Ray Kring Mayor McIver Furman called the meeting to order. The Invocation was given by Mayor Pro Tem Jack R. Blackmon in the absence of the invited guest chaplain. City Secretary T. Ray Kring called the roll of those in attendance. Motion by Jimenez, seconded by Dunne and passed that the Minutes of the Regular Council Meeting of November 23, 1966, be approved as furnished to the Council. Mayor Furman recognized the Student Council from Cunningham Junior High School, and their sponsor, Mrs. Jeanne Galvan; and read and presented Certificates of Atten- dance to Richard Silvas, Elsie Morin, Carl Lewis, Billy Rios, Mary Esther Wilmas, and Linda Cirilo. Mayor Furman read and presented a proclamation designating the week of December 1, 1966, as CIVIL AIR PATROL WEEK in Corpus Christi, and called upon citizens of the City to observe the week with appropriate ceremonies designed to honor the men, women and cadets of the Civil Air Patrol, received by a representative of C.A.P. Mayor Furman announced the appointments to Boards and Committees, and nominated the following persons for appointment and reappointment: Airport Board of Adjustment, F. Paul Beall, Dr. Roger Mills, replacing Dr. J. E. Upshaw and William Whittet, and Gordon P. Reid for reappointment; Citizens Advisory Health and Welfare Board, Mrs. Bolivar De Pena, replacing Mrs. Fred Swearingen; La Retama Library Board, W. T. Neyland, Tony Abarca, Mrs. W. F. McCroskey and Walter Dunham, Jr., replacing Mrs. L. H. Gross, William H. Keys, A. B. Zepeda and Bertram Parker; Board of Adjustment, Eduardo de Ases, replacing E. P. Limon, resigned. Motion by Jimenez, seconded by Sizemore and passed that the foregoing nomina- tions for appointment and reappointment to the Airport Board of Adjustment, Citizens Advisory Health and Welfare Board, La Retama Library Board and Board of Adjustment Minutes Regular Council Meeting November 30, 1966 Page 2 be approved and confirmed; and also that the following persons be appointed to serve on the Regional Planning Commission: Jack R. Blackmon, William H. Wallace, and Ronnie Sizemore, with Patrick J. Dunne, Ken McDaniel and Dr. P. Jinenez, as alternates; W.J. Roberts, Preston Doughty and Herbert Whitney, with J. S. Naismith, Alvino Campos, R. Marvin Townsend and William Anderson as alternates. Mayor Furman announced the opening of bids: Bids were opened and read by Mr. William Whittet of the firm Page, Southerland, Page & Whittet, for the construction of the Corpus Christi Museum Building from the following firms: Braselton Construction Company, Burnett Construction Company, Casey & Glass, Inc., Lanphier Construction Company, Marshall -Hinman Company, and Emil Stefek. The foregoing bids were tabled for 48 hours as required by the City Charter and referred to the City Manager for tabulation and recommendation. Motion by Blackmon, seconded by Jimenez and passed that the bid of Waukesha Sales & Service on the Mechanical Plant for the Museum Building, which was received by the Council after the time set for bid opening, be accepted. Bids were opened and read by Mr. Whittet for the installation of the Mechanical Plant for the Museum Building from the following firms: Waukesha Sales and Service and B. D. Holt Company. The foregoing bids were tabled for 48 hours as required by the City Charter and referred to the City Manager for tabulation and recommendation. Bids were opened and read on ten items of automotive equipment from the following firms: Bird Pontiac, Inc., Ed Hoffman Motors, Lew Williams Chevrolet, Bill Moyer Rambler, Creveling Motor Company, International Harvester, and Lewis Boggus Motors. The foregoing bids were tabled for 48 hours as required by the City Charter and referred to the City Manager for tabulation and recommendation. Bids were opened and read on Turbidimeters from the following firms: Hach Chemical Company of Ames, Iowa, and Honeywell, Inc. Minutes Regular Council Meeting November 30, 1966 Page 3 Bids were opened and read on 74 items of Plastic Pipe and Fittings from the following firms: McAllen Pipe & Supply Company; Mount Vernon Pipe & Supply Company, of Mount Vernon; Standard Plumbing Supply; Telsco Industries of Dallas; Venable Sprinkler Sales of Irving; Southern Plumbing Supply; General Lawn Sprinkler; Gulf Supply; and Alamo Iron Works. The foregoing bids were tabled for 48 hours as required by the City Charter and referred to the City Manager for tabulation and recommendation. Mayor Furman stated the Council would now consider the pending item of Appli- cation #966-5, J.M. Wilson for change of zoning from 'R -1B" One -family Dwelling District to 'R-2" Two-family Dwelling District on Lots 13 through 18 inclusive, Block 6, Park Terrace, Unit No. 3, on which a public hearing was held on October 26, 1966. Motion by Dunne, seconded by Blackmon that the foregoing application be denied, but in lieu thereof a Special Permit be granted for new construction, one story duplexes of brick veneer construction on Lots 13 through 18 inclusive, Block 6, Park Terrace, Unit No. 3. City Attorney Singer stated that passage of the foregoing motion would require a three-fourths vote of the entire Council, or a total of six votes. On vote of the Council on the foregoing motion, Furman, Blackmon, Dunne, McDaniel and Sizemore, voted "Aye", and Jimenez and Wallace, voted "Nay". Mayor Furman declared the motion had failed to pass. Mr. Bob Spann, attorney representing the City Council of Ingleside appeared and presented the Council with a resolution adopted by the City of Ingleside requesting that the City of Corpus Christi waive its extraterritorial rights in an area east and northeast of Ingleside. The resolution asked that the City give its consent without delay in order for Ingleside to honor petitions for annexation. Mr. Jerry Reasonover, Mayor of Ingleside, also appeared in support of the fore- going resolution, and stated that resolving of this matter in this manner would be beneficial to both cities and is the interest of industrial development. Mayor Furman advised that the resolution would be taken under advisement along with a petition filed earlier from Ingleside area residents opposing the proposal. (Petition #66-25) Minutes Regular Council Meeting November 30, 1966 Page 4 Mayor Furman announced the Council would consider the application of Atlantic Richfield Company to construct and operate a production platform in State Tract 470, Corpus Christi Bay. City Manager Whitney presented the application and painted out the proposed location on a map showing drilling blocks in the Bay as being approximately 3000 feet Northeast of the Southwest line, and 1000 feet Northwest of the Southeast line of State Tract 470, which location is more than three miles from the nearest shoreline; stated that the construction is proposed as identical to other platforms previously constructed in the Bay; will not conflict with the various existing and proposed fair- ways for navigational channels in the area and will comply with the current and proposed Bay Drilling Ordinance. Mr. Whitney further stated that the application had been re- ferred to the Bay Drilling Committee, and that it is their recommendation that the permit authorize a rectangular platform not to exceed 40,000 square feet in size, of the same general design characteristics as the platforms previously approved by the City, and that the detailed arrangement of pipes and equipment be subject to the same aesthetic requirements as in the case of prior platforms, the final design to be approved by the Bay Drilling Committee. Manager Mr. Charles A. Hutchinson, District/of Atlantic Richfield Company, appeared in support of the application, and stated he had nothing to add to Mr. Whitney's presenta- tion, but that he would answer any questions the Council had in connection with the foregoing application. Mayor Pro Tem Blackmon stated that members of the Council had made a personal inspection tour of this proposed facility, and observed first-hand all segments of the application. No one appeared in opposition to the foregoing application. Motion by McDaniel, seconded by Dunne and passed that the application of Atlantic Richfield Company to construct and operate a production platform in State Tract 470, Corpus Christi Bay, be approved according to specifications as recommended by the Bay Drilling Committee. Mayor Furman announced the public hearing on the appeal of the Corpus Christi Valley Workers Assistance Committee from the decision of the City Solicitations Com- mittee to solicit donations in the City of Corpus Christi, and stated that the request Minutes Regular Council Meeting November 30, 1966 Page 5 had been heard by the City Solicitations Commission November 17, 1966, during a Regular meeting of the Commission, and stated that it had been rejected on the basis that the funds raised are not proposed to be spent in the City of Corpus Christi, and that to approve an application to solicit funds for the welfare of strikers outside of our area would set a precedent which could conceivably result in other striking groups throughout the state to call upon Corpus Christi for chairitable assistance; and further that no evidence was presented to show what existing relief agencies in the Valley were contributing toward the welfare of these people. Mayor Furman stated that the Valley Workers Assistance Committee had appealed to the City Council the decision of the Solicitations Commission, and requested a hearing. Mr. Carlos Truan, president of the Assistance Group appeared on behalf of the appeal and stated that the Committee proposed to raise $4,500 to aid 700 persons in the Rio Grande Valley who are members of 150 farm workers striking for $1.25 an hour minimum wage. He stated that the only reason given for the denial of the permit was that the funds would not be spent in Corpus Christi. He further stated that the group is not in accord with the theory that "charity should stop at the corporate limits of Corpus Christi'; that this is not a strike in the usual sense but is a social movement; that the Solicitations Commission was inconsistent in denying the permit, and cited several cases where funds from approved charities have been sent out of the City, and that denial of the permit does not give the public the choice of which charities it wished to support. Mr. Truan also stated that they believe the Commission to be unsympathetic and had "already made its decision" before the meeting. Dr. Clotilde Garcia, Vice President of the Valley Workers Assistance Committee, appeared and cited an article which had appeared in the newspaper yesterday stating that the granting of the permit in question would be establishing a precedent. She stated that these people in the Valley are not asking for charity; that their committee is proposing to help them because "they understand their kind of life", and appealed to the Council to grant the permit in the "spirit of Christianity". Mr. Oscar Reyna, Secretary of the appealing organization, took issue with the statement that they were appealing to the Council in the name of organized labor; that they were only requesting permission to solicit funds as any other organization such as the United Fund and Red Cross; that no pressure will be used, and that citizens have the right to refuse to contribute. Minutes Regular Council Meeting November 30, 1966 Page 6 Mr. William Darby, Treasurer of the group, appeared and contested the authority of the Solicitations Commission to refuse the permit in question on the basis that he felt it is only their duty to investigate the responsibility of the organization engaged in soliciting funds, and to determine whether or not the funds will be used fraudulently. He stated that this organization is supported by responsible organiza- tions such as the G. I. Forum, National Council of Churches, LULACS, Labor and Social groups, and emphasized that these 700 people in the Valley are in desperate need, having worked for below minimum wages all their lives. Father Gough, appeared and concurred in all foregoing statements of members of the Valley Workers Assistance Committee, stating that he was appearing as an individual, but that he feels that if the objection to the granting of the permit in question is based on the assumption that charity begins at home, he is of the opinion that citizens should be given the chance to give or not to give in accordance with the American tradition of democracy. Mr. Irwin Brown, representing the NAACP, appeared in support of the appeal and stated that many people in Corpus Christi are working for less than the $1.25 minimum wage, and were already proverty stricken before the strike. Mr. James De Anda, attorney, reiterated Mr. Truan's statement that the only reason for denying the permit was that the money was going to be spent out of the City, and stated that he did not feel that it was the prerogative of the Solicitations Commission or the City Council to dictate to citizens as to whether or not they contribute to certain charities, that they should only determine if the money will be used fraudulently. Mr. De Anda further stated that many organizations solicit funds without a permit and it was at his suggestion that this organization apply to the Solicitations Commission for a permit, and that they have not solicited since the application was tabled by the Commission November 17, 1966. Mr. Paul Montemayor appeared in support of the appeal, and stated that he would solicit funds "even at the risk of being put in jail"; that he feels the cause is a just one, and that the Solicitations Commission exceeded their delegated functions to deny the application. Mayor Furman questioned Mr. Truan as to the origin of the appeal, and was told that it had come through the Bishop's Committee for the Spanish Speaking people, and Minutes Regular Council Meeting November 30, 1966 Page 7 that the counties in which these people live have not helped them because the people are so aroused by the striking workers; that some help has been received from around Brownsville but that most of the efforts have been in the larger cities such as San Antonio and Houston. Mr. Bernard Golding, Chairman of the City Solicitations Commission appeared on behalf of the decision of the Commission and stated that the Commission had no inten- tion of insulting anyone; denied implications that the Commission was discriminatory in rejecting the request; and stated that they "bent over backwards to make just decisions'; and further stated that "we do not want our committee to become a pawn in the game of political chess this group of farm workers or any other group is playing with the Legislature, and that they should take such problems to the legisla- tive halls of the State of Texas". Commissioner Wallace stated that a great deal of emotion has been aroused on both sides of the issue, and that he feels the Council should only be concerned with whether or not the funds derived from the drive would be misused; that the Council or the Solicitations Commission should decide on the merits of any particular charity. Mr. Wallace commended the Solicitations Commission, stating they were doing the com- munity a fine service. Commissioner Jimenez, stated that on the basis of what has been said today, he can see no reason not to grant the permit. Commissioner McDaniel stated that he feels the ordinance regulating the Soli- citations Commission should be studied with the view of giving the members clearer guidelines in deciding questions of this nature. Mayor Pro Tem Blackmon stated he felt the ordinance was clear and that the Commission had acted properly and within their discretion, and that he does not believe the ordinance should be amended, but further stated that the Council should disregard the emotionalism of labor-management questions and rule only on an accounting of the funds to be solicited. Motion by Wallace, seconded by Blackmon and passed that the hearing be closed. Motion by Wallace, seconded by Jimenez and passed, McDaniel abstaining, that the application of the Corpus Christi Valley Workers Assistance Committee for a permit to solicit funds in the City of Corpus Christi, for the period of December 1, 1966 through December 31, 1966, be granted. Minutes Regular Council Meeting November 30,, 1966 Page 8 Commissioner McDaniel stated he had abstained from voting on the foregoing motion for the reason that he felt the ordinance regulating solicitation of funds should be reviewed and possibly amended to provide guidelines for the Commission. Mayor Furman called for the City Manager's Reports. Motion by Jimenez, seconded by Dunne and passed that the City Manager's Reports be accepted, and that the recommendations and requests be approved and granted as follows: a. That the authority to advertise for bids on various items of Mowing Equip- ment, to be received December 14, 1966, be granted; b. That the authority to advertise for bids on various items of Radio Equip- ment, to be received December 14, 1966, be granted; c -a. That an appropriation in the amount of $3,066.29 to cover the City's portion of the cost of the improvement of streets around the park in Stonegate North, Unit I Subdivision, The American Building Company, be authorized; c -b. That an appropriation in the amount of $2,063.65 to cover the City's portion of the cost of the improvement of streets around the park in Stonegate South, Unit 2A Subdivision, Paul Koepke, be authorized; d. That the request of residents on Burkshire Drive between South Staples and Lambert Street to make this portion of the street one-way between the hours of 6 and 10 p.m. from December 20, through January 2, 1967, be granted; City Manager Whitney present the application of Forest Oil Corporation for a permit to drill and operate Well #9, in State Tract #786; located the proposed well on a map as being 660 feet from the North line and 3500 feet from the West line of State Tract 786; stated the well will be drilled as a straight hole and to a proposed subsurface depth of 11,500 feet; that the applicant has submitted copies of Railroad Commission Permit; Certificate of Insurance; and the required $500 filing fee; and stated that the application appears to be in order and recommended that it be approved as applied for and in accordance with all ordinances which may be hereafter enacted by the City of Corpus Christi. Motion by Wallace, seconded by Dunne and passed that the application of Forest Oil Corporation for a permit to drill and operate Well #9, in State Tract No, 786, be approved as recommended by City Manager Whitney. Minutes Regular Council Meeting November 30, 1966 Page 9 City Manager Whitney presented the application of Atlantic Richfield Company et al to drill and operate a well in State 45-47 Unit Well No, 2, State Tract No. 471, Corpus Christi Bay, and pointed out on a plat the location of the well as being in Cluster II, Well "E", in which the Bay Drilling Committee has previously approved; to be a deviated well located 1540 feet from, the Northeast line and 490 feet from the Southeast line of State Pratt No, 471; and not within Try Bay, Park, Tad Recreation Area; a casing prcgraaa of 16" casing from 0° - 150'; 10-374" caning from 0' - 2000°; cF.5ing from 0' - 9500'; and 5" liner from 9500' - 10,000°; that the well is to be a proposed depth of 10,000 feet; that the applicant has submitted Certificate of Insurance; the required $500 filing fee; and has applied for Railroad Commission Permit, Mr, Whitney stated the application appears to be in order and recommended that it be approved subject to receipt of the Railroad Commission Permit, Motion by Blackmon, seconded by Sizemore and passed that the foregoing appli- cation be approved as applied for, subject to the receipt of the Railroad Commission Permit, and in accordance with all ordinances hereafter enacted by the City of Corpus Christi. He stated that there are over 200 netters operating is the Bay at the present time. City Manager Whitney advised Captain Clark that the Council has authorized expenditure to purchase and install bouys several weeks age; that prices have been secured and specifications have been submitted to the Coast Guard, and that the Council is waiting for them to approve the type of bouys, after which they will be put on order and installed in the very near future. Mr. Harry Burnett, attorney representing the Ingleside residents who opposed the resolution adopted by the Ingleside City Council requesting that the City of Corpus Christi waive its extraterritorial rights in an area around Ingleside, appeared and requested that the Council notify him when this matter is scheduled for public dis- cussion. Mayor Furman assured Mr. Burnett that he would be notified, but that all the petitions in connection with this matter have not been received, and until they are received, the Council is not in a position to take any action. Mr. W. A. Scholl, president of Local Firefighters Union No. 936, appeared and reminded the Council of an appeal he had made to the Council on November 16, 1966, relative to charges allegedly made by three Fire Department Captains, that the Union is creating a false impression of dissension within the Fire Department, and dis- agreed with union complaints over the wearing of winter uniforms. He referred :.o a written statement he had presented to the Council which stated that Fire Chief Carlisle is harassing Union members, and that the Union wants "unwarranted attacks against it stopped". Mayor Furman again advised Mr. Scholl that the Council has no authority to hear grievances from Unions or to negotiate with Unions under State Law. He further advised Mr. Scholl that he would have to present his problem through the proper channels to receive an answer. Mr. Scholl stated that he would not appear before the Council as a Fire Union Chief, but as a member of the Firemen's Pension Fund, another matter which he alleges came under attack by the three Fire Captains. The Council agreed to hear him pro- vided he had information in connection with the Pension Fund. Mr. Scholl continued by stating that the Fire Captains had charged that the fund's board of directors had Minutes Regular Council Meeting November 30, 1966 Page 12 placed the fund in danger by stock speculation, which he labLed as false. Mayor Pro Tem Blackmon stated that Mr. Scholl was using this to rebut a story which had appeared in the newspaper, and that the Council has no jurisdiction over newspaper stories, and that he does not care to hear it. Mayor Furman at this time ruled Mr. Scholl out of order and directed him to submit his complaints through the proper channels. City Massager Whitney presented for the Council's consideration an ordinance whereby the City Council exercises its option and elects to have all of the employees of the Transit Department participate in the Texas Municipal Retirement System. Mr. Whitney stated that the employees have held a referendum, the result of which was 64 to 1 in favor of membership in the System. ORDINANCE NO. 8258 AN ORDINANCE PROVIDING FOR PARTICIPATION IN THE TEXAS MUNICIPAL RETIREMENT SYSTEM BY THE CITY OF CORPUS CHRISTI, TEXAS, PROVIDING FOR AND ELECTING TO HAVE ALL OF THE EMPLOYEES OF A DESIGNATED DEPARTMENT OF THE CITY GOVERNMENT, TO -WIT, THE TRANSIT DEPARTMENT, PARTICIPATE IN SUCH SYSTEM; AND ACCEPTING ALL OF THE OBLIGATIONS AND BENEFITS OF SUCH SYSTEM; AND DECLARING AN EMERGENCY. The Charter rule was suspended and the foregoing ordinance was passed by the following vote: Furman, Blackmon, Dunne, Jimenez, McDaniel, Sizemore and Wallace present and voting "Aye". There being no further business to come before the Council, the meeting was adjourned.
