Wallace MINUTES CITY OF CORPUS CHRISTI, TEXAS REGULAR COUNCIL MEETING June 29, 1966 2:00 p.m, City Manager Herbert W. Whitney Assistant City Attty Tom McDowell City Secretary T. Ray Kring Mayor McIver Furman called the meeting to order. The invocation was given by Commissioner Sizemore in the absence of the invited guest chaplain. City Secretary T. Ray Kring called the roll of those in attendance. Motion by Dunne, seconded by Sizemore and passed that the absence of Mayor Pro Tem Blackmon be excused for cause. Motion by McDaniel, seconded by Dunne and passed that the minutes of the Special Meeting of June 22, 1966, at 8:00 a.m.; the Regular Meeting of June 22, 1966, at 2:00 p.m., and the Special Meeting of June 27, 1966, at 8:45 p.m., be approved. Mayor Furman read and presented proclamations relative to the following: SAFE BOATING WEEK in Corpus Christi, the week of July 3, through July 9, 1966, accepted by Lieutenant Cox of U. S. Coast Guard; RINGING OF BELLS in celebration of the Fourth of July, beginning at 9 a.m., July 4, as an expression of our faith in the ideals of our Nation, accepted by Colonel Nela Soderholm and Cuban Burbank. Bids were opened and read on Interceptor Sewer Line 34A, Section I, including a portion of Line 29A, from the following firms: Fowco Construction Company, F. M. Thornton; Heldenfels Brothers; T. H. Lee Construction Company; and Burtex Constructors, Inc. The foregoing bids were tabled for 48 hours as required by the City Charter, and referred to the City Manager for tabulation and recommendation. Mr. Whitney stated that there were no bids received for the sale of City property in Ebony Acres Addition, which were to have been opened today. Other means of disposition will be discussed later. Mayor Furman brought up the pending item of Application #566-7, Stanley - Orion, Incorporated, for change of zoning from "R -1B" One -family Dwelling District to "I-2" Light Industrial District on Lots 1, 2, 3, and 4, Warnecke Subdivision on Minutes Regular Council Meeting June 29, 1966 Page 2 which public hearing was held June 22, 1966, and stated a motion would be in order for action on this item. Motion by Dunne, seconded by Sizemore and passed that the recommendation of the Zoning and Planning Commission be upheld that the foregoing application be denied but in lieu thereof a Special Permit be granted for use as a storage space and to allow the expansion of its office for an engineering department with the following conditions, and that an ordinance be brought forward effectuating the change: 1. That the permit be granted effective until December 31, 1970. 2. Subject to an approved site plan, including complete screening of the area with plant materials along the front side on Viola Street, and a solid wood fence be erected along the back side and down the south- east line. Mayor Furman brought up the pending item of Application #566-2, Brown & Root, Inc., and E. M. Fox, for change of zoning from "F -R" Farm -Rural District to "I-2" Light Industrial District on Lots "B" and "C", Tract 14, and Lot 14D, Lokey Subdivision, on which public hearing was held June 8, 1966, and stated he would entertain a motion in consideration of this item. Motion by Sizemore, seconded by Dunne and passed that the recommendation of the Zoning and Planning Commission be concurred in, and that the foregoing application be denied on the basis that this is an area which would be more suitably used as a residential area. It was further moved that a special permit relative to dogs be granted with a 5 -year limit, and that an ordinance be brought forward effectuating the change only on the E. M. Fox property, described as Lot 14D, Lokey Subdivision. Mayor Furman presented the pending item of Application #466-7, James P. Charnquist for change of zoning from "R -1B" One -family Dwelling District to "R-2" Two-family Dwelling District, on Lots 1 through 64, Block 415, Port Aransas Cliffs, on which public hearing was held June 8, 1966, and called for a motion for its ..,diipposition. Motion by Wallace, seconded by McDaniel and passed that the recommendation of the Zoning and Planning Commission be concurred in and that the request for change of zoning on the foregoing application be denied but in lieu thereof a Special Permit be granted for the construction of a townhouse complex, according to complete plans (construction and site plans) as presented to and amended by the Planning Staff; Minutes Regular Council Meeting June 29, 1966 Page 3 subject to a replat of the property; and further recommended that the project be completed within two years of the date of passage of the ordinance effectuating the granting of the Special Permit. Mayor Furman called for the City Manager's Reports. Motion by Jimenez, seconded by Dunne and passed that the City Manager's Reports, items "a" through "d" be accepted; that Items "e" and "f" be considered separately, and that the recommendations and requests be approved as follows a. That Plans and Specifications for street improvements on Navigation Boulevard be approved and that authority to advertise for bids to be received July 20, 1966, be granted; b. That the date of July 20, 1966, during the Regular meeting be set for public hearing on three zoning cases; c. That the request of 34 businessmen of the downtown area to provide locations for the display of the United States Flag on the Fourth of July and other appropriate days, be granted; d. That a revocable permit to Harvie Branscomb, Maury Wolfson, and T. S. Scibieneki, et al, to occupy a portion of the public right of way abutting the north side of the 800 Block of Leopard Street, being Lots 1, 2, 11 and 12, Block 19, Bluff Portion, for the purpose of the erection and maintenance of a metal canopy supported by masonry columns, be granted. City Manager Whitney presented the application of R. L. Kirkwood to drill Well 10, State Tract 706, Lease No. 30427, Nueces County, Texas (Item "e"). Mr. Whitre described the location of the proposed well as 1,470 feet West of the East line of Tract 706 and 3,230 feet South of the North line of Tract 706; that the well in questic.n will be a straight well and will have approximately 200 feet of surface casing; that the applicant has submitted Certificate of Insurance; included check in the amount of $500 as payment for permit fee; and had made application to the Railroad Commission for permit; and that he recommends approval subject to receipt of the Railroad Comm- ission Permit. Motion by Wallace, seconded by McDaniel and passed that the application of R. L. Kirkwood to drill Well No. 10, State Tract 706, Lease No, 30427, Nueces County, Texas, be granted subject to receipt of the Railroad Commission Permit. ORDINANCE NO. 8074 APPROPRIATING OUT OF NO. 295 STORM SEWER BOND FUND THE SUM OF $51,500 FOR JUDGMENTR RENDERED IN THE COUNTY COURT IN CASES OF CITY OF CORPUS CHRISTI VS, RUDOLF POL',=EK; JR., AND CITY OF CORPUS CHRISTI VS. ANNASTAZIE S. ORDINANCE NO. 8075 AMENDING THE CORPUS CHRISTI CITY CODE, 1958, AS AMENDED, BY AMENDING SECTION 26-5 80 AS TO PROVIDE FOR ISSUANCE OF PERMIT BY THE SUPERVISOR OF THE COLLECTION SECTION O'' THE FINANCE DEPARTMENT OF THE CITY UPON VERIFICATION BY THE CITY SECRETARY THAT AIL REQUIREMENTS HAVE BEEN MET BY THE APPLICANT FOR SOLICITOR'S LICENSE; AMENDING SECTS 26-6 OF THE CORPUS CHRISTI CITY CODE, 1958, SO AS TO PROVIDE FOR SUSPENSION AND REVOCATION OF SOLICITOR'S LICENSE UNDER CERTAIN CONDITIONS, AND PROVIDING FOR AFPFA3.,; PROVIDING A SAVINGS CLAUSE; PROVIDING AN EFFECTIVE DATE; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. ORDINANCE NO. 8076 AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A REVOCABLE PERMIT TO HARVIE BRANSCOMB, MAURY WOLFSON, AND T. S. ORDINANCE NO. 8077 BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, CANVASSING RETURNS AND DECLARING RESULTS OF AN ELECTION ON THE QUESTION OF THE ISSUANCE OF BONDS FOR THE PURPOSE OF BUYING AND CONSTRUCTING A PUBLIC BUS TRANSPORTATION SYSTEM IN THE AGGREGATE AMOUNT OF $500,000; AND DECLARING AN EMERGENCY. The Charter rule was suspended and the foregoing ordinance was passed by the following vote: Furman, Dunne, Jimenez, McDaniel, Sizemore, and Wallace, present and voting "Aye;" Blackmon absent. ORDINANCE NO. 8078 CANVASSING RETURNS AND DECLARING THE RESULTS OF AN ELECTION HELD IN THE CITY OF CORPUS CHRISTI, TEXAS, ON JUNE 25, 1966, ON THE QUESTION OF THE ADOPTION OF A RESOLUTION IN FAVOR OF THE EXERCISE OF THE POWERS OF URBAN RENEWAL; AND DECLARING AN EMERGENCY. The Charter rule was suspended and the foregoing ordinance was passed by the following vote: Furman, Dunne, Jimenez, McDaniel, Sizemore, and Wallace, present and voting "Aye;" Blackmon absent. ORDINANCE NO. 8079 CANVASSING RETURNS AND DECLARING THE RESULTS OF AN ELECTION HELD IN THE CITY OF CORPUS CHRISTI, TEXAS, ON JUNE 25, 1966, FOR THE PURPOSE OF DETERMINING WHETHER OR NOT THE TERRITORY ADJACENT TO THE CITY OF CORPUS CHRISTI AND DESCRIBED IN THE ORDINANCE CALLING THE ELECTION SHOULD BE ANNEXED TO THE CITY OF CORPUS CHRISTI, TEXAS; AND DECLARING AN EMERGENCY. The Charter rule was suspended and the foregoing ordinance was passed by the following vote: Furman, Dunne, Jimenez, McDaniel, Sizemore, and Wallace, present and voting "Aye;" Blackmon absent. ORDINANCE NO. 8080 BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, RECEIVING INTO AND ANNEXING TO THE CITY OF CORPUS CHRISTI, CERTAIN ADDITIONAL TERRITORY IN THE STATE- OWNED SUBMERGED AREAS, AND FIXING NEW BOUNDARIES FOR THE CITY OF CORPUS CHRISTI, FULLY DESCRIBING SAID TERRITORY AND SAID NEW BOUNDARIES, AND DECLARING SAID NEW TERRITORY AN INTEGRAL PART OF THE CITY OF CORPUS CHRISTI AND DECLARING THE SAID NEW TERRITORY AS ANNEXED TO AND MADE A PART OF THE CITY OF CORPUS CHRISTI, TEXAS, SUBJECT TO THE GENERAL LAWS OF THE STATE OF TEXAS, THE CITY CHARTER OF THE SAID CITY AND THE ORDINANCES, RESOLUTIONS AND LAWS OF THE CITY OF CORPUS CHRISTI AND ENTITLED TO ALL THE SAME RIGHTS, PRIVILEGES, AND BURDENS THEREOF; AND DECLARING AN EMERGENCY. Minutes Regular Council Meeting June 29, 1966 Page 6 City Manager Whitney presented the application of AtlanticRichfieldCompany (Item "f"), to deeper and operate a well in State Tract 470, Corpus Christi Bay. Mr, Whitney stated that after the passage of Ordinance No. 8080, the proposed well site is within the City Limits of Corpus Christi. Mr. Whitney pointed out on a plat the location of the proposed well as being 550 feet from the Northwest line and 1320 feet from the Northeast line of State Tract 470, Corpus Christi Bay; that the well in question shall be drilled as a straight well and no deviation from vertical is planned; that the proposed depth is 13,500 feet with a casing program of 16" conductor pipe at 150 feet to 10 3/4" surface casing at 1500 feet, 7" production casing at 9600 feet and 5" production casing at 9600 feet; that the applicant has submitted Certificate of Insurance and check in the amount of $500 covering permit fee, and photocopy of Railroad Commission Permit. Mr. Whitney further stated that the appli- cation had been referred to the Bay Drilling Committee for study and recommendation; read a letter signed by Mr. Harvie Branscomb which stated that the Bay Drilling Committee recommends approval of the application subject to the provisions of such ordinances as may be in effect now or subsequently pertaining to such operations. Motion by McDaniel, seconded by Wallace and passed that the application of AtlanticRichfieldCompany to deepen and operate Well No. 1, State Tract 470, Corpus Christi Bay, be granted as applied for. Mr. Whitney presented a petition containing 19 signatures requesting the City to install a traffic light at the intersection of Swantner Street and Texas Street in Lindale Addition. (Petition #9-66) Mrs. Helen Massey, 746 Texas, and Mr. Frank Allen appeared and spoke on behalf of the petition and stated that this is a very dangerous intersection because of the heavy traffic which does not slow down and that traffic coming from the other direction does not observe the Yield sign. Motion by Jimenez, seconded by Wallace and passed that the matter of installing a traffic light at the intersection of Swantner Street and Texas Street be referred to the City Manager for study and recommendation. Mr. A. H. Barbour, 9434 Wilkins Drive, appeared and again protested the 250 garbage collection fee for disposal areas and requested that the Council be polled as to their views in this connection. Minutes Regular Council Meeting June 29, 1966 Page 7 Mayor Furman advised Mr. Barbour that the Council is unanimously in favor of retaining the 25c Garbage fee. Mr. William Darby, Executive Secretary of the Building and Construction Trades Council, and representative of organized labor, appeared and stated that poor housing and low wages are companions and that some relief of problems in the slum areas could come from higher wages; that organized labor has always strived for a sensible minimum wage; that a city striving to upgrade its community should take care of the low wage group; that no City employee should earn less than $3,000 a year; that using the Federal guideline, an income of less than $3,000 a year is considered in the poverty level; and urged that all city contracts be subject to the prevailing wage scale as determined by the Department of Labor. Mr, Darby made no specific recommendation but offered his services in this connection and asked the Council to withhold their answer now but to carefully consider the matter City Manager Whinney stated that the minimum wage paid by the City is $1.25 an hour, which is the current federal minimum, and that with respect to contracts, involving federal participation are subject to Department of Labor prevailing wage determinations, but not those involving only local funds. Mayor Furman thanked Mr. Darby for his presentation and asked that his statements be filed with the City Secretary (Council Exhibit #4-66). There being no further business to come before the Council, the meeting was adjourned.
