MOTIONS - 9/12/00 Motion approving the application from Bayfest, Inc. to temporarily close the following street sections for the Bayfest 2000 Festival, September 29 - October 1, 2000. a) Northbound Shoreline Boulevard (inside lane only), between westbound Interstate 37 and Hughes Street, from 9:00 a.m., Wednesday, September 20 through 8:00 a.m. Friday, September 29 and from 6:00 a.m., Monday, October 2 through 5:00 p.m., Wednesday, October 4, 2000. b) Southbound Shoreline Boulevard (full closure), between westbound Interstate 37 and Hughes Street, from 9:00 a.m., Wednesday, September 20 through 5:00 p.m., Wednesday, October 4, 2000. c) Northbound Shoreline Boulevard, (full closure), between westbound Interstate 37 and Hughes Street, from 8:00 a.m. Friday, September 29 through 6:00 a.m. Monday, October 2, 2000. d) North Water Street (full closure), between Fitzgerald Street and Hughes Street from 8:00 a.m. Friday, September 29 through 6:00 a.m., Monday, October 2, 2000. e) Power Street, Resaca Street, Palo Alto Street, Fitzgerald Street, and Hughes Street (full closures), each between Water Street and N. Enclose a check or money order for $200 to cover administrative costs of handling application, payable to the City of Corpus Christi (City Ordinance #20463, 9/20/88). 11. In consideration of obtaining a permit to close a City street for a public event, the applicant or sponsoring organization agrees to comply with the following applicable conditions: A, Admittance to said event shall be free; ~.~-c O_;J~,j ~sY~-,P<~c~-.) B. All profits derived from the event shall be for charitable causes; C. Pay ~e Ci~ four-percent (4%) of the gross receipts derived from event, or reimburse the Ci~ for all ~sts incurred by the City in suppo~ of said event. A~urate financial re~rds shall be maintained and payment shall be made to the city within sixty (60) days after the event ends. The City shall be reimbursed for its installation of all traffic signage and barricading determined by the City to be necessa~ for safe control of the event. Permit to Close Sb'eet for Public Events Evidence that these conditions have been meet must be presented to the City Traffic Engineer prior to the request being submitted to the City Council for final approval. Signed: Event Chairman/Organizer Date Submitted: INDEMNITY AGREENIF NT THE STATE OF TEXAS § COUNTY OF NUECES § KNOW ALL MEN BY THESE PRESENTS WHEREAS, Section III of said standards, entitled Procedure and Permit Requirements, requires a contractor for a permit to close or block any part of a roadway to file a statement with the director of Engineering Services Traffic Engineering division indemnifying the City against all claims or causes of action by reason of or arising from the closing or blocking of the readway pursuant to a permit issued by the City. Now, therefore, in consideration for the issuance of a permit to the undersigned by the Cit7 of Corpus Christi, for the purpose of barricading, blocking or closing a street, alley or other public right-of-way in said City, said permit applicant agrees to indemnify and save harmless and defend the City of Corpus Christi, its agents and employees from any and all claims, lawsuits, demands, liabilities, losses or expenses, including court costs and reasonable attorney's fees, for or on account of any injury to any person, or any death at any time resulting from such injury, or any damabds to any property which arise or may be alleged to have arisen directly or indirectly: as a esult of the granting of this permit. The Contractor, during the term perations specified in this Public Right-of-Way Blockage Permit, will provide and aintain at the Contractor expense,, Comprehensive General Liability Insurance cove age with a Contractual Liability endorsement and with minimum limits of $300.000 r person, $500.000 per occurrence, and $1O8.OOO for property damage, and Autom lie Liabilit'/Insurance coverage with a minimum coverage of $100.000 per personrrence, and $100.000 for property damage or as required by the Risk Manager of the City of Corpus Christi pursuant to Ordinance #19277. The City of Corpus Christi will be named as Additional Insured on the policy. Evidence of required insurance coverage will be by a Certificate of Insurance furnished to the director of Engineering Services Traffic Engineering Division prior to the proposed blockage under this permit.
