REGULAR COUNCIL MEETING
August 24, 1966

Mayor Pro Tem Jack R. Blackmon called the meeting to order.
The invocation was given by Dr. Vernon Elmore, pastor of the
First Baptist Chruch.
City Secretary T. Ray Kring called the roll of those in attendance.
Motion by Dunne, seconded by Sizemore and passed that the absence of
Mayor Furman be excused for cause.
The Minutes of the Regular Meeting of August 17, 1966 were approved as
furnished to the Council.
Mayor Pro Tem Blackmon recognized in the audience Boy ScOuts, Cliff
Hunter, James Dieter, Brad Sprott, Dick Bergfeld and Henry Bergfeld, of Troop
#231 who were present for credit on Merit Badges. Mayor Pro Tem Blackmon pre-
sented each of the Boy Scouts 4th Certificates of Commendation for their interest
in governmental affairs.
Mayor Pro Tem Blackmon recognized and presented a Certificate of Comm-
endation to Charles R. Manning who is retiring after 28 years of service with the
Civil Air Patrol.
Mayor Pro Tem Blackmon read and presented a proclamation designating
August 25, 1966, as NATIONAL PARK SERVICE DAY, in commemoration of the 50th
Anniversary of the establishment of the National Park Service in the Department
of Interior, and the benefit from the establishment and development of the Padre
Island National Seashore area, one of the major recent additions to the National
Parks System, and urged the citizens of our community to reflect upon our great
fortune in havinga part of this great system virtually at our back door.
Mayor Pro Tem Blackmon announced the opening of bids.
Bids were opened and read on street improvements on Winters Drive between -.y
Horne Road and Green Grove Drive, from the following firms: Heldenfels Brothers,
South Texas Construction Company, and Asphalt Paving Company.

The foregoing bids were tabled for 48 hours as required by the City
Charter and referred to the City Manager for tabulation and recommendation.
Bids were opened and read on Water Sprinklers for Warehouse Inventory
from the following firms: General Lawn Sprinklers Company; Telsco Industries;
Thompson Manufacturing Company; Venable Sprinkler Sales Company; South Texas
Lawn Sprinkler Company, and Stewart & Stevenson Services.
The foregoing bids were tabled for 48 hours as required by the City

Mayor Pro Tem Blackmon announced the pending item of Application #766-6,
Abe Block for change of zoning from "I-3" Heavy Industrial District to "1-2"
Light Industrial District on Lots 9 and 10, Block 5, Los Angeles H.,11s, on which
the public hearing was held August 17, 1966, and explained that it was the
recommendation of the Zoning and Planning Commission that the application be
denied on the basis that approval would constitute spot zoning; that the area
is primarily heavy industrial and the intent of the Ordinance is to prevent
single-family uses in an area which could present a danger to residents.
Motion by McDaniel, seconded by Dunne and passed, with Blackmon, Dunne,
Jimenez, McDaniel and Sizemore, voting "Aye," and Wallace voting "Nay," that
the Application #766-6, Abe Block for change of zoning from "I-3" Heavy Indust-
rial to "I-2" Light Industrial District on Lots 9 and 10, Block 5, Los Angeles
Hills, be approved and that an ordinance be brought forward effectuating the
change.
Mayor Pro Tem Blackmon announced the pending item of Application #766-7,
L. M. Dalrymple, for change of zoning from "R-2" Two Family Dwelling District to
"B-1" Neighborhood Business District on Lots 4 and 5, Block 8, Bayview Addition
#2, on which a public hearing was held August 17, 1966, and explained that the
recommendation of the Zoning and Planning Commission was tilt the application be
denied on the basis that approval would constitute spot zoning, but in lieu
thereof, a Special Permit be granted for the construction of a grocery store
subject to the regulations of "B-1" Neighborhood Business District.

Motion by Dunne, seconded by Wallace and passed, with Jimenez abstain-
ing and McDaniel voting "Nay," that the recommendation of the Zoning and Planning
Commission be concurred in and that Application #766-7, L. M. Dalrymple, for
change of zoning from "R-2" Two Family Dwelling District to "8-1" Neighborhood
Business District on Lots 4 and 5, Block 8, Bayview Addition #2, be denied
on the basis that approval would constitute spot zoning,but in lieu therof,
a Special Permit be granted for the construction of a grocery store subject to
the regulations of "B-1" Neighborhood Business District, and that an ordinance
be brought forward effectuating the change.
Mayor Pro Tem Blackmon announced the scheduled public hearing on the
appeal of five property owners from the decision of the Zoning and Planning
Commission to grant to Mr. and Mrs. Jerry Sheets a Special Use Permit #60,
authorizing the operation of a trailer park on Lots 1 through 6, Block 23, Lots
3 through 6, Block 39, Nuecestown Subdivision (unrecorded).
City Manager Whitney presented the appeal, and explained that the
Zoning Ordinance, under Section 25-1, Special Uses, any person being adversely
affected may appeal to the Council within 30 days from the decision of the Zoning
and Planning Commission, and that the :°uncal shall then hold a public hearing
after publication notice has appeared three times, the first publication being at
least 15 days before the date of the hearing; that the hearing before the Zoning
and Planning Commission was held on the 5th day of July, 1966, and that an appeal
had been filed on July 27, 1966, signed by W. S. Shilling, E. M. Carey, Jr.,
Mrs. Iva B. West, Mrs, M. W. Clark and James R. Sinclair, in which they stated
that they are owners of more than twenty per cent of the lots extending two
hundred feet from the street frontage directly opposite and adjacent to Lots 1
through 6, Block 23, and Lots 3 through 6, Block 39, Nuecestown Subdivision,
Mr. William A. Anderson, Director of Zoning & Planning, located the
property on the map and pointed out the land uses of the surrounding area;
stated that at the Commission hearing, only five members were present, and
called attention to the fact that only three members had voted in favor of
granting the request, and that one member had abstained; that the Staff had
mailed nine letters and that no returns were received in favor and five in opp-
osition; and that members of the Zoning and Planning Commission had made an
inspection trip on July 1, 1966.

Mr. Anderson further mentioned that the applicants propose to have a 30 -unit
trailer park with such services as a laundry and swiffining pool available for
occupants; that he will be the manager of the park and will live in one of the
units, and that no office building would be required on the property; that a
redwood fence is proposed to be built around the trailer park; that the trailers
will be placed approximately 25 feet apart, and that the roads will be of
asphalt with curbs.
Calvin Taylor, Senior Planner , pointed out on the map that the
property in question faces on Up River Road, and that there are located in the
area, such businesses as a floor covering company, a warehouse, a dog kennel,
some very nice homes, and that the area directly across the street is a wooded
area. Mr. Taylor further stated that the uses are conflicting, but that the gen-
eral character of the neighborhood is residential.
Mr. Bill Anderson, attorney, represented the five homeowners making the
appeal, and called attention to alleged errors in the original application, stat-
ing that the correct physical terrain would show that the creek or drainage ditch
instead of going along the east side of the property, actually splits the entire
tract into two areas; that without a use permit to construct a sewage disposal
system for such trailers, three trailers had been placed on the premises, and that.
the property is not serviced by a City or private sewer disposal system approved
by the Public Works Department. He further stated that his clients object to the
granting of a special use permit for the reasons that the area is generally res-
idential consisting of one -family residences on large lots up to five acres; that
it will be impossible for many years for the City Sewer to be connected; that
because of the sewage disposal aspect, 31 trailers would create a health hazard,
and in turn cause a pollution of the Nueces River; that the applicants have done
nothing toward beautifying the area adjoining and adjacent to Up River Road and
that such area exists almost as a natural thicket; that a check of the existing
three trailers by the City Health Department indicates the installation of 150
gallon septic tanks with a permit, and that a minimum capacity for this use and
area would be a 300 gallon tank per trailer; and that the manner in which the park
has been constructed and operated to date is a nuisance, and that this would indi-
cate that its operation in the future will be conducted in a similar manner; and

and that according to the preliminary Harland Bartholomew Report prepared for the
Area Development Committee on May 6, 1966, minimum requirements for a mobile
home park has not been met. Each member of the Council was furnished a copy of
the brief setting out the objections of the opponents.
A telephone message received in the office of City Secretary Ray Kring
from Mrs. Loretta Vatzlavich and Mrs. J. R. Sinclair interposed opposition to
the granting of the special permit in question.
Mr. Briscoe King, appeared as counsel for the Applicants, Mr. and Mrs.
Jerry Sheets, and stated that there has been an earnest attempt to provide suit-
able locations for mobile homes; that the manufacturers of expensive and lux-
urious mobile homes have tried to upgrade parks and that neighborhoods of a
residential character are preferred because they are occupied by families with
children, and that they are comparable to "A-2" Apartment use. Mr. King
pointed out that in other prominent tourist districts in California and Florida,
these mobile homes are an important part of the community. He further stated that
the drainage ditch referred to in the opponents petition had been blocked off;
that the applicants did not propose to use the park for 30 trailer parks at the
present time, but that they had applied for that number because of anticipated
future plans and in order to preclude coming before the Zoning and Planning Comm-
ission again; that the applicants are willing to abide by any restrictions the
Council would impose and that the ordinance would be complied c4th; that the sewer-
age problems can be worked out according to the Sanitation Code; that a 6 -foot
redwood fence will be erected to screen the park, and it is his opinion that there
will be nothing undesirable in its appearance and that it will be an asset.
In answer to questions raised by members of the Council, Mr. Briscoe King
stated that this is an unrecorded plat, and that the Council will be presented
with an accurate plat now being prepared. Also, that the difference in statements
in regard to the drainage ditch, he stated that the ditch had been filled, and
that the number of trailers could be determined by the Council; that no fencing
has been started.
In rebuttal, Mr. Bill Anderson, stated that he owns property on Ocean
Drive and that he was certain that a trailer park in that area would devaluate
his property, yet it would be a nice place for a trailer park; that in connection

with the filling of the aforementioned drainage ditch, it would take a tremendous
amount of dirt to fill the ditch.
In answer to a question raised by Commissioner Sizemore, regarding the
eleven points in the Ordinance of compliance, Mr. Anderson of the Zoning and
Planning Department stated that the eleven conditions had been included in their
recommendation; he further stated that the ordinance is obsolete having been
passed in 1937, and that the Staff has recommended on several occasions that it
be restudied.
No one else appeared in connection with the foregoing hearing.
Motion by McDaniel, seconded by Dunne and passed that the hearing be
closed.
Motion by McDaniel, seconded by Wallace and passed that the appeal from
the decision of the Zoning and Planning Commission to grant to Mr. and Mrs. Jerry
Sheets a Special Use Permit #60, authorizing the operation of a trailer park on
Lots 1 through 6, Block 23, Lots 3 through 6, Block 39, Nuecestown Subdivision;
be tabled for further discussion, and that the staff be directed to present other
information regarding a site plan.
Mayor Pro Tem Blackmon called for the City Manager's Reports.
Motion by Wallace, seconded by Sizemore and passed that the City Man-
ager's Reports be accepted, and that the recommendations and request be approved
and granted as follows:
a. That Plans and Specifications for proposed street improvements on
Brawner Parkway, Willow and Pecan Streets, be approved, and that authority to
advertise for bids to be received September 14, 1966, be granted;
b. That authority to initiate eminent domain proceedings for the
acquisition of Parcel No. 8 and Parcel No, 11, Right of Way for Hilltop Intercep-
tor Sewer Line 34A, be approved;
c. That acceptance and final payment. of Estimate No. 5, in the amount
of $16,730.85, representing the balance due the Contractor, C. C. Hinchberger for
completion of the Meadow Park Recreation Building and Health Clinic, be approved;
d. That authority to advertise for bids to be received September 7,
1966, on 60 Parking Meters as requested by the Traffic Engineer, be granted;
e. That the bid award on Firemen's Uniforms consisting of 500 pair of

Trousers, 500 Short Sleeve Summer Shirts, and 350 Long Sleeve Shits for the
twelve month contract period beginning August 1, 1966 and ending July 31, 1967,
be made to Creighton Shirt Company, Inc., of Reidsville, North Carolina, in the
amount of $9,352.00, on the basis of low bid meeting specifications (Bid
Tabulation #66-33);
f. That the bid award on Tires„ Tubes and Tire Recapping, be made to
the following firms on the basis of low bid meeting specifications; to Bay
Tire Service, Lot I - Tires and Tubes in the amount of $25,036,74; to Firestone
Stores, Lot II, Tire Recapping in the amount of $3,134.36, for a total of
$28, 171.10 (Bid Tabulation #66-34);
g, That the bid award on Posting Machine and Tape Attachments, be
made to National Cash Register Company on the basis of low bid meeting specifi-
cations and most advantageous to the City, in the amount of $8,834.76 (Bid
Tabulation #66-35);
h. That the date of September 21, 1966, during the Regular Council
Meeting be set for public hearing on the Appeal of Charles E. Wyatt, Chairman
of the Board of Trustees, Unitarian Church relative to the Zoning and Planning
Commission's requirement of a 25 -foot street dedication;
is That the date of September 28, 1966, during the Regular Council
Meeting be set for public hearing on the abandonment of 15 feet on the West
side of Denver Street between Ropes and Sinclair Street, abutting Lots 9 a
through 15, Directors Addition,
It was agreed that an ordinance on the agenda as Item "c" relative
to the closing of the hearing given to the owners of property abutting on
Navigation Boulevard, be deferred for further consideration.

The Charter rule was suspended and the foregoing ordinance was passed. by
the following vote: Blackmon, Dunne, Jimenez, McDaniel, Sizemore, and Wallace,
present and voting "Aye," Furman absent.
City Manager Whitney presented a petition containing six signatures
representing the entire occupancy of the 3900 Block of Tiger Lane, with thA
exception of one home still under construction, requesting that consideration
be given to restricting parking in the 3900 Block on the Northeast side of T3gem
Lane from 8 a.m. to 4 p.m. on school days, stating that high school students are
using the front of these residences for parking instead of the parking proved
them on the school grounds, and that this creates a blind spot when residents are
backing out of driveways and a traffic hazard results. Mr. Whitney stated that
he has informed the Traffic Engineer of this condition and asked for a study end
recommendation on the matter. (Petition #66-14)
Mr. Mike Salinas of 4001 Bahama appeared in connection with the foregoirs,
petition, and asked that Bahama Street be included in the study for parking re-
strictions; that he has measured the street and finds that when cars are parked
on both sides, only a 12 -foot passage remains, and that he did not like to have
his home turned into a parking lot.
Mr. Whitney advised Mr. Salinas that Bahama Street would be included in
the study of traffic in this area, as well as other streets in the area.
Mrs. N. E. Sullivan, Safety Chairman and representing the Executive Board
of Oak Park Parent Teacher Association, appeared and submitted a request on the:r
behalf that the City authorize the purchase of several kits containing a series
of films and equipment to be used in teaching defensive driving to school students„
Mrs. Sullivan stated that the petition had been referred to the Traffic Safety
Advisor, Board and the School District, who has started a pilot program this Pali
to teach defensive driving in the schools. She further stated that trained in-
structors are already available to present this course.
City Manager Whitney stated the matter would be referred to the Traffic
Safety Advisory Board and the School Board for a study of the request.
City Manager Whitney distributed copies of a proposed ordinance drafted
by the Legal Department, intended to replace the existing ordinance governing
the operations of peddlers in the City. Mr. Whitney stated that the proposed

ordinance was for the Council's information and could be acted upon at its
convenience.
