Ray Kring Mayor McIver Furman called the meeting to order. City Secretary T. Ray Kring called the roll of those in attendance. Mayor Furman announced the purpose of the special meeting was to hold public hearings on five zoning applications, and such other business as might properly come before the Council, and explained the procedure to be followed. Mayor Furman announced the public hearing on Application #466-1, Charles Hrissikopoulos, for change of zoning from "R -1B" One -family Dwelling District to "A-2" Apartment House District on Lots 2, 3, 4, 27, 28 and 29, Block 11, Flour Bluff Park. Laura Copeland, Zoning Coordinator, located the property on the map and pointed out the zoning and land use of the area; explained that at the Commission hearing held April 12, 1966, Fred Rheinlander, architect, spoke in favor of this request, and stated that this was a good area for apartment houses and that approx- imately two buildings per lot were planned; that no one appeared in opposition; that thirteen letters were sent out, and two returns were received in favor and one return was received in opposition; and stated that the recommendation of the Zoning and planning Commission was that the application be approved on the basis that this is an area that is undeveloped and the request area is large enough to accommodate the requested zoning change. Charles Hrissikopoulos, applicant, was present in support of his application. No one appeared in opposition to this application. Motion by Sizemore, seconded by Dunne and passed that the hearing be closed.. Motion by Dunne, seconded by Sizemore and passed that the recommendation of the Zoning and Planning Commission be concurred in, and that the request for change of zoning from "R -1B" One -family Dwelling District to "A-2" Apartment House District on Lots 2, 3, 4, 27, 28 and 29, Block 11, Flour Bluff Park, be approved, and that an ordinance be brought forward effectuating this change. Mendez, for change of zoning from "R-2" Two-family Dwelling District to "A-2" Apart- ment House District on Lot 16, Block 5, Bayview Addition #2. Laura Copeland located the property on the map and pointed out the zoning and land use of the area; explained that at the Commission hearing held April 12, 1966, the applicant, R. E. Mendez, spoke in favor of his request, and stated that his original request was to build a six -unit apartment house on this property; that no one appeared in opposition; that twenty-six letters were sent out, and five returns were received in favor and two returns were received in opposition; and stated that the recommendation of the Zoning and Plkrning Commission was that the application be approved on the basis that the land use in this area has undergone a great change and the area is run down. R. E. Mendez, applicant, spoke in favor of his application, and stated that his original plans were to build a six -unit apartment house on the property but after inquiring about the cost had changed his mind and wanted to repair the existing house and make it into two apartment units. In discussing his future plans, Mr. Mendez stated that he would eventually locate his office on the property, and it wee pointed out by the Council that this would require "AB" zoning and that it would be necessary for him to make a new application if he desired the "AB" zoning, and that the "A-2" zoning would allow the apartment units. In answer to questions from the Council, Mr. Mendez stated that he wanted the zoning changed to "A-2." City Manager Whitney presented one communication received in opposition to the requested zoning change. No one appeared in opposition to this application. Motion by Jimenez, seconded by Dunne and passed that the hearing be closed. Motion by Jimenez, seconded by Dunne and passed that the recommendation of the Zoning and Plwnning Commission be concurred in, and that the request for change of zoning from "R-2" Two-family Dwelling District to "A-2" Apartment House District on Lot 16, Biock 5, Bayview Addition #2, be approved, and that an ordinance be brought forward effectuating this change. Minutes Special Council Meeting May 10, 1966 Page 3 Mayor Furman announced the public hearing on Application #466-4, Ed Holly, for change of zoning from "R -1B" One -family Dwelling District to "I-2" Light Industrial District on Blocks 2, 5 and 8, Colonia Hidalgo Addition, save and except those portions taken for Lexington Boulevard Right -of -Way. Laura Copeland located the property on the map and pointed out the zoning and land use of the area; explained that at the Commission hearing held April 12, 1966, no one appeared in favor of this request and no one appeared in opposition; that twenty-four lettere were sent out, and one return was received in favor and none in opposition; and stated that the recommendation of the Zoning and Planning Commission was that the application be approved on the basis that this is a logical extension of "I-2" Light Industrial District and further recommended that the follow- ing restrictions be placed on the subject property; (1) That an 8 -foot screening easement be dedicated along Linda Vista Drive beginning at the inner edge of the sidewalk; (2) That an 8 -foot solid fence be erected according to City specifications, along Linda Vista Drive behind the screening easement; That oleanders be planted 3 feet apart on center and 3 feet in front of the fence; (4) That this approval be subject to a proper plat and site plan of the area; That a sidewalk be built. (3) (5) Mayor Pro Tem Blackmon asked if the sidewalks would be built according to City specifications, and City Manager Whitney replied that a permit would be required and should be built according to City specifications. In answer to questions from the Council relative to the closing of an unopened street, City Manager Whitney advised that the change of zoning would not affect the street; that it is a dedicated street and would require a hearing by the Council to close the street. No one appeared in connection with this application. Mrs. Essie Moreland, 4741 Molina, inquired about the sewerage facilities in the area. Motion by Jimenez, seconded by Blackmon and passed that the hearing be closed. Minutes Special Council Meeting May 10, 1966 Page 4 Motion by Blackmon, seconded by Wallace that the recommendation of the Zoning and Planning Commission be concurred in with the exception that "and reasonably maintained" be added to Item (2) and "according to City specifications" be added to Item (5). In discussing this motion, it was pointed out by City Manager Whitney that Item (5) should be clarified to avoid confusion at a later date. The foregoing motion was amended for Item (5) that a sidewalk be built "along Linda Vista Drive according to City specifications." Mayor Furman called for a vote on the foregoing amended motion and declared the motion had passed with all "ayes", and that the change of zoning from "R -LB" One -family Dwelling District to "I-2" Light Industrial District on Blocks 2, 5, and 8, Colonia Hidalgo Addition, save and except those portions taken for Lexington Boulevard. Right -of -Way had been approved subject to the following restric- tions being placed on the subject property: (1) That an 8 -foot screening easement be dedicated along T.inAn Vista Drive beginning at the inner edge of the sidewalk; (2) That an 8 -foot solid fence be erected according to City specifica- tions, along Linda Vista Drive behind the screening easement and reasonably maintained; (3) That oleanders be planted 3 feet apart on center and 3 feet in front of the fence; (4) That this approval be subject to a proper plat and site plan of the area; (5) That a sidewalk be built along Linda Vista Drive according to City specifications. Mayor Furman announced the public hearing on Application 466-5, N. C. Floyd, for change of zoning from "A-2" Apartment House District to "B-1" Neighbor- hood Business District on Lot 10, Block 2, Osage Addition. Laura Copeland located the property on the map and pointed out the zoning and land use of the area; explained that at the Commission hearing held April 12, 1966, the applicant, N. C. Floyd, spoke in favor of his request, and stated that he intends to use this property as a sales and service office for his air conditioning business, that no extensive repairs, welding, or other obnoxious work would take place on his property; that no one appeared in opposition; that twenty-four letters were sent out, and two returns were received in favor and two Minutes Special Council Meeting May 10, 1966 Page 5 returns were received in opposition; and stated that the recommendation of the Zoning and Planning Commission was. that the application be approved on the basis that it is a logical extension of "B-1" Neighborhood Business along this portion of Everhart Road. N. C. Floyd, applicant, spoke in favor of his application, and explained that the property would be used for a sales and service office for his air con- ditioning business; that all sheet metal work is under subcontract to him and would not be involved; that there had been some question about a sign and that he did not care whether or not he had a sign; and stated that he would appreciate the Council's consideration in granting this request. No one appeared in opposition to this application. Motion by Sizemore, seconded by B]aclnnon and passed that the hearing be closed. Motion by Jimenez, seconded by Wallace and passed that the recommenda- tion of the Zoning and Planning Commission be concurred in, and that the request for change of zoning from "A-2" Apartment House District to "B-1" Neighborhood Business District on Lot 10, Block 2, Osage Addition, be approved, and that an ordinance be brought forward effectuating this change. Mayor Furman announced the public hearing on Application #466-6, Amado Laurel, for change of zoning from "R -1B" One -family Dwelling District to "A-1" Apartment House District on Lot 36B, Block 1, Lexington Subdivision. Laura Copeland located the property on the map and pointed out the zoning and land use of the area; explained that at the Commission hearing held April 12, 1966, the applicant, Amado Laurel, spoke in favor of his request, and stated that he planned to build a four -plea apartment of brick on this lot; that one other person appeared in favor of this request and no one appeared in opposi- tion; that seventeen letters were sent out, and no returns were received in favor and one return was received in opposition; and stated that the recommendation of the Zoning and Planning Commission was that the application be approved as a good transition between the existing "B-4" General Business District zoning and "R -1B" One -family Dwelling District zoning, and further recommended that the Staff make a study of the area relative to a more logical zoning for this area. Minutes Special Council Meeting May 10, 1966 Page 6 Amada Laurel, applicant, spoke in favor of his request, and stated that the four units would be built out of brick; that his home is the only brick home nearby; that the unite would be very nice; and requested that the change of zoning be granted. No one appeared in opposition to this application. Motion by Blackmon, seconded by Wallace and passed that the hearing be closed. Motion by Jimenez, seconded by Blackmon and passed that the recommendation of the Zoning and Planning Commission be concurred in, and that the request for change of toning from "R-lB" One -family Dwelling District to "A-1" Apartment House District on Lot 36B, Block 1, Lexington Subdivision, be approved, and that an ordinance be brought forward effectuating this change. Mayor Furman announced the regular Council Meeting of May 11, 1966, would be deferred until 3;00 p.m. out of respect for the late Mr. 0. N. Stevens. Mayor Furman asked the Council if they desired to act on the two pending zoning applications that were scheduled for the regular meeting of May 11, 1966, and members of the Council stated that as the hearings on these two applications had been closed; it was their desire to act on these two applications at this time. Mayor Furman brought up the pending item of Application #266-4, Sam Susser, for change of zoning from "AB" Professional Office District to "B-1" Neighborhood Business District on the South 1/2 of Lots 13 and 13A, Block 4, Del Monte Addition, on which public hearing was held May 4, 1966, and which was tabled for one week for further study and consideration. Motion by Wallace, seconded by Blackmon and passed, Jimenez abstaining, that the recommendation of the Zoning and Planning Commission be concurred in, and that the request for change of zoning from "AB" Professional Office District to "B-1" Neighborhood Business District on the South 1/2 of Lots 13 and 13A, Block 4, Del Monte Addition, be denied. Mayor Furman brought up the pending item of Application #366-11, J. P. Vermeulen, for change of zoning from "R -1B" One -family Dwelling District to "B-1" Neighborhood Business District on a 0.746 -acre tract of land out of Lot 16, Section 49, Flour Bluff and Encinal Farm and Garden Tracts, fronting 108.4 Feet along the Minutes Special Council Meeting May 10, 1966 Page Southeast Right -of -Way line of Flour Bluff Road, beginning at a point 456.4 Feet Northeast of the intersection of Flour Bluff Road and Purdue Road, and extending approximately 300 Feet in a Southeasterly direction from Flour Bluff Road for the most depth, on which public hearing was held May 4, 1966, and which was tabled for one week for further study and consideration. City Manager Whitney advised that the applicant had contacted his office and stated that his wife was out of town and unable to attend the Council meeting; that the applicant proposed to move in a building and build a drive-in grocery that would serve the school children mostly; that he was quite anxious to have a decision on his application as housemovers are working in that area at the present time. Commissioner Sizemore inquired about acting on this matter at this time, and members of the Council pointed out that the hearing had been closed and that it would be in order to act on this application. Motion by Jimenez, seconded by Blackmon and passed that the request for change of zoning from "R -1B" One -family Dwelling District to "B-1" Neighborhood Business District on a 0.746 -acre tract of land out of Lot 16, Section 49, Flour Bluff and Encinal Farm and Garden Tracts, be denied, but in lieu thereof a Special Permit be granted for a Drive -In Grocery subject to a proper plat being submitted. There being no further business to come before the Council, the Special Meeting was adjourned.
