right of Way, be approved; b. That the acceptance and final payment of Estimate No. 3 in the amount of $4,032.00 to Renfro Engineering Company, for the installation of air conditioning and heating facilities at the Corpus Christi Garden Center, be approved; c. That the request for authority to advertise for bids to be received on November 10, 1965, for One Chlorine Residual Recorder for the John Cunningham Filter Plant, be approved; d. That the bid award for Automotive Equipment for the Police and Fire Departments be made to Ed Hoffman Motors on the basis of low bid meeting specifications ; ( . o(Qate yti if '*' ) e. That the tax rolls for the Lower Nueces River Water Supply District and the City of Corpus Christi for the year 1965, be approved; f. That the recommendations of the Traffic Safety Advisory Board that Emerson Drive be made one way north bound; that Arlington Drive be restricted to City of Corpus Christi, Texas Regular Council Meeting October 20, 1965 Page 3 trucks and other vehicles over one ton; and that speed limits on Island Drive from Lexington Boulevard to Laguna Shores Road be reduced from 45 miles per hour to 35 miles per hour, be approved; g. That the proposal from the architectural firm of Hans and Bennett for services in connection with the proposed West Guth Park Swimming Pool, for a fixed fee basis of $10,000.00, be approved; h. That an appraiser be employed for the appraisal of two tracts of land required for Right of Way purposes for the Carroll Lane Outfall Channel; i. That the date of October 27, 1965, at the regular Council meeting, be set for public hearing on the application of Southern Coast Corporation to drill their May Humphrey No. 6 Well, located on the Humphrey Lease, J. W. Stevens Survey A-963; J. That the Interim Report from The Bay Drilling Committee be officially received by the City Council; ((!.p yyyn;i? uL 6 4. k. That the applications from Cities Service Oil Company to drill Well No. 1 in State Tract 74, and Well No. 1 in State Tract 52, Corpus Christi Bay, be considered separately; 1. That the date of November 17, 1965, at a special Council meeting convening at 3:00 p.m., be set for public hearing on six zoning applications. Mayor Pro Tem Blackmon advised that the Interim Report received from the Bay Drilling Committee made certain recommendations, and that corrections should be made on Page 5, amending the surface location 467 Feet instead of 660 Feet for Cities Service Oil Company, and on Page 4, the existing line should be 3400 Feet instead of 3480 Feet. He commended Mr. Harte, Chairman of the Bay Drilling Committee, and the other members, for their interest in the welfare of the City, and for the time and effort involved in preparing this report. Mayor Pro Tem Blackmon stated that the Bay Drilling Report made certain recommendations pertaining to the applications from Cities Service Oil Company for permits to drill in State Tracts 52 and 74, and that he felt the applications should be considered at this time. City of Corpus Christi, Texas Regular Council Meeting October 20, 1965 Page 4 City Manager Whitney presented the application of Cities Service Oil Company to drill Well No. 1 in State Tract 74, Corpus Christi Bay. He explained the application was dated August 27, 1965, and had been tabled pending the report from the Bay Drilling Committee; pointed out the proposed location of the well as being 467 Feat from the North line, 467 Feet from the East line of this tract, 1287 Feet east of 3400 Feet Bay Park and Recreation Area.or approxi- mately 4687 Feet East of the center line of Ocean Drive. Mr. Whitney explained that the proposed depth of the well is 10,000 Feet vertically, with a casing pro- gram of 20" conductor driven to 125 Feet, 10-3/4" casing to be cemented at 2000 Feet; and that applicant had submitted a copy of the Railroad Commission permit dated August 25, 1965, and Certificates of Insurance, and that the application appeared to be in order. Mr. John Brooke, attorney for applicant, spoke in support of the application and stated that applicant had waited a long time to have this permit granted, and had worked with the Bay Drilling Committee, and felt that it was in the public interest to grant the permit at this time. Mrs. Alice Scott spoke in opposition to the application, and asked the Council if the granting of this application would determine the line that might be established in regard to the Bay area, and if the permit could be delayed until a line had been established. Mayor Pro Tem Blackmon advised that a definite line had not been es- tablished as yet, and it would depend on whether the well was a producer or dry hole, and that it involved some questions of law and other factors. Commissioner Wallace stated he had voted on a line closer to shore, and he felt the line would be drawn through this well, and Commissioner McDaniel stated he felt the line would probably be drawn somewhere in the area of 4200 Feet. Mrs. D. C. Bernwenger also spoke in opposition to the application and asked if the permit could be delayed until the line had been established. City of Corpus Christi, Texas Regular Council Meeting October 20, 1965 Page 5 Mayor Pro Tem Blackmon advised that applicant had been delayed since August; that they had an expiring lease, and that it would cost considerably more money to drill now, and that he felt the application should be considered at this time. He further stated that the Bay Drilling Committee's report was a unanimous report, and a compromised report, with a reasonable solution to this great problem. Commissioner Wallace stated that in his opinion the Committee was "walking on eggs" in preparing this preliminary report, and that very little law had been written on this matter. He further stated that he hoped the Committee could assist the Council in regulating the drilling and production problem in the bay in such a manner that the City would not need to go to Court, and that the State being owner of the minerals, lends considerable weight to the possibility of adverse judgment. Mayor Pro Tem Blackmon stated that no wells would be drilled than absolutely necessary, and that the workings of the Committee was to try and protect the Bay area, and that the problem was out of the Council's hands before they had an opportunity to do much regulating. Mr. Phillip Rosenstein spoke in opposition to the application and stated that the Council should have reasonable regulations before issuing permits. Motion by Wallace, seconded by Dunne and passed, with Jimenez abstain- ing, that the application of Cities Service Oil Company to drill Well No. 1 in State Tract 74, Corpus Christi Bay, be granted in accordance with the recommen- dation from the Bay Drilling Committee. City Manager Whitney presented the application of Cities Service Oil Company to drill Well No. 1 in State Tract 52, Corpus Christi Bay. Mr. Whitney explained the application was dated September 29, 1965, and pointed out on a diagram the location of the well with reference to the lines of State Tract 52 covering a portion of the Southern portion of that tract in a Navy restricted area. Mr. Whitney explained the proposed location of the well as being 660 Feet from the Northwest line and 660 Feat from the Southwest line, City of Corpus Christi, Texas Regular Council Meeting October 20, 1965 Page 6 State Tract 52, and some 500 Feet from the Navy restricted area. He explained that the proposed depth of the well is 13,000 Peet, with a casing program of 20" conductor to be driven to 145 Feet, 13-3/8" surface pipe to be set at 1500 Feet; and that applicant had submitted Certificates of Insurance, and had applied for an amended Railroad Commission permit since moving the location, and had complied with provisions of the drilling ordinance. Mr. John Brooke, attorney for applicant, spoke in support of the application, and stated that the proposed well was located far enough out in the bay, and that the amended Railroad Commission permit had been applied for and the granting of this permit would be subject to applicant obtaining a permit from the Railroad Commission. No one appeared in opposition to this application. Motion by Wallace, seconded by Sizemore and passed, with Jimenez abstaining, that the application of Cities Service Oil Company to drill Well No. 1 in State Tract 52, Corpus Christi Bay, be granted in accordance with the recommendation from the Bay Drilling Committee, and subject to the permit from the Railroad Commission. In answer to questions from the Council relative to the completion of the well in State Tract 12 by British American Oil Producing Company, Attorney Pat McGloin, representing British American, advised the Council that as soon as information was available he would notify the Council. ORDINANCE NO, 7757 AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A CONTRACT WITH HANS AND BENNETT, ARCHITECTS, FOR SERVICES IN CONNECTION WITH ENGINEB INC AND DESIGN OF PLANS FOR THE WEST GUTH PARK SWIMMING POOL, PROJECT NO. 291-64-1; APPROPRIATING OUT OF NO. 291 PARK BOND FUNDS THE SUM OI $10,000°00 TO BE USED IN PAYMENT FOR SUCH ARCHITECTURAL SERVICES; ANM DECLARING AN EMERGENCY. Mayor Pro Tem Blackmon commended Mrs. Scott and Mrs. intense and keen interest in the welfare of Corpus Christi.
