SPECIAL COUNCIL MEETING
October 20, 1965

Mayor Pro Tem Jack R. Blackmon called the meeting to order.
City Secretary T. Ray Kring called the roll of those in attendance.
Motion by Dunne, seconded by Sizemore and passed that the absence of
Mayor McIver Furman be excused for cause.
Mayor Pro Tem Blackmon announced the purpose of the special meeting was
to hold public hearings on four zoning applications, and such other business as
might properly come before the Council; and explained the procedure to be followed.
Mayor Pro Tem Blackmon announced the public hearing on Application #965-6,
F. J. Kelley, for change of zoning from "R -1B" One -family Dwelling District to "AB"
Professional Office District, Lots 1, 2 and 3, Block 12, CA1s1len Townsite, located
on the Northeast corner of the intersection of Avenue "C" and First Street.
Tom Lake, Zoning Coordinator, located the property on the map; pointed
out the zoning and land use of the area; explained that at the Commission hearing
held September 7, 1965, the applicant appeared in favor of the application and no
one appeared in opposition; that six notices were sent out and no returns were
received in favor or in opposition; and stated that the recommendation of the
Zoning and Planning Commission was that it be approved as submitted. Mr. Lake
further explained that applicant is using Lot 2 for a film processing laboratory
and desired to expand his business to include Lot 3, and that Lot 1 is being
considered by the Calallen School District for office space purposes.
The applicant was present in favor of the application, and in answer
to questions from the Council, stated that he planned to develop the area around
May 1, 1966.
Motion by Wallace, seconded by McDaniel and passed that the hearing be
closed.

Motion by Wallace, seconded by Dunne and passed that the recommendation
of the Zoning and Planning Commission be concurred in, and that the request for
change of zoning from "R -IB" One -family Dwelling District to "AB" Professional
Office District, Lots 1, 2 and 3, Block 12, Cal all en Townsite, be approved, and
that an ordinance be brought forward effectuating this change,
Commissioners Sizemore and McDaniel stated that a review should be made
in the near future relative to the business zoning in that area.
Mayor Pro Tem Blackmon announced the public hearing on Application #965-7,
Jose Luis Arias, Sr., for change of zoning from "R -1B" One -family Dwelling District
to "B-4" General Business District, Lot 4, Block 1, Casa Blanca Addition, located
on the Southeast Right of Way line of Greenwood Drive, beginning at a point 155
Feet Northeast of the Northeast corner of the intersection of Soledad Street and
Greenwood Drive, extending 42 Feet in a Northeasterly direction along Greenwood
Drive for the frontage and 96 Feet in a Southeasterly direction from Greenwood
Drive for the depth.
Tom Lake located the property on the map; pointed out the zoning and
land use of the area; explained that at the Commission hearing held September 7,
1965, the applicant appeared in favor of the application and explained that he
planned to erect an automobile repair shop on the property. No one appeared in
opposition to this application. Mr. Lake further explained that forty-five notices
were sent out, five returns were received in favor and none in opposition, and that
one notice vas received in opposition after the hearing was held; and stated that
the recommendation of the Zoning and Panning Commission was that it be denied on
the basis that approval would constitute spot zoning and an illogical pattern to
the existing zoning.
No one appeared in favor or opposition to this application.
Motion by Sizemore, seconded by Wallace and passed that the hearing be
closed.
Motion by McDaniel, seconded by Wallace and passed, with Jimenez voting
"Nay", that the recommendation of the Zoning and Planning Commission be concurred
in, and that the request for change of zoning from "R -1B" One -family Dwelling Dis-
trict to "B-4" General Business District, Lot 4, Block 1, Casa Blanca Addition,
be denied.

Commissioners Wallace and Dunne requested a staff report within the next
thirty days relative to the dezoning of Lots 1, 2 and 3, Block 1, Casa Blanca
Addition, and 1f a public hearing on the dezoning would be advisable.
Mayor Pro Tem Blackmon announced the public hearing on Application #965-8,
The Carmelite Day Nursery, for change of zoning from "R -1B" One -family Dwelling
District to "AB" Professional Office District, a 5 -acre tract out of Lot 13, Section
"G", Paisley's Subdivision of the Hoffman Tract; fronting approximately 380 Feet
along the Northerly Right of Way line of Horne Road, beginning at a point approxi-
mately 718 Feet Southeast of the Northeast corner of the intersection of Horne
Road and Greenwood Drive and extending approximately 630 Feet in a Northeasterly
direction from Horne Road for the depth.
Tom Lake located the property on the map; pointed out the zoning and
land use of the area; explained. that at the Commission hearing held September 7,
1965, the applicant and one other person appeared in favor of the application and
no one appeared in opposition; that twenty notices were sent out, three returns
were received in favor and none in opposition; and stated that the recommendation
of the Zoning and Planning Commission was -rat it be approved as submitted on the
basis that the proposed nee is compatible with existing and proposed adjacent uses.
Mr. Jim Prendergast, representing the applicant, appeared in favor of
the application and stated that plans were being drawn and building should commence
within the next six or eight months.
Motion by McDaniel, seconded by Sizemore and passed that the hearing be
closed.
Motion by Wallace, seconded by Sizemore and passed that the application
be tabled, and referred to City Staff to work with applicant for further
consideration.
Mayor Pro Tem Blackmon announced the pudic hearing on Application #965-9,
Paul J. Koepke, for rvhenge of zoning from "tet -1B" One -family Dwelling District to
"B-1" Neighborhood Business District, a tract out of the Southeast corner of Tract
5, Oso Farm Tracts, located on the Northwest corner of the intersection of Holly
Road and Everhart Road and extending 200.83 Feet in a Northwesterly direction along
Holly Road and 660.03 Feet in a Northeasterly direction along Everhart Road.

Tom Lake located the property on the map; pointed out the zoning and
land use of the area; explained that at the Commission hearing held September 7,
1965, the applicant appeared in favor of the application and no one appeared in
opposition; that thirteen notices were sent out, four returns were received in
favor and none in opposition; and stated that the recommendation of the Zoning and
Planning Commission was that it be approved as submitted.
Mr. Paul Koepke explained to Council that his company had purchased a
seventy-four acre tract of land for the development of a subdivision called Stone -
gate, and that final plans have been approved by the Zoning and Planning Commission.
He further explained that the requested change of zoning is for neighborhood
business use on Everhart Road, and felt it was a logical extension of business
use in that area; and that it would be helpful and useful to the public in con-
nection with the proposed development.
Mr. John Thomason spoke in favor of the application, and stated that
he specialized in commercial properties, and several businesses had expressed
interest in this block of land, including a service station company, a drive-in
grocery chain and a dry cleaning and laundromat establishment.
Mr. George Hawn, representing himself, Saratoga Land Development Company,
and Mr. Startzell, spoke in opposition to the application, and stated that he was
not protesting the zoning but was opposed to the method of strip zoning. He
explained that he did not appear at the Zoning and Planning Commission meeting
as he felt the application would be denied. Mr. Hawn quoted recommendations and
suggestions from the Urban Land institute, Harland Bartholomew, and the Area
Development Committee, and stated he felt that strip zoning would be detrimental
to the whole area.
Mr. Roy Caldwell, agent for Country Club Estates, also spoke in
opposition, and stated that he did not object to progress of any kind but was
concerned with the feasibility of strip zoning.
Mr. Koepke explained that small businesses were needed in that area,
and that strip zoning applies to where you drive in off the street, and that he
would provide additional set backs or alleys.

Motion by Sizemore, seconded by Wallace and passed that the hearing be
recessed.
Motion by Wallace, seconded by Dunne and passed that the application be
reexAmined by the Zoning and Planning Commission and that further recommendation
be made.
Mr. Jose Luis Arias, Sr., applicant for the change of zoning requested
on Lot 4, Block 1, Casa Blanca Addition, explained to Council that he had been
delayed and was not present when hie case was being heard, and asked if the hearing
could be reopened.
In answer to questions from Council, City Attorney Singer informed Council
that the hearing could be reopened today.
Motion by Sizemore, seconded by Jimenez and passed that the public hearing
on Application #965-7, Jose Luis Arias, Sr., for change of zoning from "R -1B" One -
family Dwelling District to "B-4" General Business District on Lot 4, Block 1, Casa
Blanca Addition, be reopened.
Mr. Arias spoke in favor of the application, and explained. to Council
that he planned to operate an automobile re1vjir shop on the property; that it
would be a nice building; and that it would be a full-time job. Re further
explained. to Council that when he purchased the property, the owner told him he
would be able to have a garage there.
No one appeared in opposition to the application.
Motion by McDaniel, seconded by Dunne and passed that the hearing be
closed.
Motion by McDaniel that the application be denied. There being no
second to the motion, the motion failed.
Motion by Dunne, seconded by Jimenez and passed that the application
be tabled until the requeeted report on the dezoning of Lots 1, 2 and 3, Block
1, Casa Blanca Addition, had been received.
There being no further business to come before the Council, the special
meeting was adjourned.
