Blackmon Mayor Pro Tem Ronnie Sizemore Commissioners: Dick Bradley, Jr. Dr. P. Jimenez, Jr. Gabe Lozano, Sr. Ken McDaniel City Manager Herbert W. Whitney City Attorney I. M. Singer City Secretary T. Ray Kring Mayor Jack Blackmon called the meeting to order. City Secretary T. Ray Kring called the roll of those in attendance. Motion by Sizemore, seconded by Jimenez and passed that the absence of Commissioner Grant be excused for cause. Mayor Blackmon announced the purpose of the special meeting to hold public hearings on four zoning applications, and such other business as might properly come before the Council, and explained the procedure to be followed. Mayor Blackmon announced the public hearing on Application No, 267-7, Mr. Hulen H. Hunt, for change of zoning - TRACT I: from "R -1B" One -family Dwelling District, "A-2" Apartment House District, and "B-1" Neighborhood Business District to "13-4" General Business District on a 4.90 -acre tract of land beginning at the Southwest corner of the Intersection of Nile Drive & South Padre Island Drive and extending in a Westerly direction along the Southerly right of way line of South Padre Island Drive 633.97 feet and extending 332.03 feet in a South- westerly direction for the most depth; TRACT 69: from "R -1B" One -family Dwel ling District to "8-4" General Business District on a 6.17 -acre tract of land beginning at the Southeast corner of the Intersection of Nile Drive and South Padre island Drive and extending in an Easterly direction along the Southerly right of way line of South Padre Island Drive approximately 615.39 feet and extending 492.02 feet for the most depth. Larry Wenger, Senior City Planner, located the property on the map; pointed out the zoning and land use of the surrounding area; stated that at the Zoning and Planning Commission hearing held on February 28, 1967, the applicant Mr. Hulen Hunt, had appeared in behalf of his request and stated to the Commission that he is requesting a business classification on this Minutes Special Council Meeting April 11, 1967 Page 2 property in order that he might develop a small business center to serve Lexington Park Subdivision which he is developing adjacent to the subject property, and further stated that in his opinion, this request is in keeping with the 33 -acre tract recently zoned "B-4" adjacent to his property. Mr. Wenger stated that the Staff had mailed two notices and that none were received either for or against; that no one had appeared in opposition; that the Commission had tabled the request to allow the applicant sufficient time to prepare a more definite plan for development of the property; that at the March 14, 1967, Commission meeting, Mr. John Carle had appeared representing Mr. Hunt, and stated that the applicant wished to amend his previous request for "B-4" zoning on the two tracts comprising the subject property and instead, requested that "A-2" Apartment House District be granted on TRACT 11, and that TRACT I remain as it is presently zoned. Mr. Wenger stated that it was the recommendation of the Zoning and Planning Commission that the request be denied, but in lieu thereof "A-2" Apartment House District be granted on TRACT II only, in accordance with the applicant's amended request that "A-2" Apartment House District be granted on TRACT II and that TRACT I remain as it is presently zoned. Mr. John Carle was present in support of the foregoing application, but stated that he had no further statement to make, but would answer any questions the Council had in connection with this request. No one appeared in opposition. Motion by Jimenez, seconded by Sizemore and passed that the hearing be closed. Motion by Jimenez, seconded by Lozano and passed that the foregoing application be tabled for further consideration. Mayor Blackmon announced the public hearing on Application #367-2, Mr. Abe Block, for change of zoning from "1-3" Heavy Industrial District to "1-2" Light Industrial District on Lots 20 and 21, Block 2, Los Angeles Hills. Mr. Wenger presented the application; located the property on the map and described the zoning and land use of the area; explained that at the Commission hearing held on March 14, 1967, the applicant's letter of request was read which stated that the applicant intended to construct a three-bedroom home on the subject property; stated that Mr. George Stein, a nearby Minutes Special Council Meeting April 11, 1967 Page 3 property owner had appeared and definitely opposed the request on the basis that approval would perpetuate a slum district; that the Staff reported that 22 notices were mailed, one returned in favor and two in opposition; and that it was the recommendation of the Zoning and Planning Com- mission that the request be denied on the basis that approval would constitute spot zoning. Mr. Wenger further stated that it was the feeling of the Zoning and Planning Commission that this is an area which will eventually become industrial and that the neighborhood is not desirable for residences. He stated that no one had appeared at the hearing in favor or in opposition to the request. No one appeared in behalf of the foregoing application, and no one appeared in opposition. Motion by Sizemore, seconded by McDaniel and passed that the public hearing on the foregoing application be recessed for further consideration and representation from the appli- cant. Mr. John Crutchfield, local civic leader and supporter of Urban Renewal, appeared and stated that Representative Travis Peeler has submitted in the Legislature an amendment to authorize Texas Cities to draw up specific Urban Renewal projects and submit them to the voters, and asked the City Council to endorse, by resolution, the bill scheduled for hearing April 19. Mr. Crutchfield further stated that he is formulating plans for a delegation to go to Austin Friday to discuss the Bill with the Texas Municipal League to learn if TML will support the Bill. Mayor Blackmon asked that copies of the Bill be provided to the Council and stated that the request will be given consideration. Commissioner Jimenez was excused from attendance. Mayor Blackmon announced the public hearing on Application #367-3, Mr. Hutch Bryan, for change of zoning from "R -1B" One -family Dwelling District to "A-1" Apartment House District on Lot 38, Block 1, Lexington Subdivision. Mr. Wenger located the property on the map; pointed out the zoning and land use of the surrounding area and stated that the property is presently vacant; that at the Commission hearing held March 14, 1967, Mr. Bryan had appeared in behalf of the request and had presented Minutes Special Council Meeting April 11, 1967 Page 4 a site plan and building perspective and stated that he was anticipating moving a structure onto the subject property and converting it into an eight -unit apartment building that would conform structurally to the perspective submitted. Mr. Wenger stated that the Staff reported that 17 notices were mailed,one returned in favor and none in opposition, and that it was the recommen- dation of the Zoning and Planning Commission that the request be approved as requested. No one appeared in favor or in opposition to the foregoing request. Motion by Sizemore, seconded by Bradley and passed that the hearing be closed. Motion by Sizemore, seconded by Lozano and passed that the recommendation of the Zoning and Planning Commission be concurred in and that Application #367-3, Mr. Hutch Bryan, for change of zoning from "R -1B" One -family Dwelling District to "A-1" Apartment House District on Lot 38, Block 1, Lexington Subdivision be approved as requested, and that an ordinance be brought forward effectuating the change. Mayor Blackmon announced the public hearing on Application #367-4, The Duaine Development Co., Inc., for change of zoning from "R -1B" One -family Dwelling District to "A-1" Apartment House District on Lots 1, 2 & 3, Glenoak Park, Unit 1, and Lots 4 through 13, Glenoak Park, Unit 2. Mr. Wenger located the property on the map; pointed out the zoning and land use of the surrounding area; stated that at the Commission hearing held on March 14, 1967, Mrs. Duaine had appeared and stated that "A-1" zoning had been approved on this same property in August of 1965, but a time limit of one year had been placed on construction; that at that time, FHA had refused to make any loan commitments because sewer service was not available and that sewers are now available and they wont to begin construction. Mr. Wenger stated that no one had appeared at the hearing in opposition; that the Staff reported that 10 notices were mailed, two received in favor and one in opposition and that it was the recommendation of the Zoning and Planning Commission that the application be approved as requested, but with a further recommendation that the applicant consider the possibility of utilizing Lot 1, 2, & 3, Glenoak Park, Unit 1, for two-family dwellings. The applicant did not appear and: no one was present on his behalf. Minutes Special Council Meeting April 11, 1967 Pages City Manager Whitney stated that sewer facilities will be constructed in Waldron Road to serve the School and will be available to Duaine Development Company. No one appeared at the meeting in opposition to the foregoing application. Motion by Lozano, seconded by Bradley and passed that the hearing be closed. Motion by Bradley, seconded by Lozano and passed that the foregoing application be tabled for further consideration. Mayor Blackmon requested that the. Staff prepare a recommendation re the possibility of utilizing Lot 1, 2 & 3, Glenoak Park, Unit 1, for two-family dwellings. Motion by McDaniel, seconded by Sizemore and passed that the date of April Z5., 1967, at 3:00 o'clock p.m., Regular Meeting, beset for public hearing on the zoning application of Mr, Frank Peerman, There being no further business to,come :before the. Council, the meeting was adjourned.
